So I just sold my girlfriends fascinate on ebay. I shipped a few days ago and just got this message from the buyer.
Thanks for the fast shipping. damn it sucks to say, but i went to have the phone activated at the verizon store. they not only said it can't be activated because its on the reported stolen list, but they confiscated it. i didnt know it couldnt be used, it should of never been listed. anyways, if you didnt know this either, no hard feelings. i wont contact ebay or paypal if you refund my payment right away so i can buy another one.
I have a good feeling that this a POS trying to scam me. I'm looking for some advice on how to respond to this issue. By the way the phone is not stolen in any way shape or form. I know this is kind of off topic but I figured this would be a good place to receive some advice.

Did he verify the ESN prior to buying the phone? If not, its his fault and there is nothing he can do. Explain the situation to ebay and open a dispute.
He did not verify esn. I just thought it was strange that he would be trying to pull this when he has a 98.6% positive feedback rating with over 2000 transactions.
It will be easier if you have the device ID. Contact Verizon and get paper work from them showing the device has a clean ESN. This will only work if you are either still under contract or left verizon when your contract was finished. If you got out of the contract via the fee changes the esn will be bad.
Assuming the Esn is clean once you have the paperwork that says its clean you just tell the buyer that you have evidence of a clean ESN and that you will fight any dispute. PayPal and EBay see these shady people alot and know what to look for.

The only way he is Intitled to a refund is if he pays shipping and returns it to you
Even if he files a complaint he will have to show proof that he sent it back
So I would not worry to much about it
If he does send one back make Damn sure it is yours and has your esn
eBay has policies in place to protect you and the never do anything out of eBay
And you may be wise to report it to them right away and let them know what is going on This Kind of Deal is a No No you were asked outside of eBay

Also, everyone be careful even letting a potential customer check the esn. When I was trying to sell my blackberry many scammers tried to get at mine. Don't give it to them! They can do a fake activation put insurance on it and claim it lost/stolen.. at that point your esn goes bad and they receive a phone from insurion in the mail.. One scammer even tried to get me to take a photo of the back of the phone with the battery out (where the esn is written) under the pretense he was looking to see if it worked on gsm.. Duh its a world phone... Good luck man. From my experience selling on ebay is nothing but headache.

Make sure you move your money out from paypal and un-link any connected bank accounts. The guy will just call his CC company and dispute the charge. Paypal will take your money and you'll be SOL no matter how much evidence your have. Paypal's "protection" is **** and they'll screw you over in a heartbeat.

That's a scam, no doubt about it. Don't let the feedback rating fool you, because it could be a legitimate account that got compromised. The only way they could win a dispute with eBay is if they can provide proof that the ESN was bad. If you know the ESN was good, then there's no way they could possibly provide that proof.

Im not so sure about that, I just tryed to have them put insurance on a fascinate I bought used and they said you can only put it on if you bought it from them.
Definite scam. As stated before, they won't confiscate the device. It's not their right to.
Unlike with media, you actually own a phone, rather than license it (which is why software, music, and videos can actually be confiscated). For them to take the phone from the buyer would be theft.
Call Verizon, have them pull the ESN from the old phone for you and have them verify that it is good. You should also be able to have them verify if it's been activated or not.
The way the systems work these days, I'm surprised someone would actually try and pull a scam like this one. It's way too easy to verify that they're full of it.
As a few of you know I broke my phone a couple of weeks back. And I'm at the point now where I have decided that I need a thread to ***** and moan about my insurance company.
They received my phone on the 21st of June and took my excess and told me the turn around time was 10 days. So day 10 I call up to find out what is going on.
Because the insurers haven't got heard from the repair centre they will automatically send me a replacement. Call today and they don't have a replacement available so will spend the next 5 days looking for one. If they can't find one they will look at a different handset.
This has me worried, I do not under any circumstances want a phone without a hardware keyboard, obviously it needs to be android and must be rootable and have good dev support. I would be interested if anyone can recommend a handset apart from the G2/DZ that fulfills these requirements.
Also using there timeframe the worst case scenario is that the total time I could be without my phone is a month. Which I consider unacceptable given that I pay £10p/m for what is supposed to be one of the best products available in the UK. And I say that because I have to sell this product as a part of my job.
It's a joke.
Feel free to sympathise with me or ***** and moan about your experiences with insurance company's.

When my previous phone (HTC Kaiser) went bad and had to be sent in for warranty repair, I was resigned to going back to my stupid dumb-phone for three weeks and I almost went crazy.
If something were to happen to my Desire Z, I'd be seriously tempted to buy a new one with over-night shipping (no decent phone stores around here), then send the other in for service. I'd just keep the old repaired one for a spare, or sell it.

Hopefully your insurance company gets their crap together and gets you a replacement asap. Have you ever thought of calling them with a direct threat thatyou will file a complaint to whatever governing department about their incompetency?I can't see how hard it can be to get a replacement for you. FFS they could've easily bought you a new one and send it toyou rather than wasting time trying to find a refurbished unit.

Cheers for the links. I have decided to give them until Tuesday before I start going down the the root of making a complaint. If they are unable to offer me suitable replacement handset on Tuesday, I then intend to make a complaint.
I do have another card up my sleeve and its not one that I wanted to play but I may consider it. I work for the UK's second largest mobile phone retailer* and as such the insurance product I have is also the one that I have to sell on a day to day basis. We have it drummed in to our heads that this is one of the best products in country in terms of value for money and the level of cover that it offers.So how am I supposed to sell this supposedly fantastic product when my experience with it has be about the terrible. I am an honest person and do tell things as they are and in all good faith I could not recommended this insurance product given my poor experience with it.
So I'm wondering if I don't get the desired outcome on Tuesday should I tell them this and would it actually help? My guess is no but it is another thing for me to consider

I have just finished writing my letter of complaint. For some reason though I had been locked out of my online account so was unable retrieve my policy id and my claim number. So I called them up and got a surprise. A new handset is on its way to me, i should have it by the end of the week

Glad they finally moved on this.
Received my replacement handset today. Got it rooted and virtuous unity running. Wife calls me, volume is on loud but no sound comes out the speaker. Try some music and nothing.
Also the information label under the battery was almost falling off, the void sticker was missing and all of the visible screws looked like they had been unscrewed with an axe.
I now have to wait for a courier to collect the broken phone and wait for them to ship me another replacement.

I'm really pissed off. I wish I had checked that it was all working before I rooted. There is an hour I will never get back.
But I'm definitely writing to them now. The chances of me getting a phone this week are minimal. And a month without a phone is unacceptable.

I have had a horrible problem with HTC. My new desire z broke after 2 days of me having it. I sent it off to get repaired. When it came back it was scratched and dented so I complained. They agreed to replace the parts to say sorry. But it has been 5 weeks since I sent the phone to them and I still do not have it. This is because they have changed repair centers they said. It isn't good enough so after a lot of moaning they are sending me and incredible s which is good as I am not bothered about a hardware QWERTY. Still not good enough from HTC.
how did you even break the phone in 2 days? It sounds like you abused it somehow.

I have gotten nothing but good service from the loyalty department. They have replaced phones less than a year into contract multiple times at the new activation price without insurance , given me tons of discounts like the 5gb plan for $20, taken off overage charges when I accidentally went over minutes, free tethering, and so on. I've been with them since 1999 when they were Powertel and it's nice to see a company that actually rewards loyalty. So I don't understand the complaints about their customer service. Verizon and AT&T treat you like they don't care if you leave from my experience.

Customer service will not have that information, they only keep records of what and when you purchased or upgraded an actual phone, they don't keep records of your accessories .....
If you ordered it online, you should be able to look it up in your orders section, on your account page, I forget where it is actually at , it is kind of hard to find but it is there ...
You can't expect them to track every accessory that people purchase, that is why you keep your receipts and or confirmation emails....
Personally I have never had an issue with Customer service, that was not quickly resolved by a supervisor or the loyalty department.

Honestly if they do not have your receipt in front of them they are bound by company policy the cannot go into your account unless you are physically in the store. if you try to speak to the store manager you might get better help. Hope it helps, bare with the manager if you can...FYI dark days in the retail locations

That is correct, but so can you, they see almost the exact same screen as you when they login with your password ...
If you're having difficulty with an accessory, you're pretty much on your own.
your receipt will tell you if you can do anything, but you're typically looking at 30 days for accessory exchanges. that kind of data doesn't get logged in your account, so don't waste time getting mad if you lost the receipt.
Outside of those 30 days, contact the manufacturer about their warranty coverage and handle it from there.
as for going into your accounts over the phone: they can if they want to but chances are there's people in store that need tending to, and if you want to get mad about that picture yourself on the receiving end, waiting in the store so the rep could get off the phone.
Look for help from the manufacturer and after years of therapy you might be able to live a normal life again
Type up 7171 kingery hwy, Willowbrook, IL in Google maps and read the reviews. Terrible but not rippable. Then I insisted when I bought the accessory on why they needed my phone number to make the sale, it remains a memory to be forgotten after I solve the problem with tmo

Usually accesories such as batteries abd etc have very limited warranties. I think batteries are good for 30 days but i might be wrong. Also csrs are obly able to see certain things. If you bought your phone online or through telesales, they might transfer you to them or you can always call the accesories dept abd theu can see your warranty for battery. Manufacturer is good though and may have exnteded warranties compared to carrier.

Actually the batteries and chargers on new phones have a 90 warranty that Tmobile can honor. After that the batteries cannot be replaced thru them but have to go thru the manufacturers under their 12 month warranty. The insurance and lifetime warranty do not extend the battery warranty either.
If it was an aftermarket battery ... Which it sounds like it is ... since the stores do not sell batteries... of course the stores or customer service reps would not have the warranty info ... obviously.
If the charger is what you are talking about and it was purchased in the store then like many other places there is a return date and usually have to have a receipt and after that i'm sure it falls back to the manufacturers warranty. No receipt then they really can't do much except look thru paper receipts one by one for a date and an around about time of day ... Which is usually guessed. But that's why they give those things out to keep .. So if you don't have it .. That's not on them.

Hi Guys Need you advice.
I bought new samsung galaxy s3 from Gumtree guy sold it for £350. It was advertised that its unlocked on all networks. When I bought it of him it was working on Vodaphone. I rang orange to get microsim which arrived 3 days ago. I waited for text message for new sim but no message arrived after 24 hours so i rang orange asked why sim isnt active. Orange asked me for phone IMEI number which i provided found out that phone is blacklisted.
when i bought the phone guy said that he has reciept upon receiving the phone he said its at home but will give it tomorrow. So i took his pictures on Galaxy S2, made him sign the agreement and recorded him. I also took picture of gumtree ad and have his IMEI number. I rang the guy yesterday after orange telling me its blacklisted to say why did you sell me lost/stolen phone he said he will speak to vodaphone and see they can unblock it (strange). He rang after couple of minutes later said phone wont work on orange network only on vodaphone and offered me refund straightaway. At this point all i wanted was money back and then report him.
I got the refund now but asked him why he tried selling contract lost phone to me. He said he had previous phone stolen so they sent him new phone which he sold to me at point of sale he did not say he has on contract. I think he tried to scam me but i had all the proof to proof he sold me lost phone which he tried to do insurance scam.
I rang Vodafone to tell them what happened girl said all they can do is blacklist the phone (call center i rang was in Egypt) noting she can do. So i rang sales team who put me through to Customer services in uk i told them the same story but he said call in the morning system is playing up.
I have now bought sim free from carphonewarehouse today for £495
What do u guys suggest about this should i report him again and leave him to scam others (which i do not want) i dont want to go through hassell if its too much.
What would you guys do in this situation,.

Secondly if you can find the network that blocked the phone it might be worth asking them your options if any to remove block.
Seller has commited fraud unless you where informed phone was blocked.

Thats bollocks.
The device IMEI is unique across all devices, including replacements for stolen devices. So if it is blacklisted, that (usually) means it got stolen and has been blocked due to a police-report by the victim.
Punch line: avoid gumtree. I had a similar situation in the past.

Could you post details of where you met up or what he looks like? I just had my S3 stolen yesterday and I think I may have a rough idea of several people it could have been who pick pocketed me. It's gutting, but I just want to get to the bottom of it now.
I'm going to have the IMEI blacklisted tomorrow, but ideally I wish I could just get the phone back. I'd even have been happy to buy it back off him but whoever took it has turned it off and I'm stuffed.
Any help would be much appreciated.
The guy offered you a refund and apologies to you. Then he gave you the money and sort the problem! I think its an honest mistake which could happen to anyone (but the phone working on Vodafone does not seems to be blacklisted, otherwise it would not work on vodafone as well.) Just avoid buying these kind of things of gumtree in the future, or ask for a prof of purchase

Let's theorize that it was stolen. Two scenarios are possible:
a) he didn't know it was stolen and bought it from someone else too
b) he knew it was stolen but didn't want OP to go to the police so he just refunded the money. OP stated he had his voice and picture on record, so he might have panicked when he was confronted with the fact that the buyer knew it was stolen.
Yeah I have my doubts too of Gumtree... However I did buy this new One X there for a little cheaper than the shops, but it was a sealed one... I don't buy opened phones...

Even if it was a scam, the intended victim wasn't you, or he wouldn't have refunded the money.
The victim in the this case is probably Vodafone or a third-party insurance company, and if they don't care enough to do anything about it... well then they have no one to blame but themselves.
He wouldn't have let you see his face if he was going to scam you: even someone who doesn't understand what blacklisting is, would just assume the phone was defective and attempt to get a refund anyway.
When I buy a phone off Gumtree, I test everything before I hand over any money. I always do a IMEI check as well to make sure it is not blacklisted and I find out who's name the phone is registered in. These are the steps everyone should make when buying a pre owned phone.

I agree with others, if he wasintending to scam you, you would never got a refund that's how scammers work. I believe it was either an honest mistake or an insurance scam, not an intention to scam you.

I'm surprised by how many S3's are for sale on Gumtree, many state that they are sealed in the box ?
is there another scam or something that they maybe selling stolen from shops warehouses etc that would allow this ?
ie they may work for a while but then are blacklisted and become useless ?

Gumtree is fine but you need to do the deal "in prerson" so you can test devices out first etc.

I just found the topic when doing a search on Galaxy S3 ads on Gumtree as I am in the process of trying to purchase one and they seem to be a lot cheaper on there than say Ebay, and thought that you guys might have the answers to why ?

delete please i misunderstood the asurion policies.
Asurion insurance is on the specific phone, identified by the IMEI number. I don't see how it would help to swap the SIM, since the insurance is not on the phone number.

It would be on my line I have insurance on my line not my wife's she broke her phone so if I swap Sims it would show my line meaning the line with insurance,tied to the account

I found a page with Asurion info. about the equipment covered. It appears that if you swap a phone to a line, there has to be a record of airtime logged for that phone right before the phone was damaged, in order for that phone to be covered. It also states that the coverage is tied to the phone's IMEI.

well just filed i have made a few calls to the imie so we will see how things go 24 hour verification process if all fails then i guess i have to have someone fix the screen crossing fingers.

seriously i stole my wifes case cause i needed a case i work in a warehouse then yesterday it slipped out of her purse hit the ground spiderweb effect and then blamed me i feel so bad either way 100 but or 160 not much of a difference lol feel like a **** for stealing her case now to look for 2 very protective cases at a reasonable price.

New ones are about $280-320 on Ebay with Valid ESN, thats how I replaced mine after similar drop as your wife. I had my original repaired but it had colored lines and ghosting occasionally due to repair shop doing something wrong (They replaced screen 4 times due to various problems and too much pressure under display) when it seperated a little it started working properly after a few days of getting a refund. They finally gave up and gave me a refund and I used that to buy one on eBay and now I have 2 working phones lol.
nice i am going to go to the whole repair shop first if all else fails ill sell the flacky one on ebay and buy a new one lol i paid 200 for mine i got lucky and came with a wireless charger and a quick view case but this case is **** i am looking at iceptio's and what not but vzw cases are very hard to find stupid verizon and changing it to make it there own!

If that makes sense was,jot my intent to,commit fraud however if something happened during a phone swap covered under my line using her phone that should be covered thabks for the info I will let assurion know as soon as they call me back
