Help! Got a question! - Vibrant General

Lets say if I theoretically shut off my vibrant and call T-Mobile and told them I lost my vibrant while shopping. Paid the insurance fee for another vibrant. Once I received my vibrant, gave my old vibrant to my girl, would she be able to use it or would T-Mobile lock the phone? And if T-Mobile would lock my original phone, is there a way to unlock it and use it? Just theoretically speaking!

They can't"lock" it but I assume it'd be confusing if you both had the same sim card...but if she has a T-Mobile similar card of her own with data plans and etc yes it would work and T-Mobile wouldn't find out this is similar to buying the vibrant for $500 without the Contract.

You post this in a VERY public VERY highly trafficed public forum frequented by both developers and T-Mobile employees. You used your normal account that already has your location (Bakersfield), 10 prior posts, and (via a warrant that you gave cause for with you original post) log files that tie you to your IP address with dates and times of every time you visit this site. Surely most if not all of those IP addresses (assuming they are dynamic and actually change) all belong to the same ISP who can easily look at there records and see which subscriber had the IP address at those times. Your ISP has your real name, address, phone number etc.
Two warrants later and the circumstantial evidence just became concrete enough to convict you.
But please, tell us more of your theoretical plan.

Nothing will happen, I done it with a few phones from tmobile. One thing though they wont send you the phone completly free, you will pay something like $50

Well just theoretically speaking you would theoretically go to jail because that is theoretically insurance fraud and T-Mobile & Asurion, the theoretical insurance company about which you theoretically speak of can theoretically track IMEI's in use, and since Asurion is the primary theoretical insurance company for every theoretical wireless carrier, they would theoretically be able to track it no matter which theoretical wireless company your theoretical girlfriend was theoretically on. Theoretically speaking, of course.

so my friend got a vibrant, and he wanted to file a claim for a lost phone to get one for his brother. as far as I know this is illegal. can you guys give me some examples of things that might happen to him if he goes through with it or some possible consequences? "it's illegal" isn't seeming to convince him.
Insurnce fraud. He would go to jail most likely.
TMobile can track the missing phone using gps and cell towers. They'll see where the phone is and get it for him instead of giving him a new one.

Well your friend is slightly dumb. First of all, the lost phone is blocked for life. Meaning if anyone ever tries to put a sim card in it, and use it, on any network, it won't work. It is permanently blocked from registering onto any network. So basically your friend is going to get 1 refurbished phone in the mail, and his new vibrant will be blacklisted for ever.
Next, if they find out about the fraud, well he can face fraud charges. If he is underage on a family plan, his parents will face fraud charges.

Its cheaper to buy one from wal-mart than to file a claim (Wal-mart new two year contract is $98.99, asurion charges $130, not to mention you run the risk (more likely than not) you'd get caught.)

well i have to say this is a bunch of bs... i havent done this but known people that have and nothing happens to the other phone they work fine and they dont track you down or go on some sort of man hunt lol but if you say you lost your phone it would be best to not use it anymore get another phone and give the one you had to whoever as long as its not on your plan you should be good.
just so you know im not a fan of thieves but i believe in stealing from big companies cause they steal from people everyday so i would say its fair...
You can do whatever you wish. I found my g1 from a club. Used it for 2 years no prob. Its a gsm phone so whatever the case anyone can put a sim card and use it. How you do it as far as claiming to get a new one is your business

actually you can say you still have your sim but not the phone and they will be like ok? and you get to keep your sim still lol
T-Mobile can and most likely will block the IMEI number from being able to register on the network. They've done it multiple times for my sister when she has had the phone stolen or lost. They can insert another SIM card all they want and it won't work. It might work on AT&T, I don't know if the companies share blacklisted IMEI numbers.
Most likely, they would not go through the process of prosecuting a fraud case on something like this because the cost of the lawyers and other legal fees outweigh the cost of just paying the claim but you never know.

I never said they were going to track you down on a man hunt.
HOWEVER, they do deactivate your lost phone permanently. You can never use it on any network.

for your information, they do blacklist the phone from working. If you file a claim the phone was lost/stolen, the phone will be blacklisted and no longer work when you try to register on a network.

they don't blacklist the IMEI because whoever finds it still has to have a service provider... its the same way with the iphone... Phone company is gonna get paid, regardless of whoever has the phone. I do think however that they lock the number associated with the simcard to prevent "fraudulent activities" i think its like 30 days i remember reading that at the tmobile website
google tmobile insurance replacement FAQs it lays it all out.
good luck, best to do it with a prepaid card so you don't lock a good number...

I've been in the cell industry for the last 6 years and can tell you for a fact, with GSM phones they do not blacklist or lock IMEI's. Its not even possible. The only thing they might do is see if you are stupid enough to use the lost phone on your own plan.

I wanna get another cdma phone for my girlfriend but dont want to add extra line.
My question is: can I flash a second Epic or Pal Pre 2 to same Sprint phone number as on my Epic and share one phone number without paying extra?
I know that I can use CDMA Workshop to flash any phone to any number right?So will it work if I flash second Epic or Palm Pre 2 to same phone number that I have?
At best it wouldn't work well and at worst Sprint would figure it out. Not recommended.
It's probably not very practical. My guess is that they'll figure it out and then fine you or something. I think you'd have to modify the ESN to do what you want to, which is considered illegal (some say it's debatable? I'm not that knowledgeable on this topic)

Came in to say this. They won't be totally cloned, but they'll both ring, etc. And you get to choose the number!
But reading OP's statement... Google Voice is not free phone service. You will not be able to do this.

Sprint will not do this. To accomplish what you're suggesting would be to clone an ESN/MEID which is illegal (Debatable).. HOWEVER..
if you were to have 2 devices with a common MEID, and the same/shared MDN/MSID both 'tied' to one number the cell tower will only connect the MEID one time. both devices 'MAY' ring at the same time, however only one device will be allowed to connect to the call.

Just bought used Atrix, AT&T auto data upgrade

I just bought a used Atrix from a friend and don't want or need data. Plenty of wifi around me.
I have done some research on how to get around AT&T's auto data upgrade and it seems like everybody who gets a new iPhone who doesn't want or need data does the sim card swap. This is where they get a new sim card, put it in their old phone, call att and data block it, then put the new sim into their new iPhone. My question is, is this the only way to get around the auto upgrade? And will this work with any smart phone, not just the iPhone?
Sorry if this is an old topic, but I searched and couldn't find a suitable answer so I figured I'd come to the pro's.

The SIM card trick stopped working a while back, its impossible to not get a data plan with a smartphone now on AT&T unless you find a way to spoof your IMEI, which you're not going to find anything on because its illegal in some countries. Sorry.
They really shouldnt be able to force people to get data plans if they dont want them (for non-subsidized phones), but for now there's not much that can be done about it.
I don't think there is a way to avoid this since the minute you turn your phone on, they have your IMEI and all the other info based off of that. They made it very clear that you can't use smartphone without data plan. It will be added automatically

Smarter thieves often change a phone's IMEI number so that if a device is reported stolen, its harder to track. Also a way to get around having a phone's specific IMEI number banned from a network, again usually because of theft.

They are violating your privacy as a user.

If the said terms have been put into place after you have bought and signed for the device 'without you agreeing to it initially', then legally you have the right to sue them.
You can easily argue that AT&T is taking advantage of the idea.

The woman I spoke with on the phone said that back in September they sent me a similar text saying that if I continue to tether then I agree to it. I don't think I ever got that message but i flash roms so much that I could've missed it
This really brings to light just what a scummy company att really is. If there is anything I can do to retaliate it would be awesome if someone could send me a PM with some details as what i can do.

I think they detect it because tethering uses a special APN which is detectable by att.
I've also read(and immot sure how this works so dontquote me onit) but when att sends a signal out it has what's called a TTL number. This increases by a value of 1 everytime its passed down so the return number they get is higher than it should be.
Don't really know how it works but isaw those methods somewhere so thought I'd let you know

Thing is, if your on unlimited, there's NOTHING in your contract that says your allowed to tether on unlimited, and that's how they get you.
No way to sue, they state that your not allowed to tether, and will change your plan if you do, so they're completely in the right.
Remember this... we only get as much rights as the carriers allow us to have.
and the other side of the coin is......is there anything in there to not allow tethering?

Can't the method AT&T uses to detect tethering be bi-passed by rooting and removing their tethering app...?
Another way the know your tethering is when you use several IPs at the same time, like you tether, connections include game servers, youtube, etc. And it's kinof hard to explain how you were able to watch netflix movies, youtube videos, play games at the same time.

Correct. It only applies to phones purchased after the rule went into effect.

But being from the southeast, I'd really be confused by all of the 'eh' and references to hockey!

I may be wrong ( good chance I am) but I believe this is for new phones that are bought discounted for new contract or extension since in a way until that contract is up the carrier owns that phone. Just like you don't own your home until your mortgage is paid off. Not saying I agree with the new law in any way.
If the owner is willing, they're allowed to call up their carrier and ask for the unlock code. As long as the person you buy from doesn't care and has had the phone for a while, there's no problem.
I don't think it's illegal, but you will certainly avoid your warranty.
