Apple coming after HTC

Just saw this headline. I'm guessing it'll be multitouch related. Or maybe uni-body construction on the Legend? In any case, looks like it'll get ugly (especially if Google gets involved), though hopefully in the end some of their overly broad and generic patents will get invalidated.

He might be a genious but he's a scumbag and so is every one of his employees. I for one am sick of hearing about this company. They make crap products at way over the top prices. The iPhone revelotionized phones but if u think abut it, its 5 year old technology making it seem like its new. Its ridiculous, its an idiots phone.

I am curious to see if HTC is going to file a counter suit similar to Nokia's, Apple is a newcomer when it comes to cell phones. I am quite sure that HTC has plenty of patents that could be interpreted as being infringed upon by Apple.
I am just happy that these companies are helping to support lawyers during this slow economic time.

Of course, Why actually build a product that educated people can use? Apple wants drones of morons to use their products. Best way to steal HTC and Googles market share back? Offer a product we don't want and eliminate the chance of someone else competeing with a better product. Then we are forced into an Apple way of life. Locked in to no extendable memory, unreplaceable batteries, and no usable file structure.

I agree partly. I think Jobs should quit being a greedy ***** and be happy in being a leader and innovator of a piece of history. I guess the family of Henry Ford should start suing all of the other current car makers for producing a mobile vehicle with an engine, and then while he is at it he can sue everyone that uses a production line. Maybe the Wright brothers should sue all plane makers. I mean come on, move on and make something even more innovative Jobs if youre such a "genius"!

Sorry, but this is the whole point of writing patents. Make it as broad and generic as possible so you have a stronghold over your IP. You make more money that way ...
Its probably multi-touch related, which is what Apple's gone after everyone else for. They'll settle, and HTC will license Apple's patent and go about their business.

Now that I do agree with!
It amazes me that apple technology was so far ahead of the game that it has taken other companys this long to catch up with them! They are so used to being at the top when someone else comes along they get scared, and yes i would agree that it is greed, but they would not be where they are without said greed!
And no I am not an apple fanboy, I don't even own an apple product! I just have lots of respect for guys like Steve Jobs, and Bill Gates, they are innovators and do what needs to be done to stay that way! Anyone that can take a company like apple and turn it around like Steve Jobs is a stud in my book!

Agreed, it's a shame, over some small matters, how stupid, what is the world coming to, right's over "touch-use" what next? Just cos' his iPhone is losing money since the "Jailbreak", he's taking it out on HTC to bring his profit margin up, suck-ass!

You probably shouldn't fret too much. The pursuit of the patent protection is for patents registered with the USPTO. In the short term, it won't effect HTC, and certainly won't impact features/functionality in dispute anywhere except the US. Long term, it may kill off HTC if it starts dragging out while Apple bleed HTC in the courts (HTC sell more mobiles in the US market). Then it would impact us.
My big hope is that Palm, HTC and Nokia just clobber Apple with their patent portfolios and Google prop up HTC if it comes to that.

Short term, no, it probably won't be a big deal, but if HTC loses business in the US because of it, then that is a big deal in the long term. According to this NYT article (http://www.nytimes.com/2010/03/04/technology/04htc.html?ref=technology), about half of HTC's revenue comes from sales in the US.
And I agree, Apple's just being ridiculous! While I've never complained too much about them, as they do have a history of making good products (mostly), it's stupid things like this that just annoy consumers!

It is the latest in a series of legal wrangles involving Apple. Finnish phone giant Nokia sued Apple for patent infringement in October 2009, alleging it had stolen patented technology. In response, Apple countersued in December 2009, followed by a second round of legal action from Nokia. Apple is also being investigated by the ITC following a complaint by camera manufacturer Kodak. Apple are just running scared because Android is going to be massive this year. Apple try to discredit Google by attacking HTC on patents some 15 years old!

I do believe that the patents Apple speak off were registered in the US only. Patents have to be filed in each country individually. Europe / Aisia --- the rest of the world would never authorise patents like these. Brings me to think that apple has someone in the patent office who just lets them through.
So even if Apple won, the UK, and the rest of the world would be fine.

HTC is not that big, apple is way bigger. But google already said they would back-up HTC since the most patents are broken by google, and not only the htc sense interface.
This will probably be settled out court, if apple really wants to do damage to htc google will do the same to apple. And google is way bigger than apple.
I think It's kind of weak to sue only htc. But apple is weak, and they'll lose if they go up against google.

I'm not so sure Apple should have gone after them like that. Sammy has the most patents in the US next to IBM and a lot of those are cell phone patents. Why was Apple so intent on biting the hand that feeds them. Yes, I see the similarities in the phone and somewhat in the UI but not to the extent of suing them the amount of product that was purchased from Sammy.

We all knew this was to come... and to someone who said Samsung was one of the most patent-maker companies... thanks for the info, i really didn't know that.

What is incredible is how a multitouch patent was given to apple,when multitouch screen dates back to the early 80's and was the university of Toronto who first made one.
Even better Apple doesn't make touch screen or any kind of LCD they are not manufacturers of hardware they buy it.
I think they are mistaken by the fact that they were the first to do it on a cellphone,but that doesn't mean the patent is their.
Nintendo did rumble on consoles before any one else did,but the patent wasn't theirs,in fact Sony and MS pay money to a company know for patent infringement for rumble on controllers even that no other company before Nintendo had done that.
I think is the whole flawed system of patent which allow for this kind of craps,i may as well patent taking photos of unknown planets out side this world.
And Samsung fire back with hey we have the patent to connect phones to PC by USB..haha

Yeah, and actually, Apple is copying Android's notification bar for it's iOS 5 and nobody even points that out! Personally, after using both iPhone and Android (Galaxy S), I feel both are completely different and I don't think anyone "copied" the other as they give different experiences overall. One should never go just by appearance!

Unfortunately there is only so many ways you can design a touchsceen phone, and an app screen.
Their entire claim pivots on broad, sweeping claims like their ownership of "a field of square icons with rounded corners" - it's stupid, vexatious, and anti-competative.
Their entire claim about copying the physical shape of the iPad is also based on it being a flat tablet with rounded corners. It's ridiculous.

It's not the phone, this is Standard Operating Procedure for Apple. How many of us remember how the Apple Mac got its start? Apple stole the Graphical User Interface from Xerox. Then a few years later they sued Digital Research Corporation because their Ventura Publisher product for the PC contained a Graphica User Interface. The fun thing about this story is that Digital Research licensed their GUI... from Xerox!

but the way handles it is un-capitalistic.. the whole idea behind the world they live in is that there are competition that will copy your stuff as closly they can if its a good solution and if it is not they will make something better or try to.
if apple dont like it they can move to north korea.. they can probebly get excusive rights to be the only phone for sale there

Absolutely agree. The iPhone is derived from HTC Touchphones that appeared on the market 1 year earlier (also with the color white and rounded edges). The iPad is derived on Archos Pads that arrived on the market several years earlier!
As you say, this is what good companies in a capatilistic societies do: improve on competitor products or on their own products.
There was no need for samsung to shake their a*ss 3 times to sh*t straight.

Samsung did copy there ui.. there model... lol.. Nothing was creative in their design.. why is so hard for you guys to admit it?
Its a strategy they applied which was successful and earned them millions and now they have released another one which in looks is still almost the same... and u want apple to sit tight and let samsung capitalize on their success?

When this nonsense first appeared, it was revealed that samsung had developed a ui very similar to the iphone and unveiled it almost a year before the first iphone was released. It was crude compared to what we see now on iphone and Touchwiz but it's pretty clear that samsung had it first and has made it best.

Let's make a poll and see how many of the Samsung owners bought the phone cause they thought it looked so much like an Iphone. If you want an Iphone you buy an Iphone, if you want a Samsung you buy a Samsung. Appled didn't invent the round shaped corner phones, nor did they invented the wheel or hot water like they might claim in the near future.

I'm writing on behalf of Apple to insist that you cease and desist from making ludicrous claims about Apple's rights to make ludicrous claims about stuff they stole...erm...invented.
This is in itself in breach of retrospectively granted patent no 63578929, 'Patent to claim to have invented stuff (and we ain't even lying) 1895'.
The above patent is valid under Apple's patented patent system, patented by Apple Patents Inc in 4258BC.
If they stuck to saying 'well we didn't invent it but we implemented it really well, albeit in a somewhat restrictive manner', you'd have more sympathy, but this persistent reinvention of facts is just tedious.

Why would anyone buy a phone because it looks like the iphone and how many actually use touchwiz anyway, i got this phone as it is the best phone on the market and the best screen simple as.

It's funny, on a simple google search you can find tons of chinese/korean iphone and ipad replicas that look exactly the same, but Apple can't be bothered about them. Of course, you can ignore obscure producers whose phones are manufactured in the forests by panda bears cause if you sue them and you win you get 1 cart of bamboo leaves as compensation. Why not sue a top selling company with the hope that you will get a lot of money and at the same time causing them distress and huge losses. It's all about the competition and Apple relies on less conventional ways of trying to catch up / stay on top.

I wouldn't buy anything apple, I detest them as a company and don't see why all the iSheep like them so much. They are nowt special and ridiculously over-priced. I loved my Galaxy S but my Galaxy S2 is just SO much better. I'll probably get the Galaxy S3 after this.

i think iphone should not change..apple aims to sell to brainless people and it is an affordable target.

Steve Jobs will always be remembered for taking a company from the brink of bankruptcy to one of the most powerful in the world. The iPod and iPhone have forever changed the landscape for media and mobile devices. If it wasn't for him/Apple I'd probably still be using a crackberry. While it's not been explicitly stated, it's a shame that health issues have forced him to step away.

No matter what anyone says, the truth is if there were no iPhone, there would be no Android. We'd probably still be using XDA's with resistive screen and stylus.

I totally agree with the OP. As much as we fight with Apple products, they're still good products regardless and Steve Jobs started it all off with the iPod then progressed to the likes of an iPad. He's only stepping down and he's acting as a Chairman now. It must be difficult to be a CEO of one of the richest companies out there.

Well it should matter what people say because you're badly informed, Android started in 2003, and was bought by google in 2005, the iphone was first displayed in jan 2007
First capacitative screen was the lg prada
I remember having the Nokia N95 when the very first iphone came out.. it had a 5mp camera, int camera for videocalls, supported wifi streaming of music/vids etc.. apple only had these features with the iphone4 in 2010! (any my nokia supported flash!)
Jobs may be prolific, and he certainly has left his mark on the tech world, but the real geniuses at apple are the guys in marketing who make an ordinary product (which is lagging the latest tech in many aspects) seem extraordinary

Jobs is an ass, anyone who knows anything about Apples history knows this. It always irritates me when people hate on Bill Gates so much when he runs the world s largest charitable organization (The Gates Foundation) and has pledged (via the Giving Pledge) to give away the majority of his personal wealth, along with a number of other high profile Billionaires. Has Jobs? Has he hell, hes more interested in getting more money for his crappy devices and stealing IP. Even Baron Hilton is on the Giving Pledge list!

Apple and Job did nothing new, they merely took existing technologies and concepts, as viva.fidel described, and made them better. Can't knock Apple for that, they did a good job, but it's a bit rich them trying to sue others for copying their ideas...

Without Mr. Jobs, 90 % of the industry will be the same Nokia industry for much more years, all we have now is thanks to mr Jobs. Thanks for pushing to the limit all the other companies.

Let's get some fact straights. The first Android device, the HTC G1, was released October 22, 2008. So for those doing the math that's a year after the first iPhone was released and several months after the 2nd gen iPhone. Those Google guys were real trailblazers
I do agree though that back in the day Nokia made some great devices. I remember when the E71 came out. Unfortunately, Nokia like Blackberry are heading into the toilet. We all chose the Android platform for different reasons but because of the iPhone Android was forced to step up their game in order to stay competitive.

As a person, I feel for him for his health, and wish him all the best.
As for apple and all their innovations, they simply take "Water" and re-brand it "I-Clear" and everyone buys it.
He is a magician for selling water to fishes, but at the end of the day, they simply take failing fads such as video calling, re-branding it Face Time and sheep buy into it. Very clever.
The new voice control software rumoured to be in the next Iphone, will probably be called Voice Time, and suddenly everyone will be out and about shouting at their phones to "Call John!! Call John!!" and then followed by "I said Call John! Not call Joan!!". Still people will say Apple invented it, and that it's great.
As for Mac's and Mac OS, Ugly, slow software. Sure it might not crash.. apparently, but still hate it.
Anyway as I said, he is a very clever man for pulling wool over people's eyes, so I say get well soon!
