Looking for advice on possible scam. - Fascinate General

So I just sold my girlfriends fascinate on ebay. I shipped a few days ago and just got this message from the buyer.
Thanks for the fast shipping. damn it sucks to say, but i went to have the phone activated at the verizon store. they not only said it can't be activated because its on the reported stolen list, but they confiscated it. i didnt know it couldnt be used, it should of never been listed. anyways, if you didnt know this either, no hard feelings. i wont contact ebay or paypal if you refund my payment right away so i can buy another one.
I have a good feeling that this a POS trying to scam me. I'm looking for some advice on how to respond to this issue. By the way the phone is not stolen in any way shape or form. I know this is kind of off topic but I figured this would be a good place to receive some advice.

Did he verify the ESN prior to buying the phone? If not, its his fault and there is nothing he can do. Explain the situation to ebay and open a dispute.

He did not verify esn. I just thought it was strange that he would be trying to pull this when he has a 98.6% positive feedback rating with over 2000 transactions.

It will be easier if you have the device ID. Contact Verizon and get paper work from them showing the device has a clean ESN. This will only work if you are either still under contract or left verizon when your contract was finished. If you got out of the contract via the fee changes the esn will be bad.
Assuming the Esn is clean once you have the paperwork that says its clean you just tell the buyer that you have evidence of a clean ESN and that you will fight any dispute. PayPal and EBay see these shady people alot and know what to look for.

For sure contact Verizon if you can and verify your ESN is good. I have a feeling that this is indeed a scam.

She used an upgrade. I should be able to get all the right info still. I sent the guy a few messages. I'm just waiting on a response before I call Verizon.

The only way he is Intitled to a refund is if he pays shipping and returns it to you
Even if he files a complaint he will have to show proof that he sent it back
So I would not worry to much about it
If he does send one back make Damn sure it is yours and has your esn
eBay has policies in place to protect you and the never do anything out of eBay
And you may be wise to report it to them right away and let them know what is going on This Kind of Deal is a No No you were asked outside of eBay

Also, everyone be careful even letting a potential customer check the esn. When I was trying to sell my blackberry many scammers tried to get at mine. Don't give it to them! They can do a fake activation put insurance on it and claim it lost/stolen.. at that point your esn goes bad and they receive a phone from insurion in the mail.. One scammer even tried to get me to take a photo of the back of the phone with the battery out (where the esn is written) under the pretense he was looking to see if it worked on gsm.. Duh its a world phone... Good luck man. From my experience selling on ebay is nothing but headache.

Make sure you move your money out from paypal and un-link any connected bank accounts. The guy will just call his CC company and dispute the charge. Paypal will take your money and you'll be SOL no matter how much evidence your have. Paypal's "protection" is **** and they'll screw you over in a heartbeat.

That's a scam, no doubt about it. Don't let the feedback rating fool you, because it could be a legitimate account that got compromised. The only way they could win a dispute with eBay is if they can provide proof that the ESN was bad. If you know the ESN was good, then there's no way they could possibly provide that proof.

Im not so sure about that, I just tryed to have them put insurance on a fascinate I bought used and they said you can only put it on if you bought it from them.

Definite scam. As stated before, they won't confiscate the device. It's not their right to.
Unlike with media, you actually own a phone, rather than license it (which is why software, music, and videos can actually be confiscated). For them to take the phone from the buyer would be theft.
Call Verizon, have them pull the ESN from the old phone for you and have them verify that it is good. You should also be able to have them verify if it's been activated or not.
The way the systems work these days, I'm surprised someone would actually try and pull a scam like this one. It's way too easy to verify that they're full of it.

Bad ESN, now what?

So I found a person on Craigslist who had a Droid 2 for sale, good deal. So I met up with him, checked out the phone, everything looked good. I called Verizon before making the exchange for the phone and verified the ESN was clear. I get home and try to activate the phone and can't. I called Verizon back and this time I'm being told the phone is still allocated to an account but not active, probably someone who didn't pay a bill would be my guess. It's still early and I haven't tried contacting the person I purchased it from, but providing that falls through what are my options? Or are there any?
I've had verizon for almost 12 years now, can't say I've had the best experience but this just takes the prize. First guy says yes, second person says no, I'm probably out money. ><
Be careful. It could either be stolen or his and he could be filing a claim that the phone was stolen so document everything from the transaction to ensure you don't end up in the wrong. I'm not sure if anything can be done if you have a linked but not active ESN.

Yea I kinda figure that I'm out some cash and got a nifty paperweight now. I'm calling VZW to raise hell since one person told me it was clean, and the other told me the truth about it. Nothing will probably come of it, but at least I get to ***** at them for it. I did manage to get the guy I bought it from to tell me earlier today that it was on his wifes account and that she needed the money from getting rid of the phone to buy another and have it activated. Of course he hasn't returned any of my follow up calls asking when this is going to happen. Unfortunately this isn't someone I know, but do feel like giving him the ass beating of his lifetime.
Oh well, I should have tried to activate it myself on the spot so I guess you live you learn.
By the way, I've got this new thing called an Android Paperweight that runs OS 2.2 if you're interested in buying it let me know (j/k)

Honestly, if it ends up being a bad ESN and you aren't ever able to activate it you could probably sell it to a developer to recuperate some of the cost. You probably wont get it all but I'm sure you could get a nice chunk back.

I called VZW a few minutes ago to complain and found out that the person I spoke with last night didn't log anything in our account indicating a call and regarding what. The person I spoke with earlier today did. I just wish everyone knew how to do their job properly to make sure everyone in my situation ends up with the best possible results, and not out some money that could be used elsewhere.
So if life I guess

First things first, never buy a CL phone unless you activate it on the SPOT. Regardless if the 'account is late on payment' or whatever that doesn't mean they can blacklist the phone from activating on the network.
If it is a insurance claim phone it can never be used and you are SOL, but if it's stolen I'd call Verizon again and have them contact whoever owns that phone to call you. You seem like an intelligent person, not some kid posting on here, and having VZW for 12 years confirms that. Do the right thing and contact the owner should it be stolen. Maybe work something out?
You could always use it with a different carrier or sell it to someone who wants to use it on a different carrier..
They flash over to cricket easily, probly to sprint or u.s. cellular also

If you complain enough they will *SOMETIMES* allow you to swap it for a replacement with a clean ESN, though not always. You could also try going into a store and telling them you got ripped off and seeing if they have a carrier return laying that they might be willing to replace your bad one with, Verizon themselves doesn't care about blacklisted ESN's once they have them, they just simply remove it from the blacklist and sell it off

Phone can't go into download mode bad keyboard, Sprint Service center giving me BS

Hey guys, please help, my keyboard 2 W S Z, that whole roll of keys stopped working and down volume key just suddenly stopped working. I can't go into download mode anymore, don't have TEP, I wanted to get it fixed at the service center, that guy said when they open the phone they said there is liquid inside, what a bunch of lying bastards, when I told him I am very careful with this phone, never in contact with any water, he said maybe you used the phone when it's raining and got water inside, I don't know, can't help you. these F**king guys really pissed me off, he gave me the phone and went to help some guy who wanted to buy a cell phone lol, spent less than 30 sec with me, didn't offer any help, just wanted me to buy a new phone for 600 bucks.
What can I do now?
If they put the message on your account that your phone has water damage you're SOL. however it sounds like they didn't give you much time which is in your favor in this case, call Sprint customer service and say that you went into the store and were ignored when you told them you weren't interested in buying anything but only wanted a repair, ask to be escalated then request that they send you a replacement so you don't have to take more time out of your busy schedule to deal with incompetent Reps whose only interest is making a sale.
Careful...it only takes 30 seconds to check to see if the water damage label is triggered and if there is water damage Sprint won't touch the phone. If you get somebody over the phone to send you a replacement they'll see it on the phone you send back and charge your account for the replacement phone. Water damage seems like an awfully good explaination for the type of problem you're having on the phone...it's just like if you dump some coffee into your keyboard on a computer certain keys short out and stop working. I know it sucks but it makes a lot of sense to a 3rd party looking at your phone.

Same exact thing happened to me. They swapped mine though because I had insurance.
i dont really reply much but u feel your pain. you could make a download jig from an old usb cable that will force it into download mode you need to get 3 100k ohm resisters then put them on the old cable pins 4 and 5 or get one on ebay just type in samsung usb jig or something. google the instructions or you tube

FYI (to the OP) most CSR reps can add this to your account for you for no extra cost (beyond the monthly premium). I had a rep add it to my wife's line (temporarily) so that she could to the "4 bad phone swaps to get another device" thing.. she had to do that dance to get rid of her intercept and she now has a transform. The guy on the phone w/ me (at the time) said that any CSR would be able to do that for me.
Don't pay a guy from XDA w/ 3 posts to add anything to your account that you can add w/ just a phone call.

Not true. You can not just add TEP at any time. It will get added but quickly removed when Asurion checks the account and see it is not within 30 days of purchase or S&R fee.
And more than likely (being a Sprint Tech myself) you did somehow get your phone wet because keys going out is a usual sign. I'm sorry if you felt disrespected at that store but they followed the policy which is what we have to do. As soon as LD is found on board, we flag it and the rest is handled through Asurion (every carrier uses them).
But since you do not have TEP, you are kind of SOL. At that point you can either buy a new phone for full retail or use upgrade if available. Or try and find an old phone at home or from a friend. Or check ebay or craigslist places for people selling Sprint phones with a clean ESN.

Warranty is through Samsung and doesn't cover LD, physical, lost/stolen. TEP is well worth it. And if you want to use your warranty, your right you can. Ship your phone to Samsung and wait for them to determine what was wrong with it. It should only take 4 weeks or so.

I was up 4 levels from the dorks that answer the phone when u first call. I escalated to that person's supervisor, then tech support level 2, then that person's manager. THAT person added the equipment protection plan for the remainder of the month, then credited my account the price so it was free.
I swear I'll post screenshots. That person even told me that any CSR can add it at any time.

Some douche sold me a phone then reported it stolen the next day... idiots....
I called AT&T and begged them to unblock it but to no success.. so now im contacting the idiot who did it.
But anyways, does anyone know if its possible to do anything as far as this?

there are ways of "faking" an IMEI but they are all illegal, and i doubt forum admins would allow posts about this here

good luck. I would call the police and report this, this is FRAUD. Also make sure you have some proof, a listing or other proof that he was selling this. The police wont do much, but i would call him while recording the call and make sure at the end of the call when he admits to everything, he knows hes recorded and use that as leverage to get him to call ATT and have the phone unblocked
He probably sold you a stolen phone. Did he show you a receipt from when he bought it originally? Or maybe someone else reported it stolen to piss him off and now it is your problem.
He told me he would call AT&T and get it unblocked. I have all the text messages, I have the original listing saved.. and now he disconnected his phone. . It was definetly his phone, he had the original packaging and all so I know for sure it wasnt stolen...... what a bummer, I dont like getting involved with the police.. itd be a waste of time.. im considering finding him and beating the heck out of him........

He probably reported it stolen so he could get a new phone from at&t by doing an insurance claim. Likely he has a police report too (it's required for a stolen insurance claim last I checked.)
If that's the case you need be very careful dealing with him and document everything. If he already lied to the police that's a very serious crime and hes going to be trying to cover his ass. I use to have a supervisor that is now facing 25 years in prison for lying to the police.

If for some reason the above two items failed, then start googling the IMEI stuff. But yeah - it's illegal itself, so you'd be better-off trying to resolve this properly.
You might look up the laws in your state regarding recording. In good ol' Arizona, the law states that any conversation can be recorded, so long as one person in the conversation is aware of it ... that person can be the one doing the recording.

Blacklisted S4

Okay so I bought an S4 off craigslist and the next day he reports it stolen and blacklists it, I contact his friend trying to work it out (note: everything we said to each other was over texts, so I have them still as proof - and I got his friends number the day I met him.. he deactivated his service).. he said he doesn't know why his friend blacklisted it but he would call AT&T to unblock it, shortly after he said he did it.. I waited patiently but to realize that it was still blocked so I text him again, he doesnt respond for a full day so I told him I will call the Police. He must have gotten scared because he finally responds and unblocks it.... I used it for a couple hours, then my service cuts off and he sends me this long message telling me that he blocked it again and is calling the cops because I threatened him?. I never said anything threatening to him but whatever....
So I call the police, report everything and tell them the story. A couple hours later a detective calls me and asks if I would like to prosecute, I agreed... so now Im waiting to see what happened...
What do you guys think? I should easily win right, I have all the proof. All the texts.. from before I purchased and from after.. and I have his original craigslist post....
I told this guy 100 times to either unblock it or just give my money back and id cancel the prosecution but he didnt respond, so whatever. ..
Anybody been through something similiar?. Think I should win? He clearly commited insurance fraud... and must have created a police report to report his "stolen" phone..

Yeah definetly, I flip phones every now and then on craigslist but only meet in public areas infront of cameras, and I make sure its a real number. Which in this case it was, he must have thought I was bluffing when I said I would call the police.. I just turned 20, I really don't have time for this mess with school and work.. I gave the detective his information and he said he located him and spoke with him, and will me a line up after the weekend.. I mean seriously? Just give me back my money dude, why even risk jail time when I told him id drop charges...... people these days are ridiculous...

That's... really messed up. You should definitely win. So long as you have all that information condemning him, I don't see any reason why you should lose. Obviously this guy is retarded because he doesn't realize that he will be convicted of fraud (against you), insurance fraud, lying to the police, and possibly other things. Over a phone? How much could this guy possibly make from a scam like that? A few hundred bucks maybe, and obviously can't keep doing this because AT&T would catch on to the fact that he keeps buying phones from them with insurance and losing them.

I sell phones on Craigslist all the time and this is why it is no longer a good practice. Can no longer trust anyone and that causes more low ball offers.

ask for purchase reciept with signature name and id
ask for his/her id
go to local att/tmob/verizon whatever store and and confirm IMIE/serial belongs to seller
ask for manager and tell them phone is being sold not stolen (or call)
friend sells/buys phones off CL all the time, unless they agree to all the above he wont deal with them. only way to be safe. also, i would report the guy who did it; thats insurance fraud, falsifying a police report, and some minor infractions. you have his number? call him leave message and tell him you will report insurance fraud; they will pursue it.
I have a detective on the case already, he deactivated his number but he was stupid enough to tell me where he lives and gave me.his friends number the day I purchased it.

I sell my old phones on CL and have noticed people are being extra paranoid these days.
When I sold my iphone 5 the buyer asked for the imei # I refused to give it over the text. how do I know what this person plans to do with it?
of course they asked if it was stolen, I obviously said no. I showed them the original box, even the shipping box it came it, I of course removed my address. Let them pop in their sim card and they were satisfied.
I'm curious to know how much you bought your 2nd hand S4 for? I would think someone looking to scam someone would try to make a quick buck with people that aren't gonna think twice to buy it if it's too cheap.
Let's say like 300? no one in their right mind would sell you an S4 for half of what it costs new, of course unless if they were going to scam you... I would be suspicious of it before I agree to buy something that seems too cheap...

I waited patiently but to realize that it was still blocked so I text him again, he doesnt respond for a full day so I told him I will call the Police. He must have gotten scared because he finally responds and unblocks it.... I used it for a couple hours, then my service cuts off and he sends me this long message telling me that he blocked it again and is calling the cops because I threatened him?. I never said anything threatening to him but whatever....
So I call the police, report everything and tell them the story. A couple hours later a detective calls me and asks if I would like to prosecute, I agreed... so now Im waiting to see what happened...
What do you guys think? I should easily win right, I have all the proof. All the texts.. from before I purchased and from after.. and I have his original craigslist post....
I told this guy 100 times to either unblock it or just give my money back and id cancel the prosecution but he didnt respond, so whatever. ..
Anybody been through something similiar?. Think I should win? He clearly commited insurance fraud... and must have created a police report to report his "stolen" phone..

You will win. You can take him to small claims court and have him pay the fees too.
See if you can get a cache of his ad just in case for evidence. Most likely he'll cave in and refund you.
Show him all of your evidence and say "we can take this to court and I'm sure I will win."
On a side note, what an awesome detective working your case. I'm sure he's very busy too. These guys have back logs of cases not resolved and have to work tons of overtime.

300 is right. But it was in bad condition, the frame was jacked up. Other than that nope. I thought I just ran into some idiot.. turns out I was right, an idiot he was.

It's not small claims though, the detective asked if I would like to prosecute him in court and I said yes. Later asked if it would be small claims and he said no, so im guessing its the real deal... anybody know if any fees will have to be paid out of my pocket for court?

My phone is marked as stolen? Wtf?

So I got a new phone right from bell a month ago via their insurance thing when I broke mine. Worked great for a month. This morning it said something about incorrect sim and to contact bell.
Call them and they tell me it's stolen.
I take my receipt and the warranty thing in but the serials don't match and they want to keep the phone. I grab it and leave. I've taken my stuff off it. And been on the phone it bell for like an hour.
Has anyone heard of this before? Do I have any options besides smash this with a hammer and buy a nexus 5?is it possible to get a resolution from bell customer support?
Since when have they been able to disable a phone remotely like that. I don't like that they can do that.

This is something you need to contact either the insurance company where you got your replacement phone or your carrier. They've been able to block ESN's for a while now....I know that they were doing it on Verizon, and I think AT&T does it now too...its probably just a matter of time before all do it. Helps prevent people from stealing phones if they know it can be disabled remotely by the carrier.
Heard there was a way to block ESN. but no way to unblock it. ...

This is basically what I'm being told.
Being given a run around. Basically they may or may not have made a mistake and I'm out of luck. All my different paperwork has three different serial numbers and none of them match the phone.
So how the f does that happen?
I wish *****ing to bell got any kind of results, I feel bad for the poor workers I am highly frustrated at even though they have no power.
I don't know what to do. The one lady said to sell it to Europe. Or make it a toy for my kid.
I dunno what to do.

How did you pay for it? Maybe you can dispute it if you used a credit card...other than that you are out of luck I guess
