New evidence against Google's willful violation of rights of use of Java and Oracle
At the main competitor to Apple in the mobile platforms serious problems - found new critical evidence of guilt Google intentionally unlawful use of Java technology in the development of Android. In addition to the risk of losing the case, Google could face difficulties protecting patents from charges Android Apple and other competitors.

According to Florian Mueller (Florian Mueller) from FOSS Patents, evidence was obtained from the two emails, one of them is sent to the head of Andy Rubin, Google (Andy Rubin), the principal founder of the project Android, who later became a popular mobile platform Google.
At first Rubin (Rubin) came up with Danger - PDA with a mobile platform based on Java, then he started to work on Android (before he became part of Google) - and the Android platform has not been entirely based on Java, and was a modified version of software is modified enough to make Google free of patent claims Sun and paying any licensing fees.
Andy Rubin (Andy Rubin) - the openness of
Even back in 2005, before the release of Android, Rubin (Rubin) wrote:
"If the Sun refuses to work with us, we will have to choose: 1) abandon our findings and move to the use of languages MSFT CLR VM and C #; 2) in spite of all use Java, and be prepared to defend its decision against its enemies, which may occur on our way ".
Referring to this letter, Müller (Mueller) notes the view of the judges on this subject:
«Google judged simply and unceremoniously, preferring to risk the possible start of litigation than fair to pay for licensing Java».
In a letter to Rubin (Rubin) clearly says that Android team is fully aware of the size of attachments to the platform on Java-based resources and effort, and believes that this was too much to move now to the alternative language proposed by Microsoft. However, Google does not agree to pay for the licensing of Sun Java, and, judging by the comments Rubin (Rubin), his company is going to just keep working and wait for developments, inviting the "enemies" to give adequate legal battle.
We need licensing negotiations Java»
A second email was written almost five after the first-mentioned, it is known as "draft Lindholm (Lindholm)». Here is a quote from the letter:
"So, what we really were invited to do [the founders of Google] Larry Page (Larry Page) and Sergey Brin (Sergey Brin), a study of alternatives to Java for Android and Chrome. We went through a lot of options, but none we could not find suitable. As a result, we believe that we must begin negotiations on licensing of Java on favorable terms to us. "
In response to this letter, the judge Elsap (Alsup), according to Florian (Florian), stated that
"Good counsel from Oracle will need this document (the draft of the letter) and the Magna Carta, to win the case and found that Google intentionally violates the rights of Oracle».
Google also has publicly accused the Oracle (the company that now owns the patent rights of Sun's Java), as well as Apple and Microsoft, «in the conduct of deliberate hostile campaign against the Android ... using bogus patents," without saying a word about whether the creators of Android by law to license the use of Java, or will they continue to deliberately refuse to do so.
Google tried to make this letter did not appear in the case against Oracle, claiming that the message Lindholm (Lindholm) is protected by law secret (the right to counsel not to disclose information received from the client). But the judge Elsap (Alsup) requirement rejected Google, noting that this "is not a full draft by e-mail," and that he had no one was sent. Then there was detailed in a Bloomberg article on the subject, and when Bloomberg asked for comments on Google, a company spokesman Kathleen Todhunter - Gerberg (Katelin Todhunter-Gerberg) said the refusal to comment on this question.
If Google would be guilty of a willful violation, Apple and others will be easier to sue him for Android
We can assume that Oracle is unlikely to get from Google's $ 2.6 billion in compensation for damages for unlawful use of Java in Android, and total control is likely to be reduced to the possibility of a settlement in principle, not to prove guilt Google Android for the use of Java .
The consequences of the settlement will be far more serious than paying royalties Android company Oracle, which, like Microsoft, is now far behind Google in terms of popularity of mobile platforms on the background of Android, located in the public domain. As the first of all developed mobile platform, Oracle Java (which is still licensed by Nokia Symbian and RIM BlackBerry) was in third place after the Android (on all producers devaysov total) and Apple iOS.
The judge, a leading cause Oracle, the plaintiff asked to rewrite the action in the damage to a portion thereof. But the argument about the independence of the Google of its revenues from advertising to business of Oracle and the calculation of the amount of damages the court disagreed. Instead, the judge accepted the arguments of Oracle's "theory of network effects" and said that Oracle may, in its assessment of damages to take into account some of the activities of the defendant in the U.S., non-mobile business.
Outcome of cases with guilty pleas Google's use of Java enables Oracle to punish the defendant three times. First, Oracle itself will receive its compensation, and secondly, competitors, Apple and Microsoft in particular, it will be easier to deal with search engine to prove infringement of its patent rights by the defendant, who had already been found guilty of willful violation of intellectual property, and, third, Android licensees also have the potential to fall under the same legal fire.
A few more reasons for headaches Google
Huge profits from the Internet - will allow Google ads without much effort to repay the court costs and to pay such compensation, but Android licensees may want to stop using "open" Google's software because of legal liability, which is fraught with such use.
Because Google itself to avoid any royalties, Microsoft and Oracle, then the licensees may fail to see Android in the use of Google mobile platform version of Linux / Java / Flash any advantage. Then it is logical to assume that they decide to do a better design your own unique software, as is already done Samsung (working with Bada), as HP's webOS, such as Nokia, in collaboration with Microsoft, and Motorola as its Linux.
Market introduction of many different mobile platforms will be on hand to Apple, which always showed the best results in a competitive market struggle than the struggle with one big monopoly platform. In addition, the legal dispute resolved against the Android, the platform will provide a great advantage alliance Nokia and Microsoft, as well as strengthen the position of Oracle with its JavaME. But, of course, the impact of Android in the first place, will open huge opportunities for Apple, which has now gone far ahead of Nokia, RIM, HP / Palm, and Microsoft.
A similar situation occurred with BSD Unix in the early 1990s - tyh, while the legal issues have helped Linux to get ahead - this platform has a good head start before the BSD, which for several years, nearly forgotten, and only in the last 5 years, Apple, entrenched in the electronics market itself, BSD Unix back in popularity.
The date of the final trial of Oracle against Google is scheduled on October 31, the companies still have time to negotiate. But it is doubtful whether Oracle wants to surrender and to reduce the amount of compensation to claim. In addition, Oracle may continue the judicial struggle with Google to solve ITC, and to ban imports of U.S. mobile devices based on Android, which will be further development in the mobile market, Google devastating.
Wasn't the actual problem that they found these patent issues and asked Sun to clarify them but Sun took no action and left the issue in the middle?

Here's a quick summary of what's going on. The main issue here is that Oracle used to be on the other side but now started agressively attack OS projects since it aqcuired Sun.
http://www.engadget.com/2010/10/05/google-responds-to-oracles-android-patent-lawsuit-we-break-it/
Google knew, and also admitted to knowing, about the licensing issues but because they had faith in Sun they pushed forward, never ever imagening Oracle would turn on them so quickly.
I am deadly sure that Google will stand out to protect their Android partners.

From: Pocket PC Live! [[email protected]]
ATTN: Piracy users
It has come to our attention that our software has been cracked just like every other software. We take this issues very seriously.
If you are NOT using the pirated version, you can skip this mail to save your time. or if you want to know more about our brains, keep reading..
We are teaming up with many developers to implement a module in our softwares that will cross check our applications for pirated versions in your device. For example: Software1 checks for Software2' pirated version and for exchange software2 checks for software1. If a pirated version has been detected, the module will force the device to Bootloader mode and makes it not to return for ever! We have made it in a way that the module functions in a separate thread and so there will be no slow-ing of device during the check process and the complete check process takes just less than 2 secs benchmarked on a standard 416Mhz Intel Xscale processor. This check might also be skipped as well by the crackers, but they first need to know which application checks for which and unfortunately those details will definitely be kept confidential by us(developers).
SO if you are using pirated versions, delete them before you loose your $400 device on spaing a few 10$. we will not be responsible if the device gets forced to Bootloader and turned to a heavy brick! You cannot even re-flash the device We have taken every step in the module to not disturb the safe versions and detect the pirated versions alone perfectly! Its rather a simple and easy process though.
This technology has been developed by CartyStudios, Inc. and is getting good view and publicity for us among the developer's world. Very soon every software going to implement this modules of exchange check technology. Pirated users, face the end very soon!

Sounds awesome.
I can't wait to sue them like how Sony was sued over their DRM/CD fiasco that could "crash" a computer.
Ah, it's great to be an American. We'll sue everyone. lol
this is _INSANITY_
No developer in their right mind would do something like that.
1. this is illegal to do.
2. what if the software error occured and someone got into this trouble by mistake in software/ error/ etc
3. people who use pirated software would never buy legitimate copy anyway. so they are immediatelly discounted.
4. one should understand that if developer is ready to destroy someone's property to protect his own copyrighted material, deserves the worst. bottom line is: this is not likely to be the case.

Gee, wonder what will become of the world, if everyone starts taking justice into their own hands.
Sounds like a scare tactic.. they would get sued pretty fast. What if it wrongly detects a pirated copy? There was a developer who did something like this before, and he was stopped pretty fast.
Maybe in Europe or America, where most of the people using Original software...but not in Thailand/indonesia/and china , where 70% people still using pirated software.. :
BTW no offense to ppl who are staying there, i just pointing to BSA finding ....
thanks
I think the whole announcement is strange:
1) If you do go to such length to protect your software, why would you want to tell the whole world how you do it. For a good hacker the knowledge that the protection runs in different thread and messes with the device is sufficient to find and crack it, and the fact that different software check each other doesn't matter. (Just another clue what to look for).
2) This would be useless if someone uses only one pirated software. Who will check it?
3) This is next to impossible to implement. To prevent reflashing you need to corrupt the bootloader and this is different for every device. Still, theoretically possible but this is more work than MS puts in to windows protection (and for a 10$ piece of software???)
4) If I were considering buying their product I definitely wouldn't after reading this announcement. What user in their right mind would pay for something that due to an error could kill his device?
No I am not in support of piracy, and I think that anyone who uses cracked software basically makes a choice to risk destruction of his equipment be it from viruses or protection module.
Any way I suspect they dug their own whole with this so if this is true it won't be around for long.
It's impossible they think all this seriously. They will get sued really hard.
See the following three threads on a simlar case:

The degree of piracy protection depends on the amount of work the author puts in or on his intelligence. Resorting to this just shows a lack in one of those areas.
Great, a breakdown handphone is a good excuse to buy another new phone! ;-)
This will get those guys to be sue if their software has bug especially those without warning on their web and during installation (legally the developers must provide warning) especially in Europe & US. They will be sue to their pants drop. The developers will pay a bomb for the protection technology and collect peanuts from their software (as no body will buy) and pay hell of legal fee when sue. Commercially does not sounds good.
Of course piracy is wrong.
I think a better way is to just delete the pirated software used, not the whole PPC software. This will be Win-Win situation and commercially more feasible. Delete the whole PPC software is action same as people who writes Virus, exactly no difference.
A good example is one of my Legal software, which on the web say able to upgrade with the old Code, but unfortunately when my Code is keyed, it still say "Unregistered Version". A quick check via email with their technical support, the same answer that I old version code can be used. Conclusion is I give up the new version and reverse back to my old version.
My 2 cents worth.
I have heard that law enforcement agencies have teamed up with car manufacturers. The built in GPS devices of new cars will autocheck your speed according to TeleAtlas maps and if you exceed the speed limit by more than 10%, the car will selfdestruct. No need to complain about your car being destroyed, because you brought it upon yourself by speeding!
What a bunch of... Don't believe that mail, some jokester is just having a bit of fun, that's all
i think this has just happened due to their software(UTA3) nowadays cracked
it seems like they are trying to make people afraid of
This is bollocks. Carty's software is freely available on IRC.
But every programmer that makes software has to be live to the fact that if it can be run on a CPU, it can be disassembled. If it can be disassembled, it can be reversed.
If any manufacturer warns you that they'll trash your hardware because of piracy, I'll show them the laws of trespass, tort, criminal damage and the various laws enthusiastically enacted across the globe to prevent malicious hacking and criminal damage, even if it is committed by self-appointed vigilante software manufacturers. Patent pending or no.
Class actions a-hoy boys . I'll happily take on your case.

Yeah total BS.
I keep hearing "piracy is wrong". I just don't belive that. If I was born eating fruit and living in trees I would knock the next monkey over to get the bannana - I was however born into this high tech world where certain tools and information are just as important. Any person smart enough to obtain what they need should do so, its up to the vendor to either prevent it in code or make the product less attractive to hack because of demos, basic versions or versions with some disabled functionality being freely available.
Even if it is moraly wrong, piracy can't be beat. There are millions of geeks/programmers around the world with too much time on their hands and the desire to hack and share.
lol.. monkeys and bannanas.. ROFL
No Comment!!!
Lol
I assume this message alone could ruin their business seriously. As they started developing on a magician they might found out a way to destroy the bootloader & maybe from some other devices. But why would I want to install software with such a risk of malfunction anyway, if it were true? To hard-reset it when some thief puts in a different sim as mine?
Maybe we find out the truth about this in the near future, but in the mean time I take pity on them
You know, this thread reminded me of an old Russian saying. It is roughly translated like this:
"Locks are for honest people.", meaning there is nothing that can't be cracked / hacked / broken in to.
levenum, very smart sayng
According to tweakers.net (dutch), a very popular and more important, trustworthy Dutch IT website.
XDA-Developers (And thus also Duttythroy.net) breaches intellectual property laws regarding ROM Cooking.
However Microsoft and HTC both agree "We can't live with 'em and we can't live without 'em."
Microsoft will not send take down orders to sites such as XDA-Developers, who offer customized ROMs for windows-mobile telephone.
Some sites offering ROMs based on Windows Mobile 6.5 got take down orders last week. They, However, appeared to be hoax.
“Taking action against sites such as XDA-Developers isn’t a matter of concern for Microsoft” says Maarten Sonneveld of Microsoft Netherlands against tweakers.net. “What happens there, the modifying of ROMs, is illegal. The intellectual property however is not with us. The ROMs are intellectual property of the producers of the phone or the mobile phone providers if it concerns branded telephones. We simple only deliver the OS.”
The biggest producer of Windows Mobile-phones, HTC, also says they don’t have any plans to take action against ROM sites. “What happens there isn’t allowed” says HTC Benelux-CEO Mark Moons,
“But XDA-Developers is the biggest and most active community of Windows Mobile-developers. We can’t live with ‘em and we can’t live without ‘em.”
Last week it seemed there were to come an end to tolerating Windows Mobile-communities.
A certain ‘James Young’ sent emails on behalf of Microsoft to site managers in which he stated that they were sharing illegal content, and summoned them to stop their practices; some site managers, in fact, did this.
It mostly concerned ROMs with betas of Windows Mobile 6.5, the update of Microsoft’s Mobile OS that should appear this summer.
The email of Young appeared, however, to be a hoax.
Microsoft denied against XDA-Developers that the summoning came from them, they also say that the email address is incorrect and that summons such as these always are sent by written letters instead of email. Not so long ago someone with the exact same email address and name sent the same kind of emails to sites that, according to him, placed illegal content for the Xbox. The Pirate Bay also received a message by ‘James Young’ in the past.
Aside from this: a funny fact is that recently Arne, when he still was on our team, contacted Microsoft and HTC concerning this very issue as we were wondering the legal status of sharing ROMs.
He however didn't receive any clear answer even though he called a zillion times and emailed to infinity, twice.
source: translated with google
so, HTC and Microsoft have acknowledged that they can't really stop us as that would pretty much halt independent development for Windows Mobile... i'd say that's a good thing
disillusionment
really microsoft is big company, but in this behaviors it will be smallest in eyes of thier system users and developers.
So small comment to microsoft (go to hell) u did not stop the developing & progression in the world.
Commercial facts
As I understand the info shared by Nemonique...
The matter of bann this develops... is concerned by the brand... but... this makes people buy devices... cause at last... the business is sell devices.. no matter if it has the shipped version X.XXXXXXXXXXXXX or the Last upgrade Y:YYYYYYYYYYYYYYY, it does´t matter they buy the OS original and upload to their devices... the upgrading modding and sharing is responsability of the user... they lost his warranty by unlocking... the business is to sell devices.
I think this ends on summer... so... provide links here is risky... pirate bay has almost closed cause the GUB on swed has told them "if you search on that site we bann you from Internet providers..." so the user at the end is the responsable.

In other words: They're not going to do anything since any Action against this site will seriously harm the Windows Mobile Community.

So, being this said, why not remove the fake email's posted on Sun_Dream's thread, and perhaps, if there is a way, restore all the info that was deleted, to show appreciation for his work. I think that would be the best way to apologize for the action taken(which at the time was justified based on the unknown/unconfirmed veracity of those emails, and as a precaution to protect XDA), and welcome back Sun_Dream.(not that he was banned, but we all know how uncomfortable he must have felt.
Well i want just to comment the legitimacy of rom modifying. It is illegal but noone cares. Microsoft cares about leaked betas but not too much as you see - they can afford few leaks here and there, but they can not afford to loose such large community of beta tersters and developers (a massive feedback for roms and devices) - and it is for free for them so thats why they do not care. Microsoft takes money for licensing their mobile OS to OEM manifacturers and Operators. One as these OEM manifacturers is HTC, their reason to not care is that forums like xda-developers makes them popular - free advertising - if they cut the rom upgrades and ban rom cooking they risk bad advertising and sales drop, why they should loose money instead of making them ?! Also some other phone manifacturers have turned to WM - SonyEricsson, Samsung (with OMNIA series, the other ones were crap) they feel whats happening and they want a piece of the pie . Why mobile operators do not care ? Well they buy some licenses for their branded devices and in most cases the mnifacturer makes the rom and the operator makes the customization. No one takes measures because in the long run it will harm their profits.
Someone may ask: Why it is illegal i have license for my device? - The license is for one and only one version of Windows mobile + upgrades of the same version. You may upgrade to new WM major version only if your OEM or Operator offer you a upgrade.
So we @ xda-developers make things which operators and OEMs will not do, this makes people happy and Microsoft is happy because of rapid growing popularity of windows mobile (more popularity = more profits), OEM's are happy about the popularity of their devices so everyone is happy
I am really sleepy so please excuse me if i have any typos or misstakes
So, I guess this infamous internet investigator was a hoax after all, huh? I guess it did sound a little far fetched that M$ would hire someone and would give him/her a dumbas$ title like that.
In any case, I completely agree with xplode's statement. M$ doesn't necessarily make much advertising on their WM platforms and equipment manufacturers don't spend that much money on advertising their stuff either. In fact, HTC is just beginning to have some sort of advertising (public kind like TV commercials and such) in the US. I gotta be honest, if it wasn't for this site, I would not know that HTC ever made anything beyond the Wallaby, which BTW I didn't know was manufactured by HTC until I nearly bricked it and found this site.
Just think about this for a second. Think about the number and size of forums and blogs dedicated to WM vs iPhone, Symbian, and BlackBerry. And now compare that to the money spent in advertising of the same devices. More than likely, Apple would top the charts in spending since everyone out there was literally brainwashed by the iPhone's outstanding marketing campaign. The Blackberry has always been out there somewhat competing with WM, but due to the lack of interest of freelance developers out there for these devices, they have had to dump big chunks of cash into advertising.
To put things more into perspective, think about how the announcements by HTC show up in this site right after being made by them. Normally, within a few hours the WM communities will get winds of new devices coming this way... which is, for lack of a better term, free advertising. They create a big expectation among seasoned users and new comers alike. Some of them, even willing to dump large sums of money on the new devices even though theirs are only a few months old. For this same reason, (and once again, I agree with xplode) shutting us (and other communities down) would be like cutting an arm. Plus, they don't pay us, so what's the harm?
Aside from all that, M$ understand that not everyone will have money to upgrade devices as they are released, but if the customer is kept happy, he/she is more likely to be a returning customer when his/her situation allows. So, let them keep their betas and their leaks.
All in all, kudos to M$ and HTC for understanding our role in this game. And as far as James "Jacka$$" Young, go kill yourself... you and people like you are the reason why the internet has a bad rep these days.

Htc must release the source in a timely matter, not just for us, but all devices out, and future ones coming. The best way to do this imo is not to start a big fire and smoke them out per say, but to go though proper channels. Obviously emailing them is having no effect, 120 days is not timely, I mean in 120 days this device will be outdated technically.
Imo this is the proper channel: http://gpl-violations.org/faq/violation-faq.html
Go there, read their page and then email them. Here is the letter I sent to the. Subject, "htc again, this time the vision" :

As I'm sure your aware from other devices they released, ie desire, they are not releasing kernel source codes in a timely manner. In the case of the desire it has been over 3 months and to my knowledge is still not released, however my complaint today is about the htc vision, known in the usa as the G2. This product was offically released on oct. 6 2010, with no source code available. When contacted about it, they said it will be 90-120 days before its available. Maybe I'm wrong, but as my interpertations of the gpl this is unacceptable. Since the product is commerically available, then surely the source code is, and just being held back purposely.
Thank you for your help!

No offense, but perhaps you should have someone proofread your letter first. There are a number of grammatical errors in there. If you're posting in the boards, people just don't care, but YOU should care if you're sending a letter that is supposed to be accepted as intelligent and factual.
I can't stress this enough. I know a guy that does AMAZING web-design, but never gets hired(without me as an intermediary anyways) because his grammar and spelling is horrible. He miss-spells every other word, uses many words out of context, and rarely uses proper punctuation and capitalization.
This is not a rant and rave, but if you'd like a regulatory entity to take you seriously, it's in your best interest to put your best foot forward and proofread.
Sorry if this comes off as 'complainy', but if you're going to represent a community as a whole, i.e. xda or developers entirely, just do so gracefully.

Formal letters to companies should begin "To Whom It May Concern: As I'm sure your (you're) aware from other devices they have released, ie (i.e.) desire (the Desire), they are not releasing (htc has not been releasing) kernel source codes in a timely manner. Sent from my HTC Vision
"To whom it may pertain to...
Just purchased a HTC T-mobile G2 aka HTC Vision and have been a avid HTC supporter for quite sometime. Ever since I owned my first HTC device the codenamed blueangel. The fact that HTC would work with the developer community pulled me toward your devices. I can't believe you guys (HTC) would lock down the successor to the device that helped you start the "open" revolution. I know it was most probably T-mobile that made you do it but that is besides the point. Especially since they have blamed you in the press. You have spit it the face of the developer community and shame on you and T-mobile. This protection will be broken I have no doubt of that but the fact that HTC put it there at all is what is in question. Please don't make this a race of protection...hack...protection...hack. OPEN means we should work together not against each other. So please do the right thing and help us either root these devices or give us the kernel source to help us along. Or even better do both of the above and show you respect the dev community like we all thought you did. Below I have included the first post of a stream that will become a torrent against HTC from the XDA devs.
Thanks for your cooperation."
Message I just sent HTC with a copy of the first post here. Don't care about grammar and neither will they if they receive enough complaints. We get enough people involved in this and it gets engadget or another blogs attention then maybe they will listen. This might be our only option considering the thinktank threads have gotten kinda quiet.
We cannot comment on whether or not HTC has blocked any customer from rooting or hacking their phone.
Rooting the phone may open the phone up to virus attacks and other un-secure activities, as well as introduce intended functionality, and as such is very difficult for us to support.
We cannot comment on whether or not HTC, Google, or T-Mobile has blocked any customer from rooting or hacking their phone.
All three companies work very closely to bring you the best experience on the phone possible.
I do understand how important it is to be able to use your device to the best of its capabilities.
We are not withholding the kernel; we are currently working through the legal channels that we must go through to make the kernel available to you. Each product is individually under review.
When the kernel is available, you will be able to find it on developer.htc.com. I apologize for any inconvenience you may have experienced, and thank you for your patience in this matter.
You can contact HTC Technical Support via telephone by calling 866.449.8658 between 6AM – 1AM EST, seven days a week.

That was a quick generic response. boo...hiss...
My reply to HTC
I understand the position of HTC to not comment on the situation at hand even though it has already been outed in the press by T-mobile that HTC did indeed lock the phone. So either you are saying that the T-mobile press release was a hoax and HTC did nothing with write protection or HTC just want's the problem to go away. As far as not wanting us to root because of unsafe activities.... Well I don't even know where to start with that comment. We are all big boys and girls and can handle the effect of our actions. It's like saying Toyota installed a system in my car that will only let a certified technician open the hood because I may insert washer fluid into the engine instead of oil. Most companies would love it if you would void your warranty. Does it not lead to less operating cost for HTC in the long run to not support it's products because the warranties are void? You don't want me to void my warranty then do as the GPS companies do and make a disclaimer that I have to read and agree to before I go any further. Also on the subject of voiding warranties did HTC not say that G2 had 4gb's of internal storage? Yet only 1.2gb are available for use because of this lock? Back to the car analogies. If Ford says your car has 200 horse power in the brochure and (AFTER!!!!) you buy it you learn that only 50 horse power is unlocked you might be a little angry. No? I understand the position of all big companies is to play dumb until something either is forgotten or legal channels make them play smart but I do have to say that I did not expect this out of HTC. This post isn't directed at you Sarah but merely my G2 and thousands of others crippled devices. If you could pass this and my prior message to someone higher up that might at least read it and think it over it would be greatly appreciated.

Ok, really, did Microsoft pay to have this forum created?
This is a desktop oriented OS... Sure, it WORKS on some Tablet PCs.. Not many and really, who has them?
This is a hacking/developing/home-brew community. Microsoft runs services for consumers, not developers. Android is the most used OS on the forums and I consider it crap that XDA has placed Windows in the position of honor.
XDA (Cross-Digital Assistant) is for Cellular Digital Assistants and and Personal Digital Assistants. Windows 8 is neither. It supports concepts from Windows Phone 7, but we would not have a iOS forum and we would not have a Kubuntu forum.
I vote the forum be removed. I also vote that XDA stop selling out.
Reserved so the first post won't be a microsoft consumer representative posing as a user.

Interesting idea. Let me inform you sir, that this forum has always been Windows Mobile centric since and/or from it's foundation (Hopefully I'm not mistaken). Then along came Android and things got.. Well let's say complicated.
The "free" approach that Google has installed in all of you, has created a whole bunch whiners and trolls who feel entitled that everything should be given to them without any sacrifice from the user. Not like this was any different when it was Windows Mobile only, but we had our secluded spot.
I do not care for Android but everyone should have their own space, understood?
OR
Technology changes faster than the blink of an eye, and if you are reluctant to change, you are in the wrong forum.
Believe me, XDA for me used to be one of those "secret-spots" I'd come to have a nice read and communicate with new and old members alike.
Ever since Android has been introduced to XDA, things have gotten more intense, like debates among who's OS is better or not (Even in Non-Android forums)... something that I may not care but YET I respect others wishes.
Needless to say, I hope you revise your post and be MINDFUL OF OTHERS who will have a need for this forum.
If you do not wish to remain here for a meaningful discussion "On-Topic" mind you, then go back to your Android thread where you belong then.
Thank you and have a nice day. Sometimes it's nice to see things from another perspective, try it once in a while.
I don't get how it can annoy you in any way possible? Just ignore it and you'll be fine. And who knows we could use this to find stuff about which tablets it ports to etc. So IMO it's kinda needed.

Do you see a Donut, Froyo, Gingerbread or IceCream Sandwich forums here?
Windows has been fundamentally the same since NT. They've partially implemented security permissions and have yet to keep up with the level of Linux in that department. Because of additional convolution, they could have a Windows7/8 forum in addition to the Windows CE forum (which mobile fits into).
There's no call to have a windows 7 and 8 forum at all. Having a new forum for that is like having a new forum for each manufacturer's UI implementation. There's nothing revolutionary about the 8 interface. It's simply hiding the default Windows interface and it's a merge of the Windows7 phone interface into the desktop.
Windows needs to do a total revamp, starting with NTFS. The Filesystem is garbage. It hinders use and development. I know because I have developed Windows applications. Modularisation is the key to a good operating system. Never in my life have I considered a partial implementation of permissions (Windows 7 and vista), nor a Skinned UI(Windows 8), nor merging of a mobile and a desktop platform into a single interface (Windows 8), worthy of an entire forum.
Windows CE variants, and Windows Vista variants... Sure. Windows 8 is not XDA material. It's not a digital assitant like WP7, and it's not a phone. Howabout a Windows forum with Arm and x86 categories?

Dude, leave the fanboyism aside. All the above are not facts, but YOUR opinion and YOUR opinion ALONE.
This is exactly the same thing I was talking about. You obviously have no interest on a Windows forum.
YET you are here trolling because YOU do not agree with it, so therefore NO ONE ELSE can have it??
Should I complain to XDA (i.e) Because Google has privacy issues AND violates them on a constant basis, so therefore we shouldn't have Android? NO, simply NO.
These are opinions and not facts.
XDA is set up in this place to CONTRIBUTE and DISCUSS material ON TOPIC of the above mentioned forum, not to spew hatred because you simply do not agree with.

No sir, you are exhibiting fanboyism. If you've ever tried to program cross-platform then you will realize how convoluted and screwed up Windows methods are.
Hardware abstractions requiring proprietary drivers hinder development
Interfacing devices requires implementations of $10,000 signatures from Microsoft
Utilizing user granted elevated permissions requires 30 additional steps to a program
Tools which assist with elevation of permissions are considered "Malware"
Installation of applications requires access to a unorganized "database" called the registry
Utilizing pieces of equipment which you have purchased in a different way is entirely too convoluted to even consider for any sort of software distribution.
Microsoft's provided generic drivers are buggy, so you can test and pay to sign if you're serious.
If you'd like links to any of the above, I'll show you in code, or examples I've dealt with in the last few months. Why do you deal with them? Because you're told by the mass market that it's what you want. It came on your computer. You learned it.
These are normal every-day life for you when you run Windows. Learn Linux and you will not have these problems. You will soon learn that they are *IN FACT* problems. They require several work-arounds and cash in order to utilize your creative freedoms as a developer.
You say opinion, I throw the gauntlet sir.
Well, I'm not bigger Linux fan than Windows, I use Windows for everyday. But really, Windows 8 is not available for ARM, and we don't know for sure if it will ever be, and when. So I see no point on making 2 boards for Beta release of some system.
I don't see boards for Fedora, Ubuntu, RedHat, Knoppix. Most of them are more available for XDA devices than Win8 (more is not appropriate word here, as its like dividing 1 by 0 for now)
I see no place for Win8 boards on XDA Developers for now, while it has got nothing to do with portable devices but some press notes.

Adam, I have read your post in it's entirety and I have to say that even if these issues are preventing development, you came into this forum and I quote: ("Android is the most used OS on the forums and I consider it crap that XDA has placed Windows in the position of honor" "Ok, really, did Microsoft pay to have this forum created?").
Do you really think that this is are reasons enough to have it your way? Would you be happy if I went and trashed the Android forums just for the fun of it? If you would have posted this in the Android forums, you would have not heard from me at all. The issue at hand, that I see.. Os that you come into this forum insulting XDA and the future users of this forum and then say, this shouldn't be here at all.
Your complaints cannot be fixed in this forum at all, because XDA was designed to find tweaks and even hacks etc to make our OS better and responsive. Are you so mad that you are willing to deny the chance to other users because of your own jealousy and hatred for such a corporation?
Learn to share and let others live as they see fit. If Windows works for them, then it does, period. Or would you rather have them all move to chromium and/or Google products? That's very kind of you but users do not need to be berated for choosing as such. This is more on the lines of fanboyism. I said it before.
Would you be okay if I do the same on the Android forums?

This should have been your first post instead. I do not disagree whether the forum should exist here or not, but rather the manner you come in busting doors left and right only to proclaim Android as king of these forums and who knows what.
I understand your motives and why you feel as you do. I do not take that away from you, neither it's my intention. Its just that everyone has the right to have something, and if Linux was to be added tomorrow, I'd be happier for those who will make the most of it. Even if unrelated as it may be.
I only want to convey the message that one-sided approaches will get alot of people offended. That is all I want you to see.
I respect your opinion, and I feel you bring up a good point. I wish I could help to make that situation better but unfortunately I do not have such knowledge.
But this forum is my home now, as new as it may be it will be of the utmost help to me and perhaps other users.
And I had felt insulted that you accused XDA of selling out (Your home) and that you are trying to take my home away.
I only hope you can be comprehensive of my side as well and that we can both stand in the common ground.
I understand. We don't need a new forum for every version of Windows.. We don't have a forum for every version of Chrome. We don't have a forum for every version of Android. We don't have a forum for every version of OS-X. This is not a XDA OS. It's a Desktop OS. You will not be developing for this platform as an XDA. Obviously paid advertisement
If they have a Windows 8 forum, they need a Ubuntu forum and a OS-X forum. It makes no damn sense except that Microsoft has paid off XDA to promote their operating system. I read a statistic last month that the vast majority of people on this forum were on Android. Yet, somehow Microsoft's OSs are all listed at the top. It's not even alphabetical or in any order. Obviously paid advertisement.
Then stack the fact that the Windows 8 is not even a mobile OS. Microsoft has officially released that mobile and desktop apps will be mutually exclusive because of architecture and battery life. This is not a mobile development platform. Obviously paid advertisement
Microsoft is ****ting on my home. Might as well call it Computer-Developers.com

This is not a troll thread. Its blatently obvious why a desktop OS has no place on XDA developers. They have no plan for a mobile version yet.
Dude. Get over it. If you don't like it then don't read the forum. Pretty damn simple.
Really, I'm not joking here.. I've seen this before. Lockergnome used to be reserved for the technically savy until they started the forums and everyone signed up to ask questions. It used to be a series of blogs and a newsletter with quality control. That control is now gone and the articles are just about "cool stuff" that people think is smart. At one point it was technical, now it's artsy.
The thing that keeps this forum prestigious is that it is limited to a certain kind of device. This will open the flood gates for noobs to ask questions about EVERYTHING computer related. Once that starts, we will be tailoring to the masses. The noobs will take over and basically turn the place into another garbage forum like http://www.lockergnome.com/ . It will take 2 years. Mark.
Please, XDA, I urge you.. Contact User Experience Admin Svetius Windows 8 is a desktop OS, not a mobile OS. It is not designed for any mobile device. If you care about the forums, lets try to keep the desktop and laptop stuff out.

I'll kill this argument
Windows 8 is a desktop OS, yep surely is. But it also has ARM support and has ARM support for a pretty long time (since about 7850, which was the January build).
Now what do the majority of phones run? ARM. Windows 8 is on a forum where phones run ARM processors...It's pretty simple the reason
Same reason why the htc tablet (running vista and windows mobile) had its own forum. It's not as if this hasn't occurred before...
Just let it go
Hello folks!
I wrote this guide to help the many app developers out there who are looking for help with how to 'properly' market their apps to achieve their individual goals, be it maximising profits, awareness, market share and so on.
What's extremely important that needs to be realised is that marketing isn't only about advertising or promoting an app, but rather covers a whole range of aspects that may not seem very obvious at first. A brief description of these are listed below:
Product - The actual product that the consumer will have, in this case, your app
Pricing - The appropriate pricing strategy for your app
Promotion - How you will inform and persuade the consumer to download your app, either for free or for a price
Place - Also known as Distribution, this deals with how you get your app to your customer
What will be covered?
We will be covering both the pricing and promotion strategies of marketing your app. The reason we won't be talking about the product and place is because you've probably already got your app that you want to be marketed already developed and at hand, and the distribution channel will more likely than not be the Play store. The other reasons is that the success of your goals through marketing is largely dependent on the pricing and promotion of the app, especially in the mobile app market. I've seen plenty of apps that have so much potential, but are hindered and held back by the lack of appropriate pricing strategies or exposure to the consumer, thus hopefully I'll be able to help out a little in those two departments

Pricing
Pricing largely consists of a base pricing method, and then fine turned with a pricing strategy.
Pricing Methods
Generally, there are 3 main pricing methods
Cost-based (mark-up) pricing - Simply putting a price that will cover the costs/effort of the development of the app and an additional amount that will provide a satisfactory profit margin. In our case, depending on how much time/effort/money you've spent on your app, you solely base the pricing on how much you think you deserve for your app. In all honesty, this wouldn't be the most smartest choice, especially for apps that have alternatives that are superior or free, or both. Even for apps that may one-of-a-kind or has a major differentiating factor that makes it stand out, a price tag alone may be enough to stop potential customers from downloading the app.
Market-based pricing - Putting a price on your app determined by the interaction between levels of supply and demand - whatever the market is prepared to pay. This may be quite hard to implement without proper market research, which will be expensive or time-consuming, so unless you are a big company, or are willing to fork out a bit of cash to conduct market research, this may not be a good starting point.
Competition-based pricing - This is probably the most common method of determining a price of an app. It's setting a price according to the prices of your competitors. However more likely than not, the most common price of your competitors is $0, and this is most likely the case for apps that have many similar alternatives on the market. However, this doesn't mean that you have to make your app free. Do a Play store search for 3rd party launchers, and you'll see lists of successful apps that are priced similarly and despite the price tag, still garner tens of thousands of downloads and purchases.
Pricing Strategies
Depending on your source, there will be a varying number of pricing strategies, but the main ones are:
Price skimming - This occurs when you charge a very high price for your app. Generally, this is used as a way of conveying a 'prestigious' and 'high class' image of a product, and in the case of apps, truly does not work. In fact, such a strategy for an app may even result in an unfavourable image of the developer. As 'The Most Expensive Journal' puts it, "the practice should be considered digital begging.".
Price penetration - Introducing an app for a low price (including free), building up market share and/or a customer base, and then hopefully introducing a paid/donate version. In all probability a more realistic approach that many developers take, it is probably the smartest and most appropriate pricing strategy that will not only get you that all-important customer base, but also a profit. Be extremely aware though, of having the appropriate balance of free/paid features - no one will buy an app if the free version is lacks the necessary room for testing and trialing, and having a trial app that basically does everything a paid version means that any profit will entirely be based on the goodwill of your customers.
Loss leader - Unlike for businesses, there isn't really much difference between this and price penetration for apps, because they both essentially do the same thing in actuality, that is, introducing an app at a low price (including free), and then garnering as much market share and customer awareness as possible. The only theoretical difference between price penetration and being a loss leader is that the latter approach is taken in hopes that the customer will download or purchase your other apps. However as already mentioned, in reality these theoretical terms won't actually matter because they both do the same thing.
Price points - This applies to in-app purchaes, such as upgrades in games. It basically means setting key prices or price points for the 'upgrades' or purchases in your app/game, an example being having certain 'upgrades' costing $0.50, a higher tier for $1.00, an even higher tier for $1.50 and so on. This is good at 'luring' your customers to purchase more and more 'upgrades' in your game because you start off with a really low price point, and then consistently increase the subsequent price points. Be mindful however to not go overboard with it, such as $1, $150, $300 etc. but common sense would have probably ruled that out already.
Promotion
There's a quite common misconception among many people - a misconception that promotion is the same thing as advertising. However in theory, promotion encompasses advertising to also include relationship marketing, sales promotion, and publicity and public relations.
Advertising
This is probably the aspect that many developers focus on nowadays - having as much flashy images as possible in order to raise awareness and achieve downloads.
Youtube - Youtube is a great way of advertising your app, its features, as well as creating a connection between you and the customer through dialogue. As DoubleP90 says, "watching a short video is way better than reading something, and as always if it's enjoyable it will be shared by people.". People are also more inclined to watching a short video that conveys information visually and aurally rather than reading paragraphs. Advertising in video form will also, more likely than not, provide more information about your app in the same time as a person reading your preamble and going through the help section and all that.
Ads in online magazines and subscriptions - Try to find online magazines and subscriptions that have an audience you think will be interested in your app. The great thing about this method is that your app will be given access and exposureto an already established target audience. Contact online magazines and subscriptions to see if they're willing to put have a banner of your app somewhere in their medium, either for free or a price. For example, if you have a children tracking app, find an online magazine/subscription geared towards parents.
Web ads on sites - Another way of providing exposure to your app, it'll be a good idea to find a website that has the same target audience as your app, just like the online magazines and subscriptions covered previously. There is not point in advertising your elementary spelling game on a website for the aurally impaired.
Direct marketing - This is an approach where you directly approach potential customers offering information about your app. Again, be smart with your time and efforts when choosing potential customers of your target audience. Forums are a good place to start, but be aware that this may create an unfavourable image of you and your app for many people
Relationship Marketing
This is more important than many perceive it to be. In our case, this involves keeping your app users up to date with the latest happenings regarding your app such as future updates, invitations for testing and suggestions, and so forth. It's main focus is to develop a long term relationship with your users through customer satisfaction. It provides a win-win situation where your customers are happy with your app and are more inclined to purchase more of your apps, and you get those all important ratings and profits from the additional sales as a result of customer loyalty. I've known and come across apps that excel in this area, as well as those who leave their users in the ditch and run with the money. How would I know? By simply glancing at the app comments on the Play store. This is probably the most important medium of feedback for you developers, so make sure to regularly check up on it and respond to user concerns.
Sales Promotion
Sales promotion is the use of activities or materials as direct inducements to customers, and aims to:
Entice new customers
Encourage trial download/purchase of your app
Increase sales to existing customers and repeat purchases
Sales promotion is primarily used in a complimentary way to increase the effectiveness of other marketing activities such as advertising. Examples include:
Discounts - Pretty obvious what this one is all about. If you have a paid app, you may want to consider having a promotional discount for a limited time to draw in customers to your app. Big companies do it all time with those $0.99 app sales in the Play store, and they do quite a good job at enticing customers to purchase your app, especially if they're going for pennies.
Premiums - Basically giving customers something extra for their purchase. Usually running for a limited time, you may want to reward all your first-week sales customers with a free download of another paid app, or an extended subscription period for apps like Evernote.
Refunds - Part of the purchase price is refunded back to the customer for a limited time. It's basically another method of discounting apps. Can be used in conjunction with coupons or vouchers.
Free download or trial - This is the most common way of promoting an app, and is used by small time developers and big corporate companies. It may be the best way of promoting an app, as potential users are more inclined to download an app that's free than purchasing a trial version, although this may not necessarily be the case for every app.
Publicity and Public Relations
Theoretically, publicity is any free news story about your app and:
Enhances the image of your app
Raise awareness of your app
Highlight the app's favourable features
Thus from the list, it's quite an important aspect of marketing to gain as much publicity as possible. Usually bigger companies have more ease in this department than small-time developers as they already have a substantial exposure and market share (Eg. Do a youtube or google search on Google Keep and see for yourself). So what does this mean for you guys? Try to contact possible outlets that have the same target audience as your app. tlovidiu has a list of sites that review apps for free.
Public Relations are the activities aimed at creating and maintaining good relations between you the developer and your customers. This can be done by donating part of your proceeds to charity, such as what Swype is doing, or not having any ads in your app, or at least, not having air-push ads (trust me, they get on everyone's nerves). Regarding ads, make sure you don't cross the line separating reasonable ads in your app and ads that literally pop up every 10 seconds, because the latter will most likely result in an uninstall, a bad Play store rating, and a 1 kilometer virtual radius from all your apps.
...aaaannd Bob's your uncle
Hopefully I helped out a bit. Any suggestions or fixes are welcome. If you would like to know a bit more, make sure to check out DoubleP90's "little guide to promoting your app"

People may find direct private messages advertising apps to be somewhat similar to junk mail in your mail box
