I have just got off the phone with a very nice gentlemen from HTC customer services.
He informed me that Vodafone are at current flatly refusing to support the HTC HD2 handset. They have NO plans to release a firmware update for the HD2.
He has had this confirmed by his management team as he gets a number of calls on a daily basis regarding the issue.

The issue lies with warranty and insurance! Quite a large issue if you are a Vodafone customer.
It shouldnt matter whether or not they are actually stocking the device any longer. After having the HD2 on their books for only two months and it being a new device to market, they must continue to support any firmware updates/fixes for the duration of the contracts of all their customers that have an HD2. This is surely a given?!
If they supply you with hardware that is necessary to use the services they also provide to you then it must be legally binding that they support any fixes (ie firmware updates) for the hardware supplied to ensure that it functions as the manufacturer intended.

How? You can always revert to the 'original version' and if device is so badly broken that you can't revert, HTC staff wouldn't be able to check ROM version as well.
Besides, if there is some clear hardware problem with your device (like broken button or speaker, screen not responding etc) I don't think HTC service is going to complain about ROM version, this would be just idiotic.. Has anyone any experience with HTC service and non-official ROMS? Frankly I don't think HTC cares, software modding is the whole point of getting HTC device in the first place for many, many people. I am also sure they are aware that many operators provide atrocious support for new ROMs and customers don't have any options.

This is true... the phone WILL go to HTC for repair. But that is not the issue. It is an entirely seperate issue that is somehow intertwined. Its all a bit of a mess really.
As a Vodafone customer for more then ten years from both consumer and business side i have never seen such a debacle.

When you take out a contract with Vodafone they supply you with a phone that has a vodafone ROM on it. That's basically a stock ROM with some changes, either cosmetic, programmatic, or both. They are then perfectly within their rights to tell you that you will void the warrantly if you modify that ROM or replace it with someone else's. It's like getting a car under warranty and expecting to get it fixed for free, even though you've put a new engine in it.
It has NOTHING to do with HTC. This is part of your agreement with Vodafone.

Correct, one size does not fit all. All opperators customise the ROM to suit their needs. Installing a generic ROM from HTC on Vodafone or any other operator for that matter would not only void the warranty but would cause all manner of problems for the support department of each operator. Can you imagine how many customers would brick their device trying to upgrade? Even the most simple of instructions are not often followed correctly.
The Vodafone forum moderators now review all my posts before they display them!! All cus i posted a watchdog link!!

I think the latter. No company would give a phone which is factory prerooted or apps like 2init preloaded.

Motorola's standard policy is that rooting the phone voids the warranty.
You definitely were not sold a brand new, unused phone. You could take it back to the shop for a refund - but then you wouldn't have a Defy+, and you say they are difficult to get. You might be able to negotiate a partial refund, but keep the phone, on the grounds that you understood you were buying a brand new phone. You say the phone works fine so that might be a good choice for you.
If, however, the phone ever did develop a fault, then the fact that it is rooted would mean that you couldn't get it fixed under warranty (although Motorola might agree to fix it, for a fee). Before deciding to keep the phone it might be worth checking whether you can unroot it - although that might depend on how it was rooted in the first place. The other thing to bear in mind is that Motorola's warranty only applies to the original purchaser - it doesn't transfer with the phone. So if it's already been registered with Motorola by whoever rooted it (you should be able to check that by entering the IMEI number on Motorola's support web site), you might still have no warranty, as a second user.
Hi guys I was super excited when I bought this device, still am. I installed my necessary apps like SwiftKey. Transferred my contacts and some necessary work data.

Depending on where you're from it won't. All EU members are covered by law that basically states "if you can't prove it broke it, you have still got to fix it!"

If you hand it into the police (At least in the UK) after a period of time, 4 weeks or something, it legally becomes yours if no-one claims it and you can go and collect it

Only the police can do that, and only after they try to find the rightful owner / give them a chance to report it lost and have it returned

Wipe data & system and install a new rom via Odin and you're done.
Wipe data removes 99% of tracking apps, wiping system removes the rest.
Use a custom recovery and delete everything than use a custom rom/kernel and flash modem/bootloader files too via odin

It is traceable via IMEI.
But someone who lost this phone (apparently it looks like this) and phone was bought on contract, there is huge possibility that someone will block IMEI on network provider. After that 2 ways left. Sell it to foreign country or use it w/o mobile network.

oh, yes you guys are right. forgot the old ways now that everything is smart. On "dumb" phoness you were able to change the imei with the right tools, never tried it on smarthphones. Anyway the chances that someone who throwed away a smashed phone without battery to be looking for it are slim, i would use it

And that has something to do with him because ... ? phones don't comit crimes, people do. Let's say police was tracking a phone for some reason, once the criminal sells the phone it will be tracked for an X amount of time until police knows for certain the buyer doesn't have anything to do with the seller. Anyway more than 50% of phones out there have been used in... unapropiate way from prank calling to showing the latest vid of a gf to your friends (and you know what I mean by prank and vid).
Let us not make any more of what it is: a found phone, repaired, end of story. Nobody will come after it and if it does you can show the owner the receipt for spare parts. If he is as honest as wanting his/her phone back at least they can pay for repairs.
Just use it if you really wanted to... The authorities aren't gonna bother raiding your home and arresting you and stuff just for the sake of a lost phone. So just use it normally. If they blocked it then fine just use it as a gaming device or multimedia device. If someone tracked it then give it back to them and charge them the cost for fixing it. If it really came into accusing you of stealing(which has 0.1% chance of happening) then dare them a lie detector test.

Which one would you prefer in terms of stability and battery saving? I cant figure it out which one is superior.
Best thing to do is use both for a couple of weeks and see what you feel is the best for your needs

Warranty on this device is a grey area, you are allowed to unlock the bootloader which is usually where your warranty expires, that's not the case with OnePlus.
