The damage however is done - Apple does not care about winning (well maybe a little) but about the news coverage of them suing for copyright infrigment.
Worst case Google has to move Android development to e.g. their r&d center in Switzerland or UK (afaik none of both countries have software patents). US-customers are screwed, not Android.

It is such a childish thing for them to do. Just because android is getting bigger than apple for once.

I doubt the courts will let android be taken down by Apple. Surely there will be some line drawn!

Guys calm down. Swearing and wishing a horrible death to someone who died already a painful death is not making you look mature or protecting any company from IP claims.
We are talking about huge companies sueing each other publicly. Just because the press didn't cover it before as much didn't mean it didn't happen. Take SCO for instance. I think 99% of the readers won't even recognize that brand - had they been able to prove (or at least successfully claim) copyright to Unix, Linux (known as today) and by extension the Linux-based systems such as Android would not be FOSS (free and opensource). (At least not in the US)
My point is, let them wage their wars, sit back and enjoy the show. If no media cover it, they won't try such high-stake obviously media-oriented stunts.
Even if Apple should gain the patents, they most likely will result in FRAND (fair, reasonable and non-discriminatory) which means a few Cent more to the already very high IP cost per device.
Oh, just a note:
Both Google-released Android browsers rely on Webkit which has been started as a fork of KHTML/KJS by... Apple.
If you want to print something on UNIXiod operating systems you most probably use CUPS by.... Apple
The only non-proprietary programming language for GPU-based programs, OpenCL, was started by... Apple
Don't say they just steal. They added and continue to add a lot of great functionality to opensource software we rely on every day.

Yeah, it's 25 patents. Compared to how many patents there are total, like Motorola which is owned by Google which has like 4000+ patents, that's very little.
It also depends on specifics, like for example Motorola owns its own patent on multi touch etc.
This will be a large lame battle of "technicalities" that can be interpreted correctly or incorrectly.

If the courts allowed Apple to ban devices infringing on these patents then this would create a monopoly. So it won't happen all I see happening is the possibility of Google paying a fee to apple for use of the patents. Which sucks!

How on earth could anyone possibly grant apple a patent for lists? Even the old Nokia 3310 had lists. The patent office might just as well have granted them a patent for the ability to make calls.

these are tough time we're living.. we might lose one of our life's luxury, Android. without Android, everything is locked; you can't do this, you can't do that. Android OS frees your life, free as in freedom to do anything you want with it.
Apple will never stop Android. I actually think they arent't even interested on that. I know it's very annoying to see those news about lawsuits against android and/or devices with android os. This concernes all of us but I think it is importat, especially at this times of turmoil, to take this more objektively. Also, it is important to stay rational and don't let feelings control our reactions. Only now we'll be able to understand these happenings. I hope some of you will get what I'm trying to say

'coz companies need each other to compete. If there wasn't android, apple would be a random company which produces some electro stuff, and less people would recognize the whole smartphone section the way they do it WITH Android, RIM, WP7 and WebOS or Symbian as competing companies. And doesn't this bringing us together? To have a mutual enemy, is far more productive as you might think
It's also a rule of law, that monopol's aren't allowed in business section. People have the right to be able to choose between various options. Just imagine there were only one Car manufacturer, and this would be GM :O!! Idon't even wanna think about that... At least in Germany, don't know how they handle this in other countries. And because of that, I assume Apple isn't interested on destroying Android. And if they do, google would just change the way how patended things on Android OS works and boom...we're out of that game . How can you just patent something so you can sue other companies? Also I read in the newest lawsuit against the galaxy nexus, they are claiming that Ice Cream sandwich rips off Siri...really? SIRI JUST CAME OUT! Google voice actions for android has been around since what eclair? So Apple is going to rip off Google, file a patent for it, then turnaround and claim they had the idea first and sue google? How does that work?

Uh the fact of the matter is that Android does infringe on many patents. There's a reason manufacturers pay MS a ton of money to prevent litigation, because they know they'll lose. If OEMs wants patent lawsuits to stop then Google needs to rewrite their OS to stop it from infringing on other people's patents. Deal with it.

Siri WAS from Google Voice Search. What FAGpple do is,
-They improved the app by adding many fcuked features.
-They improved microphones to synced with the app.
But still, its Google Voice Search, what is FAGpple's default search? MobileMe? Bing? It's Google.
Also, you guys must remember. Processor chips for iPhone is now manufacturered by Samsung.

These patents really are straight ridiculous, it's clear apple doesn't want to compete they want to be a monopoly. This isn't just apple vs Android this is apple vs blackberry and apple vs windows phone too. Apple wins all this stuff then there will be no competitors, thus creating an apple monopoly. I'm sure it's all a result of them loosing the pc battle to Microsoft in the 90s and being bitter about it but you know what? They wanna destroy Android then make a better product, price more competitively. Take tablets who wants to pay $600 for an ipad when you can get a nook color for $120 refurbished and then root it and put cm7 on and you have a full working tablet!

What's even more stupid is Apple is trying to patent facial recognition as well, even though they don't even have the freaking feature yet.

They are also claiming that the nexus infringes their patent of the hyperlink, this is getting ridiculous. Microsoft and apple are also the ones that want everyone to agree to a commitment to not sue for patent infringement of technologies which are essential for devices to work. Apple wants everyone to do as they say, not as they do.
Even if android is a copy of iOS (it isn't), it is an open source alternative. They are attempting to sue a company distributing free, open, software.

The lawyers are horrible. It is easy to defend that. All they need is to get a hand on any documents that show Apple researching Windows OS because everyone knows everyone, including Apple researches other companies.
The recent Samsung documents telling the designers how the Galaxy S should differ from the iPhone are a real blow to the whole case, in my opinion. That's what has to stand the brunt of the attack now.
Also, one of Samsung's documents was rejected by the court. I think they brought it in too late. That's why they leaked it to the public. Ah, Samsung. What are you doing to yourselves?!

I hate this trial just as much as anyone, but Samsung made absolutely NO effort in differentiating their 1st gen Galaxy S (mainly i9000 model) from the iPhone. The first thought that came into my head when they revealed the phone was "why does it look like an iphone inside and out?" I know the needs to take down Goliath and all, but the first Galaxy S was just downright blatant mirror image of the iPhone...even down to the touchwiz icons and UI.
With that being said, the US patent system needs a complete overhaul to stop these frivolous suits and the Supreme Court needs to set precedence once and for all.
Todays consumer are smart. They know what they are buying. A small boy will differentiate sammy from apple. Grow up apple

Korean, japanese and russian companies all have the same principle: first copy a device, then optimize and extend it so much with the gained experience that it becomes superior to the original.
The Chinese unfortunately are not quite there yet - mainly due to lack of hightech but it won't be long.

The main problem with the video is that they exclude software, where Apple (partially more or less involuntarely since they base on FOSS software) has contributed lots of patches and extensions to existing standards and helped push new ones. Google's Chrome for instance would at least have had a much harder start if not for Apple's Safari and the resulting changes in the Webkit engine.
Apple has definitely made worthwhile contributions to the advancement of technology. For example they may have stolen the mouse from IBM but if they hadn't, IBM probably wouldn't have done anything with it.
These days however they are just plain being lame. Google should sue them for having web search in the safari browser. It's about the same level of idiocy as what Apple have dropped too.

The universal search patent is especially retarded.
This has always been my bugbear with patent law. Nokia's recent sign up for ms means apple now have legal rights to all of Nokia's patents and are now using Nokia patents against Samsung and htc, and indirectly claiming them as apple's (which from a legal standpoint they are!). However, the simple solution would be to do what LG and Sony already do and that is pay the damned patent license. Yes it increases overall handset cost but not significantly.
It's sad when you consider the patents would have only added on about $5 to the cost of each handset. I doubt anyone would have said "oh man, the s3 is great, but its $5 bucks over my budget".

Wrong. It may very well be the case that Apple are suing over technology that overlaps with others patents, but it should not be doing so because it does not have the right to sue over patents it has licensed from others. From a legal standpoint they are anything but Apple's patents.
Even Intellectual Property licensed with the explicit intention of allowing a third-party to sue over the IP, isn't valid for a suit (big case on that in recent years).
Licensing means I say "Okay you can use my spatula when you need it in exchange for your mother's bra". It doesn't mean if on some other occasion someone else has it you can scream "Thief!! That spatula doesn't belong to you, give it back!" At the end of the day it's still my spatula so I can still give it to whomever else I want, and if someone steals it, that's my concern not yours.
Same thing: the patents are still Nokia's. The absolute best Apple could do is pressure Nokia into suing. You cannot sue on someone else's behalf except in exceptional cases like the would-be plaintiff is under-age, or dead.
Well, whatever the case may be, we all know that Apple is a crap company and it's trying to threaten our beloved Android. I love the fact that Android is open-source. I love the fact that Android-based devices are popping up everywhere. Nikon has made an Android-based camera. Isn't it lovely when all your devices use the same software? Isn't it amazing that we can legally hack these devices and modify them? Thank you Google for being such a friendly company!

It would kind of suck if zooming on photos and multi-touch is now removed. Combine that with the universal search and I would think we'd all have grounds to get our money back for products not being what we paid for at the time of purchase. Hmmmm.

As ridiculous as that seems, I'd think it a good laugh if I saw a dude rock up in an apple store demanding help since the "stolen copied Apple-tech" has a problem.
I'm just glad most of these ridiculous patent wars are in the US only and the rest of us can still enjoy imports without too much hassle.
As far as the patents go, Apple would probably patent the fact that their devices use a battery if they could, its stifling competition to the detriment of all consumers. Competition is healthy and stimulates innovation

As someone who values an iOS device over Android I guess I'm going to have the unpopular opinion here. But Samsung released a document that told it's employees how they needed to copy the iPhone. I mean come on. Are people that fanboyish that they're just going to ignore this huge piece of evidence? It's literally a guide on how to best copy the iPhone. As someone who's used an iPhone since they came out, used a Galaxy S, Motorola XT860, Galaxy Tab, Galaxy Tab 10.1, HP TouchPad, HTC One S, and currently using a Galaxy S 3 until the new iPhone comes out, I can easily say that I can see how they would think they're copying features.

Haha there are those rose coloured Android goggles. I've never seen a company break a product down and say "we need to copy these features" like Samsung did.

Microsoft with Windows, also based on Apple designs. The problem is not the copying of designs (yes its unoriginal, its bad karma, we know) but instead the fact that Apple was able to patent such basic design ideas like a rectangular screen with rounded edges. That technically makes all touchscreen devices and laptop computers infringing devices. The patent office should not have allowed the patents to get approved in the first place. Even though App,e patented the idea, it doesn't mean they were the first to think of it.
Who should hold IP over an idea - the person or persons who thought of it first, or those who filled out the paperwork? Hell, even calculus was thought up by two people at the same time, without knowledge of the other.
Patents like this (if exercised when the devices first started appearing) can only inhibit technological advancement, as it removes competition. Competition fosters growth.

Indeed! At to put perspective further, Apple even copied (Xerox) to get where they are. The game is not "who copied who", but rather who gets the patent first.
Apple is playing a dangerous game of "patenting" and sueing everyone. Making the competition unable to input basic idea in their products, I honeslty think it's a matter of time before Apple Gets sued by everyone they've copied over the years, and they copied a lot of people!

Copying isn't the real issue, it's the patent office. For example one of the design patents Apple was granted was for a rectangle with rounded corners. I think that anyone that's used a tray in a cafeteria knows that this is a silly patent. Yet Samsung had to defend this in court.
The patent office has publicly stated that they are under budget and overwhelmed with patent applications and that they do little research on prior art these days. They have stated that the will grant patents and let the courts sort it out. This is their way of sending a political message to Washington for more money. What results are judgements like we saw last Friday.
I believe that Samsung took a calculated risk when they copied Apple's alleged patents. They were a distant second place in the phone market behind Apple and saw what was happening to RIM and Nokia. Copying Apple not only thrust Samsung into first place, by a wide margin, it netted them $6 billion. That's a good leverage on the $1B judgement.
In any event, Samsung is now the number one phone maker an the threat of these kinds of lawsuits in the future are minimal since the Samsung products are now superior and we find Apple copying Android.
Gotta wonder about the jury.

I'm no Apple basher. Even though I've never used any of their products (other than an Airport Express for my WAP), I'm sure they make great products.

Yes, the awards by the jury presumed EVERY Samsung phone purchased was a lost sale for Apple. My understanding is that this decision alone is grounds for appeal.

I've been saying this along, does Apple think its customer base is not smart enough to differentiate between Apple and Samsung products? "Oh NOOOOs I just bought a Samsung when I thought I was getting the iPhone!" The entire design patent is a joke, next lawsuit is against Applebees for using similar name and rectangle tables with rounded edges!

Its not a law but they do have a gentleman's agreement that they will not sue each. Only they know the ins and outs of the deal but they cross license each others tech. Long story short if they did start to scrap like apple vs Samsung then both will lose out in a very long and very expensive exchange of blows that will most likely do nothing but limit both companies progression and revenue.

Wise decision not to sue
I think it's a great, mature thing to do. All the circus with Apple and Samsung is bad for both companies.

I think it's actually a case of Apple and Google. In this case Samsung are a proxy for Google.
The problem started when Eric Schmidt, who was on the Apple board, started developing Android as a touchscreen smartphone OS (not the original intention) having learnt about the plans for the iPhone through his role on the Apple board.
Steve Jobs felt very personally betrayed over this and famously said that he would spend Apple's last dollar to destroy Google's Android.
The more damage Apple can do to any manufacturer's ability to make money from Android, the more they damage Android itself.

Apple and Microsoft simply have been competing and coexisting in the Desktop space for a very long time. They had to find a way to deal with the whole patent situation in a way that would not interfer too much with both there businesses which means cross licensing of basic functionalities while they both retain some exclusives.
This is actually the case in most established markets. Motorola and Nokia have a cross licensing agreement as well.
When Apple and later Google entered the Smartphone sector though they began competing with the established manufacturers. Having no networking IP themselves (or very little IP at all in Googles case) but lots of new ideas for the operating system and UI this pretty much led to disturbances in the balance of power in that market. It will take some more time before all companies involved figure out what is what again and then the whole patent business will vanish from the news while the money changes hands for patents as it always has.
