DETROIT -- An Ann Arbor woman said she is waiting for an apology from Sprint after she bought a phone that had pornographic videos on it.

Rhonda Lee said she bought what she thought was a new Sprint EVO HTC cell phone from a third party Sprint store in Westland.
The phone is usually sold unwrapped, but all of the pieces were wrapped.
When Lee showed off the high-tech phone to co-workers and friends, they discovered five pornographic video downloads.
Some of the explicit videos were as long as 11-12 minutes.
Lee said she was disgusted and mortified by the X-rated videos.
"I'm so, so embarrassed, you couldn't imagine … I mean for you to be going through your phone and you have friends and you're going through your phone and all of a sudden porn shows up. I mean so, so upset," said Lee.
When Lee tried to return it to the third party store, employees first denied that the phone had been used, but they later admitted that another man prior to her purchased it.
After a bit of a runaround, Lee said the Sprint corporate offices told her she could get a replacement phone at the Briarwood mall.
"What upsets me, I keep thinking about the what ifs, not just being me, but what if somebody bought it for it their kid? I have a lot of friends that are religious, what if it was given to them as a gift?" said Lee.
When Local 4 asked a Sprint salesman if it was common practice to sell used phones as new ones, he told us to contact the corporate offices.
The corporate offices have not yet responded.
Lee is a Local 4 viewer and e-mailed us her story.

This happened to a friend of mine, a lady, she contacted a lawyer and sued. It was Verizon. Multiple people from Verizon showed up at her lawyer's office. She didn't contact Verizon first. She went directly to the lawyer.
This happened in NYC. The phone was loaded with porn featuring Verizon store vendors. 2007 or 2008, I believe.
BTW, I don't know how much was the settlement, but it was 67% for her, 33% for the lawyer.
I'm disappointed, mine didn't have any. Maybe it's included in the OTA?
I am outrage as well as a sprint customer I too want this extra bonus to come with my phone!!!
Why should Sprint apologize for a resellers mistake. Also Sprint should not be saying anything because they did not sell her a phone and should not have any employee risk saying something offhanded. It is best they refer it to corporate. The third party store should be the center of topic. The Local news channel is wrong for linking this to a coporate Sprint store.
What can someone sue for if porn was there when they are an Adult buying the phone? Nothing because people rarely win lawsuits over this kinda stuff. Kiddie pron perhaps.
I can leave that stuff on my phone and sell the phone. Whoops my bad that's all.

Let's sue Sprint under the auspices of "what if a really religious friend of mine bought this for their kid and they were traumatized for life" so she can get a fat settlement, as a result of which the costs are passed on to the consumer.
We've become too litigious for our own good, and the rest of us end up paying for it (literally).
News flash lady -- even religious people have sex and know about porn.
Sprint should apologize, give her the phone for free and move on.
Shouldn't Sprint have the records of what data was downloaded when to that phone? If they do, they can easily verify when the porn was downloaded and who had the phone at the time.
why is that the folks who can/would appreciate such things don't get them.

In my opinion, the sprint stores that are operated by third party are shady. There is a tremendous difference between a sprint store and a "sprint store". There is no way for a customer to tell if they are walking into a sprint store or a third party store just by looking at it. Perhaps if they walked in and asked a salesperson.
I bought my evo from a third party store and was charged for two activations and shipping costs despite picking it up from the store.
Sprint customer service actually disparaged their own store and said "some times our third party stores put additional charges on accounts like this". I made note that the store had a sprint sign on the building and she said "yeah i know its tough to tell unless you look on the website".
That being said, I wish I had an extra bonus on my phone when I got it.
Over the years, I’ve bought a lot of phones and have done a lot of returns/exchanges, mostly with Verizon up until this year. With all the carriers, I’ve now been told “don’t worry all returned phones get sent to a warehouse and all data is wiped.” I stopped listening to that when I got a Verizon replacement that had someone else’s contacts and pics (this happened 4 times over that past few years). I keep a lot of business data on my phones and so not only did I hard reset my Evo twice, I also used a nice Windows freeware app called Eraser, to secure wipe the Micro SD Card.
I bought my Evo knowing that it was a return to the Sprint store. Mine didn't come with porn, but it did come with several (~10) shots of a brunette in various places (bar, house, and a couple places I couldn't tell). I'm guessing it was the first owners girlfriend.
She was attractive, but she definitely wasn't naked!

I went to a large Carphone Warehouse store in the centre of Bristol today. No Nexus S dummy models on display, no posters, no literature.
I asked an employee about the phone and here's how the conversation went:
- "Hi, do you have any Nexus Ss in stock?"
-- "Nexus what?"
- "Nexus S, it's the new phone from Google & Samsung"
-- "Sorry, haven't heard of it"
- "Err... it came out today and it's a Carphone Warehouse exclusive"
-- "Well... we'll probably get some in next week"
I know this isn't exactly the launch of the next iPhone, but you'd think since Carphone Warehouse have paid to be the only distributor in the UK, they might at least have a poster or something saying 'Coming Soon'.
I'll be disappointed if in the new year the tech sites start reporting poor Nexus S sales and lack of consumer interest in the UK. I fear that with a launch like this, the phone doesn't have a chance

Carphone warehouse haven't got a clue half the time, i've been in that place countless times, asking about products, and they don't have a clue! But they know everything about the iPhone, typical.

In UK Nexus S is non-distributed exclusively by Carphone Warehouse, a as worse as Best Buy company.
This is so ridiculous - Eric Schmidt must be a Monty Python fan.
Vodafone was just like this with the n1 when it first came out. It might go down to profit margins compared to the more favorable models of phones that have a bigger profit. Nexus phones are good solid phones but don't seem to be the taste of Joe public only a small number. I'm not to sure why Google is with Vodafone again the only thinking i have behind this is they branch across Europe and parts of Asia.
Apart from the launch in London P4U store, any news on other demo unit availability?.......are all P4U stores able to show them now?
I will try as best i can to update this when people let us know where units are in store to play with, until it is clear that everybody has them available to try.

Played with the phones yesterday at p4u in oxford street (bond street), however today the store doesnt have any demo units. says they will get demo units soon.
Gonna have a look around later......i read somewhere late yesterday that more P4U stores would have units in today (21st), will be in MK later for some physio, so will try and locate a store there, then back home to Northampton, so i will have a pop in the store here see if i can get lucky.

I don't know about stores in the rest of the uk but a few phones 4 us in london and three stores are expecting demo units next week between the 26th-1st
So, apart from someone elsewhere saying they tried one out in a Birmingham store, and some stores saying they are getting them soon, do we have any definite sightings yet?
I would like to try and populate the OP with store locations so people can go and try for themselves.

Yes there is definate sightings in london. The phones 4 u store in bond street that did the launch now have a display model however, you can't check out the camera/video or front camera or music in headphones because of the way they secured the phone.
The three store also down bond street a bit further up (opposite selfriges) had a clean demo yesterday i.e it wasn't bolted to anything so i got to test out camera/video, front camera/video, audio, phone calls in the shop and got to walk around in the shop with the phone to test out the camera on different subjects. I don't know if they would have bolted the phone down now but I am glad I went in search again yesterday as i finally got to play with it without any restrictions as such (apart from obviously not being allowed to go out the shop with it)
I thought HTC distributed demo units for reviewers,but 4 days later still no reviews apart 1 or 2 short amateur videos.

Definitely not in P4U in Manchester Market Street. Person said check in first two weeks of march but not to quote her on that

Thanks Phil, OP updated, was it you in another thread that said you had a play in a Birmingham store?
It has been advised by the HTC staff that go around demoing the phones to shops that the demo units are running atleast 2 month old software and is not retail software.

hello Guys I have a update for this thread.
Three store islington angel - London has a demo unit however the guy is such a pr**k and won't let anyone play with it. He claims it is his personal phone when I know it isn't because I saw him in the morning but because I had to go somewhere i said to him i will come back after he said ok. When I went back he was on lucnh and I asked the staff they said I would have to wait for him to come back as he was the only one with the demo and demoing it to customers then when he came hes telling me its his personal phone.
I thought you know what let me leave it because the staff in the three store in islington angel are FOS anyway, no wonder when I walk past it is always empty and there is like 6 or so staff members sitting in there twiddling their thumbs or talking aboslute rubbish amongst themselves on top of that they are absolutely clueless about phones but that's another matter.
Also three store in Kilburn - London also has a demo unit thankfully they let you play with it. So far all the three stores that have the demo units they are not bolted down to anything, the staff members have it around their necks.

I was in my local 3 store (AGAIN) yesterday looking for a unit to play with, the young lad who approached me as i walked in store asked if i was after anything, i said i wanted a One to play with, he told me that it was only announced a couple of days ago......i told him i already had it on pre order since last Tuesday, he sort of looked as if i was lying, then said they wouldn't have any for a while because it's not out yet, i pointed out the Xperia Z that they have had for the last few weeks wasn't out either and he just shrugged his shoulders, i then pointed at the big A frame in the store front that showed a big pre order poster with the One on it.....again he just shrugged.......kids eh?
haha yea, i swear it never ceases to amaze me how little the people who work in these retail outlets (not just phones) know about their products.
usually i just nod and agree when i realise that i know more than they do lol

From my experience unless your buying an iPhone or Samsung the sales assistant does not know a thing and will guide you to either if you ask for anything but these 2 brands?
If I try and buy accessories for my HTC One it's almost near impossible as well.
Yesterday I was in Bluewater shopping center in Kent, now until Westfield opened it was the largest shopping center in europe.
I walked from one end of it to the other and there's 2x carphone warehouse, 2x phones4u, 1x EE, 2X O2, 1x Vodafone, 1x independent phone shop.
Now I kid you not I just wanted a replacement case for my phone, no one and I mean no one had one!
What they did have mind is racks of s4 cases! But ironic as it is they didn't have any s4 phones!
When I did enquire they just brushed me off and always gave a negative passing comment.
This I would like to think would not be having a negative effect on their sales but I can bet is has? When I upgraded the sale assistant was 'advising' me to wait 4 weeks for the new Samsung handset as it would be 'worth the wait'.
Has anyone else had experiences like this?
My local cpw prefered the one over the Sony I went in to look at. They suggested waiting for an iphone, I wasn't interested. They only had the car holder available for the one, no cases or anything else. The car holder I bought for £14 less from ebay, shopping around helps.
The shop didn't have a real one as a demo unit, so I bought it without seeing one. Glad I did though

I have to agree with both of the above comments. I tried cancelling my contract via retentions and wanted to ask for deals on the HTC one. All I gotwas deals on cheap ass phones and when I asked about deals on the HTC one they realised I wanted something high end and said I could pre order the s4 or the iPhone is a good phone. I was like.... No .... I'm interested in the HTC one. Sure enough any "deals" were the same as a new customer could get by goinng through the website! Needless to say I got my Pac code and left.
The retentions guy and subsequent calls had no interest in offering the HTC one at all and like mentioned above. It's either Samsung or iPhone they offer people. Unless people see the one for themselves and don't get swade by the sales people HTC will miss a lot of sales due to the sales pitch of customer reps pushing other brands instead of being impartial like they claim to be!!
Can anyone tell us whether commission or sales bonuses etc have a bearing on this?

Yes I noticed this too, already when I was deciding on buying a desire and wanted to see some all sales assistants always wanted to show me the sgs too.
Anyway Samsung is smart I saw they make a lot of accessories for their phones too. I still haven't found a pouch for my One and indeed lots of accessories for the sgs4 even when it hadn't even been released.
One assistant though assured me none of the pouches would fit because he had tried them for his own One.

It's a shop assistant.
It knows less than you do but is convinced that it knows more.
See also record shops and hi-fi shops.
Clothes shop assistants are the opposite because they always know you look a total spunt in what you've chosen to wear but will never tell you.
Avoid shop assistants.
Maybe we should make HTC aware of our experiences if this is happening to us I wonder how many more it happened to?

Secondly the couple said they were preferable looking for another HTC and the assistant came out with "oh I wouldn't bother, Samsung is what everyone wants and should have now" and tried to tie them down to a S2 for 2 years.
This isn't the first time I've seen Carphone Warehouse and there Samsung biased. It's ridiculous. After they were gone and I finally got served, I told her the One was the best phone I'd ever used and not everyone "wants a Samsung" she didn't have much to say this time around.

This behaviour is quiet concerning, I took the time to email them yyesterday after reading the replies.
I have to ask how damaging must this been to a company like HTC who right now are on the ropes?
Well its taken 4 high streets, 1 retail park and 2 shopping centres but i managed to find a case!
O2 had 3 in stock, they said the only get a few at a time because of lack of interest, again asked why didnt i wait for the SG4?
I remembered after I posted, I went to cpw 3 times altogether, first time I was told the phone was free with the contract I wanted. But my gf was moaning so we left. I went back just before the shop closed but then found I needed to pay a bit towards it. I didn't have any money on me.
I went back the following morning, the nice girl told me they where out of stock. I said you had them last night when you closed, can you check.
The nice girl came back with the phone I wonder how many other customers where turned away. If I hadn't insisted they had them I would have left without it.
HTC could do with better support from retailers
Samsung offer very large subsidies/rewards to retailers who sell their phones especially the flagship model which is maybe why everyone gets redirected to those phones. Also HTC brand awareness is not as strong as Samsung or Apple whose marketing budget is ridiculous! Samsung have released several adverts for the S4, especially in America where as I can only just remember the HTC one advert.
I know HTC in America have started offering vouchers or cash back to customers who buy their phone so may be more ONES will be sold in the future.

A): not a single person was looking at the 3 HTC ones they had displayed -the guy couldn't even find them through the sea of other phones. I barely noticed them and showed him where they were - after I finally found them. No one there seemed to know anything about the phone either. Was there for an hour and NO ONE (except me) even looked at one and there were probably 30-40 people there. Funny thing is i thought there would be a crowd and id have to fight for one. SADLY was a breeze. This was the first week they were out.The store was litered with samsung, apple and LG.
And B): the ONE display was facing the back of the store and was no where even remotely visible to anyone that could walk in. Not even noticeable unless you knew that the phone was aluminum and knew exactly what you were looking for.

the CPW i went into were quite sanguine about the one vs s4, the assistant said the one is nicer and they were roughly selling 50/50
i eventually bought it from a phones4u as it was cheaper and they weren't umming and arring about selling one off contract
There are two things about this issue.
First of all, not all of the sellers have tech knowledge good enough and yes it doesn't make sense. BUT, it is kinda understandable. I mean, there will be someone else there who can help you.
But what really annoys me had happened to me a few days ago. I was in a biiiig techmarket, comparing XZ, S4 and One, and some stupid sales assistant came and was like "omg why are you checking them just buy s4 rest is crap"
Even if what he said was true, this was the most annoying thing i've ever heard from a sales assistant. You are only there to inform, noone cares about your subjective comments. I'd have fired him right away.
Two largest T-mobile centres here and another operator (3 total) never heard of One, still don't have it and don't know when will it arrive. They all redirect me to information about One S, SV, etc.
People are raging like nuts here, spamming T-mobile and HTC pages on Facebook, etc.

The sales assistant that helped me with my One today complained about same thing. He said that HTC One is the "not so popular" big gun. He said they don't have any accessories yet, not even from HTC.
Oh well, at least the phone is sooo good this time.
I just picked up my One yesterday.
I walked into the Telus store and asked the salesman what he would recommend in an android phone and the first one he showed me was the HTC One!
Also the Nexus 4 was recommended as well.
He barely mentioned the SG4. It was tucked away with the rest of the phones but the One was right in front of the door as you walked in and couldn't miss it if you tried.
When asked what phone he would use, he picked the HTC One.
Things are looking up.
After reading all the bad news yesterday about HTC (people leaving the company, articles about a "future without HTC", etc): I opened my dutch news app this morning when drinking my coffee and saw this:

I expected to see an article about the Galaxy S4 being sold 10m times in the first month, but this nice dutch website preffered to focus on what HTC has done. Apparently, HTC has sold 5 million One's in "one month". So it has done 50% of what Samsung has done in the last month. And I guess that doesn't include what HTC has sold in March/April.
The weird thing is, I always read my twitter feed first. I have not seen a single report about this anywhere on Twitter. On the other side, NU.nl is a big and serious website here in the Netherlands.
What do you guys think? I am very happy to see this and it's far above my expectations. If this is true, HTC is not dying anytime soon!

its reported by the wall street journal quoting an official HTC exec (wsj needs subscription)
the news was just posted by Android Authority
so i would believe it

you missed the fact which stated that it's most likely orders done by the shops and carriers, not to customers themselves. meaning they aren´t real sales yet
However, I do hope they all sell in the end anyway though. HTC deserves this, and beyond this as well. at the end of this month, which means soon enough, their capacity to create Ones will double from the amount right now. (if not already)

High demand with nothing to sell is still not a sale though, unless they are also including unfulfilled orders by their carrier partners and local stores~~ The phone has been launched in my country a whole month ago, and not a single store has more than 1 unit for sale at a time, with some stores getting 5 units per 3 days (that's on the high end) >.>
Making my 1-to-1 change for a faulty NFC chip all the more painful, as I'll have to wait 1-2 weeks for HTC to bring in stock ):

I didn't miss it, though I forgot to mention it in the first post. I'm not sure about the 10m from Samsung either, are those sold or orders done by shops/carriers?
Either way, I was expecting this exact message but with a 1 instead of the 5 million. Even if it's just orders done by carriers/shops, it's far above my expectations!
And it's good HTC are doubling their production, it's indeed awfull they often have 1-2 units per store also in the Netherlands.
I think samsung is aiming the same, 10 million orders but not all of them sold; they're still in storage of retailers / carriers.
Also when i went for accessory shopping, I was told everytime that they didn't have any since they got such few phones (1 - 5 maybe a day). saying it was not worth it yet buying accessories for such a scarce phone. it affects a whole deal.

Very respectable number to be honest, sure Samsung has double that in less time but people wanted another S3 and well, thats basically what they got.
Learned people got the One and now word of how good it is, is spreading.
But HTC, why did you release the HTC First? /sigh
5 million Seems like a stretch actually... Supply is still a serious issue..... The unlocked versions in US have been in backorder status for the entire month.... HTC ONE launch has been delayed by over 1 month in most Asia countries....
If they are counting confirmed orders then 5 million may be accurate... But it's highly unlikely that 5 million have been sold already....

Well Samsung counts confirmed orders, and brags about those numbers. HTC would likely want to do the same in this case.

i think if supplies are enough,it will surpass S4 sales.here in riyadh,One were sold out in two days in all carriers/online stores here..and we are not so lucky to get one..they told us stocks will be avail in 2 to 7 days ..just sayin

And how do you know they're BS'ing? Do you have your own sources within HTC, or are you just pulling stuff from the place where the sun don't shine?
For Samsung or HTC or any other vendor the important part is shipping them. They don't care if the units are sold to end users, warehouse or aliens. The sales figures are important and they start when they exit the production storage facility. From business point of view the numbers are quite accurate. 150+ operators all around the globe importing the phones, add also independent companies, import export business, BestBuy or Media Markt type of electronics mall bla bla bla.
Samsung, LG, HTC, Apple... They all trade stocks so sales figures are important. Especially when quarterly earning reports behind the doors. Once they sign an agreement, let's say with Vodafone, for 1,000,0000 units worldwide, that goes as 1,000,000 units sold to Vodafone in sales figures. When the end users get it is not their concern.
Well, probably not so many units in reality. Never seen a "One" besides on Champions League game )

HTC One is selling good in Turkey aswell. I saw many people who doesn't even know HTC but after seeing review unit they are amazed by quality.

Exactly. HTC sells to the carriers so those are their sales numbers. They have already made their money.The carriers and other suppliers sell to us, and their numbers reflect that.

Samsung and the general industry counts what they have pushed through to their sales channels... That number may or may not sell but that is what gets reported... Which is why at times manufacturers take a hit on unsold inventory at a later point....remember blackberry tab?
It's possible that HTC managed to send 5 million devices through their sales channels as the article suggests... but looking at the acute supply issues that still exist this means that there are approx 5 million devices out in the wild in the hands of customers..... That appears unlikely as apart from UK and US its really not available easily anywhere....

You are completely right. I would add thought that more of those 5 million units are in consumers hands then the 10 million from Samsung. HTC is pushing this phone out fast. Last one I got was made 6 days before it came into my hands. I would imagine there is a decent stockpile of S4 in some places where I do not think that is true of the ONE.

So then where are these units. What warehouse are they hiding in? Why did some guy pay $800 on ebay for my ONE? No one has stock of the HTC ONE. There is no surplus anywhere that I have heard. I have only heard their are not enough to go around.
