So sprint terminated my service contract because i was using to much data or using it the wrong way but for the last two an a half months i haven't even been using my rooted phone as a hotspot so i don't know why i would be using to much data or using it the wrong way but my phone has been acting dumb lately and my internet service has been poor but i haven't been roaming i don't think but what i am wondering is how long until i can get another contract on sprint since they terminated it for me ?? any help will be appreciated.

I would guess at least six months but it's just a guess. Pretty sure they won't let you sign one for awhile tho.

You can call CS, and ask for the specifics of why you were dropped. If you believe them to be incorrect you can dispute it. Also mention to them the fact that your Data speeds were garbage, and it would be difficult for you to max your Data with those speeds. Don't forget to ask them my favorite question. Well have you updated your PRL? Because once I used the Verizon PRL which made me roam even though it said I wasn't. You can only use 300 MB of data while roaming. (I got a warning for it)
Also when you get your bill look at your data usage.
Perhaps it was slow because you where unknowingly using it?
For the mean time I would just go with T-mobile

No, as far as I know you do not have to return the device. But you do I believe get charged as if you terminated your contract early.

I think you would get charged for not following your contract and "abusing" data. It is in the terms and agreements
Doing the math it wouldnt work out very well.
Pay $200 for the phone
Pay $35 for the activation fee
Pay roughly $80 for the month of service
Possibly pay up to $350 for the ETF.
The phone is probably only sellable for $500 anyways.

I have to agree, just be forewarned: Their "unlimited" is the same as Sprint's, just instead of having full unlimited access to 4G, you get 2 GBs of 4G and the rest is 3G or worse... Worth a shot, I would still just make sure that you dispute it, too, just in case some kind of data follows you like in a credit check. I'm paranoid, though.

I used to roam a lot and never got a warning for that either. I don't use my phone for calling much tho.

I used 100 GB in a month when I worked in a Wimax area. I would say I use at least 10 GB every month tho.
I average between 18-25GB on my line. My wife a steady 17GB. The other lines about 14GB each. So quite a bit altogether. My all time high was traveling, 26GB.

Hey there, I just wanted you option on something. This guy post this thread about how it is BS that Sprint charges an extra $10 a month for the phone, about how Sprint is charging for the phone and not the service.

Here is what I think about the $10 extra a month:
Sprint charges $10 a month for 4G.. And if you think about it you are not losing totality. You may not have 4G yet in you area, I know in Felton, Delaware where I live there is not yet 4G. But for every $10 we put in extra every month... It helps them put up more 4G towers. And the more towers the better coverage we will get. I may be wrong, but you need to think about it from more of the positive side. And besides, When you bought the phone you knew there was a $10 a month extra charge. But you still bought it. Anyways. I want to know what you guys think about all of this.
If Sprint takes my 10 bucks/month and builds more 4G coverage, then so be it. Let those who want the service help pay for that service. The extra 10 hurts, I know as a grad student but if that money improves my 4G service then I will be happy.

Sprint has said many times over that the $10 is NOT for 4G but rather a surcharge for using the phone itself - in other words: hardware.
Even though I do agree the logical reason is for 4G. I just wished Sprint would come out and say this.

The problem is they can't say it is for 4G since everybody will not be able to access it.
Hardware is the thing that everybody will use...this way you don't get people complaining about the 4G fee when they don't have 4G. (legally, you are not allowed to charge for a service that is unavailable to a customer.)

That's for the Aircards, Over Drive and MiFi, not for the phone data usage.
Now check your data usage history for the last 6 months and compare them with your current usage (since the evo) and you will provably notice that you are using more data than before, I went from using about 1Gb per month to over 4 Gb this past month. Not sure if this is what Sprint calls Evo features but if the $10 is due to the increase on network load and it is going to give me a better network I'll pay with no problem, not to mention that I am paying $80 less per month for 3 lines than what I was paying with At&t for two lines and getting more.

Thank you for clearing that up. When thread was started about a month ago, dealing with this $10 fee, I mentioned that broadband cards are limited to 5 GB. If you can catch 4G on a broadband card, then it is unlimited. Trust me, I hit the 5 GB cap using a 3G broadband card

i had at&t previous to the evo and my 4g coverage in atlanta is not all that good. For daily use, i only get great 4g coverage at the office but i don't need it there as we have dual DS3's pipes. Its still the same thing as the placebo effect, we assume they will add more 3g/4g towers because we pay an extra $10/m. i don't expect them to add more 4g towers in atlanta before adding even one 4g tower in Orlando, fl. I also need them to add more cell towers so i can have better coverage with just 3g cell service...
I just checked Sprint and checked my roaming data 1.3 gigs, but then it wasn't in red, and it said 1.3gigs/Unlimited

That is incorrect!
They have the right to terminate/regulate/throttle your contract/usage/data, but if they cancel you, there is no ETF. I have spoken at length with several Sprint reps about this, and it is fact.
I have been concerned that they would try to cancel my contract because I have the PRL hack and have been over 12gb of roaming data for several months in a row now, since way before the Evo came out. But, they keep telling me it's okay. They even give me free bonus minutes for my trouble every time I call. The secret is to call it in yourself, and act like a concerned customer that just wants to know what to do, but be persistent, they will be more than helpful if you take this approach.

Also, they will give you warning before they cancel you. Remember, they want you to keep sending them money, and you wont be doing that if they cancel you. They will send out a warning letter asking you to change your usage pattern. If you don't change in the next month, then ur gone without any further notice.

I think we just stumbled across a fool proof way to get out of your contract without the etf. Just act like a data roaming fool for a few months to get them to take notice, then ignore the warning they send you and poof.....you're out of your contract the next month.

Problem with that is, it takes 3+ months for it to actually get to you. If you're lucky you will get it within the 3 months but most people get cancelled at month 6 - but it will definitely work if you do, do that.

Yeah, that's actually what I was trying to get out of talking to them. I finally got one the managers to confirm in writing that I would be able to opt out all 5 lines for free if they decided to cancel/suspend me. Just waiting for that letter but it never comes, been over 6 months of intentionally high data roaming. I run Pandora all day and stream netflix/hulu while tethered to 4g, and of coarse lots of mp3 downloads.

Never seen anyone get cancelled because of high data usage... this is for roaming calling usage. Right now you're just messing up everyone else's usage and giving Sprint a reason to cap their data

i dont know about the 5 year ban..but yes they kick you out if you use a looooot of roaming for 2-3 months
I remember seeing somewhere that if you use more than 50% of your data in roaming for 2 months they cancel your contract..no ETF
some get a letter, some dont.

Not sure, but you can easily leverage them into a free Airave CDMA hotspot. They overnighted me the hardware for free and it costs me no money per month. I have two Epics in the household and only had to speak to a couple of representatives to make it happen.
As a result my battery life at home is much better, and no more roaming.

Use the Verizon PRL. Roam Control will give you slow, 1x data. If you use the Verizon PRL hack, you'll get full 3G, which means you'll use data a LOT faster. The ban makes sense, but if you're leaving Sprint, why does it matter?
Also, they might take your phone number, but I'm sure they give you a warning beforehand to find another carrier, so you might be able to port it over, or at least to Google Voice first.

My buddy came from the middle of Minnesota and moved to Wisconsin in some area with no coverage andwas always roaming. They called him telling him that he was usng to much roaming, so he let them cancel it and went with a different carrier. He was happy though because he could not stand the battery on the epic, which I have haha. O well hope this helps!

It said exactly what a poster earlier said. If you use more than 50% of your data while roaming they reserve the right to terminate service on that line free of any ETF's. My wife called and said she was in college and we were helping her out by paying for her phone. Maybe that worked, I have no idea. Maybe they'll cut off her service today...honestly I hope they just leave it alone.

You're right, you are now because you're with another provider (and they all do except att that just doesn't have unlimited)
Sprint doesn't throttle phones.
I sort of want to be canceled because I want to switch to Verizon or AT&T.
I know how to do the Verizon prl. My question is, are they making you pay an ETF? And, if they cancel you, do the do anything with your ESN? Will I be able to sell my phone to cover the cost of a new phone on another provider?

Just a regular sprint one, I think I was on the 190.001 or whatever the number was. If that's not the one you were talking about either way I didnt do any of the semi-shady flashing anything to Verizon.

Unfortunately they dont make you pay an etf although they should make you pay extra for every KB of abuse.
Hopefully they lock down your esn so it can never be used again.
You want out of contract? Be a man and pay the etf.
No one made you sign the contract but you.

Maybe I wasn't being throttled. Up until 2 months ago when I was out of normal coverage I could still watch things on megavideo. Within the last 2 months all of the sudden I cant even get data coverage that is fast enough to sync my email without timing out. This area is covered with a Verizon 3G signal. This has happened with 2 different EVOs on stock ROMs and steel H rooted rom as well as myn's 2.2 RLS5 ROM

I know nobody made me sign the contract. I could pay the ETF. I just don't want to. That's the beauty of America. I don't have to do anything I don't want to, and there's a way around everything.

I think this isn't even remotely directed at me (I see who you quoted) but on the chance that it is... I wasn't doing any of that and am not under contract with Sprint and haven't been since December. Before I got my EVO and had a winmo phone my grandfathered SERO plan had a $5 option for data roaming while off the sprint network as long as it didn't go above a certain percentage of your usage, which it shouldnt have ever anyways because unless I'm snowboarding or exploring CO I'm not off Sprint coverage more than 2x a week

I'm going to bold what I'm about to say because you need to understand it.
This behavior right here, your behavior, is the PROBLEM.
It is EXACTLY WHY carriers get away with throttling and limiting and ****ing the customer.
It is EXACTLY WHY there is always a new law to bend people over even more.
You're not just ruining it for Sprint customers, you're ruining it for everyone in society and the day this is understood is the day we might actually be able to mature as a people.
Hey, I think you guys should lay off the guy. It wasn't his daily there was no Sprint coverage. And this is America, he has every right not having to pay an etf because Spring decides they've had enough. So bottom line, go troll somewhere else, this guy doesn't deserve it.

If Sprint stops providing coverage in your area then they have to waive your ETF and that is a separate issue.
However, if you sign up for Sprint and you use the coverage and then just decide you don't want it anymore and therefore are going to abuse your way out then you can honestly go jump off a bridge.

I see the news that Sprint is doing away with unlimited hotspot. I use the wifi tether app to provide a hotspot for my laptop in the field.
How can i see how much data I'm using while tethering?
I`m getting the itch more and more to go to Verizon. Sprint cell service is very spotty, there becoming more like the rest, and their 4G sucks and it will be another year and a half before we can see any change from them with LTE.
Would this change in the data be grounds for me to cancel due to change in the contract?

If you are rooted and using wifi tether, this "shouldn't" affect that, as that app makes it seems like its the phone using the data. What sprint is after is the people using the Sprint Hotspot app.

No, this does not change your contract. If you are already in contract, this doesn't affect you until you re-sign the contract.

You sound like a sprint employee. Sprint is a multi million dollar company they can afford it, also alot of us on sprint are getting screwed for having to pay for 4g when we can barely even get a 4g connection. Not to mention the crappy reception.

Oh bull****. Sprint tacks on an extra 10 (I think it's 20 now $) to own a 4g phone. Despite the vast majority paying have no access to 4g. Your comment is purely ignorant. How do you not recall this argument from 18mo ago? Are you new?

While capping data use on its 3G network to 3GB, 5GB, or 10GB per month, Sprint has continued to offer unlimited 4G service. Now, the cap for each of these plans will cover the subscriber's combined monthly data use on both 3G and 4G. All data use above the cap will cost 5 cents per megabyte.
The monthly allowance for data use while roaming on non-Sprint networks will be 100MB for the 3GB plan and 300MB for the other two plans, with each megabyte over those caps charged at 25 cents.
For Mobile Hotspot plans on phones, data usage will be capped at 5GB per month of either 3G or combined 3G/4G service, depending on whether the phone can use 4G. Use above that cap will be charged at 5 cents per megabyte. Those plans will have a 300MB monthly cap for data roaming.

Umm, do YOU remember the argument? It is WIDELY known the 10 dollar fee is for Premium Data, NOT just for 4g. EVERY smartphone has a 10 dollar fee now, not just 4g phones. So your argument that the 10 dollars is for 4g is stupid.
