I need your advice.
I purchased HTC Touch HD ,more than one, devices with some accessories from (www. . . . . .co.uk) website last Wed 17-Dec-2008 and it was shipped through a well known courier company. It was expected to be delivered on Dec20.
I followed up with the two parties.
Conclusion: the shipment is confirmed to be missed (lost) and can not be traced.
The sender company representative emailed me today that I should wait until all parties' offices open after Xmas leave and until that they can not assist me.
I live outside UK.
1-What should I do?
2-What compensation I'm entitled to claim?
Your advice please.

Just emailed him now, to see if he can take credit cards through a PayPal type service. Are there any places you would recommend to purchase from?

I've had very good experience with clove.co.uk.
The $330 price is suspiciously low - significantly lower than what I've paid for with 2 year contract
I bet it was those horrid people at DHL or BusinessPost.

I tried my best to order 2 Nexus 4 8gb today (I live in France) but Google Wallet only said my payment was refused.
I updated my credit card information and now my order is pending in Wallet, but if I look in "My Orders & Settings" in Google Play, the current status of my order is "pre-ordered" (see screenshot) although other people from my country have already a planned date of shipment.
Is anybody in the same case ? Do you think I will receive my phones within the first wave or will I have to wait ?

My status was "Estimate Shipping: 15th November, 2012" but it changed to "pre-ordered" like yours a while ago. I don't what this means but I emailed google and I am waiting for an answer.

According to our records, your order should ship by the evening of November 15.
Upon receiving your shipping confirmation email, you'll be given a tracking number that will assist you in determining your package's estimated delivery date. Please note that it might take up to 24 hours before the tracking number returns any information.

Well, I received that email too. I believe that this is an automated reply that the system sends by looking up your order number. That's encouraging news but I don't believe in a bot especially at this extremely complex situation.

I'd tend to agree with the overreacting part except in reading the OP's response to EE it appears they'd provided this information already and EE is acting as if this was the first communication. Sounds like EE is very unorganized.

Fact is they never bothered to respond to two previous emails asking what the delay was, and when I got through on the phone, they asked that I scan/email receipt as this would speed things up. Did this, heard nothing. Then tried to phone them, discovered they are no longer taking phone calls and was told to email prev address instead via recorded message. I know from prev 2 emails that they don't bother to respond to emails sent to this address. Then, this morning, I received the email in the OP.
I reckon I am perfectly entitled to be pished off with them!

I got a notification around the 9th/10th apologising for the delay and that my watch will be dispatched soon. Then i got a text on friday from dhl to say it's on it's way. and monday lunch time they delivered it.
Got the same email. Sent them my details however I no longer have any order confirmation emails about my Z1. Let's see what happens...

After taking the phone out of the box, I notice it requires a micro SIM, I've been using a nano SIM for a while in my Moto X so I head to my local carrier and grab a new SIM for $5 (grand total $452 CAD). Power on phone, get an OTA update immediately. Reboot, and then once I open the browser (primarily white screen) I notice the infamous "yellow band" along the bottom. Whatever, not a big deal.

After playing with the phone for a while I notice that the rear-facing camera (you know, the primary one) isn't recognized by the phone at all. No apps at all have the "switch camera" button and a hardware information app doesn't even know it exists. I open a support ticket.

Blah blah in the support ticket - I did basic troubleshooting to prove the issue (factory reset, check for updates), and then I ask the following 3 questions:
1) Are replacement units in stock and when could I expect to receive one?
2) I was charged $30 in customs fees when receiving the phone, is that going to happen again with the replacement? Am I on the hook for any shopping costs as well?
3) Would the replacement unit be refurbished, brand new, or are you simply planning on repairing mine and shipping it back to me?

Couldn't you have disclosed that information a little sooner? Also, expecting consumers to sit around after 5PM from Monday-Friday is a bit ridiculous... I don't have my own shipping/receiving department at home, so I can't exactly guarantee I'll be there every day after 5PM indefinitely.

The intent was to save me time, but I don't think it's working. I've since requested that they cancel all of the Hong Kong/China RMA, and just RMA it normally through the USA. At least then I'll get a phone that works, even if I have to fight over the customs to get it here.

Alright, so I spent most of last week arguing and dealing with OnePlus over shipping details and such for the replacement. To sum it up, I was told that it would be the international version, that it would ship from China to avoid customs fees, and that I wouldn't be paying a dime.
Fast forward to July 14 - the phone ships! Tracking information! Hoorah!
Wait, DHL?!?! From California??
Thanks for listening OnePlus. I called DHL today once it cleared customs and was told that the fees I would be responsible for at the door would be $34.71. Again. DHL mentioned that OnePlus did not mark ANYWHERE on the package that it was a warranty replacement, and that if they had the fees would have only been $10 for processing. So screw you OnePlus, and screw you DHL for trying to charge me processing for nothing.
I argued with them about it for quite some time, but it sounds like I'm pretty much screwed.

Alright, so finally some good news!
To my extreme surprise, I received a call from Andy at OnePlus this morning. I had actually requested a phone call during the initial RMA request, so after several weeks without a call I definitely wasn't expecting one now. This is the only response I have had since informing OnePlus that there were customs charges on the second shipment a few days ago, so I was impressed to see that they were concerned enough to actually call about it. That, and I left some pretty heated words in the support ticket that may have forced the call. I'm not sure, but either way I was definitely happy to receive the call.
Anyhow, Andy assured me that if I did indeed get charged a second set of customs charges that OnePlus would have no problem reimbursing them for me. He sent a follow up email so that I knew where to send the invoice/receipt to, and so that's where things are sitting now.
On a side note, I managed to negotiate the charges down with DHL from $35 to $15, but not without providing them every single piece of proof I had (export paperwork with TNT, commercial invoice, copies of RMA info from 1+ website, etc.) that I had shipped the other unit back to them. Even still, I am hoping that they hold up their offer and reimburse the remaining amount.
Summary
The $350 "Flagship Killer" phone turned into a $450 "D.O.A." phone really fast.
OnePlus has had my money for nearly 2 weeks.
I have a OnePlus One with a faulty camera in a box that I can't use.
I have no idea when a courier is going to come pick it up.
I'm really hoping I'm lucky enough to be at home when they show up.
My new phone won't even ship from OnePlus until they receive the faulty one....
In China.
And then it has to ship back to Canada...
From China.
Joke's on me! It's DHL again...
And another $35 in customs fees, yay!

Managed to negotiate DHL brokerage fees down from $35 to $15
Andy from OnePlus called me directly, offering to reimburse the second set of customs charges if applicable
Submitted invoice/receipt to 1+, just waiting now.
I'm aware that there is a chance the camera issue could be related to a bad flash or something software-related, but I'm not bothering with any of that in the off chance that it's actually a hardware issue. Better safe than sorry.
Presumably you already paid upon importing the phone so tax/duty doesn't apply for warranty repaired items. As long as the shipping label clearly states "warranty repair" you shouldn't get a problem.
FWIW I had a weird update too but fastboot oem unlock and reset cleared it up.

I completely agree, there's no way I should be hit with customs charges a second time on something I've already purchased by they couldn't promise it.
DHL is the only company that has consistently hit me with customs charges.

I think there is just some confusion regarding the "Chinese" phone. I doubt they were every planning on shipping you a Chinese version of the phone. Both versions are produced in China, so just because your phone was going to be shipped directly from China, it doesn't mean it wasn't going to be the international version. By shipping directly from Hong Kong, they could pay for the custom fee in one shot. If they sent it from the North America distribution center, it adds another layer of complexity that they didn't want to deal with. Their comments didn't say anything about shipping you a Chinese version - I think you read too much into their comments.

Friends ordered 2 from china, the LTE bands don't matter since we live in Europe i hope for them that they don't get a faulty one.
So the hardware from the international one and the Chinese one are really different? I thought it was just software, kernel related or whatever. So there is no way to mod the modem to work exactly like the international one.
I hope for you that this gets resolved!
Heads-up to OP: I read a couple other ppl have reported camera not detected on an earlier build of CM-11s, upgrade fixed it. Have you tried factory wipe & install CM11 M8?

Well I think she misunderstood your question too. I think she was simply stating how the two versions were different. I wouldn't take her response as a confirmation that they were sending out a Chinese version.
You have to remember that English may not be the native language of the people you are getting support from......
All in all, I think there has just been a misunderstanding in the communication. I really doubt they were sending you a Chinese version to replace an International version unless you specifically asked for it.

Thanks, and I believe the hardware is more or less the same but in order to use North American bands you need to flash a radio and I'm a bit nervous to do anything like that with this phone in case it's an actual hardware problem. I'm worried that OnePlus may try to refuse warranty support because of it.

I tried, and no it didn't work. Wiped everything including system, flashed M8, and still only front-facing camera. Looks like it might actually be hardware-related.

You have to remember that English may not be the native language of the people you are getting support from......
All in all, I think there has just been a misunderstanding in the communication. I really doubt they were sending you a Chinese version to replace an International version unless you specifically asked for it.

I'm not mad at her, I'm not sure why you're so adamantly defending her. It's not her fault at all, she just works there.

In my opinion, when I ask if the model I'll be receiving from China is different from the one I purchased in North America and they come back to me with "China version and global version could support different bands" that tells me that they are likely sending me a different model that "could support different bands."
If it makes you happy, technically speaking neither of us are right since it hasn't happened yet.

Excellent, yes I had just confirmed that with the customer service rep this morning.
For future reference, TNT shipping is possibly the worst courier for returns from a consumer.
They only pick up from 8AM-5PM Mon-Fri (which is when I and most people work), you cannot drop it off anywhere for them, I need to provide (create) a commercial invoice with my signature, provide customs information (ie: export license, some sort of harmonized code?), all of which I don't have since I'm just a consumer, and provide them with 4 copies of all of this, signed and dated.
Here begins the hour of paperwork and printing required to return my defective product. There has got to be an easier way.
Oh right, and a lithium battery form too....

Oh dude, I know. I've been wondering for so long why there isn't a startup delivery service that ONLY hires people willing to work when the rest of us are at home. Oh well. We're not happy either about how this is turning out, so keep us updated (via your customer support contact) and we'll evaluate the procedure. In non-business speak - we're looking for a better provider, but I'm aware that doesn't help you at this point.
Wow I am really sorry to read that, I like must of us had to wait a week or 2 to actually get the phone (express shipping dont do any difference) but thank God my phone is flawless (knock on wood), I hope that was an isolated issue.
