if you pay for your phone (say £100 or so) from the vendor/service provider, does the phone remain unbarred to network when/if your contract is terminated early, or barred (non-payment, dispute etc)?
I would imagine so if the phone is "free" from vendor, as they own the phone, but what rights do you have if you at least contribute towards the price of the phone. Bear in mind that the £100 or so usually covers the mass trade price that the provider pays for the phone...
I had bad issues with my Orbit and high bill problems due to the known gprs issues. O2 did nothing to help me until I demanded my contract termination.
They acknowledged that, and while I am still getting bills (which I am disputing) I believe my actual service has been barred and terminated (I dont use it anymore anyhow so I wouldnt know). I did pay for the phone and as of now it works with a Virgin sim card.
Will this be barred in the future, or do I have enough legal ownership of the phone to make them not bother barring, or what?
Thanks.

I am going to London for a few days and want to buy XDA II. I have spoken with a shop in London and they said that they have it in stock and start selling on 1 November. I need a piece of advice from those who live in UK. I was told that the phone will be sold with a contract only.
1. In order to buy a contracted phone, do I need only ID and credit card or I need a permanent address in the UK as well?
2. What is O2 policy on early contract termination? I could not find anything on their site.
3. If I pay cash and leave the country does it mean that I am not paying early contract termination fee since they do not have my credit card number and I am not the UK resident?
4. Any ideas how to buy XDA II in the UK at minimum price in my situation?
Many thanks.
I bought the XDA online.... (original)
When I went to register it with O2 they checked through the deal I did with the link....
If I had not confirmed the registration when I purchased the device I would have been billed the full amount after a certain time.
If you buy a phone they will run a credit check including where you worked last....
If you terminate early I know many people that have been billed the full price.
sorry but it appears you have no option here. catch 22 situation...
hope that helps.
Ian.
Sorry my English is not that good. What 22 situation means?
What if I ask a friend of mine who lives in UK to register on his name, can I pay with my own credit card or it must be his credit card? In this way I would pay the charges for early contract termination from my card. Depends how much it is à course. Anybody knows how much O2 charges for early contract termination?
catch 22 - from the film by the same name... I think
basically you do it one way... you get screwed, you do it the other... you get screwed.
If you get your friend to register it you might be able to get the registration transferred over but your friend would be putting a hell of a lot of faith in you.
The cost for early contract termination is the cost of the phone without contract plus any extra charges O2 wish to lay on you. The XDAII is what £700 without contract? (speculative price)
either way, I wouldnt like to be you or your friend when you terminate the contract early.
sorry,
Ian.
I've got an idea. I ask my friend to put XDA on his card and purchase the insurance for the phone as well, while I pay cash back to him. Then I leave the UK and he reports XDA stolen or lost and gets a brand new XDA for himself for free.
Is it very illegal in UK to do in this way?
I would prefer a more legal way to get around.
errr it would be very illegal...
like insurance fraud illegal...
if it wasn't everyone would be doing it...
please dont suggest that here again...
I had a feeling that it's illegal
But is there a legal way??? I would appreciate if somebody will give an idea how to do it legally. Somehow a lot of phones are getting out of the coutries of origin, get unlocked and sold. So there should be a way I believe.
lol how could it not be illegal i mean they have to give him 2 phones at the price of one
if it were not who would stop people from doing the same thing with cars
and figtherplanes for that matter

Click to collapse
Yeah thats because the supplier can source the items from other dealers (like when buying MS software)
but that usually doesnt happen until the item in question has been out for a few months... with the XDAII being so new their will likely be limited availibility... so I'd imagine getting one with a contract below the RRP O2 is selling it for will be hard enough never mind buying once cheap without a contract.
the phone when released is subsidised by the operator in the hopes they can make up development costs with the contract. They may begin to release phones to other parties after this time but they wont so close after the release date.
Ian.
P.S hence why that XDAII on ebay is so dodgy... where the hell did he get it from? (if he actually has it in the first place)
http://xda-developers.com/phpBB/viewtopic.php?t=3270&highlight=ebay
There are phones available really soon after the initial release in the country of origin and sold usually in small shops (not chain mobile shops). That means that somehow the phones are purchased somewhere at low cost with a contract (operator's logo on the phone) and then shipped outside the country, get unlocked and sold. Which is probably not 100% legal scheme but if they can do in bulk means that there is more or less legal way to do it.
O2 are like pitbulls when the go after their money. I dont think they will allow early termination, so add up 13 months at the chosen tariff, put that in an account then each month it will be drawn at the monthly tariff by O2, when 12 months expire give 1 month notice and thats it. If it still seems cheap this way then good luck. Regarding the insurance claim, the phone companies now demand a written statement from the police and the owner, they have got very upset at all the claims and investigate each claim. I dont think a phone, no matter how desirable is worth a criminal record.
What is the situation with existing O2 customers? How much existing customers pay for a new XDA II?
Let's say my friend is an existing O2 customer and he buys XDA II. Can he sell it then to me and use the old handset instead?
I need some help
Cor I wonder about some of the Posts I read here.
Can anyone help me out with the Keys and combination for the Store room at O2 head quaters.
All plans and electrical documentation along with type of cctv and alarm systems would also be helpful..
If you work there then perhaps you could leave all of the stock on the Road outside the rear door. Please post a note here to let me know this information
I assume that it would not be so bad if I just rob them directly rather than do it behind their back.
Is that Legal.?. after all I am not making some bad insurance claim.
.... Well I am laughing....
Looking to get a cheaper Hero/Magic when T-Mobile US launches it? Don't want to be stuck in contract anymore, for any reason? Here's your chance.

Although the contract technically says you CANNOT get out of contract because of this raise, at least one person has already done it. There's also the fact that a) I did not receive this notice on a cost increase, which I'm sure is illegal, and b) raising ANY price of a service while in contract without the ability to cancel it is illegal (AFAIK, even if the contract says otherwise).
I'm calling up on Monday.

DEACTIVATING THIS PHONE OR DOWNGRADING FEATURES OR RATE PLAN MAY LEAD TO ADDITIONAL CHARGES
To provide you with significant savings vs. buying in a retail store, the price you paid for your device includes an Instant Savings Discount from this authorized retailer.
By accepting this Instant Savings Discount, you agree to repay $200 of this discount ($300 for smartphones and netbooks) and authorize us to charge your credit card in repayment of this amount if, during the 181 days after your new equipment is activated, T-Mobile notifies us that the services you purchased have been suspended, disconnected, or deactivated, or if you return your purchase outside of the return and exchange provisions of our 30-day Satisfaction Guarantee.
Please note some of the reasons T-Mobile may notify us of a deactivation include if:
You transfer this equipment to another T-Mobile line of service after it is activated
You change your T-Mobile rate plan to a lower monthly service rate than was specifically required at the point of purchase
You deactivate texting/data features that were specifically required at the point of purchase
The new line of service activated with your order is used to replace a pre-existing T-Mobile account
The only reason you would ever have to worry about this is if you did something stupid like remove your data plan! I'm a RadioShack associate, and my store's wireless specialist, and our T-Mobile offers never require anything but the data plan,so there's nothing to worry about!

This is really nothing new, 3rd party "authorized resellers" quite often have always had clauses like this in their contracts. Basically it gives them a means to recoup their lost commissions or other costs if you bail out.
If you go though an authorized reseller your bound not only to tmobile's service contract, but whatever that authorized reseller may bind you to as well. Always read what you're signing.
I remember the 1st cell phone i got long ago though an authorized reseller had something in the contract that if you canceled service and did not return the phone to them, not only would you have to cover tmobile's ETF, you would owe the authorized reseller something like $200 for the phone.
All true, but there's still some users who have been using "the shack" and other 3rd-party retailers (like walmart) to try to get around cancellation fees, etc...because they believe they're not subject to what's mentioned in the OP here.
This would probably help more people if it were posted in egzthunder's sticky thread at the top of this section, where this type of thing is being discussed.
so i got my focus about 2 months ago and extended my ATT plan. now my company tells me they will no longer reimburse ATT phone accounts, only sprint. so i'm considering switching to sprint. i'm frustrated because i would have just not gotten the focus and let my ATT account expire, but now i am subject to that damn $250 plan cancellation or whatever.
anyway, i would be interested in using the focus with sprint if possible. like unlocking an iphone, i would think unlocking the focus would allow one to use it with other networks. is this true?
otherwise i'll probably wind up ebay'ing it. at least it will cover the $250 ATT cancellation fee plus a little profit.
your ebaying it.. you can't put a gsm phone on a cdma network.
I suggest moving to another company that does reimburse your AT&T plan, or at least offer a discount! If you mean 100% reimbursal too, then you are very lucky, I only get an 18% discount on my bill through the job.
But seriously, what AT&T may suggest is having your service auctioned off to someone else to avoid paying the early termination fee... the downside I think is you may lose your cell number. I would suggest calling customer service and going directly to the cancel service option, then escalate to a manager. Those are honestly the only people that do anything to help... trust me I know!
i can keep my cell number, but i think the company takes the plan in whole. meaning that if i leave the company, i probably lose my number at that point. that would be a deal breaker if true.
i get a 15% discount PLUS they were paying another $50 of my bill. the 15% stays intact, the extra $50 off goes away.
15% isn't bad and probably worth staying with ATT if the hassle is too great otherwise.
You can't use a GSM phone on CDMA carrier. The best you can do is use with T-Mobile if you get it unlocked. Even that you will lost 3G capability.
CDMA carriers typically don't allow any phone that is not provisioned by the carrier. So, basically, you can't even use Verizon's CMDA phone on Sprint.
BTW, the ETF from AT&T is $325 pro-rated.
Bell you did it again, me thinking this month I could actually get a new phone (18 month upgrade)
Well, they breached my contract and now they're saying that I can get a new phone September NEXT YEAR
So i cancelled my phone and I am not paying my penalty ($600) I told them since they have breached my contract, I have a right to breach theirs by not paying the Penalty. What would happen if I just don't pay that $700 bill?
I am thinking of going with Wind Mobile, Unlimited Text, Call, Data for $50 a month, holy **** what a deal. Galaxy Nexus for $99 on a 3 year contract.
Is there any way to get out of paying my penalty?
Thanks.
The general thing that most companies do with unpaid bills is to send it off to collections. Its bad for your credit rating, very bad. You need to find the original documents they provided you when you signed the contract with them and look that over and find out what you actually agreed to. They very well may have said something like we reserve the right to decide when you can upgrade phones or whatever. In which case they would be within their rights.
Before you do anything rash like simply refuse the pay, do your homework, find out exactly what it was both parties agreed to.
Its possible that you got an unethical sales rep who was trying to corner you into signing a new contract now to get a new phone. Talking to another rep may resolve your issue.
Please try to keep topics in the "Atrix 4G General" section about the device itself. Thank you!
