If this includes the tab 2 then ill be mad. But I thought they partially made the tab 2 so it doesn't infringe. Goshdang every major company should sue them .

Ah good point. But the 10.1 is pretty much off the shelves now except for a few "closeouts" so if that's true that it isn't the Tab 2 then this would be almost meaningless.
I guess makers of flat rectangular picture frames better beware, they are next.

I pity the book stores who are obviously next, with their rectangular shaped objects that display glyphs that are scanned with the human eye and translated into words in the brain. God forbid they put pictures on the cover as that's clearly infringing on the photo gallery app patent!

It's because we allow stupid laws to exist that are designed to protect the little guys and only serve the big fish that things like this happen. In the old days, companies had to innovate to compete for business. Now it's all about how much of your competition you can eliminate so that people are forced to buy your ****ty products.

I believe this was just for the original Tab, which did look a lot like an iPad. I think both Tab2 devices are a ok!

Apple Injunction
Forget the Apple injunction on quick search box for Samsung Nexus and Galaxy S III. This new app on GooglePlay does most of what was removed because of the injunction: Veveo vtap QuickSearch

It's not just Apple that's the problem here, every big electronics company is suing each other over SH*T, and in Apples case, it's only about halting sales of the competitions products, it's F*CKED!

I find it amazing that Apple and Samsung work closely but at the same time they fight like cat and dog. Sure ,you have to protect your product without exception but this just gets sillier and sillier with each court case.
While Samsung pumps out tens of thousands of high-end LCD panels for Apple, the two companies remain embroiled in longstanding intellectual property litigation, with Apple accusing Samsung of blatantly ripping off the iOS user interface, as well as Apple’s iconic product designs.
Samsung isn’t just “Samsung,” though. Dont know how anyone could mistake an Apple/iOS product for a Samsung/Android device. Lets not forget that Apple didnt invent the tablet , That was Microsoft that did that Pity they just lost in Germany - Apple Loses Bid to Ban Samsung’s Galaxy Tab 10.1N in Germany
Good for the lulz but bad for the consumer.

It is fair, Microsoft stolen Apple OS in the earlier time also. But, I read somewhere saying that the window and mouse concept doesn't come from either of the companies, it is from Xerox.

Halted in europe

Reports are coming in that Apple has been granted a preliminary injunction for the entire European Union (excluding Netherlands) that will halt distribution of Samsung’s Galaxy Tab 10.1. This comes on the heels of a postponed launch of the device in Australia due to a lawsuit with Apple.
The decision by the Regional Court of Dusseldorf in Germany to block sales of the device comes after a judge sided with Apple on claims that Galaxy Tab infringed on patents related to the iPad 2. While Samsung can appeal the court’s decision sometime in the next month, the Telegraph’s Shane Richmond is quick to point out it would be heard by the same judge. Apple is also said to have a separate lawsuit filed in the Netherlands as well.
Samsung had this to say in a recent statement about their legal disputes with Apple:
“Samsung believes that there is no legal basis for this assertion. We will continue to serve our customers and distributors and the sale of Samsung products will be continued.”
And Apple has made their stance on the situation clear…
“It’s no coincidence that Samsung’s latest products look a lot like the iPhone and iPad, from the shape of the hardware to the user interface and even the packaging. This kind of blatant copying is wrong, and we need to protect Apple’s intellectual property when companies steal our ideas.”

I fell bad for the android fans in Europe, I have to say that the galaxy tab 10 is the best android tablet out there. I have owned and used them all.
Yah, I have a GT 10.1 and and iPhone 4, and there's really not much different about any of the tablets. There all a flat sheet of glass....

Atleast with the phone there is some argument with touchwiz looking similar to iphone with home button. But with the tab 10.1? Seriously Apple cmon let consumers have choice to buy what they want. Eventually the better product will win, not by blocking compitetor product sales.

I ordered my GT10.1 yesterday from Germany and it shipped today (at least i hope it did).
Of all Sammy products, the GT10.1 seems the least like an apple product, in specs, hardware and software, especially compared to earlier phones.
Yet Apple is after the GT10.1 probably cause they know they've lost dominance in the cell phone market to android phones, and very much fear the same will happen in the tablet market,especially since GT10.1 is the most credible (if not better at least hardware wise) competition.
Apples is a smart innovative company, but I felt from my iPod touch days that I couldn't live with their suffocating and closed (my-way-or-no-way) approach to using their products.
Now, it seems like apple is taking their domineering ways one notch further and just trying to suffocate any competition.
I hope Apple keeps making good products but I hope they don't succeed in killing alternatives. Just leave the choice to us customers.
Well, this is unique. The EU has been quick to block, ban, stop or otherwise harrass American companies just because they're American companies. Even when there's no legal reason or precidence to do so.
Part of me wishes Apple well just for that reason. Alas, the logical part of me wishes justice be served.
Isn't it ironic that a decade ago that Microsoft was the evil empire and Apple was the underdog. Now Apple has become the evil empire and scarier than Microsoft ever was.
One thing is for sure, if Apple stops me of using a product I like, then Apple is more than a just a bad product ... This is such bad advertisement ...

I don't want to get involved in a fight with anyone, especially with americans, but just today I was speaking with a woman from USA, also told me that she is patriot..and she mentioned me these: I cannot believe that americans are making technollogy, and others just develop that tech in a way that americans will never understand. I gotta be honest here, samsung could have put a little more creativity into the design of the sgs2. If the iphone/ipad were my business product I would be a bit upset as well. Its just business, in the end.

Apple is paying Samsung for all the Galaxy Tabs that could be sold till the court announces the verdict.
It seems like a business move by Apple to me. They probably have enough cash to play with. They'll pay out Samsung but in return they will have the customers who will buy the iPad 3 next year. In this way there won't be any loyal customers or fanboys for the next Galaxy Tab.

The title of the thread is wrong, it should be:
Court appointed Apple's request to temporarily halt the distribution of the Galaxy Tab pending a patent hearing.
People are making a too big of a deal out of this imo. The temporary injunction only lasts for 3 weeks at which time the actual hearings will have started and the court will decide whether to prolong the temporary injunction. It's just business as usual.
TBH Samsung did copy Apple when it comes to exterior design, anybody can clearly see that, but what gets me is that they are also claiming trival patents like scrolling, finger operated touch and swipe to unlock. Those patents or utter nonsense!
Honestly so many people think my phone is an iphone first glance, lets be honest gs1, gs2 and the new tab look like apple products.
Apple were just smart enogh to get the desighn right first.

All this litigation only makes me like Android more and more and sets my mind to avoid Apple products.
I don't get what all the fuss is all about from Apple unless they're really worried about someone finally getting a little too close to their spot.
Samsung makes some really powerful phones & tablets and maybe Apple could spend more time trying to come up with some better wider options at least for their loyal fan base rather than trying to choke the competitors who are.
And to be frank, personally, the only thing I hate about the Samsung phones is the lame default GUI that comes on the phone & end up stripping it all out & using a launcher anyway.
Sure the freedom could lead to inconsistent design, unstable app combos & a host of other 'too much freedom' complaints.... But then if you have a reasonable sense of aesthetics & know what you are doing, you could also go the other opposite end & really build a really handsome, ridiculously powerful phone that is customised purely to YOUR choice.
Quite honestly, Samsung doesn't even need to worry about UI - it's the power, price & flexibility that Android with any high powered device has to offer that is the real hook pulling people in.
That said, at the end of the day it's still a huge hats off to Apple for defining & setting the bar on the design scale.
Enough of my rant & please definitely not looking to take sides or start any unnecessary arguments. If anything offends you, then apologies in advance.

There should be more control over copyright and copying of products global wide, It's obvious samsung are copying designs from apple, but hypocritically apple are blatantly copying the androids ui with there new up and coming ios5 swipe from the top to reveal notifications.
Considering samsung supply a good chunk of the parts made to build the iPhone 4 they could easily put a halt to there supplies.
Problem is even though it really won't effect such huge companies but simply dents there progress for a few weeks, it changes people's perception, we are hearing apple are now the largest most powerful company on the planet, trying to slap court cases on other companies is only going to make them unpopular, well at least until the next episode of east Enders is on.
Basically it's all rather pointless, but then if they manage to ban imports if the sgs2 into Europe, maybe I should swap my iPhone for an sgs2 now as it will be sort after and worth more, sell it and buy a jigsaw puzzle and a notepad
Whether you guys hate Apple for what they do or not, you gotta give em credit. Their user satisfaction is much greater than Android... and anyways I prefer the iPad to any other tablet, and I prefer the Galaxy S II to any other smartphone. The iPad is a solid tablet - it has everything a user would want- ease of access, apps, and a thin profile. The Galaxy Tab is also beautiful and light, but Honeycomb is new and still needs work, and it needs more apps. Overall I love my Android phone and my Apple tablet... works perfect for me .

I would think it means almost nothing for android. As far as for Samsung it probably just means more money spent on appeals in court.

I'm trying to figure out if this means licensing deals will be worked out now or if features will be stripped from products.
It would kind of suck if zooming on photos and multi-touch is now removed. Combine that with the universal search and I would think we'd all have grounds to get our money back for products not being what we paid for at the time of purchase. Hmmmm.

I think now one thing we can do is go to apple store if we encounter any issues with Galaxy Tab and Galaxy S phones and ask them to fix the damn issue. Let's see if they say that it's not an iPhone or ipad, tell them their bosses at Cupertino think otherwise

As ridiculous as that seems, I'd think it a good laugh if I saw a dude rock up in an apple store demanding help since the "stolen copied Apple-tech" has a problem.
I'm just glad most of these ridiculous patent wars are in the US only and the rest of us can still enjoy imports without too much hassle.
As far as the patents go, Apple would probably patent the fact that their devices use a battery if they could, its stifling competition to the detriment of all consumers. Competition is healthy and stimulates innovation

As someone who values an iOS device over Android I guess I'm going to have the unpopular opinion here. But Samsung released a document that told it's employees how they needed to copy the iPhone. I mean come on. Are people that fanboyish that they're just going to ignore this huge piece of evidence? It's literally a guide on how to best copy the iPhone. As someone who's used an iPhone since they came out, used a Galaxy S, Motorola XT860, Galaxy Tab, Galaxy Tab 10.1, HP TouchPad, HTC One S, and currently using a Galaxy S 3 until the new iPhone comes out, I can easily say that I can see how they would think they're copying features.

The problem is not the copying of designs (yes its unoriginal, its bad karma, we know) but instead the fact that Apple was able to patent such basic design ideas like a rectangular screen with rounded edges. That technically makes all touchscreen devices and laptop computers infringing devices. The patent office should not have allowed the patents to get approved in the first place. Even though App,e patented the idea, it doesn't mean they were the first to think of it.
Who should hold IP over an idea - the person or persons who thought of it first, or those who filled out the paperwork? Hell, even calculus was thought up by two people at the same time, without knowledge of the other.
Patents like this (if exercised when the devices first started appearing) can only inhibit technological advancement, as it removes competition. Competition fosters growth.

Indeed! At to put perspective further, Apple even copied (Xerox) to get where they are. The game is not "who copied who", but rather who gets the patent first.
Apple is playing a dangerous game of "patenting" and sueing everyone. Making the competition unable to input basic idea in their products, I honeslty think it's a matter of time before Apple Gets sued by everyone they've copied over the years, and they copied a lot of people!

Copying isn't the real issue, it's the patent office. For example one of the design patents Apple was granted was for a rectangle with rounded corners. I think that anyone that's used a tray in a cafeteria knows that this is a silly patent. Yet Samsung had to defend this in court.
The patent office has publicly stated that they are under budget and overwhelmed with patent applications and that they do little research on prior art these days. They have stated that the will grant patents and let the courts sort it out. This is their way of sending a political message to Washington for more money. What results are judgements like we saw last Friday.
I believe that Samsung took a calculated risk when they copied Apple's alleged patents. They were a distant second place in the phone market behind Apple and saw what was happening to RIM and Nokia. Copying Apple not only thrust Samsung into first place, by a wide margin, it netted them $6 billion. That's a good leverage on the $1B judgement.
In any event, Samsung is now the number one phone maker an the threat of these kinds of lawsuits in the future are minimal since the Samsung products are now superior and we find Apple copying Android.

Does anyone buying a Samsung tab REALLY think they're buying an iPad?
I'm no Apple basher. Even though I've never used any of their products (other than an Airport Express for my WAP), I'm sure they make great products.
But mistaking a Samsung, or any other, device for an Apple device?

Yes, the awards by the jury presumed EVERY Samsung phone purchased was a lost sale for Apple. My understanding is that this decision alone is grounds for appeal.

I've been saying this along, does Apple think its customer base is not smart enough to differentiate between Apple and Samsung products? "Oh NOOOOs I just bought a Samsung when I thought I was getting the iPhone!" The entire design patent is a joke, next lawsuit is against Applebees for using similar name and rectangle tables with rounded edges!
I'm not a fanboi, I just hate stupidity!

That actually makes a lot of sense, 1 billion dollars isn't much considering how many phones Sammy sold/will sell on the back of emulating apple.
Best advertising campaign indeed, people will now see that apple are bending them over and banging them without even having the courtesy of using lube when it comes to price.
I kinda knew that somehow apple would be their own downfall and it will be something like this, there is always a case of being too smart for your own good.

Apple accuses Samsung of patent infringing features and designs. Meaning you pay less for the same if you go with Samsung. And another thing brought to mind is Apple obviously didn't care to much about the said patents, they settled for 1.05 BILLION dollars, meaning Samsung doesn't have to change a damn thing.
Like the article says “Best billion dollar ad campaign Samsung ever had.”
IMHO the patents at question are generic to almost ALL mobile OS's, just Samsung can execute much better than any other company and Apple saw them as a threat so the only logical way to go about it was a lawsuit...
My advice to Samsung though, break contract with Apple and quit making iPhone parts! =P

Samsung has already changed their hardware and software design starting from s3.. Apart from the software patents nothing is going to hurt samsung.

No they should not. Keep in mind that Samsung now earns on both their own phones and iPhones, this is business and business is about squeezing out every last dime.

Apple didn't settle for anything. Samsung made offers but Apple took it all the way to trial. The jury awarded 1.05 billion didn't they? Im not that familiar with patent law in the US, but it seems like they've been awarded that amount and it's tough **** if they don't like it.

That's really bad advice. You might as well tell Apple to stop selling iPods. Selling components is one of Samsungs main businesses, they're obviously not going to stop doing that for one of their main customers.

I agree that 1 bil $ is too low. Samsung came from nowhere to the top by copying Apple products. They made tens of billions on phones that look exacly like iPhones while their competitors like HTC and Motorola struggled trying to market their not-copied original designs. This is just a slap on the wrist. The verdict should have at least been for 20 bil $ in my opinion.

Samsung became top smartphone company because they wasnt sleeping and was giving latest/best hardware smartphones not because "copying" apple..... ^^

Yep.. totally agree with you.
Samsung's main strategy is marketing. Here in India if you enter a mobile store the first thing they show is a Samsung phone in your budget. They do the same for television sets and refrigerators.

How many iPhones and ipads have sold in the last few Years? To which Samsung supply chips for both, pretty sure the 1+bn dollar would have nearly been paid by apple them selves.

You mean rectangular phones with a screen? Car manufacturers make billions as well using the round wheel on their cars instead of developing some other shape. And why is that? Because it's the most optimal shape. Tell me how to make a touchscreen phone without using a rectangular shape with a large screen covering most of the phone.
The problem in this case is apple getting a patent on a god damn generic thing. You wouldn't let someone patent the wheel would you? It's the same ****ing thing.
But yeah, nothing would please me more than this lawsuit blowing up in apples face.

The galaxy S2 and S3 don't look like iPhones, but the original galaxy S looks near identical to the iPhone. Samsung themselves have proved its possible not to copy.

even a five year old knows what the difference between a galaxy s and iphone , seriously if any company wants to copy a iphone , lol mold it into a exact replica of it , why bother to add two extra capacitive buttons on it

The jury were given a questionnaire that first set out whether those patents were infringed and then they were asked to discuss whether those patents were valid.. it's seems pretty backward to discuss it like that and I believe that the jury went in with prejudice that the patents were already valid without exploring the matter in more detail.
If you were reading into the trial, you would be more inclined to believe that there was substantial evidence of prior art for most if not all of Apple's patents.

Exactly, I disagree with Samsung getting to number 2 by copying. I think they earned it fair and square.
Apple's retaliation at loosing out on sales to companies which are making better phones than theirs. Seriously Apple, make a more OS unrestricted phone and people may just come back to you.
IOS is dated and too restrictive compared to Android. And people have woken up to this a long time before the 4S was introduced. Apple = sore loosers

Apple is loosing appeal. Many collegues of mine asked me info about SGS [ 2 | 3] because they were grown tired of iPhone and iOS... here and there I read, expecially among fashion/rich youngsters, iPhone isn't cool anymore; reasons are questionable but who really cares?
Anyway there will always be iOS users and fanboys and it must be this way. We need competition to have always a better OS.
About the lawsuit... Samsung copied the whole first wave design and it gaines success only for that. The first SGS, at launch, had very bad performance due to the terrible file-system used. So the lawsuit was lecit.
The real earthquake was SGS2 with its unmatched -among Androids- fluidity... its design was vaguely inspired to iPhone, but not the key to success.
Too bad no one of the jury debated the rightfulness of those patents :\

Note 10.1 Owners & XDA Members:
First, let me introduce myself. My name is Ed and I am the owner of a small networking and integration firm in Louisville, KY. While I am extremely proficient in my profession, my interest in mobile devices is a personal one and really more of a hobby. The number of times I've been corrected by Entropy512 will confirm that.
Anyway, enough about me. What I was wanting to know is, am I the only one who feels like Apple is monitoring my spending habits and basing their lawsuits on them? I mean seriously... the only Samsung device I own that has yet to be added to an Apple complaint is my absolutely gorgeous Tab 7.7 (GT-P6810) and it's 7.7" 1280x800 Super AMOLED Plus awesomeness! My other devices include the original Galaxy Note (GT-N7000), a Galaxy S III (GT-I9300), and a Galaxy Note 10.1 (GT-N8013) that I literally just bought yesterday!! Now today I read that Apple has added all but one of my devices to their most recent complaint. I would really like to own a device without having to worry about whether or not it was going to lose features. Am I the only one who feels this way?

I don't feel like Apple is tracking spending habits, however every device listed is a very powerful (and popular) device. I've recently decided to pick up a GNote 10.1 over the TF700, and it feels like Apple is targeting anything popular that Samsung is rolling out. They really are trying to cripple the U.S market for Samsung, and It's really annoying.
iWay or no way I guess. I hope they get decimated with patent lawsuits.

I get what you're saying. However, if you're gonna wish, you should probably wish for Apple to be annihilated, not decimated. To decimate is to reduce by 10%. I'd be happier with 90%. Apple was a very likeable company when they were on the verge of bankruptcy.

I mean, all of us also can see, where is the part which S3, N7000, and N8000 have copied from apple ?
On its first launch of Galaxy S i9000, yes, apple has the right to say that, since from the design, make-up and appearance, it is quite "similar".
I said "similar", not "same". Apple also claim that the gallery model on i9000 is copying their products, with a pinch method to zoom, etc.
Yes, apple may say like that for i9100.
But what right do they have to sue all samsung products ? Getting frustrated after Steve Jobs pass away ?
Especially on the N8000, I don't see anything similar on the iPad products.
From the looks, it is different alrd. Not to say about the S-Pen, Multiscreen, Pop-up play, floating keyboard, with the 3D surround speaker on the left and right side of the N8000.
I only see that apple is getting more and more ridiculous.

Ever since from Samsung S2, Note 1, S3, Note 10.1,.... Samsung always can grab apple market.
With android as the open source, and a lot developer supporting android, how Apple can win market ?
In Singapore itself, the market for samsung has been grown eversince Galaxy S2. And one by one, ppl start to change from iPhone to Samsung.
Now you tell me, how not to jealous, in here, at least before Galaxy S come out, almost everyone here got an iPhone (I think arount 80% of the mobile market here was under Apple).
Once i9000 come out, ppl here still confuse to change or not, since i9000 is Samsung 1st debut to beat iPhone.
But after that, come out i9100, the market just suddenly boost up for Samsung here.
Up to now, only in around 2 years+, at least here, Samsung can grab at least 40 - 50% of iPhone market.
And now, with Galaxy Note 10.1" (with its all special features), don't u think if this device is very cool, it will grab the iPad market as well ?

+1. Apple has handled this worse than microsofts attempt of monopoly back in the 90s. At least microsoft just sought to dominate the market and didnt attempt to go suing its competition into the ground. Anybody of sound economic mind sees nothing good coming out of these rediculous lawsuits. Samsung is the center off apples imperialistic crosshairs only because Samsung is the only android manufacturer that can compete with Apple. If HTC was where Samsung is then Apple would no doubt go after them. I will vote with my dollar and not buy Apple products. But there will always be isheep out there who will pay for an overpriced product just to have an iproduct.
My guess is that this will all end in a massive antitrust smackdown of Apple. When the devil overplays his hand there is always hell to pay.
Imagine Apple thinking they have a patent on the rectangular phone with rounded corners. Motorola was making phones lile that 25 years ago. Pathetic.

In USA it won't. It is American company, they won't do that to their own against company from the other side of the ocean.
In Europe though it's more likely, but Apple doesn't have monopoly, so maybe not.

No wonder Apple and Samsung couldn't reach a settlement. This case is a rough replay of Apple suing Microsoft many years ago when Apple believed it was owner of the graphical user interface. In that case, it was well documented that both Steve Jobs and an Apple design team had visited Xerox PARC to see the first mouse-driven, graphical user interface available, then adopted its elements for the Macintosh. That case didn't get very far.

No matter what patent apple has for its products, I still believe that "general" technology is not suitable to be patented.
If technology is being patented generally, then, there would be no further invention.
And same thing goes for design.
If a product has been copied exactly the same, without any improvement at all, and you just put your own branding, then yes, I would agree that one is a violation to the copyright / patent. But if a copy has been improved with a lot of enhancement, I don't think it would be considered as a violation also.
I just couldn't believe a giant company like Apple would do such things, and forget that technology doesn't belong to 1 company only.
If Samsung has never started with its first Galaxy S (which according to apple is "copying" its iPhone), there won't be any improvement / invention so called as Phablet (N7000). No further invention like what we see at the N8000 as well, with its pop up play, real multitask with a multiscreen support, and no need to talk about tablet with smart-pen. Has apple done such improvement ? Other than its SIRI, which I believe before apple came out with it, others have known about this SIRI as well. Its so called as "Retina" display also come from where ?
Apple, you have grown up, but yet still act like a child ! Compete with your own innovation, let the consumer choose the technology, and let technology keep on improving !

Great article. Loved reading the comments section on it also. I'm really sick of Apple. The flawed patent system will be overhauled and many of apple patents will retracted as they should've never been issued in the first place.
I'm very interested in how the Motorola case against apple goes and this Samsung appeal.
I wonder how apple is feeling about MS jumping into the table game. If the surface does retail for the rumored $199, apple will have a heart attack..lol. apple is a household name BUT they aren't bigger than MICROSOFT. THEY don't have reach like MS does. It might take a collaboration of MS and Android to take down apple.

I had to jump in on this conversation with one question. What ever happened to the original develops of the GUI? I think it was Xerox. Why didn't they sue someone (Apple or Microsoft or both) for patent infringement back in the 80's? It might be a different world today if Xerox entered the PC market with its own interface.
They tried to years after the fact. The courts told them no dice.
