Agreed with knutars. Ebay can be a mess if you don't know its rules. If buyer received what was shown and described on listing then he is stuck with it. So don't worry if you did not mention the box was not included.

Exactly as the others said. Wasn't mentioned, so it isn't required. That's the way eBay will see it too, if he does submit negative feedback and such. Not to mention the fact that i've yet to see an eBay auction where you aren't capable of asking the seller a question. It was his own assumption that the box was provided. You're not in the wrong in any way, and he's just trying to get some money out of you.

If I remember correctly, the box has a sticker with the phone's IMEI, MEID, S/N and other phone specific info. So, i don't know if someone else's box will solve your problems.
But yeah, like others said, if the box wasn't mentioned in the auction description and especially if your item was listed as "returns not accepted". Then there's nothing he can complain about.

Can still post a comment about the negative feedback, making him look like a moron. I mean seriously.... he wants you to pay HIM an extra $40 to send the phone back to you.... i'm assuming on top of what he already paid for the phone? That just sounds like a scam to me. And who's to say you'd actually get the phone back. For all you know he'd send you a rock, or a broken phone, and you'd probably wind up SoL.

I ordered a Galaxy Note GT-N7000 (i9220) from 1saleaday.com on 03/15/12, and finally received the shipment yesterday (03/28/12). When I opened the shipping container, I discovered an unsealed Galaxy Note box (These were sold as BNIB) that contained all of the accessories, but no Galaxy Note. I have been in constant contact with them the last two days, at which point they tried to persuade me into purchasing today's deal on the Note, at which point they would refund my money and cancel my previous order. Unwilling to do this, because I am already out $584, and was not prepared to throw good money after bad to a company that does not even have a customer service phone number, I was finally informed at the end of their business day today (4:30 PM EDT) that I would NOT be receiving a refund, after all. You see, apparently I am not alone in this, and rather than them take care of the customers who have already tied money up in their shady venture, they now want to do an "investigation" into how widespread this may be. I signed a sworn affidavit attesting to the fact that I did not receive the phone, just the box and accessories, yet they still refuse to refund my money or send me the phone. I do not believe they do this to everyone, but I think they selectively choose random customers here and there when they think they can get away with committing fraud. So, consider this a heads up that doing business with these losers can leave you without the item you paid for or the money you used to pay for it.

I have gotten a tentative refund from my credit card company, but this could easily devolve into a "he said, she said" mess, which I want to avoid. What I do not want to avoid is publicly defecating on their business name, which I am in the process of doing across the internet.
I bought a motorola Atrix lapdock from them a couple of week ago. Finally got it 3 and1/2 Weeks later. It was a b#$&h trying to communicate with them. It was only $55 but I was that close to calling my credit card company and filling a claim to get my money back. that's the first and last time I'm buying anything from 1 sale. Might be a good idea to call your credit card up and see what your options are.

Exactly. I'm no fan of 1Sale either, but they can't just issue such a large refund immediately. If I were in charge, I'd want to investigate this claim as well.
Their internal investigation is of no consequence to me. They asked me to just sign an affidavit so they could issue the refund, I did so, and the minute I told them I was not interested in buying today's special, they changed their tune. Either state that I am getting it, dependent on some conditions, or tell me they need to look into the matter further.

+1 for sure, I always set up my tripod and camera before I open the package, even if I'm super excited to get it. I've gotten a box of CD's and a few rocks instead of an XBOX on Ebay. I'll never make that mistake again.
I had an interesting experience with them as well when I was in the market for a 2nd computer to do some dev work on. Received the computer that I purchased from them and it had a bad power supply. Argued with them and it took 3 weeks after receiving the computer for them to issue me an RA and return shipping label, then another 3 weeks to get my refund.
I ordered 3 htc Evo views from them all came flawless. Also ordered 32gb cards a bunch of other things from then with no issues. Hope everything works out in your favor...

This thread should be locked. The merchant is very reputable and who tells us you didnt just tale the device sell it in the blackmarket. Ive never had problems with them and they dont care about stealing a $550 device+they have sold almost 1000galaxy notes nobody has complained

Those symbolise the various builds of nexii, everything except Yakju gets updates from samsung and have some minor changes
I see. How is one supposed to know which phone is which? Does it say on the box?
There are reviewers saying the one from Newegg is a Yakju build.
Also, that a few of them have arrived already opened and seemingly used (no introductory sign-in screen).
Makes me a little wary...

You are welcome. You want yakyu as it is the build that gets the updates first and directly from Google. If your device didn't come with yakyu, you can use the Galaxy Nexus Toolkit from this site to put yakyu on it quite easily. Having said that, the average person will not notice the difference between yakyu and other builds.

You can install an app that will tell you the build info. It will not say it on the box and if you ask the seller, they will likely not know or provide incorrect info.
People on XDA prefer yakyu. Everyone else doesn't care and yakyuxw is not per se bad. Having said that, people on XDA also don't care what it comes with as they can just install yakyu using the Galaxy Nexus Toolkit.

I'd say the most reputable phone stores are negri and expansys. Amazon and newegg are good as well, but those are the top 2 as far as phones go.

I got mine from handcent and it got to me in 2 days from the uk with free shipping
How does the manufacturers warranty from Samsung come into play with these phones being brought from on-line retailers? Is it an American warranty or does it have to be shipped overseas for unforeseen problems?

Ok so I ordered the Nexus 4 about two weeks ago. I have been so excited to get it and I literally just got it about an hour ago. Now something crazy has happened. About 30 mins after UPS dropped off my phone UPS came back with another package. The package looked exactly the same as the first package he dropped off and I was like WTF??
I opened the box and behold it was another Nexus 4. At this point I am all like WTF google better not have charged me twice. I ran to my computer and checked my bank account. They only charged me for one phone. I went to the google play store to check my transaction history and it also said that I only purchased one. I opened the package and looked at the invoice. Both packing slips have the same order number on them. I think Google actually messed up and sent me two Nexus 4s for the price of one.
Has this happened to anyone else? Should I be worried? Should I do the honest thing and send it back or just accept this as a Christmas Gift from Google? I would love to give this second phone to my sister for Christmas. What do you guys think?

Yes. If they charged you for one phone and mistakenly sent you two it's theft. I would contact them and let then know if I was you. They may give you some sort of a deal for being an honest person... Even if they don't, you can offer to pay for it and won't have to wait for shipping. Just my 2 cents

It certainly is theft. You are in possession of property that you didn't pay for and was clearly shipped to you in error. nbebbe42 is correct, contact Google and have it returned... just make sure they pay for the shipping.
There's an FTC rule that essentially deems all unrequested merchandise a gift and therefore an individual or company who ships something to someone by mistake has no recourse in recovering said merchandise.
Like I said, legally right, ethically wrong.
I was all ready to tell you to keep it but after reading these posts I thought how I would feel and I've always returned stuff that wasn't mine. I certainly wouldn't think of it as stealing though, I guess you just have to decide.

Legally speaking you are a %100 to do with it what you will, AS long as your name is on both shipping receipts. Ethically speaking by returning it you would put people through the hassle of getting it shipped back putting it back in the system and also risk the employment of whoever made the error.
If you think about it the amount of man hours to deal with these slip ups usually out cost the actual product being returned. I'd say make someone you love have an even better Christmas/Hanukkah or whatever you celebrate

You should do the right thing and call Google about it. See if they hook you up, give you a nice discount or something. At the end of day if you don't call you will be a thief. You should also consider giving it to a Dev at retail if Google will you let keep it. Development is slow.

Someone lost it and you happen to stumble upon by accident.
Now you could turn the phone in to the authorities like a good man and maybe Santa will have something bigger in store for you this Christmas.
Or you could keep it like any normal person would do.
If you keep it however, they could trace it back to you (your signature receiving the order)
Likely scenario, someone messed up the order and the phone was sent to you. Whoever was supposed to receive the phone will not receive it, and will file a "lost/stolen" with Google and they will ship another one to them as an apology.
It isn't stealing because you didn't take it, it shipped to you

If I were you, I'd make sure the one I opened doesn't have the hardware problem where the earpiece constantly makes static/electronic noise even when the screen is off. cause that affected many phones. If it does have that problem, I'd send THAT one back to goog

Yes and No about that. I've been using eBay for over 8 years. I use it pretty much daily lol.
If it is in the US, they will give you a free return label to ship it back.
If it's in another country, you have to pay out of pocket and it must have a tracking number. To ship it with a tracking number (a must to have since they have to see it is delivered), it will be well over $30 (if I'm not mistaken) to ship it to China.

I saw one negative feedback on the seller feedback, saying that it is scam this SD card, well I think It does, I guess we have the same tracking number, it shows nothing on the website.

Storage can be altered to show wrong size. You won't know until after you exceed the space and try to use it. I'm willing to bet most feedback was left after a quick check.

The wait is over! Ebay has finally shut this guys account down. I contacted paypal (I paid as a paypal guest account) they informed me since I paid as a guest there was nothing they could do to recover my funds. So I am contacting my visa card to get this refunded. I will never do this again. I figure this guy is laying on some nice beach in china drinking a margarita with some girls, telling them about the chumps he has worked lately.
Got my note Wednesday and another showed up today. Looked at my bank account and I've only been charged for one. Same order number on the invoice and everything. I did email them. Hopefully they'll reward my honesty. Do you guys think they would've ever known if I didn't say anything?
My friend once got two LCD televisions, but ordered only one.
He never said a word about it to the company where he ordered those. He still got them and never heard anything from the company.

I seriously doubt they would have ever noticed if you had not said something. Sounds like someone forgot to mark the order a fulfilled or shipped.

What if you kept it and they found there error in a month, you sold it or gave it to someone and now the want it back.

Your most likely right but @supremekizzle did the right thing.
legally they can't do anything. shipping something to someone is concidered a gift if you didn't authorize the purchase.
reap/sow/comes around crap... things don't come ariund they just keep going. and whose to say what's just happened isn't a reaping.
Definitely kudos for keeping it honest in a sea of immorality....

Yeah, but in all likelyhood if I would've kept it they would've found out anyway. The funny thing is, it originally was shipped with UPS shurepost which I upgragged to UPS ground. The second one I got was also upgrated automatically. So I wonder if they shipped it out using the exact same shipping label. Maybe they would've never found out after all. But it'd be a ****ty thing for me to do to keep it

We got once two cupboards... and at this time it was legal to keep them (in Germany) without informing the seller. Only when they ask I have to say that I got two. When I remember correctly then after 2 year they both were mine (before I was only nicely to store the second one

Man screw that. I wouldnt have said a word... Karma doesnt affect business deals, only when you screw over a person.
I had a similiar issue with a Nexus 10. I had to exchange it so Google sent me an RMA, i sent it back and they said they never got it yet they sent me a new one when they were in stock.
Then refunded my money. So in essence, I got free Nexus 10 Tablet form Google.
The same people that hoard our data and then sell it without our knowledge or TRUE consent (yeah, Samsung does it too!) dont deserve the same rights that the shop keep down the street from me deserves.
OP you wasted your time emailing. They gifted you a tablet. Were were you when I was struggling for donations to buy mine? lol

I'm not a huge believer in karma. At all, actually. I was worried more about them coming back at me asking for the money to pay for it months later. Maybe they would've never found out, maybe not. I will never know for sure now...

I'm not sure that's true. Zavvi sent out PS Vita's by accident to customers and made a legal case out of it. AFAIK, they were actually backed up by UK law. That said, I'm sure it's entirely a country dependant thing.
Well letting them know saves you from worrying I guess.
