I am not a smart person, but this is my stance on this.
A appelas court aleady ruled that if a company charges for a phone, it becomes the property of the purchasing party and therefore can modify it anyway they want to. If a company gives the phone away free of charge as part of a service, the company retains the possesion of the phone.
So as long as I have to keep paying for my phones, Sprint and Verizon and all the others can KISS MY ASS!
Keep voting for liberals and you will continue losing freedoms!

Lmmfao, that's all I gotta say about any of this. You can't copyright how a device is used, only the design of the hard/software rooting is no different than upgrading the os on your PC, someone really needs to go buy a vowel and get an effing clue, whichever dumbass at the copyright office thought this would fly needs to be fired and sent back to 7th grade civics and economics classes to relearn how patents and copyrights work. Next some genius is gonna try to say you can't use your computer for both work and play without some kind of written contract. This will never stick apple already tried and lost and they aren't broke like the government. Apple lost the patent battle for device use and had their entire patents ammended and/or redacted and lost the jailbreak war, once said device is sold 100% ownership of that device is transferred to the purchaser, otherwise no one really owns anything at all so it would never hold water in a court test.

I don't see how what we do is any different than formatting my hardrive in my PC and installing linux. If I bought a new PC with windows 7 on it I'm still likely to format immediately and reinstall windows 7......and not a stolen copy!

Sent my bricked xoom in to Motorola a few weeks ago, they called today claiming it was not repairable, they are sending it back tomorrow. They didn't mention anything about it being rooted, just stated they will not cover it. I guess I asked for it.....

This is why I got my 1 year warranty from Bestbuy. They cover it regardless of what I flash.
I wonder if there is any way to pull that off with the best buy warranty, any idea how long it is till you can no longer buy a warranty

You can purchase the Best Buy PSP (their black tie service plan) up until the day you can return your Xoom for a refund (30 days / 45 if you are a silver rewards member). With the Best Buy PSP you can literally trash your Xoom and they'll give you another one (stupid policy IMO). This includes rooting/hacking/flashing/doing whatever the hell you want to it.

You're making a smart decision. Unless you are 110% comfortable with development tools I would always advice against rooting and flashing custom software on your Xoom. In almost every single instance where I've seen someone come post about their bricked Xoom it was obvious that they didn't have the first CLUE what they were doing.
It was bricked by clockwork SD partition for some reason now they say they can't fix it

To OP, sorry to hear that. I had the same issue as you and the whole process from the day I called to the day I received the new Xoom was 7 days. I was kinda suprised, was thinking that I might have to pay for the repair. Maybe too many bricked Xoom sent in for repair with the same issue.

I wonder if it would be worth your while calling Motorola and explaining exactly what has happened, mention that you'd be willing to pay for a repair subject to cost? It would be a real shame if they can't help you out.
Motorola had my xoom for 3 weeks. Just got a call.from the customer advocacy office telling me it is not repairable and it is not covered under warranty, I offered to pay and they said no,

So you were hoping they would honor a voided warranty cause sales are weak? Don't want to be dickish but thats the risk we run rooting and flashing. It's like if i bought a new car put a blower on it and blew the motor. I couldn't take it back and say fix it. But glad to hear you found a way to get a xoom.
Not honoring a voided warranty is one thing; we all take on that responsibility the moment we unlock the device. Refusing to repair the device even if you are willing to PAY for the repairs is quite another. Hard to believe the thing is just a throw-away.
I have liberty mutual insurance, I sent it to Motorola not expecting anything but it can't hurt to try, I work in the auto business and we warranty a lot of things that are or should void the warranty but in order to keep happy customers and no bad press we just warranty it, I figured they might just fix it like they have for others, oh well, maybe ill post a YouTube video of it stuck at the MOTO screen and use it for Target practice Haha, or even start a site called WWW.trashmyxoom.com. Haha only thing to do now is laugh it off ....oh and don't do it again!

Cause att is a large corp that started as a landline company that offers internet service and now they're the second largest provider in an industry where the line between phone service and internet service is quickly fading. They're essentially a telecommunications goliath along with verizon that the fcc needs to break up. Remember the too big to fail of the banks. That's what we have here with these two companies. Now that they're swallowing up their smaller rival im amazed at the fact that few people are speaking out on this. Were the ones that lose out because of lack of investments. These companies will try to take advantage of their copper networks before they put any significant investments into fiber optics which is already at least a decade old. That's why google is buying up fiber optics lines, most of the fiber optics network is underused in the US. Googles setting up their own internet service which will outcompete these old farts. What we need is more companies like apple and google which try to give consumers choice as opposed to having gloiath corporations like att and verizon which try to bloat our phones with crap and charge extra for tethering because theyre both internet providers and cellphone companies. God forbid you use your smartphone as an actual smartphone...that costs extra.

This process of getting paid by such companies that will in return give donations at election time for their campigns so they can get re elected is really annoying and is not a government. Att did their board meeting and voted 95% not to be involved with net netruality. Its just bad for isp's all the way around. Obama will veto if it passes the house. Do the iPhone's even use that feature? I mean I keep hearing of patent suits about stuff I'm not even aware of Apple either being the originator of or having said feature in use. Like that bogus siri feature. Can't give a source but I thought I saw somewhere that Apple was fussing over that. When Google and vlingo clearly had that feature in use easy before the 4s every came out.
Since android is open source are they able to get patents for those things?
I'm starting to think that if open source means no patent, that Apple is finding features they like, tweaking them a bit (even though from all accounts siri blows) and they're applying for patents to make Google waste time and money fighting, about what amounts to non issues.
It's not like Apple doesn't have somewhere around $17 billion in cash on hand.

I think that legally you are under no obligation to return the device. They mailed it to you, it is now yours.
Of course, its absolutely not the right thing to do...especially with a pair of companies you are in an ongoing relationship with (who you have alerted to the problem). Would probably just get the IMEI locked out or something and be left with a useless brick and bad karma.

It is designed to stop scams and fraud, but it still applies to honest mistakes and accidental shipments. Basically if you receive something in the mail that you didn't order, it is considered a gift and is yours to keep.
I'm not saying he should keep it (he absolutely shouldn't), but just pointing out the rules.
Interestingly enough, while this applies to physical goods, it is not really true for money. If your employer accidentally cuts you an extra paycheck, or your bank makes an error that leaves an extra $100 in your account, that money is not yours to keep. Your employer has a number of rights enabling them to recover the money (varying by state) and banks have a very long time to figure out that they made a mistake and take it back from your account (and come after you if there's not enough left in the account).
If you do the right thing in either situation, you can't really be harmed. I saw a story once where some woman ordered an ipad from best buy, accidentally got 5 ipads, reported it, and they opted to let her keep them all in the spirit of the holidays!

Basically if you receive something in the mail that you didn't order, it is considered a gift and is yours to keep.
I'm not saying he should keep it (he absolutely shouldn't), but just pointing out the rules.
Interestingly enough, while this applies to physical goods, it is not really true for money. If your employer accidentally cuts you an extra paycheck, or your bank makes an error that leaves an extra $100 in your account, that money is not yours to keep. Your employer has a number of rights enabling them to recover the money (varying by state) and banks have a very long time to figure out that they made a mistake and take it back from your account (and come after you if there's not enough left in the account).
If you do the right thing in either situation, you can't really be harmed. I saw a story once where some woman ordered an ipad from best buy, accidentally got 5 ipads, reported it, and they opted to let her keep them all in the spirit of the holidays!
