Pretty interesting article. But I swear reading patent applications is a headache.

From what I have seen, while Apple seems to believe they control patents on such things as "rectangular smartphones with rounded corners", their competitors hold patents on REAL technology, such as LTE.
I have a feeling Apple is about to get the smackdown of the century.

Apple coming after HTC

Just saw this headline. I'm guessing it'll be multitouch related. Or maybe uni-body construction on the Legend? In any case, looks like it'll get ugly (especially if Google gets involved), though hopefully in the end some of their overly broad and generic patents will get invalidated.

He might be a genious but he's a scumbag and so is every one of his employees. I for one am sick of hearing about this company. They make crap products at way over the top prices. The iPhone revelotionized phones but if u think abut it, its 5 year old technology making it seem like its new. Its ridiculous, its an idiots phone.
I am curious to see if HTC is going to file a counter suit similar to Nokia's, Apple is a newcomer when it comes to cell phones. I am quite sure that HTC has plenty of patents that could be interpreted as being infringed upon by Apple.
I am just happy that these companies are helping to support lawyers during this slow economic time.
Of course, Why actually build a product that educated people can use? Apple wants drones of morons to use their products. Best way to steal HTC and Googles market share back? Offer a product we don't want and eliminate the chance of someone else competeing with a better product. Then we are forced into an Apple way of life. Locked in to no extendable memory, unreplaceable batteries, and no usable file structure.

I agree partly. I think Jobs should quit being a greedy ***** and be happy in being a leader and innovator of a piece of history. I guess the family of Henry Ford should start suing all of the other current car makers for producing a mobile vehicle with an engine, and then while he is at it he can sue everyone that uses a production line. Maybe the Wright brothers should sue all plane makers. I mean come on, move on and make something even more innovative Jobs if youre such a "genius"!

Sorry, but this is the whole point of writing patents. Make it as broad and generic as possible so you have a stronghold over your IP. You make more money that way ...
Its probably multi-touch related, which is what Apple's gone after everyone else for. They'll settle, and HTC will license Apple's patent and go about their business.

Now that I do agree with!
It amazes me that apple technology was so far ahead of the game that it has taken other companys this long to catch up with them! They are so used to being at the top when someone else comes along they get scared, and yes i would agree that it is greed, but they would not be where they are without said greed!
And no I am not an apple fanboy, I don't even own an apple product! I just have lots of respect for guys like Steve Jobs, and Bill Gates, they are innovators and do what needs to be done to stay that way! Anyone that can take a company like apple and turn it around like Steve Jobs is a stud in my book!

Agreed, it's a shame, over some small matters, how stupid, what is the world coming to, right's over "touch-use" what next? Just cos' his iPhone is losing money since the "Jailbreak", he's taking it out on HTC to bring his profit margin up, suck-ass!

You probably shouldn't fret too much. The pursuit of the patent protection is for patents registered with the USPTO. In the short term, it won't effect HTC, and certainly won't impact features/functionality in dispute anywhere except the US. Long term, it may kill off HTC if it starts dragging out while Apple bleed HTC in the courts (HTC sell more mobiles in the US market). Then it would impact us.
My big hope is that Palm, HTC and Nokia just clobber Apple with their patent portfolios and Google prop up HTC if it comes to that.

Short term, no, it probably won't be a big deal, but if HTC loses business in the US because of it, then that is a big deal in the long term. According to this NYT article (http://www.nytimes.com/2010/03/04/technology/04htc.html?ref=technology), about half of HTC's revenue comes from sales in the US.
And I agree, Apple's just being ridiculous! While I've never complained too much about them, as they do have a history of making good products (mostly), it's stupid things like this that just annoy consumers!
It is the latest in a series of legal wrangles involving Apple. Finnish phone giant Nokia sued Apple for patent infringement in October 2009, alleging it had stolen patented technology. In response, Apple countersued in December 2009, followed by a second round of legal action from Nokia. Apple is also being investigated by the ITC following a complaint by camera manufacturer Kodak. I do believe that the patents Apple speak off were registered in the US only. Patents have to be filed in each country individually. Europe / Aisia --- the rest of the world would never authorise patents like these. Brings me to think that apple has someone in the patent office who just lets them through.
So even if Apple won, the UK, and the rest of the world would be fine.

HTC is not that big, apple is way bigger. But google already said they would back-up HTC since the most patents are broken by google, and not only the htc sense interface.
This will probably be settled out court, if apple really wants to do damage to htc google will do the same to apple. And google is way bigger than apple.

Unfortunately, Apple has such enormous orders that if Samsung said FU, they'd be hurting themselves more than Apple. Apple could go to anyone and get what they need - hell, they could build their own fabs and do it themselves.
Jeez apple. They're not even THAT similar! The only similarity is the app drawer with the box around the icons! Big whoop!

That's cool. If Facebook can now redesign its own servers, Apple can make absolutely all its own phone and tablet components too. Meanwhile Samsung will supply all Apple's competitors and the Apple shareholders can ask Black Turtleneck God why cash reserves have dropped so precipitously so fast.
Apple is either going to have to sue everybody (oh wait, maybe they are) since all seem equally guilty to me for ripping them off, or actually try to compete through the innovation they're supposedly so good at.

I am going to have to disagree on that, while Apple has a tremendous amount of money at their disposal, they can't afford to go a year or two without making a phone/ipod while their factories are built. They rely on outside sources for pretty much everything, to attempt to become completely self reliant would be a bone-headed move and would absolutely kill their stocks.
They are not going to build their own factories...its VERY hard and expensive...most just buy the factories from others and recycle them. Most likely though Apple will just go with someone else in worst case senario..like LG, Sony, Toshiba etc..
Apple makes Samsung electronics biggest customer, a swap would hurt both of them tremendesly.
They are not going to split their business over this though...its far too insignificant...it might even be on purpose to have Samsung and Apple cross license each others patents and then let Apple have leverage over other Android makers...like M$ sued HTC that time..
Apple is a more innovative company than Samsung and everyone owes Apple a lot. There, I said it.
Now that I said it, the pathetic thing about this suit is that by the time Sammy has to pay up and/or dump Touchwiz--which they would do without many tears--and Apple has wasted its own time and money, iOS 7.0 will be out which will be holographic 3D scratch n sniff. ;-)
people seem to forget that apple used to use their own processors and switched over to intel only a few years ago. now they concentrate on being artists

Apple makes solid products, no doubt, and you definitely get what you pay for (albeit at a premium price), but I think they are going a little crazy lately. Couldn't have said it better myself. This just proves how much our patent system needs an overhaul because it is clearly being abused. It is no longer beneficial but harmful in that it is stifling innovation due to everybody being scared of being sued. I own and like certain Apple products (MacBook and iPod) but this is just ridiculous. I can honestly say I'm disgusted by this news and cannot see myself buying an Apple product again! Make your product better in order for it to compete more effectively instead of just trying to get rid of the competition. Screw you Apple!
That is why I sold my macbook and went back to Windows. Because they started being that way. I just hope HTC wins their appeal. I don't want to see them get their handsets baned. They make a quality product anand shouldn't be punished for it.

while I have to congratulate apple on their master troll award, they can suck a fat one, especially jobs... when they feel threatened they stoop to using patent law or design/hardware complaints to try and stifle competition

I don't know. They have sued almost every company that has anything to do with android or mobile devices that have android. Lets see. Samsung,HTC,Motorolla and Google just to name a few they have sued. I'm sure there is more but those I know of. Seems to me they are trying to kill off the competition.

I have to agree with this. I switched back to windows for all my computing needs and never looked back.
I feel like apple is a cult, once you are in they make you feel that you can never leave. I felt that way when buying my latest laptop, a custom built Maingear, but I honestly don't miss it at all. Not even sure why I bought my mac book in the first place.

It won't ever get that far. If apple really thought they could take down google they would be after them not HTC. They are just trying to chip away at some competition because they can't keep up with all of the manufacturers of smart phones running android (htc, motorola, samsung, sony, lg) they are one company going against many many companies. Its just like windows against osx. Only one company makes hardware for osx, but countless others make windows hardware. Why do you think they made it possible to run windows on a new mac? All of these companies should band together and just ***** slap apple. Apple- can't beat you fairly so we will just sue you into oblivion...used to love apple...**** you steve jobs!

this is ridiculous from both parties. they're just acting like a bunch of babies at this point. I was reading on fortune magazine over the weekend that judges are getting sick of this crap by both camps and are gonna be getting more likely to throw these cases out with prejudice. the previous judge that threw out the case of apple v motorola recently sets a pretty nice precedent for telling this two children to go play nice.

I completely agree with your viewpoint here, and i don't like to point fingers, but in this case Apple is at fault. Should Apple had let things be, and chosen to compete on advertising, features, and other commercial traits, this would not be happening. Instead, Apple has been filing one patent action after another, first holding up the evo 4g and replenishments of the htc one x, then achieving the recent injunction against the galaxy nexus. This forced Google's hand, as we can see above, to play the same dirty game in order to achieve leverage to halt Apple's anti-competitive behavior. Apple has to come to terms with the fact that real competition exists in the marketplace and that winning the fight has be accomplished on innovation, price, differentiation and other business factors outside of the courtroom.

IOS 6 is suppose to have features that have been exclusive to android like face unlock. So if Apple got an induction for the slide to unlock feature why couldn't Google get an induction against apple if they do release that feature in the next os.

To be fair, Apple launched the first nuke in this mutually assured destruction with the Galaxy Nexus ban.
Not going to happen for a few reasons:
1. The patent in dispute is based on a 3G standard that Motorola is letting many other companies use. This isn't like Apple's design patent suits. It is a standard, so all they likely need to do is work out a licensing deal.
2. There would be way too much backlash and public disapproval of such a decision.
3. Apple has way too many backers: Verizon, AT&T, Microsoft, the FTC, and Congress to name a few. That is A LOT of support.
4. Things usually tend to fall Apple's way. Whether it's bias, really good lawyers, or the result of being the most valuable company in the world, they seem to get their way more than they should.

Whatever dude. I think Google, Samsung and Motorola have been pretty frickin patient with Apple and their psychopathic former leader Steve Jobs (RIH). Especially considering the Apple you know today was all started from stealing from Xerox and then stealing from a whole industry only to turn around and claim it as their own.
I say we file a class action lawsuit against the patent offices who are giving Apple all these bull**** patents. Does the patent office really not give a damn who the technology belongs to? I really would like to see Apple come out with SOMETHING original.

They have been doing this for over a year, there's an apple fanboy I used to go to high school with on my Facebook and rants all the time about how Apple is taking action against Android for their "thievery" I lol'd then put him in his place by stating lock screen usage and notification drawer, which have been android for years!!! I pointed every little flaw in his arguement only for him to delete his status he made and remove from his friends. That's Apple fans for you. This will not end and will have little effect to any of us in the long run.

Here's why: Apple is the golden child of the good ol' Us of ****ing A, and the entire system is corrupt. How much would you like to bet that the judge who placed the GNexus ban is getting some sort of payout or campaign contribution. Apple will win because apple has the deepest pockets. They have a great legal team, and have the best marketing team on the planet. I personally see them as a threat to all technology, as I fear they're going to use patents to kill innovation.

Patents are fine, but you can't say someone is stealing from you, when they take your idea and throw in some new ideas/inventions. You patented something specific. You didn't patent something square and is a phone.
What is annoying to me is for a couple of years now the courts have ruled for Apple. But now when people start suing Apple, their reply is "im sick of this."
Why couldn't you have said that from the beginning? To me it seems that Apple has all the control with it's lawsuits.
Well, Apple is the US company being judged by US courts, at least vs Samsung. Let's see what happens with Google.

I'm fairly certain judge Koh or whatever her name is got bribed, the case she's handling had till recently, based on her comments not been going Apple's way, including not allowing a ban on the SGS3 to go through, and then suddenly she changes her mind? Not likely at all, the law has been generally against Apple from day one, nothing has changed law wise for this sudden turn around.
AND her turnaround comes way too close after Judge Posner's ruling that injunction's are not to be used as punishment and to stop competition
BGR is the worst place to get Android/Google news. It is run by a bunch of Apple fan boys, so of course they are going to over speculate the situation. Go to a reliable source like Engadget or Phonedog.

she didn't change her mind because she was bribed. she changed her mind because initially she didn't find apples argument for unified search to be reasonable to warrant a patent so she threw out the case but not without prejudice. then apple appealed the case to a higher court. the appeals court found apples argument to be justified in the unified search patent and Judge Koh was ordered by the federal appeals court to retake the case and find a decision. she was not allowed to revisit the issue if the patent was legitimate or not, the higher court had made that decision for her. so she had to work on what she was given, and under the assumptions that she was ordered to accept from the higher court, lead to the conclusion of the injunctions. Judges make bad decisions and good decisions, they're just human beings. Ultimately though they make decisions based on the law and orders from above, not what is right or wrong. The problem here is not the Judges, it's a combination of Samsung's God awful legal team, Apples abuse of the patent system, the failure of the patent system in technology and our austerity mindset with regards to budget cuts for the patent office.
its a bit retarded that apple has to stop any phone that will be better than theirs
