You are NOT out of luck!! Thought I'd post this for an FYI.
Best Buy seems to be your best shot at a new Evo 4G still on 2.2 Stock. I've gone through 4 now from them (had hardware issues on 2) and all have come out of the box with 2.2.
I asked the CSM helping me to not do anything to the phones...I'd prefer to power em on. Got home, cancelled update...Stock 2.2 ready for Root / Flashin.
If you're in the market for a new Evo 4G...check Best Buy first. With a little polite direction, you should have the same experience.

I just bought one from my local best buy and it was 2.3.3 out of box. It was the last one the store will have also. You are very lucky
Wish I could take mine up there, but I just got one from Sprint this week that they sent me to replace my Epic. Ah well I guess I will have to wait like everyone else for root.
I work for Best Buy and can honestly if anyone gets a 2.2 in DFW, consider yourself lucky. My refurb through the Black Tie Protection came with 2.3.3.
I can say however that my battery is absolutely amazing.
A friend of mine has bought two from bestbuy. First one returned due to software issue and the newest going back to extreme light bleed. Both on 3.70 software. You can get lucky at some bestbuys. I think the more rural ones may have left over stock that has been sitting for a while. Two in a row that are not updated are pretty good odds.

I got 2 Evos at the start of this month, and I didnt know about the 2.3.3 thing so in short both of them, one white and one black were 2.2 and me being a geek updated without researching.
Last friday had to go back with mine because of a small hairline crack the body had around the volume down and of course they said besides that the phone is working and I was ready to fight, but before I even started talking he said, "but you still on your 30 days exchange so if you want to just change it, i can do that" and so I did and this also was 2.2, I said "just activate it, I don't want to update it, cuz mine ran sluggier than my wifes and thats the only difference, she didnt get the update and i did" He was like, ok that makes sense. check it and see if that was your problem...
On my local store they didn't seem to have a shortage or anything, I saw him pulling it out of a nice stock of EVO's.
Same here in NY. My buddy and I got Evos in a local BB Mobile and they both had 2.2 on it. The Rep who was taking care of me almost updated the phones until the manager and I both told her not too. The manager is a personal friend of mine whom I do rooting of devices for. ;-)
I got my Evo about a month ago with 2.2 installed. At the time I was totally unaware that updating would lock me out. Good thing I didn't

I bought mine at the Best Buy in Rockwall, which is a DFW store. They had about 30 with 2.2 and 30 with 2.3 and they gave a wide open choice on it 2 weeks ago.

So I totally dropped my phone and shattered my screen today. The phone worked for about an hour then it died. I charged it and when I turned it back on and tried to use it, the screen totally got screwed up and I couldnt do anything.
Its pretty bogus that TMO wants me to pay them another $130 for a replacement phone and if I dont return the broken phone within 15 days, they will charge me another $300.
My GF doesnt really like hers. The APPs are way too expensive. I think she might be going back to her G1. Im seriously thinking about a Nexus One, but would have to dish out another $279 for that phone.

Wow, sorry to hear that man Did you manage to shatter it even with the rubberized case that came with it still on? I have mine on there at all times, but I'm still terrfied I'm gonna do exactly what you did.
If I were in your exact situation right now, I'd take your gf's HD2, and get her a mytouch slide. You get another chance with what can truly be an awesome phone, and she gets the latest android phone tmo has (or will have very soon) with a hardware qwerty....and, maybe even less out of pocket than the other options.
Sorry to hear that...That's exactly what I'm afraid also. Just texted the wife telling her to take care of that beauty cause one drop and it's gone

How can the HD2 be a powerful phone with all the problems it has? Ive had it replaced already because of the shotty service I was getting in places I had great service with my G1. Even with the flashing of several different ROMs, the phone froze all the time. The only problem with getting her one of the MyTouch Slides is that we used our upgrade eligibility to get the HD2's, so we would have to pay FULL price for the phone. She does really miss the Android market.
Yes, had the rubber case on it, but it landed on the corner of the screen. The rubber case doesnt go over the screen.

Well, it has been for me and others as well...since you were asking, I thought you were saying you thought it might be worth another chance. Did you get a chance to try the new upgrade from Tmo?
I was confused too, when you said you'd have to pay $279 for the N1...I thought that indicated you had an upgrade available to you yet.
And yes, I did notice that the rubber case doesn't go over the screen. I was asking because without that it's possible to have the screen shatter even if the impact point isn't on the face of it.
I just havent had the best luck with this phone. Seems like it has lots of potential but its not fairing very well so far. The $279 was a price I pulled from the site. I dobubt TMO would take their phone back and give me some kind of credit on a different phone even with the phone insurance. Hell TMO doesnt even sell the N1.

That's correct, you have to just take the replacement phone of the same model, since it's done through the insurance company totally independent of tmo...they're just the ones who sold you the policy. I honestly was under the impression that the deductible was $100 for the HD2, but if they told you $130 then it must be $130.
I think that the $279 price for the N1 is for new lines and maybe upgrades, but it's honestly been a while since I priced it out.
If you end up deciding to get your HD2 replaced for now, feel free to PM me if you want and I'll do whatever I can to help you avoid having so many issues this time.

LOL That's funny because just 5 minutes before I saw your post I was having a conversation with one of the moderators about how there had been a rediculous number of new threads started in the past 48 hours about the new Tmo ROM update
It was pretty much known that it was coming soon, and a couple of days ago somebody found a backdoor to the file on tmo's servers, before they had announced it. A bunch of people (m'self included) grabbed it right away, but it now looks like tmo has pulled the old switcheroo and substitued some oddball incompatible ROM in it's place for the time being (from the Dash, or something equally goofy). Hopefully they'll greenlight it officially soon...this exact thing happend with the tmo TP2 upgrade earlier this year too. I'll be happy to get you a copy, if you have an easy way to transfer a 200MB file You can check out the threads here in the general section about it, there's a lot of reports of what's different, etc.

Thanks for the offering of help. I read one of the threads saying it was a Dash file now. Damn TMO. I only read the one thread. Didnt seem like much was different. Have you tried 4shared dot com to upload the ROM too? So since its not "official" than it has to be flashed? But if it were official then it would get sent to the phone from TMO?

Actually, our handy-dandy moderator zelendel has created a link where you can grab it if you want to check it out: Tmo HD2 ROM upgrade
Now, one of the underlying differences between WM and Android is that any updates to WM must be applied manually, even official ones. They come in the form of a full ROM upgrade, not in "patches"...and they're never OTA or direct to the phone. Official carrier or manufacturer issued ROM updates are applied by you running a .exe file on your PC desktop that handles all the flashing for you, over USB. Custom ROMs of course have a more involved/complicated process.
This upgrade at that link has the usual "offical update" installer....but Tmo has obviously decided to hold off on letting us have sanctioned access to it just yet. But, the one they finally release will likely be very close to this one we're playing with now.
Thanks for the link and the information. After using the G1 phone for week, I quickly remembered why I didnt want that phone anymore. So last thursday, I ended up ordering a phone from the "insurance". The phone came today. My GF says, they sent me an complete phone package, with case, battery, ear piece, manual and alls I got to do is send back the phone.
I wonder if the phone comes with the update on it already!
I probably wont be able to play with it until tonight, more than likely tomorrow though. Im swamped at work and will more than likely work late tonight.

I snagged the update on the first go around the leaked version and let me tell you it has worked wonders!!!! it has been about two weeks and I have not had the Sleep Screen of Death or any of my other issues! I read about complaints when people downloaded the official one on the 18th but it looks likes they pulled that one because they where having more issues than it fixed?!
So is the moderator link the "official" download, or the leaked version?

It's the same one. There is no difference between the one that was leaked and the one that was removed from T-mobiles website this weekend.
so why am I hearing/reading conflicting reports, some say its great, others say more stuff is broken.
Because not everyone uses their phone in the same way or with the same expectations. I upgraded this past weekend and haven't had any problems but I also haven't opened up every app and setting to look for everything that has changed. YMMV
After 5 weeks of running around the D.C. and Northern Virginia area I will have my evo as soon as I get out of work! The only downside is, it will come with 2.2 >.< and I can't root it yet oh well. How is everyone liking Froyo?
@EVO 4G congratulations man! it'll be nice to welcome another into the clan! as far as froyo goes, honestly, i'm kinda disappointed. My battery life seems worse and the phone seems to run hotter.
now take my opinion with a grain of salt. it seems that my results are not typical. i'm looking into what i can do to fix that.
anyways, congratulations and i hope they find a root for 2.2 so you can enjoy everything the EVO has to offer!

It may not come with 2.2 preloaded. Just tell the employee that you are busy and will perform the update yourself at home on wifi instead of 3g/4g.
thats a really good point. it might have been sitting in the packaging long enough to dodge the 2.2 update
God, I hope that is the point. The way they have been selling and the fact that sprint's website is advertising 2.2 I doubt thats the case for this one >.< . We will see though.

I picked up my Evo yesterday afternoon (Thurs) from a Sprint store, I had been on the list for a couple of weeks and they told me they would get some in on Wed. or Thurs. I also was on a list at Radio Shack and they told me they might get 3 Evos on Friday. On my drive to Sprint I pulled into Radio Shack and noticed a car with a Sprint logo parked outside. The manager told me again that they would be getting 3 phones on Friday...long story short: I left Radio Shack and went to Sprint, paid the full $320+ for the Evo, left Sprint and 20 minutes later RShack called me and told me I could come pick up my phone. With Radio Shack it would have been $199 + tax and that's it, no upgrade charge for the new phone etc., only the $10 more per month for the Evo plan. So I had good luck mixed with bad luck but I'm glad I've got my first Droid and it's great.
I love my EVO, best phone out there and best phone I've ever had (coming from WM TP2)!

You should of taken it back to the sprint store and got it at Radioshack so you didn't have the mail in coupon

Sprint would have charged me a $35 restocking fee to return the Evo. I didn't even think about trying to return it as I'd signed the new contract etc. I did have Sprint charge my account so if I take a few months to pay it off my refund will show up in the mail. I really wanted to buy at Radio Shack though, if the manager would have slyly let me know the phones were in yesterday I would have waited for him to call.
Hi all. I am a pretty active community participant and have been going back and forth between my lovely epic and the mighty Evo. And I have been torn and built back up and torn again. But I have come to a conclusion. I cant live without the community backing, and company backing. The Epic is amazing, it just seems to be missing something, and no that isnt Froyo lol. I have read up and down about the Evo and although it doesnt have the Sexy AMOLED screen, and the keyboard, I have decided I can live without them AND save 50 bucks! So I will be returning my Epic tomorrow and ordering an Evo online where they ship in 3-5 days. I can live for that time without it. I just feel the Evo is more sturdy, I have never been one for being a first adopter and I realize this now. I have heard some pretty bad things about the Evos battery life, is it really that bad, im guessing not but just need some input! Thanks

Another note and reason I am returning the Epic, I need a phone, not some super gadget lol. And the Epic is just amazing, the hardware is SUPERB and top quality, but I will admit I am a phone geek but have other priorities, so what if the Epic is faster on 2.1 than the Evo is on 2.2, I have heard this time and time again, and its not for me. Why am I rambling? Because I think a lot of other people are in the same ballpark. And its a hard decision, it really is.
If battery is an issue for you, then take the $50 you saved over to Seidio online and buy the 3500mAh Battery. You will never run out of Juice again. As far as sexy appeal, I am perfectly fine with the extended size. Its still lighter than a G1 with Stock battery in it (I had the Extended G1 battery as well for 2 years).
You won't regret it, just like you won't regret going back to the EVO.

I have never had the Evo
I had the Hero and loved it
And I love Freshhhh
I cannot part with Fresh!
Yet this AMOLED Screen is EPIC!!!! Buttttt like I said, I need a phone and Evo had the best talk quality this is very important to me! Also the otterbox is too!
the battery lasts fine with the new htc kernel. Getting a minimum of 12 hours with VERY heavy use.
Also as far as speed comes into play, the evo is slightly faster on 2.2 then epic.

You can still return within the thirty days and get your refund plus your upgrade price. I know, I went through two epics the first week and got lucky they had some Evos come in the same day I returned the second one, so I opted for the Evo instead. Good luck!

Actually I had to return mine to stock. I accidently deleted my rsa keys, so my 4g is forever gone. Going to get it replaced through the insurance.
But I liked fresh the best. sense ftw.

not sure exactly. No one really knows how it gets deleted, but I guess I flashed something (probably radio and wimax updates), and it wouldn't work after that.
Sprint has it up for buy BTW. I already ordered mine. Go get them guys

Just got an email from Sprint this morning, saying I can get it now. Waiting for Best Buy to open to see if they have any in stock, or if I have to order from Sprint.

Jimbobtexas Best Buy shouldn't have them until Friday I believe. The pre-order online should then get it to you here by Thurs/Fri. So it should be the same time or so.
The nice thing about online is that you get to waive the activation charge, it has free shipping, and you can charge it to your account. Makes it much easier if you need to return in within 30 days.

I am on the fence right now about the 3D. With GB on my Evo, I am not sure it is worth upgrading to it just yet. I think there is a couple more phones coming down the pike in about a month or so that might be better choices for me. Besides, EVO 3D does not have a kickstand! LOL

I ordered it online at 8am Eastern time and spoke to "order support" or something a half hour later and was told that my order has been received by the warehouse, there is stock, and my phone is awaiting pick up from UPS. She said they always ship using the fastest available service, so I'm hoping it arrives here at work tomorrow.
I just came to comment that "of" is oddly capitalized in the topic.
I didn't order because I don't think the 3d is worth full retail price if I have a working evo. Waiting for the next generation of phones or maybe the galaxy s2 if it turns out to have amazing developer support like this evo.
I'm waiting to see the fury that will be unleashed on the forum this weekend once this phone is in full circulation. Waiting to see if a couple of the issues get worked out first.
In the meanwhile I have a fully functional recently updated Evo!!!!!

O and I ordered mine last night at about 11:40 PM CST. Excited to know that I was near the front of the line so if they are true to the fastest method of shipping should get it tomorrow!
Flashed stock Sense yesterday to my Evo. Couldn't STAND it. Can't imagine no root, no CM7, no nandroid, no custom ROMs... and being stuck with Sense, improved or not.
Though I've preordered, I'm skipping this one. Anybody want my spot in line at Radio Shack on Friday?
Me and my bro get ours on Launch day. We have upgrades and we're trading in our Evos. I'm going to miss my e4G.

gl with w/e you choose. I don't mind running GoLauncher, ADW or LauncherPro over Sense. This phone is more than fast enough anyhow, I don't need AOSP as much. But I will flash it when it becomes available, no rush though.
When you order via telesales, do they charge it to your account? Or do you have to use a card?
I'm really on the fence about this one, especially w/ all the phones that'll be coming out the next couple of months. Okay I have the $7 sprint insurance and my phone fails to connect to the sprint network(unrooted and stock 2.1).
I went to the sprint store today and they said they fixed it because the PRL was outdated blah blah blah....and the pohne worked fine.... for 2 hours then it failed again.
I chatted with sprint about it and a rep told me to go to the sprint store to get a new hero(he first offered me a refurb instinct! because he did not have any refurbs for the hero).
So tomorrow I have to go to the store again to claim a new hero.... but I'm 99.9% sure I won't see it since its discontinued.
What phone should I ask for if the hero is not in stock? (I am not asking for an evo or evo 3d just the next comparable phone that replaced the hero)
definitely do not get the instinct worst phone ever lol. if anything try and squeeze the lg optimous s out of them, it was very similar to the hero accept it didn't have sense, if they don't have any heroes in stock that is.

LG Optimus is very similar spec to the hero but better for some reason. Also has a real proximity sensor, still doesn't do flash. This would be a sidegrade though, you should shoot higher, sometimes the reps are good about that.
EVO 3D would be ideal but aim for a EVO Shift
Instinct is a big NO WAYYYY!!! That phone almost had me give up my cell phone and get a landline again it was so bad. The Optimus is a decent phone. My son has one and he generally likes it, however it doesn't have a large developer following so your ability to stick with it for the duration of your contract could be problematic.....if your contract extends beyond the next 6 months or so.

If his Hero is stock he'd probably be happy with an Optimus.....Agreed there. The Hero has been a lot more fun for me to tinker with though IMO.

Last time I checked (about a month ago) Aosp was primarily for the Optimus V some reports were that it would run on the S but it was buggy as hell and required the hard buttons remapped.... There were only 2 roms at the time worthy of a daily driver (stock & 1 custom). There were ony a couple of custom kernel choices and very few tweaks. It's also quite cumbersome to root (had to follow like 5 seperate threads and the screen is totally blank for 3/4 of the process). Please don't get me wrong it's not a bad phone, but if you're used to all of the customization of the Hero (like me)....I personally find it somewhat dissapointing.
***EDIT*** To be fair and objective since I don't give my son's Optimus the same love & TLC as our other phones & Nooks. I just popped over to Android Central to have a fresh look around. It seems like the rooting proccess has improved substantially in the past month and there are a couple of flashable "Sprint fixes" for the Aosp rom. Also new since I last visited is a unofficial beta CM7.....For what it's worth.
I sat down and had a beer with an old friend last night, he told me he had a samsung moment and since they didnt have that phone in stock he got an epic 4g.
They offered him a keyocera android phone and he said he paid for a high end samsung phone when it came out...not a keyocera.
I played with the optimus at the store and I like it...my upgrade is in 2 months...if they're feeling nice and let me renew my contract I'll get an evo 3d.
But an optimus S will be fine
I only need two things...my dish network tv everywhere app and pandora...

Right now im using the hero over wifi since the 3g radio fails to connect... if i get a new hero i will root it and flash ginger deck with gapps... the thing feels clunky as hell on stock 2.1
Right now the fastest battery friendly rom is ginger deck right? Any other roms worth trying?

i would use aospcmod and set it to 3520-691 ondemand and your battery will last forever.
Well lets wait and see if I get the new phone on Friday. 99.9% guaranteed i'll get a refurb but meh its worth avoiding the $100 deductible from asurion.
Played with the optimus in the store again... the thing flies on stock 2.2.
Played with the evo shift and the slider feels firm compared tot he epic which feels cheap in the hand.
Going to use my upgrade towards the Galaxy S II or Motorola photon on september or whenever the phones are out
