The U.S. ITC said today that they have started to do a formal review of the complaint Google's Motorola Mobile Unit filed on August 17.
The handset maker, which Google bought in May for $12.5 billion, claims Apple infringed seven of its patents on features including interactive voice commands, location reminders, e-mail notification and phone/video players. The case seeks a ban on U.S. imports of devices including the iPhone, iPad and Mac computers. Apple’s products are made in Asia.

is android in danger?

With android under attack from all sides, including microsoft, apple, and rim, who are now joining together to try to kill of android because of the threat it presents to them, can it survive in it's present 'free' state?
The latest blow came from the 6000 patents bought from nortel by a consortium of companies led my apple and microsoft, who are no doubt going to add these patents to their list of lawsuits against google and it's partners, i.e. any company that produces android handsets.
microsoft is already trying to get $15/handset from samsung.
Their goal is to make android so costly to google and the handset manufacturers that they will effectively kill it off.

Ya, seems everyone is out to stop Google. I think they have a plan in place and maybe even as early as fall, with the launch of ICS, they'll reveal that plan. I would say that they have so far reassured their manufacturing partners that they have a plan in place to put these failing dinosaurs in thier places. Otherwise, most of them would be abandoning android.
Maybe Google is taking a closer look at Bing, would be too funny if they charged ms a couple bucks per search if they found something infringing.

I think these patents are only enforcable in the US. Every other country doesn't have these patents. So the $15 is only for phones sold in the US by Samsung.
What funny is that apple microsoft and intel can't sue each other because they bought it as a consortium. I'm not worried that google will find a way around this, considering that the android platform is the best out there.

There is a difference between asking $15/handset and getting it. Additionally, I doubt Microsoft is serious about the number and is more likely attempting to licensing a large patent agreement with Google that would cover more than phones and only using this as leverage.
Google could just buy RIM and by doing so get the Nortel patents anyway.
It could also ask partner companies to cross licence for android products which will not only strengthen the patent portfolio but will also protect the android platform and in doing so help out both Google and its partners. HTC and Samsung and Google should have formed a consortium to buy the Nortel patents but by Google's bidding pattern looks like they weren't really interested.
The patent sale as been approuved by both Canadian and American Gouverments. Damn!

But yh with the 3 other major platforms, Microsoft, Apple and RIM all bidding to keep Google out shows how all 3 view android as a great threat. Microsoft and Apple are hardly best pals but against Google they joined the partnership. Microsoft was already immune from the patents as its already paid the license to fee to Nortel to use them, so even if Google got the patents they wouldn't have had to pay any royalties. Their bid was a tactical one.

If this includes the tab 2 then ill be mad. But I thought they partially made the tab 2 so it doesn't infringe. Goshdang every major company should sue them .
Ah good point. But the 10.1 is pretty much off the shelves now except for a few "closeouts" so if that's true that it isn't the Tab 2 then this would be almost meaningless.
I guess makers of flat rectangular picture frames better beware, they are next.
I pity the book stores who are obviously next, with their rectangular shaped objects that display glyphs that are scanned with the human eye and translated into words in the brain. God forbid they put pictures on the cover as that's clearly infringing on the photo gallery app patent!

It's because we allow stupid laws to exist that are designed to protect the little guys and only serve the big fish that things like this happen. In the old days, companies had to innovate to compete for business. Now it's all about how much of your competition you can eliminate so that people are forced to buy your ****ty products.

I believe this was just for the original Tab, which did look a lot like an iPad. I think both Tab2 devices are a ok!

Apple Injunction
Forget the Apple injunction on quick search box for Samsung Nexus and Galaxy S III. This new app on GooglePlay does most of what was removed because of the injunction: Veveo vtap QuickSearch
It's not just Apple that's the problem here, every big electronics company is suing each other over SH*T, and in Apples case, it's only about halting sales of the competitions products, it's F*CKED!

I'm sure someone will come up with prior art to it anyway and make them burn.
The damage however is done - Apple does not care about winning (well maybe a little) but about the news coverage of them suing for copyright infrigment.
Worst case Google has to move Android development to e.g. their r&d center in Switzerland or UK (afaik none of both countries have software patents). US-customers are screwed, not Android.
It is such a childish thing for them to do. Just because android is getting bigger than apple for once.

I doubt the courts will let android be taken down by Apple. Surely there will be some line drawn!
Guys calm down. Swearing and wishing a horrible death to someone who died already a painful death is not making you look mature or protecting any company from IP claims.
We are talking about huge companies sueing each other publicly. Just because the press didn't cover it before as much didn't mean it didn't happen. Take SCO for instance. I think 99% of the readers won't even recognize that brand - had they been able to prove (or at least successfully claim) copyright to Unix, Linux (known as today) and by extension the Linux-based systems such as Android would not be FOSS (free and opensource). (At least not in the US)
My point is, let them wage their wars, sit back and enjoy the show. If no media cover it, they won't try such high-stake obviously media-oriented stunts.
Even if Apple should gain the patents, they most likely will result in FRAND (fair, reasonable and non-discriminatory) which means a few Cent more to the already very high IP cost per device.
Oh, just a note:
Both Google-released Android browsers rely on Webkit which has been started as a fork of KHTML/KJS by... Apple.
If you want to print something on UNIXiod operating systems you most probably use CUPS by.... Apple
The only non-proprietary programming language for GPU-based programs, OpenCL, was started by... Apple
Don't say they just steal. They added and continue to add a lot of great functionality to opensource software we rely on every day.
Yeah, it's 25 patents. Compared to how many patents there are total, like Motorola which is owned by Google which has like 4000+ patents, that's very little.
It also depends on specifics, like for example Motorola owns its own patent on multi touch etc.
This will be a large lame battle of "technicalities" that can be interpreted correctly or incorrectly.

If the courts allowed Apple to ban devices infringing on these patents then this would create a monopoly. So it won't happen all I see happening is the possibility of Google paying a fee to apple for use of the patents. Which sucks!
How on earth could anyone possibly grant apple a patent for lists? Even the old Nokia 3310 had lists. The patent office might just as well have granted them a patent for the ability to make calls.

I was very disappointed to read the verdict - sad day for Samsung and their users. My question is - if Apple gets the judge to invoke the injunction does that mean that our rooted phones will also have to strip out the offending routines? Just makes me hate the zealots even more. Wonder how many of the members of the jury and judge had iphones? Does that mean that Apple cannot have any part of Project Butter?? Love my JB and the fact that my 2 year old phone is still cutting edge!!
On a different note, you mentioned that you are using FFC. I have installed one, but so far have not been able to fire it up. Is there any zip file with the i9000 FFC files on it? Would really like to know if mine is working.

Their patents that they were suing Apple with also just recently got invalidated.
All I want to see is Google doing something. I want google to sneak some patents over to the OEM's and help em out a bit.

Stock AOSP is not the problem, its mostly over Samsung's Touchwiz UI. Having familiar icons etc.
I dont see how their going to change the design though, from a rectangle to a square?

The fact of the matter is nobody bought a sgs1 or any other Sammy products thinking it was apple products.
When you go to the big box stores apple products are usually merchandised in another area than most other OEM's.
Apple just has their panties in a wad because Sammy is actually selling more smart phones than them and their products are comparable, better IMO, to theirs.
Its not Sammy's fault that apple has only released like six smart phones. They put out products to appeal to everyone, not just an elite group of pretentious asses.

I just saw the most incredible interview involving a Mercedes Benz executive talking candidly about his disgust with how Apple has been acting lately in court about the whole smartphone ordeal. I wish I could find it to share in full but I came accross it while channel surfing. In a nutshell, he said "We at Mercedes own over 80,000 patents worldwide including the rights to the first self-propel
led 4 wheeled vehicle, or as we all would call it today, the 'CAR'. We could take every car manufacturer in the world to court with legitemate claims that they copied our idea and force them put out 3 or 2 or 5 wheeled vehicles etc. Do we? Of course not! We exist today as we do because we bring the absolute best we can build to the market year after year. When he's asked if they're worried about the constant attempts to copy them as Apple claims Samsung and Google did, he just smiles and says "let them try, that's what has kept us at the top of our craft for over 100 years. Why would we stop now?" -Absolutely brilliant! That's how a real innovative company acts. Mercedes for president!

I would think it means almost nothing for android. As far as for Samsung it probably just means more money spent on appeals in court.

It would kind of suck if zooming on photos and multi-touch is now removed. Combine that with the universal search and I would think we'd all have grounds to get our money back for products not being what we paid for at the time of purchase. Hmmmm.

I think now one thing we can do is go to apple store if we encounter any issues with Galaxy Tab and Galaxy S phones and ask them to fix the damn issue. Let's see if they say that it's not an iPhone or ipad, tell them their bosses at Cupertino think otherwise

As ridiculous as that seems, I'd think it a good laugh if I saw a dude rock up in an apple store demanding help since the "stolen copied Apple-tech" has a problem.
I'm just glad most of these ridiculous patent wars are in the US only and the rest of us can still enjoy imports without too much hassle.
As far as the patents go, Apple would probably patent the fact that their devices use a battery if they could, its stifling competition to the detriment of all consumers. Competition is healthy and stimulates innovation

As someone who values an iOS device over Android I guess I'm going to have the unpopular opinion here. But Samsung released a document that told it's employees how they needed to copy the iPhone. I mean come on. Are people that fanboyish that they're just going to ignore this huge piece of evidence? It's literally a guide on how to best copy the iPhone. As someone who's used an iPhone since they came out, used a Galaxy S, Motorola XT860, Galaxy Tab, Galaxy Tab 10.1, HP TouchPad, HTC One S, and currently using a Galaxy S 3 until the new iPhone comes out, I can easily say that I can see how they would think they're copying features.

Microsoft with Windows, also based on Apple designs. The problem is not the copying of designs (yes its unoriginal, its bad karma, we know) but instead the fact that Apple was able to patent such basic design ideas like a rectangular screen with rounded edges. That technically makes all touchscreen devices and laptop computers infringing devices. The patent office should not have allowed the patents to get approved in the first place. Even though App,e patented the idea, it doesn't mean they were the first to think of it.
Who should hold IP over an idea - the person or persons who thought of it first, or those who filled out the paperwork? Hell, even calculus was thought up by two people at the same time, without knowledge of the other.
Patents like this (if exercised when the devices first started appearing) can only inhibit technological advancement, as it removes competition. Competition fosters growth.

Indeed! At to put perspective further, Apple even copied (Xerox) to get where they are. The game is not "who copied who", but rather who gets the patent first.
Apple is playing a dangerous game of "patenting" and sueing everyone. Making the competition unable to input basic idea in their products, I honeslty think it's a matter of time before Apple Gets sued by everyone they've copied over the years, and they copied a lot of people!

Copying isn't the real issue, it's the patent office. For example one of the design patents Apple was granted was for a rectangle with rounded corners. I think that anyone that's used a tray in a cafeteria knows that this is a silly patent. Yet Samsung had to defend this in court.
The patent office has publicly stated that they are under budget and overwhelmed with patent applications and that they do little research on prior art these days. They have stated that the will grant patents and let the courts sort it out. This is their way of sending a political message to Washington for more money. What results are judgements like we saw last Friday.
I believe that Samsung took a calculated risk when they copied Apple's alleged patents. They were a distant second place in the phone market behind Apple and saw what was happening to RIM and Nokia. Copying Apple not only thrust Samsung into first place, by a wide margin, it netted them $6 billion. That's a good leverage on the $1B judgement.
In any event, Samsung is now the number one phone maker an the threat of these kinds of lawsuits in the future are minimal since the Samsung products are now superior and we find Apple copying Android.
Gotta wonder about the jury.

I'm no Apple basher. Even though I've never used any of their products (other than an Airport Express for my WAP), I'm sure they make great products.
But mistaking a Samsung, or any other, device for an Apple device?

Yes, the awards by the jury presumed EVERY Samsung phone purchased was a lost sale for Apple. My understanding is that this decision alone is grounds for appeal.

I've been saying this along, does Apple think its customer base is not smart enough to differentiate between Apple and Samsung products? "Oh NOOOOs I just bought a Samsung when I thought I was getting the iPhone!" The entire design patent is a joke, next lawsuit is against Applebees for using similar name and rectangle tables with rounded edges!
I'm not a fanboi, I just hate stupidity!
