VIEWER: 'New' Phone Loaded With Porn
Woman Says Third Party Sprint Store Sold Her Used Phone
POSTED: Wednesday, July 7, 2010
UPDATED: 9:42 am EDT July 8, 2010
DETROIT -- An Ann Arbor woman said she is waiting for an apology from Sprint after she bought a phone that had pornographic videos on it.
Watch: Woman Says New Phone Had Porn On It
Rhonda Lee said she bought what she thought was a new Sprint EVO HTC cell phone from a third party Sprint store in Westland.
The phone is usually sold unwrapped, but all of the pieces were wrapped.
When Lee showed off the high-tech phone to co-workers and friends, they discovered five pornographic video downloads.
Some of the explicit videos were as long as 11-12 minutes.
Lee said she was disgusted and mortified by the X-rated videos.
"I'm so, so embarrassed, you couldn't imagine … I mean for you to be going through your phone and you have friends and you're going through your phone and all of a sudden porn shows up. I mean so, so upset," said Lee.
When Lee tried to return it to the third party store, employees first denied that the phone had been used, but they later admitted that another man prior to her purchased it.
After a bit of a runaround, Lee said the Sprint corporate offices told her she could get a replacement phone at the Briarwood mall.
"What upsets me, I keep thinking about the what ifs, not just being me, but what if somebody bought it for it their kid? I have a lot of friends that are religious, what if it was given to them as a gift?" said Lee.
When Local 4 asked a Sprint salesman if it was common practice to sell used phones as new ones, he told us to contact the corporate offices.
The corporate offices have not yet responded.
Lee is a Local 4 viewer and e-mailed us her story.
If you have a consumer problem, call Ruth to the Rescue at 313-298-WDIV or e-mail [email protected].

That's upsetting.
From Team HTC Evo.

This happened to a friend of mine, a lady, she contacted a lawyer and sued. It was Verizon. Multiple people from Verizon showed up at her lawyer's office. She didn't contact Verizon first. She went directly to the lawyer.
This happened in NYC. The phone was loaded with porn featuring Verizon store vendors. 2007 or 2008, I believe.
BTW, I don't know how much was the settlement, but it was 67% for her, 33% for the lawyer.

I'm disappointed, mine didn't have any. Maybe it's included in the OTA?

I am outrage as well as a sprint customer I too want this extra bonus to come with my phone!!!

Why should Sprint apologize for a resellers mistake. Also Sprint should not be saying anything because they did not sell her a phone and should not have any employee risk saying something offhanded. It is best they refer it to corporate. The third party store should be the center of topic. The Local news channel is wrong for linking this to a coporate Sprint store.
What can someone sue for if porn was there when they are an Adult buying the phone? Nothing because people rarely win lawsuits over this kinda stuff. Kiddie pron perhaps.
I can leave that stuff on my phone and sell the phone. Whoops my bad that's all.
The news has lost all their integrity lately.
Sent from my PC36100 using XDA App

Well that's not the problem, the problem is that they sold it to her as new.

what if it was her porn, but she was embarrassed that her coworkers found it so she said it must have been put on there by the reseller? then it just spiraled out of control from there

Oh no, porn. The world in going to end.
Sent from my SPH-M900 using XDA App

That's what happens when you don't seal the box!

lmao.ill exchange my EVO for her's

Yaaay!
Let's sue Sprint under the auspices of "what if a really religious friend of mine bought this for their kid and they were traumatized for life" so she can get a fat settlement, as a result of which the costs are passed on to the consumer.
We've become too litigious for our own good, and the rest of us end up paying for it (literally).
News flash lady -- even religious people have sex and know about porn.
Sprint should apologize, give her the phone for free and move on.

Shouldn't Sprint have the records of what data was downloaded when to that phone? If they do, they can easily verify when the porn was downloaded and who had the phone at the time.

why is that the folks who can/would appreciate such things don't get them.
"we made our money the American way...we sued for it"

In my opinion, the sprint stores that are operated by third party are shady. There is a tremendous difference between a sprint store and a "sprint store". There is no way for a customer to tell if they are walking into a sprint store or a third party store just by looking at it. Perhaps if they walked in and asked a salesperson.
I bought my evo from a third party store and was charged for two activations and shipping costs despite picking it up from the store.
Sprint customer service actually disparaged their own store and said "some times our third party stores put additional charges on accounts like this". I made note that the store had a sprint sign on the building and she said "yeah i know its tough to tell unless you look on the website".
That being said, I wish I had an extra bonus on my phone when I got it.

Over the years, I’ve bought a lot of phones and have done a lot of returns/exchanges, mostly with Verizon up until this year. With all the carriers, I’ve now been told “don’t worry all returned phones get sent to a warehouse and all data is wiped.” I stopped listening to that when I got a Verizon replacement that had someone else’s contacts and pics (this happened 4 times over that past few years). I keep a lot of business data on my phones and so not only did I hard reset my Evo twice, I also used a nice Windows freeware app called Eraser, to secure wipe the Micro SD Card.

I bought my Evo knowing that it was a return to the Sprint store. Mine didn't come with porn, but it did come with several (~10) shots of a brunette in various places (bar, house, and a couple places I couldn't tell). I'm guessing it was the first owners girlfriend.
She was attractive, but she definitely wasn't naked!

Silly woman Android Phones is for Porn! http://www.youtube.com/watch?v=IraQfhlMwi4

hope she washed her hands after returning it

I've had awesome customer service from sprint. I always treat purple with respect and kindness and receive the same. If ur rude to the reps then they will not want to help u. They also just recently moved my one year premier upgrade a month early for me so I could get the epic

(this isnt aimed at anyone... I re-read it and it sounds like I am trying to call people out, and I am not lol) if I went to your work at mcdonalds and was a **** about not wanting salt on my fries, would you smile and turn the other cheek and fix it? Or would you spit in my food? I will be the first to admit, if you are nice and respectful, I will bend over backwards to help you out. If you are a bag o' douche, then you can suck it. Social engineering makes the world go 'round.
When calling customer care for help on something, which one of these will work better?
"So, I love (like, enjoy, whatever) my sprint service, I have never had any issues with my account, but my phone is starting to act up. I have insurance, and know I can pay $100 thru assurion to get a new (refurbished) device. I know my upgrade isnt until november, but is it possible to move up my upgrade?"
OR
"I saw online you moved up someone elses upgrade by a month, and I demand the same thing or I will have to talk to your supervisor! I have had sprint service for 22 months and will cancel and tell everyone I know to cancel also if you dont do this. My uncle knows Dan Hesse and will make sure you get fired also."
I never have had any issues with getting my upgrades early. Got the epic for free even

Personally I treat all colors with respect. I am a bit partial to blue but purple deserves respect as well as the rest of the colors of the rainbow. Pardon the interruption, I had some teeth pulled today and the vico's are helping a bit too much...
I've had great customer service as well, but why in the heck is this in the dev forum????
i was hoping that no one responded to this stupid thread so it can get lost on page 2 somewhere. this has nothing to do with android development. oh well, the op got what he/she wanted......attention.

I'm not quite as pleased with the customer service here as I was with vzw personally. I recently had a frustrating few days with them as I was one of the unlucky few to receive an epic with the malfunctioning capacitive buttons. Long story short they wouldn't swap me out for a new one, then I was talked down to for returning the malfunctioning device by the sales staff saying I was costing her a sale. I returned it and decided to just get another from best buy....payed a little extra but the device works great...just wish it wouldn't have been such an ordeal to get here

As a customer service manager for 14 years I am particularly sensitive to how I am treated by other companies. I have a unique view from both sides of the fence so I am never overly judgmental or expect the world from anyone on the other end of the phone.
That being said, I have NEVER in my entire life been treated the way that sprint treated me as a brand new customer of only 2 1/2 months.
I switched to sprint because T-mobile coverage in my area was less than acceptable. Ever since switching I have been fighting with them over promises made, bills messed up, unauthorized billing, you name it. Not once have I ever spoken with anybody from sprint that has given me the impression that they care one bit for me as a customer.
The people they hire to man their phones could really care less whether you stay with sprint or not. Not even their escalation managers want to take any time to try and solve your problem.
The reps in the official stores are no better. Just as soon as they found out that I bought my epic from a "third party store" and not an official sprint corporate store they treated me like a red headed step child. Oh, I apologize that I didn't hunt down one of the 3 official sprint stores in Utah. The damn store had ONLY large yellow sprint decals all over the windows and sign. How the hell was I suppose to know that it wasn't an "official" sprint corporate store?
I made a HUGE mistake in switching to Sprint and the next two years can't come fast enough so that I can get out of my contract now.
It's also interesting to google "worst customer service". You will find Sprint at the top of every list.

Ive been with them for 8 years the last 2 have shown great improvement.
In 2008 Sprint received a score of 56, AT&T, T-Mobile and Verizon all received scores above 70. Sprint received a 70 rating this year, a 14-point improvement which is pretty amazing really.
Your Google suggestion is very misleading with much of the sprint Worst CS being from prior years.
The current ratings are much better.

Anyway Sprint CS P me off at times...so does Cox cable internet , Directv , Samsung & a few others.

Hmm, i wouldn't know whether they are the best or the worst because i really don't know. The beauty of my Sprint service is that it works well enough that i don't call customer service.

How is it misleading? The very first google result is MSN's Customer Service Hall of Shame with Sprint at the top in 2007 and jumping only three spots to number 4 from 2007 - 2010.
2007 - 1st
2008 - 3rd
2009 - 3rd
2010 - 4th
You consider 4th worst company for customer service an improvement? When they disappear from that list altogether then I'll consider it an improvement. And before you start throwing this "well they're a big company" BS my way, consider that there are very large successful companies that never make this list.
Also that link you provided only compares their customer service with other wireless carriers. The MSN list is much more comprehensive.

Apples to oranges.
Of course you want to compare wireless service to other wireless service. What are you going to do? Dump your Sprint phone and buy a toaster because Litton Toasters customer service is better?
Oh, and please provide a link. I'd like to actually read what you're reading and, as funny as it is to do, not compare phone CS to toaster CS.
Thanks.

na If in the market for cell phone I would compare carrier CS ratings , Prices & my local coverage.
Those factors made my decision easy.
My Coverage is better then the others , I save about 40.00 a month and get more.
I have no need to call CS everyday....maybe twice a year if headaches come from it oh well its worth great coverage & major savings.
Does that make sense to you?

Yes, and when we're not following prompts for people, we're dealing with the old "it's not taking my Google password WHAT THE HELL I HATE SPRINT" epidemic.
Typically, most people aren't very smart.
Anyway, YMMV with any store, independent or not. I like to think that I do a great job, but I hear horror stories about other stores. Then again, I call Sprint everyday, so I know what the corporate system is like.

There are the ups and downs of any store. You just got to be lucky.
The first time I went looking for an EVO when it launched, I went to a thrid party seller. They said the EVO was out of stock everywhere and we could use temp phones until they get some. So I got the Hero with a huge employee discount. They kept promising they were getting them in a week. Three weeks passed and now Evo yet. So wtf, luckily for the 30day trial I cancelled and went directly to a Corporate store which had Evo's that people on the list didn't pick up.
Two months later, that third party store called and said they have Evo's. lol

It seemed to me that Sprint.com usually had it in stock. Telesales definitely had no problem sending it to people. Many of the people on my waiting list went to the corporate store or best buy because Sprint wouldn't let us VAD the phone for two months and we could only order six Evos for inventory every two weeks.

I ended up having to go to ten difft corporate stores before I could find an evo that a customer didnt pickup. I didn't see any hoarding in fact a couple employees at the corporate stores couldn't get evos because the store manager said the customers on the waiting list had to get em first.

It was actually backwards.... Sprint didn't have any, we had to keep referring customers to BB's, RS's, Wirefly, etc...

Sprint Rep

Basically, my Evo had finally came to an end after heating up multiple times and basically frying the processor etc. So, what did I do? Just like anyone that has a full upgrade and has seen the Evo4GLTE and Samsung Galaxy SIII commercials. I went to Sprint in search of my new S3. I traded my OGEVO and got $60 towards my bill on the new phone. Got home, everything was perfecto! Went to sleep, worked all the next day. I get a call from my friend asking if I had talked to my uncle. I said no, why? He said, someone tried to call my grandmother, pretended to be me and told her I along with my girlfriend and my best friend got arrested in Cancun Mexico... Asked for $4100 wire transfer immediately.
Basically long story short, the day after I traded in my Evo is when this happened, a Hispanic man helped me, my family said it was a hispanic man trying to sound like me. Does it sound like the Sprint guy to anyone else? I mean, I didn't erase anything on my phone, as I should have. There were only two people I text, and the only two people in my SMS box were the two people he said I got arrested with... My grandmother in my phone is under "Nan" so its obvious that's my grandmother. I put two and two together and basically came up with this odd hunch that its the Sprint guy who is trying to scam my family. My mother filed a police report but haven't gotten a phone call from the detectives... & assuming the detectives don't have time to worry about this. I have no other choices, but to be SOL.
Leave your comments and feedback's please. I am just curious to understand what others think about this problem I am trying to deal with.
I think..uh...I don't. I got bored halfway through the story

It was most certainly that person, because here are the rules sprint has with turning in old phones
Sprint's policy is to erase user data from all mobile devices collected through the company's takeback programs before they are reused.
Either two things happened
A) Sprint resold that phone the same day without erasing the data which holds them accountable
B) That person you turned it into was behind the scam and stole the information and re-used it ( I hope you had his name)
C) Even if that person had nothing to do with it, this incident occurred after handing the phones to sprint, so they could be responsible.
You need to GET BACK TO THE STORE ASAP and talk to the manager about this, and tell them to contact the authorities and open up an investigation. DO NOT WAIT
That is one bizarre chain of events! :screwy:
Yeah I know. I need to go back up there tomorrow after work. It was Monday of this week that I got the phone. Tuesday when I got off work is when thIs happened. I hope I'm not too late. Yes I remember his name, Edgar! It's all his fault!

One more tip, DONT CONFRONT HIM YOURSELF!
Goto the manager and explain everything, then he will confront him
Its not too late, this guys an idiot its so easy to track his wire transfer, hes headed straight to jail!
Also if you can take your grandmother, maybe she can hear his voice and confirm its him on the scene.
Wow what a crazy story. It doesn't surprise me one bit.
I had a interesting one myself. I had to calk sprint one day an talked to a rep in Chicago.
We upgraded our rate plan which went very smooth. But my wife, usually pays pretty close attention to our bills happened to look at the account 2 days later. The rep I spoke with had activated 2 extra lines that day and sent them to herself.
It was such a HUGE ordeal to contest the new lines. But when I threatened legal responsibility for the actions taken by them, they removed them.
Do not be afraid of telling them you will take legal actions against them. I ended up completely getting out of my contract and now I'm with boost. Obviously same company but I couldn't beat their service in my area. Plus a hell of a lot cheaper bills.

That's crazy bro, that happens a lot sadly.. not with sprint reps but with scam artist

Something similar happened in the Atalnta area as well so could be coincidence......
An 80-year-old woman in unincorporated Stone Mountain reported to DeKalb County police that she was scammed out of $6,500 last week.
The victim told police that on Feb. 17 around 12 p.m. she received a call from the suspect, identifying himself as Robert Wells, who said he was with the American Embassy in Barcelona, Spain.
According to the report, the victim told police that the suspect said her grandson had been in an accident and that he had some unpaid medical bills that needed to paid before he could return to the United States.
The woman told police that the suspect transferred her to the grandson; it was later determined that someone was posing as her grandson, according to the report.

Who is to blame for this poor G2 launch on at&t, my experience..

So I go to my nearest local at&t store and when I ask for it they said I think we have it on display, but not in stock. Maybe will get stock later from delivery. I go to my next nearest store, and they have it on display as well. I ask him to get me one and he says they have none in the back. I have a definite contact that would hold one for me at his store but its an hour from me but I was about to take the road trip. As I left the 2nd at&t store, I get in my car and the 2nd at&t store rep calls me on my phone and says I found some in the back they were in my managers office. I go back and purchase it off contract. I dare ask for any available cases, he goes to the back again and says they cant find none but one pink one. I said no thanks, no offense to pink cases.
So with that being said, who's fault is this? I actually think it's LG's fault for not pushing for a bigger launch. They dont seem worried, oh well I got one and I'm liking it. Gonna root it and debloat this poor bloated G2. I just hope the battery life is better than my sgs4, I'm using whatever charge it came with today. It sort of reminds me of my nexus 4, the double tap to turn on/off is a stock feature I thought I would never see.
Anyone else with a similar experience? Maybe companies should not launch on Friday the 13th??

This is why I ordered on AT&T website. I placed the order 9/10 at 11pm and it was in my hands on 9/12. I hate dealing with local AT&T stores, at least in the DC/Metro area.
ordered the friday it came out on 9/6 was in my hands monday morning, have been in contact with the guys on IRC, hope we can get this thing cracked soon. =P
Same here. Premier order was even worse. I actually ended up getting one in store this morning. My premier order is still processing from the 11th. Will refuse it when it comes since I can't cancel according to them even though it hasn't shipped.

Bottom line is At&t employees are bunch of dummies. Kidding. Im sure people are quite smart going in but once theyve been in the cluster F ( that is At&t) they are screwed. At&t tells them what phones to push ( Iphones, S4's HTC's etc) and all the others are just fillers. Ive been into at&t stores before and educated the sales rep about the phones they have on display and in most cases they dont even care. This is your freggin job people!! Hello???!!! I ran into the same thing when I purchased the LG OGP - they were clueless and kept wanting me to take a look at the HTC One! Im sure its partly LG's fault but end of the day (IMO) its not just At&t employees that are clueless, Ive encountered the same thing at TMO and Verizon stores too. Never set foot in a Sprint store so I can comment on them.

I've experienced the same thing from AT&T, T-Mobile, and Verizon. Almost none of the reps that I've spoken with are knowledgeable on phones. I went to a Verizon store wanting to purchase an HTC Droid DNA and was directed to a Note II. I advised him of the reason I was interested in the DNA. Not interested in the Note for the same reasons.

Well I used to work for At&t and I can tell you that they do not really care which phones you buy (to an extent). They only really make money off of contracts. The problem is that they only educate workers on the more popular phones, so they tend to show you a Samsung so they don't look stupid since they know nothing about LG. The problem is that they are really pushing you to increase your MRC (Monthly Recurring Revenue). So they want things like Mobile Protection Pack and they encourage you to add a line or buy marked up accessories. It doesn't matter which phone you buy. They spend very little time teaching employees about a Snapdragon 800 and lots of time about the 5 key behaviors of sales. I just happen to be a hardcore phone enthusiast so would be able to talk with customers about every phone. So this is the real reason behind another terrible LG launch. Like the G Pro. At&t only cares about phones that will bring in more customers so they can increase sales, like iPhones. plus people who buy iPhones tend to buy more accessories and have multiple cases. And people like us tend to shop online and only buy store accessories when we're desperate and are waiting for our case from Amazon to arrive. So there you have it guys.
I agree.

Why is Verizon employee telling me not to get this?

Verizon employees keep telling me this phone is crap when I try to go buy one. They told me they have only sold one and it was returned. But this contradicts everything ive read. It has outstanding reviews. Any ideas?
most likely bc they don't get paid out well on it, or know nothing about it and would rather sell you an iphone or a moto x.
Or Droid since those are Verizon most advertised phones. Lg is underrated making the pretty much the best phones since ca one year now.

Lol. Please tell me you can see a crappy sales pitch when you hear that. They most likely dont know what their talking about.
Ya definetly can tell, but my dad cant lol. Hes picking it up for me and they are feeding him the lines. He doesnt think I should get it now. Hate Verizon
Verizon sales reps have a $100 accessory quota and will talk down any phone with little choice in accessory.

Yeah took my VZW rep 10 minutes to turn on the phone. Couldnt find the power button to save his life...LOL
Moto pretty much owns Verizon and Samsung spends way too much on marketing. LG is kind of out of the picture unfortunately.
Interestingly enough, I stopped by my local Verzon (Corp Store) to check out the flip case for the G2 and the Sales Rep said, "they don't carry accessories until the phone is released" and that the "G2 is available for pre-order only." I asked to speak to a Manager who said the same thing only added a condescending "I have been the Mgr here for years and know my inventory."
I thoroughly enjoyed whipping out my G2 and dropping a "well I guess I'm from the future?!" They spent the next 30 minutes finding the phone in their inventory and asking each other about specs, selling features, etc.
Bottom line: Verizon doesn't care about the G2. However, they're all trained up on the motox, S4 and upcoming 5S
Had the same experience on Friday. Pretty much told me the phone was garbage and I would be bring it back. Tried selling me the S4 (coming from the S3 lol), or the Moto X.
edsceao recognition
FWIW, my sales rep literally had never heard of the phone and I had to show her which one it was. She also knew absolutely nothing about the device when it came time for her to activate it. I had to show her where the power button was, etc...
Same experience with me. The idiot sales rep tried to sell me an HTC One when I asked for the G2. She claimed it was much better phone and was very excited about showing me the new cases for it too. I hate dealing with these people.
They have too much current inventory belonging to their moneymaking manufacturers and too high of incentives to keep you in the "droid" family. The guy at the corporate store by me didn't know what it was when I asked for it but did find it & bring it out for me to see. No demo units on the floor until the 17th or 18th though. Even though I've never had an lg before, I'm strongly leaning toward this one. Gotta buy it outright tho to kelp unlimited.

Ya the guy at mine told us he had it for 3 months??? That doesn't even make sense lol. He said that it got slow and broke after 2 months. Hasn't this phone only been announced for like 2 months? Cant believe they would lie that terribly.
Exact same experience, I was told that LG was garbage and stick to the HTC one or S4.

Probably someone who has it confused with the original g, or pro?
I understand that us XDA members know much more about these devices than your average person. Much more. But sales people? Ridiculous. Have you ever listened to one of these guys sell a phone to someone after the customer explained what features they needed? I've heard these people lie (or maybe they're that ignorant) to get the customer on the phone with the biggest profit margin. I saw a lady looking at a maxx until the sales person came up and took her to a DNA because it had better battery life. Anyway, how many people have you heard say they hate their phone? (Non enthusiasts) Most of the time it's a phone you or I would like. They hate it because they were sold the wrong phone. These days they're packing enough stuff into one phone that it doesn't matter so much but not too long ago, you really had to find a phone that fit you. Still the case I guess but MOST sales people just don't care about the customer. If I go to a store, it's only because I can't wait for next day shipping.

I can say my experience at the Verizon store in midtown Omaha, NE was the opposite... The sales person that assisted me was an extremely attractive young lady of 23 to 24 whose phone knowledge was excellent. Instead of trying to sell me something else, she knew the best way to work with a customer is to be agreeable, pleasant, and empathetic.
Usually I get some jackass in an over-sized oxford with droopy slacks trying to work me with his easybro "charm". "Hey man, you gotta protect that inVESTment... you NEED this screen protector."

Picture or it never happened
I love me some stupid VZW sales reps. And the corporate store prices for accessories are horrible too.
The sad thing is it's going to be very difficult for this device to succeed. LG has done virtually nothing to market it that I've seen, and the Verizon reps don't even know it's on display in their store. Were it not for the online reviews I stumbled upon, I wouldn't even know the phone existed.
If the exact same phone had Samsung on it and their marketing behind it, then the sky would be the limit.
