So... they make extremely generic designs, patent them, and wait until someone releases a product that remotely looks like it so they can sue the balls off you. This. Angered me beyond belief.

If you feel something is not right here, then the one to blame is the patent agency that granted Apple the patents. If a company invests time and money in an invention and gets a legal document guaranteeing it the right to be the sole producer of that invention, then it's not the company's fault that it chose to defend that right. In fact, if a company does not vigorously defend its IP, it runs the risk of losing it (anyone remember the "there are two r's in Xerox campaign?).
I'm not familiar with the specific patents, but most of what I'm reading are complaints, like the OP's, that the patents are too vague. If so, the patents shouldn't have been granted and the agency in Europe responsible for making that decision erred. If the patents are appropriate, then it's Apple's right to protect its intellectual property.
I'm sick of the patent wars, but Apple is just playing by the rules it has been given.

Ironically, many of the people who complain about vague patents have never actually read through a complete patent file. Usually all they see is a one line summary quoted by whatever tech blog they visited that day and assume that one line is the entire patent. If anything, patent rage is too often just a product of fanboyism, and not rational thought.
The only people who think patents shouldn't exist are people who've never invented anything. They're just consumers who are too emotionally attached to their interest in technology and feel that the courts can never possibly do anything beneficial ever for anything.
There's also a kneejerk reaction from the anarchy of the tech community to shut anyone up who tries to see all sides of an issue. We've decided that patent law is a war of good vs. evil and any other way of looking at it is wrong.
Do Samsung products look more like iDevices than any other Android vendor? Probably. Is it really THAT hard to come up with a unique form factor? Or drop TouchWiz? Or something other than glossy plastic? There's a whole world of trivial design variations that could've avoided the 'similarity' mess that Samsung actively ignored. Ah well.
It's not like this generation of Android tablets is all that impressive anyway.

Apple=sleazy tactics.... Ya think??? remember the smear camaigns they did on Vista? I firmly beleve that APPLE is the reason Vista did as bad as it did any why everyone hates it so much. Granted, it wasn't the best OS in history as it was a 'bit' bloated and slow, but overall, it wasn't THAT bad... Almost all the 'problems' with it was HARDWARE VENDORS not releasing decent drivers for it. I ran it from the time it was a RC until 7 was a RC and never had any trouble with it. Hell, I had more problems with Windows XP Tablet Edition (SP2 & 3) on my HP TC4400 than I ever did with Vista, even when it was a RC. 7 is WAY better, but Vista wasn't a miserable failure (unlike Win Me). Ever heard of the Mojave Experiment? MS took Vista, re-labled it "Windows Mojave" and had people check it out. Almost everyone LOVED the "new" OS... only to be shocked when they were told it was actually Vista.
Apple is a miserable POS company and I'd LOVE to see them go bankrupt and dissapear off the face of this planet, along with their crappy 'OS' and devices, but unfortunately that's not going to happen due to all the kool-aid drinkers.
Beofer you hate on me for calling their 'OS' crappy, MS's oses might be crappy, but at least you can do things with them. Good luck trying to do anything outside the "apple box" on a mac....

Just reading that article was enough to make me rage out. I've always thought that apple used terrible tactics and produced sub-par products. This patent stuff is just pure ignorance on the part of the patent office and the judicial system. the fact that apple was granted patent rights to a folder icon or something similar is ludicris. If I was able to patent everything I made to say tweak my computer or alter my webpage, then I would have a whole lot of things I could sue people over.
Apple already has the market cornered in a lot of places because people are mindless zombies who will pay an extra $500 for a computer so that it can run their "sleek amazing Operating system" ("cough cough" basically linux "cough cough"). Apple doesn't make hardware except in special cases, and their OS is limiting on what you can do to configure it as well as the access you can obtain using it but people use it because it "looks good". I guess that's all that matters right? Paying an extra $500 dollars for a computer that is aesthetically pleasing. Hell, apple will have you think they invented multitasking and copy and paste. I guarantee they would try to sue some one for that as well.
Its all just corporatism at its best. Stuff like this is what makes the free market economy a cut throat place to work in.

I hate Apple. I've been doing my part to talk people out of buying iPhones and anything Apple. I don't like how everything of theirs is completely locked down and you have to play by their rules. Hardly any customization.
When it comes to this kind of stuff, it just makes me sick. Yea, it's legal but it's just wrong how they can get away with stuff like this.
There's nothing we little people can do other then try and turn anyone we can away from iPhones and Apple Products.

I think Samsung is kinda infringing on designs that look similar to iPhones or iPads, but kinda hard not to. Maybe if they change the color from black to, idk, grey or green or something, & they had a patent for that, they would be better off. But everyone knows that black is a more common & neutral color for electronic devices. Hopefully, Samsung & Apple will settle this problem like gentlemen & not like 2 little kids fighting over a toy.

Reading this made me think Apple's new slogan should be "There's a patent for that."

I don't have a problem with Apple suing Sammy over patent infringement. Patents and copyrights are the basis for creativity and ingenuity. Apple developed a great product (whether we like it or not) and got patents on many of the features and components of their product. If other companies want to copy/steal their intellectual rights to those features and components, I think Apple is well within their rights to stop those companies.

QFT, but surely you must see that Apple is abusing the legal system. The amount of lawsuits, and the reasons for them, are utterly absurd. Rules keep order, but abusing loopholes can cause more chaos than having no rules at all. Fu** Apple

They're suing over design likeness, at least in the EU. Basically they say no one can have a thin, rectangular tablet with a black face. That is why they've gone after Samsung and Motorola. It would be humorous if they go after HTC for their non-black faced tablet, ha ha.

Apple sues Samsung for 'copying' the iPhone and iPad

Just read an article on Engadget that show Apple's patent diagram of the phone next to a Galaxy S I-9000. I think it is extremely hilarious that Apple is actually trying to follow through with this. I also found it tickling that the I-9000 had the app drawer open to resemble iOS. The corner shot was cheesy also. Anyone have thoughts on this? I hate to flame but this is just terrible and since we all own a Galaxy S device is applies to us.
Had some arguments with people on Engadget about icons. I guess we aren't able to use icons that represent that app, since that's what the definition of an icon is. This is my response to that:

Just because Samsung makes parts for apple doesnt equate to Samsung having rights to apple patents and copyrights to implement in their products. Apple is doing the right thing by suing. Hopefully samsung stops making stuff that looks like apple products, and start churning out some original looking phones.
The patent courts desperately need an overhaul. For gods sake, apple is trying to patent making a phone out of a certain material. Imagine mercedes benz getting a patent on using certain metals to make an automobile. This **** is ridiculous. **** apple and their petty antics.

A screen on a slate. Hardware-wise, how different can we possibly expect these devices to be? We have come to expect a particular form factor.
Would you buy a laptop that has the screen and keyboard swapped so you have to type with your arms hovering in the air? And were laptop manufacturers copying each other by using the classic keyboard-down screen-up form factor?
Nah. This shouldn't be an issue, in my opinion.

Apple sues for specific similarities in the hardware and software being sold as a package. Both the hardware and software emulate the iphone look. The color, contours, materials, operating system layout, specs, TW, etc are all similar enough to warrant this lawsuit.
You might not like apple, but they have the right to protect their patents, copyrights and trademarks...as does any company.
I expect the typical trolls and nerd rage against apple in here, but you have to blind not to see a similarity here.

As Reuters reports and Apple has confirmed, Apple CEO Steve Jobs is stepping down from his leadership position. Apple's Board of Directors has named Tim Cook the company's new CEO. Jobs has been elected Chairman of the Board.
"I have made some of the best friends of my life at Apple, and I thank you all for the many years of being able to work alongside you," Jobs wrote in his resignation letter.

According to Reuters, Apple shares fell following the announcement.
Hopefully I won't get shunned by the community for this, but I'm actually a little disappointed.
I do really like Apple products, and I think without Jobs, they're going to become less of a competitor in the future. Less competition can make Android handset makers lazy because they aren't trying to steal the iPhone business.
And it's definitely going to hurt the tablet market. I like some of the newer tablets, but IMO, the iPad is still the best available right now. And if the iPad slows down, the tablets won't be in a hurry to catch up.
Maybe I'll be wrong. And maybe you guys won't hate me for that rant.

I think he was just done. Everyone gets burned out eventually. We're better for what he brought us. Honestly I'm a little sad now for the Mac world.

+1 on that. I prefer Android, (obviously) but Apple started the non-business smartphone thing which opened up the market for Android.
The control thing is also an issue with me, but you can't argue with results. Apple is successful and tons of people use their stuff. They're obviously doing something right.

At least he'll have a more hands-on connection with the board of directors though.

I'm old enough to remember what it was like to screw around on computers with dual 5.25 drives and monochrome screens, as well as the days Jobs was flying the Jolly Rodger over the headquarters of Apple. He's NOT an electronics innovator, he never was! Waz was the innovator! He screwed around with some code and got Apple where it is today though an overwhelmingly adversarial mode of management and leadership. I remember the Apple II... and do you know why? Because my dad was a developer on Unix platforms most of my life and the machines I played with at home as a kid blew those heaps of crap out of the water. Machines like the Leading Edge and the Compaq Deskpro series of 286 and 386 machines. Am I the ONLY one that knows where the GUI for the Mac came from??? It's not like Apple invented it! They basically STOLE it! Not that Gates is a whole lot better, but gimme a break people! Jobs is quite possibly the most cut-throat, aggressive man to ever rise to corporate power!
Does he have a vision? Yup. Is he successful? Sure is. Would I EVER buy an Apple product? Absolutely not. I don't like the philosophy of Steve Jobs. I don't like his management. I don't like his character. I don't like his history. I don't like the path he's led computing down in many regards. I don't like his belief in the "walled garden" user experience. If someone wants to argue Jobs hasn't run Apple as a dictator, you have NO legs to stand on. well thats a harsh comment personally i like apple products and ios would i buy one instead of an android device? probably why? because android basically came from ios if you look at android and ios and compare how theyve grown everytime ios grows android seems to grow also there would be no android without ios without ios we would still be on cupcacke....what jobs has done with apple is awesome hopefully him backing down doesnt effect their products.

He's put his vision and his philosophies ahead of even the good of that company, which is how his ass got tossed the first time before he founded NeXT, which would certainly have gone belly up if not for a buy-out from Apple!
As for the fool who called my likening him to a NAZI stupid, consider that Jobs is WIDELY regarded as a man who'd sell his own mother to get the next iPhone out of development. He's a political and organizational socialist, in much the same style as NAZI and Soviet leadership. His cult of personality fits right in with them too. He's got this vision of an Apple world, and an Apple experience, but I can't see where he's ever given a damn about people's lives. There are definitely some valid points there. There are several fallacies, too.
Was Jobs an overbearing ****? Probably. In a social settings, that's terrible. In a business setting? It's genius.
Apple's "walled garden" creates an unparalleled experience for the consumer. Set yourself up with a nice Mac, an iPhone and an iPad, and see how easy it is to stream media to every room in your house, your TV, etc. On top of that, everything in uniform and is actually held to, if nothing else, an aesthetic standard. The apps are interface are very high quality and 99% work just as they should, all the time. I, for one, am very envious of that.
My Incredible doesn't play nice with Windows all the time. Sometimes I download what sounds like a really cool app, only to find out the interface sucks or it crashes all the time because the developer hasn't updated it for Gingerbread. I can't expect my phone to stay updated, because technology moves incredibly fast and Verizon is greedy and holds out on said updates, as we've all seen recently here. With an Apple product? I'll get the same update as everyone else, the day it comes out, and it won't involve Verizon forcing me to have Slacker radio installed on my phone.
Google (and Microsoft, Nokia, whoever) can try as hard as they want to stomp out that "walled garden," but that simplicity and efficiency is totally unmatched on any other platform. For the average, not-so-tech-savvy user, (parents, girlfriends, that one dumb friend) putting them in a walled garden is genius. They can't break anything.
Personally, I think that's what Steve Jobs is leaving behind; an amazing marketing strategy and a fully realized vision of a simplified automation of technology aiding the average person in their everyday life. Not "being a big mean Nazi at the head of a company."

Just for reference, I love my Incredible, I had a Moto Droid before it, and my next phone will hopefully be an EVO 3D. I use Google Music and Banshee, and I dual-boot Win7 and Ubuntu. I'll probably have a Google TV by the end of the year. I am by no means an Apple fanboy. Don't even have an iPod. I'm just calling it how I see it.

I will agree with every point you just made. I don't see how it conflicts with anything I said, either. And yeah.... they sure are shiny!
That said, the guy really did run the place into the ground before he was expelled. He's effectively destroyed Apple as a legitimate computer company today. Anything running OSX is obsolete before it hits the shelves. OSX, itself, is obsolete and poorly maintained. Apple USED to be something to lust over in computers, and then they got wierder, and weirder and more expensive, and the walls of that garden nearly crushed them. I think the cold hard reality is that their stuff is overpriced for what you get, it's becoming more a pain in the ass to use, ESPECIALLY if you don't want to become "one with the Steve Jobs way", and if they continue down a path of eco-system isolation, you're going to eventually see an Apple that looks like it did in the G4 era. And nobody ever thought that giant would go bust 5 or 6 years before that! ....they're already going down the road of weird proprietary connectors again! I think he's been lucky as much as "visionary".

You don't know what socialism actually means. To help you along with your education, here's the definition:
Socialism - an economic system in which the means of production are publicly or commonly owned and controlled cooperatively
You can dislike somebody without stooping to calling them a Nazi or socialist, especially when they don't carry any of those traits- and in this case the total opposite traits. Apple is as capitalistic as they come.

I was actually going to point this out. Apple is an extremely wealthy company.
Not sure how everything Apple makes is "obsolete as soon as it hits the shelves," either. Their retina display is head and shoulders above nearly every other handset screen available. OS X is more or less leading in terms of desktop interface. Windows and even some Linux distros are copying the OS X desktop. And the iPad still pretty much beats every other tablet by miles.

The original iPad was all about proprietary connectors, as are most of their portables. But, the marketplace supports their interfaces rather robustly.
Their Macs have all sorts of interfaces and are again industry-supported to a wide degree.
You're offering zombie Apple-hating points that have been spouted for many years, yet Apple's been doing generally quite well for some time.
Although, it seems you don't even know the difference between a German Nazi (i.e., National Socialist German Workers) Party and actual socialism. "Socialist" was placed in the Nazi Party name to lure in the real socialists (who were considered enemies of the party's goals), if I recall correctly.
So, perhaps I should suspect your similarly "off" assertions about Apple's successes and Steve Jobs role, as well.

I'm not a fan of Apple products either, but from a competition standpoint, it's a necessary evil. The more competition, the better for the consumer. But from a business standpoint they just aren't open enough to be compatible with a corporate windows network.

A guy takes a failing company and turns it into one of the most powerful companies in the world. He then gets cancer is now probably dying from it and all this ass hole can do is say that. Nice. No my problem is with idiots. In this case it's the idiot who is talking **** about a guy who stepped down because of his most likely pending death due to cancer. All he could do was bad mouth the guy, and for what? Because he is the CEO of a company that competes with the company of a product he bought! That's just freaking sad. If a family member of his falls ill due to cancer I don't think they'd want anyone to treat them with any type of disrespect.
That thing about Macbooks? Its not about not being able to afford a Mac, it's about acting like they are worthless or don't present some kind of value for the added price. Agreed. My friend who has an iphone cant wait to switch to an Android when her plan is up. I think most people famously live by "never satisfied".

Samsung confirmed it will sue Apple immediately if it releases an LTE device. This seems directed squarely at the new iPhone as currently the iPad does sell with LTE on board. Obviously, this legal case is just a start of a huge change, not the end of anything.
Considering Apple iPhone 5 is almost certain to come with LTE on board, let's see what happens.

Is anyone else alarmed by the statements that Google and Samsung are distancing themselves away from each other? Even if this is just for the patent stuff could it not leave a bitter taste in each others mouths?
I'm quite happy for Apple to innovate, but if they want to do it over everyone else's dead body, they can f-off .... and die themselves.

Apple has innovated by the actual definition. Same for Samsung and others.
The good thing about all this is other manufacturers are forced into becoming Patent Trolls to Patent stuff they wouldn't usually bother with just to keep Apple's hands off it, and that's gonna mean Apple has less power and they won't be able to use these Bully Boy tactics anymore.

A very eloquent statement. And very true. I can't believe apple defects to suing rather than innovating. It saddens me. I used to like the iPhone. I believe it has helped the market grow like never before, but not any more. Silly apple. Innovation is for mature companies. Haha.

Yeah, and Apple really innovated with concepts such as... "a rectangular device with rounded corners and a flat surface."
The really frightening thing is that they managed to actually get a patent for that. I'm usually very proud to be an American, but the US Patent Office is a huge disgrace to the country.

it never will, samsung is one of the major contributors for android.. sometimes its better to keep mum rather than pledge the support and get into trouble

As far as I know the Galaxy S3 hasn't been the subject of any lawsuit so far, so clearly the fact that Samsung innovated with the S3 rather than copy Apple shows.
Innovation isn't copying another company. Here's an example of innovation:
Apple buys Siri and includes it with every iPhone 4S, putting it into the hands of millions.
Google, rather than copying, creates their own "knowledge graph" and builds something better; something that responds incredibly quickly, accurately, and reads most answers out loud back to the user in a really easy to understand, human voice. This is innovation.
Samsung, on the other hand, created something that looks like Siri, tries to act like Siri, pulls data from the same sources (Wolfram Alpha + others) and is a hell of a lot slower. It was basically a complete failure all around.
Google has managed to pretty much avoid any problems with Android so far by creating their own innovative features. Samsung has done this for the most part in the S3, but there's still a hint of copying there, especially with S Voice as I have stated above.

Taking something that exists and making it better is still innovating. Taking multiple things that exist and combining them together to create something much better is innovating (S Beam for example)

I'm not a patent lawyer, so I'm not going to comment on the validity of the case, but the US does seem like a hostile place for a non US company that competes with Apple.

This time it's not about rectangles with rounded corners but some stupid software patents such as slide to unlock and auto-completion. That's pretty sad but I'm surely happy for not living in america, it would suck to only have apple products to choose from.

For me the question is why did Apple get patents of such simple things in the first place?? Why not get a patent for the letter A and every time someone uses an A ..........
I am NOTE amused.
There's one that covers clicking on a number from an email to open a dialler. Having to do away with such simple things will render them super powerful dummy phones.
Also v happy to be in Europe over this.

i thought this feature was there long time even in early windows mobile times
So did I. Either it's a refinement of the idea or they're trying to claim a patent on an idea kicking around from before they started thinking about making phones.

We have to take into consideration two different things here. First Apple has every right to defend it's patents. Everyone of us would do the same if we had valid patents and someone would infringe on them. The one thing that's wrong here isn't exactly Apples behaviour, that's completely legitimate. The problem is the US patent law. E.g. Apple holds a patent for clicking on phone numbers in e-mails to directly call it. They successfully sued HTC because they had infringed on that patent. The question is not whether it's right or wrong to sue, it's law, it's their right to do so. The question is: Why on earth were they able to get this patent? My first WM Smartphone had been able to do that long before the Iphone was available. Why is it possible in the US to patent something which has clearly not been invented by the person/ company who/ that is claiming the patent because the corresponding technology/ software/ whatever existed long before the patent application is filed? That's the real issue here. Most of Apple's patents are no inventions but old technologies that have been improved/ optimized by Apple. To every sane person it should be clear that you cannot patent something you have not invented. And if you use and/ or improve an existing technology which isn't protected by patents you are free to do so but it should also be clear that you cannot patent the outcome because your product is based on something you have not invented and thus is simply not yours. It's not right to claim the invention of someone else for yourself. That should not be protected by the law.
One addition concerning software. E.g. you should not be granted patents for gestures which have been known to mankind for thousends of years (pinch to zoom...), the only thing that's new about it is the fact that the gesture is used with a touchscreen. But the code should be protected. So if someone writes his own code to enable pinch to zoom that's alright but if he uses your code that's infringement. But patenting things like gestures, scrollbars, icon grids, click to call... is just insane. Only imagine what situation we would be in now if it had been possible to patent breaks, breaking lights, steering wheels, seats, seatbelts, windscreens... There would not be many different cars because it would not be possible to build one without infringing on the owners patents. Those things had all been whell known when the car was invented, the only thing new about it was using them to build cars. And that's exactly what Apple has been doing. They used existing technologies to build the Iphone.

Agree with altae. But I dislike Apple more and more now. I just don't like being told what I should buy. And I want more options, not less. I can say with pride that I've NEVER bought any apple products. They're overpriced, communist design sucks
Overpriced is right. In parts of Asia, those Iphone 4s can cost over $1000usd. That's a lot of money for re branded Samsung hardware, running ios.

It was. Only problem is that Apple patented it.
Only time will tell now with aos v ios as google is stepping into the mix by launching a lawsuit against apple based on software similarities. The drop down menu was firstly seen on win mobile yet aos patent it first and then was included in the ios 4.
The whole samsung issue came with sammy not renewing its hardware contract with apple.
The problem is it will only affect the consumer of devices that are more powerful. As apple wont make drastic changes to their product rather adding an S to the back of things that are already released.
U have to give them credit in some regard due to changing the smartphone world for all

Samsung won't tell apple to f**k off, because they make far more money from delivering hardware to apple than they lost in court.
And on a side note, allthough i find the decision incorrect, maybe that is a good thing, samsung loosing this battle.
It is a kick that will make them create even better devices than before.
And as for apple, they are simply way behind the competition, so their only way of fighting back is by suing other companies.
We don't have to worry though, time will wash away apple, they cannot stand the combined assault of android devices

Patent law dictates non-obviousness. Most functions were already there, or there were apps for it in Windows.
A they shouldnt have gotten a lot of patents anyways. Patent granters were sleeping.
B The jury spend to little time on validity of Apples claims. Some patent trials have gone on for years, and here in 3 days they go throught 200, plain bullsh*#t
Only good that can come of this is Samsung/competitors tighter on innovation side. Which is a good thing.
That and offering side loading functionality throught apps that add the functionality. Either way Apple is screwed in long run if it wants to continue to innovate. Closed vs open, is like dictators vs the free world. Free world always wins , in long run anyways.
