Class Action suit. Does this effect you? - Moto G 2015 General

If you purchased a Motorola phone or smart watch and submitted it for warranty service, a class action lawsuit may affect your rights and you may be entitled to a cash payment or other benefits.
You could be owed money.

I think most of the time these things are fake and simply a way to build a name/address/info database to use for other purposes. Just my 2 cents.

Insurance for your Galaxy Tab + discount code

Im not sure about other carriers but T-Mobile or better put Asurion does not insure the Galaxy Tab. I found Square trade offers insurance.
https:// squaretrade. com/pages/
Extended warranty of 3 years plus Accidental damage is $ 150 total.
I also found a discount code "TURKEY" for a 30%. its not covered for lost or stolen but atleast damage! you have up to 90 days after purchase to place the order (dont know when the discount cod expires though).
Anyone have any experience with Square Trade?

Good post!
I'd offer SquareTrade for my Galaxy Tab as well.
I'm very familiar w/ SquareTrade...
So you know the basics of the SquareTrade Care Plan, it will basically cover you up to the coverage limit listed at the time of the quote; this is usually covered up to the actual retail price of your device.
The coverage limit is the retail price which should be considered as the no-commitment price for your Galaxy Tab.
The coverage should include 3yrs w/ ADH; protects against damages in the full 3yrs, up to the coverage limit. The first year should still be covered under Samsung for regular warranty issues while year 2 and 3 will be protected by SquareTrade.
The cost to cover it may be less than the total cost to pay insurance for 2-3yrs. There are "NO" deductibles for this warranty on the Galaxy Tab so you should also consider that there will be a out of pocket expense, later, with your insurance.
Lastly, SquareTrade claims a 5 Day guarantee which means that if items that arrived for repair are not completed by 5 working days then you'll get your warranty purchase price refunded while you still keep the coverage. - Sounds good right?
For repairs or mail in items, SquareTrade also offers prepaid shipping so you do not have to pay for a label to get it there.
You have 90 days to purchase the plan and that's 90 days from the date of the purchase on your receipt. -- You can add your receipt to the online management page once you login to your account.
Hope this helps and be sure to use the coupons on eligible days since those 30% coupons don't last forever!
*I've covered my HTC EVO with the SquareTrade plan and my GF's Samsung Captivate... soon to be covered is my Galaxy Tab too!
** About experience, you should check it out on Nextag or Epinions for reviews.
SquareTrade has a majority of 4-5 star ratings by consumers.
The general rule to a easy warranty claim is the read the contract and understand that a warranty just can not cover obscene instances that are just not covered by the warranty, or issues that begin before the "advertised" term starts.
It's not common that people have a poor experience as our people on the phone's are pretty forward thinking and are friendly.
My store said no and so did customer service when I called yesterday and asked

I can guarantee you that asurion will not honor that if the time comes that something happens to the tab. Call their number and confirm with them if you want, but every single internal document that I see about this says that the insurance will not work with both the tab and dell mini. Reps are either greedy with commission or too stupid and apply it anyway.
First of all: Thanks |OP| for bringing the subject.

This made me research a bit -thanks to your post-. Got the following quotes:
Code:
Covering: Tablet
Total Coverage Amount: $600.00
Coverage Area: Domestic
Policy Term: 2 Years
Deductible: $0.00
2 Year Premium: $89.00
Policy Fees: $8.90
Total Policy Cost: $97.90
And SquareTrade's:
Code:
Item: cell phone
Coverage Limit: $600.00
2 year product Care Plan $62.00
Estimated Tax: $0.00
Total $62.00
Then I proceeded to check BBB for both (edited by me for compactness):

Getting out a ETF - idea

Just spent 45 mins trying to download a Google voicemail. No dice. That's how bad sprint 3G is in downtown Chicago. It is pretty much unusable. After calling Sprint and getting nowhere as usual, I am done and want out of my contract (this is not a bash sprint thread - just the facts).
I really don't feel like paying the ETF considering I can't use something I am paying for. I was thinking of just filing a small claims lawsuit (not a lawyer or anything - but had a friend who did something similar). It takes about an hour to file (I think) and costs $75. I don't believe sprint would bother fighting it - they would prob just contact me to settle (I want out of contract sans ETF and they pay court fees). It sure would get their attention if a bunch of people started doing this.
Viable? Looking for opinions - never done anything like this before and I figure if nothing else it would be a learning experience. Judge Wapner here I come!

Here's my suggestion.
I'm assuming that you've called Sprint more than once and thus it is in the notes, right?
Call *2, dial 000000000 until it moves you along.
And explain that because you aren't getting the service you're promised you want out of your contract with no fee.
They will extend that to you. They have to because they aren't fulfilling their end of the contract. They actually extended that to me although I'm not cancelling.
Downtown Chicago as well and the worst service I've ever had...but mine is going on 2 months worth of horrible service...before my 3G was so fast I never even had to think about putting on the 4G...
I've loved Sprint but two months without proper service is making me want to jump...I may be a G2X owner shortly.
After countless calls and dealings with tech after tech about my data speeds. They are finally going to take care of me. My bill will be adjusted every month until the speeds are back to normal. And my upgrades have been reset as well my etf was waved too. I got so much because of how the "tech" handled my ticket. Basically told me to deal with it. I have been in contact with a very helpful and nice lady on the ceo's team and she made sure I was taken care of.
So send an email to the ceo's office be nice and they should take care of you
from my phone duh
They let me out when I moved here to Washington because there was no signal at all. All I had to do was email/fax them proof I was living here. They sent someone out to check it though to verify it was true. Going to miss my EVO but have to have service.
It states in your contract that they have the authority to assess an ETF upon termination of contract, tower and throughput issues are not valid nullification points.
If you take them to small claims, they'll just wave your contract in your face and be done.
In all seriousness, just escalate as far as it needs to go. Retentions will do just about anything, save for waiving ETF.

They are required to give you a certain level of service and if they can't provide it then they violate the contract.
They will waive it.
I knew how poorly it was going to go but I figured I was going to call anyway.
First person told me there were no problems with their towers and asked about hardware replacement. I said no, when I'm in areas that I get a good signal my phone works fine...2nd person said there were problems (i knew it) and that they are working on it. He also mentioned possibly letting me out ETF free.
I really don't want to go that route though, I just want the service I was getting to come back, I loved Sprint's service when it's working. I don't want to ditch the carrier just because of two bad months but nobody has confirmed anything on it getting any better, which I know they can't.
I called retentions awhile back, stated that tech support says the area is fine and working as it should, I said, no, it isn't and it hasn't been for months...I went to some local Sprint stores and asked the employees there, which informed me that, yes, the towers have been stuck in the middle of being upgraded for 6+ months now because Qwest hasn't installed the new T1 lines yet. All the lady in retentions would say was Okay and act dumb. I guess I could keep trying.

It costs over $200 to file a suit in small claims court here in Miami-Dade county, so I'd look into that before digging any deeper into this. I doubt Sprint will send out a lawyer to contest a $200 case, but it may cost you as much as the ETF itself would just to TRY and get out of it this way.
Just continue to call and complain. Eventually, you will come across an employee who will help you.

The Sprint CS rep told me that there was a notation associated with my area 'users may experience slower data speeds'. They are acknowledging there is a problem - and they aren't kidding! It doesn't take much bandwidth to download a voicemail. Data speeds are non existent.

Agreed which is why they are violating the contract. Thus no ETF
OP - here. A previous poster was correct - looks like it costs $120 to file a small claims suit and i would also have to pay an appearance fee of $176. That ain't gonna work! Oh well - have to see what Sprint will do for me...

What's hilarious about that is that a T1 line only has capacity to serve a single customer with a really good 3G speed (1.5Mbps), or two with a so-so speed (750 Mbps). My cable modem equals TWELVE T1 lines. So if they're waiting for T1 lines to be installed to the tower, that explains a LOT.
Or the reps just don't have a clue what they're talking about. That's probably more likely.

Yea, I knew it. Once you take someone to small claims court, you usually end up suing for court costs, too. However, you have to pay the charges up front and you could still lose and end up having to pay the ETF anyway.
Call them or email them (or chat) and tell them you want a credit on your bill (even for now) they gave me $50 off my bill just for calling them and bugging them lol I also asked for credit off my bill.
Also just use a verizon prl and they will give you the boot.

Alright, I hate to be the bearer of bad news, but DO NOT take them to court. There is a section in the Sprint PCS Terms and Conditions of Service (that you signed) specifically stating that you agree that all disputes will not be taken to court but arbitrated. If you take them to court they will show that you agreed not to, judge will drop the case, and you will be liable for both your court fees as well as Sprint's (You are not liable for Sprint's arbitration fees though if you go that route). Quoting all relevant parts of the T&C now. There is an exception to that for small claims court, but you would definitely lose against Sprint and still have to pay their court fees.
It is almost always the better route to fight with them AND SEND THEM WRITTEN NOTICE OF YOUR DISPUTE until they let you out of contract. Also STOP using the phone during the dispute that way you can get them to waive any monthly bills AFTER the written notice of dispute.

The arbitrator’s decision and award is final and binding, with some exceptions under the Federal Arbitration Act ("FAA"), and judgment on the award may be entered in any court with jurisdiction. We each also agree as follows:
(1) "Disputes" are any claims or controversies against each other related in any way to our Services or the Agreement, including, but not limited to, coverage, Devices, privacy, or advertising, even if it arises after Services have terminated — this includes claims you bring against our employees, agents, affiliates or other representatives, or that we bring against you.

We agree to make attempts to resolve the dispute. If we cannot resolve the dispute within forty-five (45) days of receipt of the notice to arbitrate, then we may submit the dispute to formal arbitration.
(3) The FAA applies to this Agreement and arbitration provision. We each agree the FAA’s provisions, not state law, govern all questions of whether a dispute is subject to arbitration.
(4) Unless we each agree otherwise, the Arbitration will be conducted by a single neutral arbitrator and will take place in the county of the last billing address of the Device. We will agree on the arbitrator, and if we cannot agree, then the arbitrator will be appointed by the court as provided by the FAA.
(5) The arbitration will be governed by the arbitration rules selected by the Arbitrator. The federal or state law that applies to the Agreement will also apply during the arbitration.
(6) We each agree not to pursue arbitration on a classwide basis. We each agree that any arbitration will be solely between you and us (not brought on behalf of or together with another individual’s claim). If for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then our agreement to arbitrate doesn’t apply and the dispute must be brought in court.
(7) We each are responsible for our respective costs relating to counsel, experts, and witnesses, as well as any other costs relating to the arbitration. However, we will cover any arbitration administrative or filing fees above: (a) $25 if you are seeking less than $1,000 from us; or (b) the equivalent court filing fees for a court action in the appropriate jurisdiction if you are seeking $1,000 or more from us.
Exceptions To Our Agreement To Arbitrate Disputes Either of us may bring qualifying claims in small claims court. In addition, this arbitration provision does not prevent you from filing your dispute with any federal, state or local government agency that can, if the law allows, seek relief against us on your behalf.

Don't worry if you think you over spent on Galaxy S3. Price protection may cover u.

So I talked to my credit card company today and they said that they will cover/repay me the price drop within the first 60 days of the purchase. The customer service rep was generous and told me that most of the credit card companies have this policy for 30 or 60 days price protection.
After doing some research I found out that out of my 8 credit cards, 6 of them have price protection on them.
This is my card's policy:
http://www.maximizingmoney.com/cred...owest-price-on-freedom-credit-card-purchases/
Please go ahead and try giving your credit card company a call and ask for the price protection policy. You may be lucky to have 90 days protection and so you can wait for longer for even more price drop.
Note: Most of these card companies cover purchases only in US. So you may be lucky only if you bought it from Negri or expansys. Also you have to be minimum a resident of US for this offer.

I'll keep this breif, got my z2 from phones4u, with £70.50 cashback as part of the offer..... My cashback went into my account on the 28th of april but a duplicate payment also went in. I know they only give me 7 days to pont out any contract errors/phone faults etc to them, otherwise tough luck on my part, so i was expecting to either hear from them within a few days or have the money took back from my account, neither of these happened.
However on monday (21 days after paying me) i recieved this email:
As you will be aware, you have recently received an automated payment from Phones 4u directly in to your bank account for £70.5 on the 28th April 2014.
Due to a process error, in addition to the agreed payment, you have however also received a duplicate payment of the same amount also on the 28th April. As this was not part of the offer we therefore require this overpayment to be repaid by 8th June 2014.
In order to make the repayment as convenient as possible for you, you can make one payment of £70.5 by one of the following methods:
Check or postal order made payable to Phones 4u Ltd, sent to the following address:
Phones 4u Ltd
Osprey House
Ore Close
Lymedale Business Park
Newcastle Under Lyme
ST5 9QD
Bank transfer to the following bank details, Sort Code 30-00-02, Account Number 00704305, quoting your reference number and your surname,
Credit / Dierct card payments can be processed by telephoning 01782 676944 or 0800 294 6023 Monday to Friday, between the hours of 9.00am - 4.30pm.
Please accept our apologies for this inconvenience. We appreciate your assistance.
Yours sincerely,
Phones 4u
My question is can i legally not pay this??? I've searched through the t&c's and can find absolutely nothing about errors on there part (altho any issues/errors or whatnot at my end need to be dealt with within 7 days) and this email also doesnt mention any further action if i dont pay....
Am i legally allowed to tell them politely to go f*** themselves and pay more attention to what they are doing in future?
P.S. Dunno if they operate in other countries but im referring to uk law
Pay it back. It isn't yours.
Also, they do have full legal recourse to recover the money, regardless of how long ago the error occurred. It doesn't need to be in the T&Cs because it's already in the law of the land.
Dreadful OP. Give the money back. Morally and legally the correct thing to do.
Send a reply stating "for any non contractual payments to be made by me will unfortunately incur an administration charge of no less than £69.00. "
"payments made by myself in the form of cheque or postal orders will also incur a single charge of £1.50 for postage and packing.
Please advise me on how you wish to proceed."

I would pay it back mate or else they will keep chasing you for it & pass it on to a debt collection agency.
if you wanna go into the black list dont pay it. my uncle is a 2 business owner and 4 mortgage owner because of silly £60 payment he didnt pay he cant get any loan from the bank.
If your device is not network locked and you have the original bill with you, you may not pay them back. They aren't "legally" entitled to it.
Had the same issue with Domino's btw. Didn't pay em ****.

What do you mean by original bill?? All my bills get emailed to me so i have at least 2 years worth, i didnt think there was anything they could legally do apart from ask you to pay it back. I think its something to do with statutory consumer rights, kinda how shops state 'please check change before leaving as mistakes cannot be rectified later, (and yes i am that person who will walk out of a shop, then stick my head back through the door to tell them they gave me too much change, but cant have it back as i've left the shop)..... and whoever mentioned it being morally right to pay it back, id normally agree but this is phones4u were talking about, my morals followed theres out the door

The payment receipt for the phone. With which you'd be claiming warranty in future if needed.

Ehm if he recieved money that is not his of course he has to pay it back. If someone transfers 1 million to your account by mistake it does not make it yours. And you have to pay it back.
Nah, look at phones 4 u terms and conditions.
Phones 4 u cannot be held liable for any action ..... Caused by any neglectful act by yourself.
That's a 2 way street right there.

2 wrongs do NOT make a right; it doesn't matter who makes a financial error, its part of being a good human being to give anyone, person, or business their money back if you receive it in error..
Hard to believe that people now a days even have to ask something like this..No wonder this world is going to hell, no one gives a damn about anyone but THEMSELVES
Don't get me wrong, I'd pay it back. But he doesn't want to and he wants to know can he say "tough"
Morally, no
Legally, probably no too, but he's well within his right (just as these big Businesses do) to apply administration costs, fees etc.
And please, we all know the world's going to he'll because of banks and big business, and they're the first in line to charge excessively for menial things.

Agreed, but, once again, just because some one or some company doesnt do the "right thing", that doesn't mean that its ok for them OR us to be the same way...
Karma is a funny thing; live your life and treat others the way YOU want to be treated, and life will be good for you...
That's why I'd give it back,
but he's not me.

This is something only a lawyer can tell you, they would have to go through the T&C and find any loopholes or ways out, this of course would cost more than £70 so just pay it back and avoid any trouble.

Once signed up for cheap mobile with free xbox 360, next day, 2 phones and 2 xbox's arrived, I rang up place to enquire as to the two phones being sent. Reply was 1 is your contract phone sir and one is the complimentary payg phone. I then said but what about the 2 xbox's, "what?"
Two xbox's came.
"sir, our records show only 1 xbox was picked and sent, I suggest you go and recount the items, ok?"
Err ok.
"is there anything else I can do for you today?"
No that's all thanks

Ethically, yes. Legally, Nope.

Check with your home owner's policy for cell phone coverage!

OK, like many of you, I have traditionally paid the $8-12 per month for device protection / insurance. But I recently started questioning that and did some digging. Here's what I found:
My Amex AND Visa cards both provide courtesy device protection with a $0 deductible for 90 days after purchase date. It's automatic, and offered by pretty much most credit card companies these days.
My home owner's policy provides up to $5000 in home electronics coverage, with a $50 deductible. It's automatic as well. Phones and home electronics are considered personal property and your home owner's policy covers you anywhere in the world, not just in your home.
I called both credit card company and the home owners company to go through what's covered and what's excluded in detail. Accidental loss, theft, water damage, screen breakage - they are all covered. Yeah, sure, you have to go through a claims process and they aren't going to overnight you a replacement phone. But I am more than happy to just go online and buy a brand new device while I wait for claims to reimburse me. That way, I am getting a brand new phone too, instead of a refurbished unit.
Just wanted to share this with folks - most people have this coverage automatically, no reason to pay the high cell phone carrier insurance rates.
Thanks. I work in Auto insurance and I never thought to call my home owners insurance. I'm going to give them a call.

Most credit cards offer extended warranty. Regarding about filing a claim with your insurance company, your premiums will go higher if you file too many claims. So for a small claim, it might not worth it.
Hopefully I don't lose my phone too many times, in fact I hope I never lose it. The whole premium going up after a claim isnt something I worry about. I can either pay $150 a year PLUS $175 deductible for carrier provided insurance, or make a claim with my home owners policy and take my chances with premium increase the next year.
