Sprint, Airave, and upgrading a line - EVO 4G General

I'm trying to buy a phone to replace my wife's POS Samsung Moment. She wants the Evo, so I called Sprint a few weeks ago to order her one. I was prepared to pay full price for the Evo since neither myself nor my wife is due for an upgrade, but the sales rep on the phone took a look at my lines (I have 4 phones plus a "line" for my Airave) and told me that she was going to upgrade me based on the Airave upgrade eligibility. Dumb me, I actually argued with her and told her that it wasn't a phone, and she acknowledged it but said that it would save me money and make me a happy customer. Hey - whatever she can do, that's great, so let's jump on that! Bad news - they were out of stock of the Evo AND the Evo Shift, and I flat refused to get her the Epic (I am not a fan of Sprint's CURRENT Samsung offerings...but would love to look at the Nexus S.)
On a Friday afternoon trip, she decided she'd had enough of her phone locking up, so she wanted to stop by the Sprint store. After waiting in there for about an hour and a half (I expect crap service there, and am never disappointed...) the sales rep brought us out a white Evo (what she really wanted.) However, when we explained what the Sprint sales rep on the phone was going to do, he acknowledged that he HAD done that before, but he'd gotten into trouble for it. He was adamant that he wasn't going to do it for us, and while I was perturbed, I wasn't going to ask him to jeopardize his job. He told me that the reps on the phone shouldn't have offered either.
So who was right? I admit it sounds fishy to try and skirt the prices by "upgrading" an Airave, but if the phone rep wasn't so quick to offer to do it, I'd be calling shenanigans. I don't *want* to pay full price, but if I can save $150, I'd be stupid not to.
We didn't buy it - I'm going to try calling back and getting the Nexus S when it's released and see if I can get the same offer.

I don't think they are supposed to upgrade an Airave line. If they do then that probably would mean you'd have to send in the Airave and be stuck with that number as an additional line.

You can do one of two things.
1. Ask for the manager, listen to what he/she tells you, then ask for like an area or district manager about the data lockup with the Moment. Also remind them that it's also illegal against the FCC for any type of phone in service or not to not be able to dial out to an emergency number such as 911, and when the lockup starts on the Moment, you can't call out at all.
or
2. With Sprint, if you've had your phone replaced three times due to a hardware or software issue you've been having then Sprint offers you an early upgrade.
With both of these Sprint will offer you an early upgrade, but most likely it will not be an Evo, or they will offer you a discount on some phones to upgrade to.

You mentioned lockup - I've been lazy and haven't researched her issue, but that's EXACTLY the problem...the phone just freezes. Can you provide any link to information regarding that? It's well out of warranty and this would be the first time we're reporting this, unfortunately.

Sprint had made it very clear to all reps not to use the upgrade on the Airave line. Many people have done it in the past but in no way should they be doing so now, it does put your job on the line believe it or not.
And as far as what the guy above said, it's not that easy.

I have no reason to believe it doesn't. Perhaps I just talked to someone who didn't care
So why does the airave show the upgrade eligibility? If it can't/isn't supposed to be used, then take that visibility away from the customer. That would simplify things greatly, and no one would be having this discussion in the first place.

Once i got my airvana my account did the same thing. My wife should be available for the 150 but it switched to the airvana now. I dont know whats going to happen when she goes in for the upgrade either.

Because the system shows it as a line, simple as that. Your car shows it can go 150mph, do you use it?

Hah it's cool, it's a forum. Theres no way for Sprint to remove an upgrade from a line and since the airave shows as an additional line it has an upgrade. Bugs that cost more to fix then leave alone and educate reps about I guess.

Can't you get around this by just going into Bestbuy, RS, or wirefly, then telling them you want to upgrade the 'airave number', it'll show up qualifying as a upgrade, then you buy the phone for the upgrade price (usually the same as a new customer), and walk out, then switch your airave back to that number in a day or two via the sprint site or calling sprint.
Going to try this, since we have 3 lines, all go on a $150 discount (saving them for the EVO 3D) and an airave with a $150 discount, too, which I want to use now on a Nexus S 4G.
Yeah, yeah, this is kind of unfair and cheating the system, but it's Sprint's fault/error/issue, and I'm pissed that I've been getting 0 - 150k from the tower by my house for 5 months now and they don't seem to care. 4G is like 500k tops, unless you're standing across the street from the tower, then it's 2k, which is barely faster than 3G's optimal speed. :|

HTC Hero early upgrades

Sprint is great, I was 6 months into a 2 year contract and had 1 upgrade for my Airave line. I used that on the HTC Evo. I got on the phone with Sprint and asked them about my upgrade status for the 5 phone lines and was told that it was due in Oct 2012. I asked for early upgrades, they gave it to me! I picked up 3 heros and thinking of 2 other phones to get.
GO SPRINT!!!!!
oh but my contract was renewed for another 2 years but its ok!
Yeeaaa I have a hard time believing this one. First, airave upgrades dont exist. Second, upgrades are every 22 months besides your premier line (if you have a plan that gives you premier status) meaning by what you wrote 4 of your lines were upgraded on Dec 2010 and I don't think we are there yet
gg what do I have to gain by lying? Oh and I meant Oct 2011 hehe.
And btw Airave upgrades do exist. It might not be necessarily upgrading the Airave unit but there is still an upgrade credit. I used that to get my Evo and the Sprint rep simply swapped it out to my true phone line.

Actually its fully legit to do it. We do it at best buy constantly. I upgraded my sisters line with her airave and Im using my airave upgrade for the next android. All your doing is using the airaves upgrade and not activating it and swapping it to your main line. This puts your airave on a 2 year contract.
Nobody gets fired, its a screw up in sprints system that theyre too lazy to fix.

You aren't getting any evo on an early upgrade. you have to wait until your truly due for one. i tired this already, WON'T happen. i just happened to find a sucker on craigslist that traded me his new evo for a used hero + $150 cash.

Early upgrades are possible on extremely rare occasions. I gave 2 last week for the evo for the same customer. My only customer to get one since the phone was released.

hey I'm curious. Do you mind me asking on what grounds did you give the early upgrade? Oh and is it possible to buy a phone out of contract at full price without activating it in store? I tried to do that today and it was annoying as the rep kept insisting I had to have it activated before I walked out.

Best part...one of your coworkers told me how and what to do. Before that "fool" opened his mouth we refused to do it. Then that "fool" told us it was completely ok to do and until you guys changed the system it wouldnt be an issue.
Next time I'd refrain on pointing fingers at us "fools" before checking what your "fools" are doing. Ive had far more f-ups from Sprint reps like yourself than I have from Best Buy account reps. Your the "fools" who had to halt the samsung moment cl14 upgrades because your techs couldnt figure out how to run the file. We were loading them the minute they hit the site.
Btw, in regards to your "Airave upgrades dont exist"
Yea... The system shows it, you can't use it and yes best buy/radioshack **** up all accounts from opening lines when customers were wanting to upgrade to using airave lines as upgrades. The airave, though it is now seen in the system as a line can not be used as a line to upgrade. Also please stop telling customers activation is free and tell them if they switch the phone to another line within 30 days they lose the rebate.
But of course one retard opens his mouth, the rest follow. If I show u a glitch in the system to give free evos will u use it too? Cause I know one. Just cause u can do something doesnt mean its allowed and then retention has to fix all ur **** ups. No update was evrr halted either, find a new source.
We have 6 lines and they all got upgraded 5 months ago at the same time, last night 3 of them could be upgraded so we upgraded 2 of them to the EVO for $199

I think it's safe to say we can ALL forget about upgrading a Hero to an Epic4g even a single day before October 10, and the only way we can even fantasize about an Evo a couple of weeks early is if Sprint ordered a staggeringly HUGE quantity of them only to have demand for it completely collapse once the Epic4g arrives. I really don't see that happening, either.(*)
(*)In fact, I personally think that's why there's an Evo shortage right now. Sprint knows demand for the Evo is at least partly driven by the fact that right now, it's their ONLY 4G android phone. They almost certainly have an agreement with HTC to promote the Evo exclusively for some minimum number of days, shortage or not. Thus, they're being extremely conservative about replenishing their Evo inventory only to levels they know can be sustained by ongoing new sales once the Epic4g is out as well. They don't want to end up in a situation where stores have a mountain of Evos piled floor to ceiling and a 6-week backlog for Epic4g.
From a PR standpoint, Sprint's ideal scenario would be to have every Sprint store be sold out of one or the other for at least a couple of days each week... but have enough in stock at SOME Sprint store within 50 miles to ensure that anyone (with a car) who walks through the door and is determined to have one *today* can go to bed happy that night, but will also tell everyone that they're so popular, they're sold out *almost* (but not quite) everywhere.
If you have any line that is elgib. for an upgrade and you upgrade on that line and switch it to your line then you lose your rebate.
If you were going to do this then you would have to wait until the rebate has been processed and then switch the lines so...

Tmobile Credit

Might be inappropriate in this forum, if so I apologize. But if you are posting to 'Samsung Vibrant General', then you have Tmobile...
I called TMO again asking for any update regarding the GPS bug, they gave me the same old script.
I asked if there was anything they could do to credit or compensate my account for the lack of functionality.
I was put on hold for 1 minute and then was given a $20 statement credit.
Maybe if they have to dish out plenty of those, they'll also get on Samsung's back harder.
Good Luck.
bugging tmob and asking for credits does nothing to help with fixing the gps problem, especially since they have pretty much nothing to do with the issue. if you don't like the phone or can't live without gps, return it until it's fixed.
What lack of functionality? GPS?

They notate this stuff on your account so I hope you use your freebies wisely. People getting credits in other threads won't have much leeway when they're asking for a 1 year upgrade or anything else. It really does nothing. Complaining does more than asking for a bill credit.

If you don't think this is such a bright idea because its Samsungs problem well I guess you don't like free money off your bill; who cares where the blame is if either of them are giving something for the troubles I suggest we do it.

what makes you think this is free money? for every credit tmob gives for an invalid reason (like gps not working on a phone that tmobile doesn't make), that delays things like hspa+ expansion, getting more and better phones available, etc. not to mention the fact that a bunch of people calling and asking for this credit is going to make a lot of customer care reps miserable, at least that was my experience when i worked customer care for tmob years ago.
if you are so unhappy with the phone, return it. but as far as tmob goes, you are receiving all the services you are paying them for with this phone.

I'm happy with my phone and personally I never use the GPS for anything hense why i don't really care.
Here is my point and i will shut up. We have these phones there is a "problem" and t-mobile can give you "something" for your troubles. i suggest you take it. Tmobo reps are there to serve I don't care if I bug them its there job. Its not like the CS reps are the developers for Samsung when we aren't calling. Plus this doesn't hinder the development in fact its the opposite they actually will press Samsung in the future for a better product as well as increase there testing of said product.
At least in theory.
my two cents
JTHM for life
so i take it when you get your credit card bills, you ask the post office to pay part of it since the mail did not make you happy and they delivered it?
or when you buy clothing that tears up early or has some bad material etc, do you go to the store and ask for money.
you either take it back or you keep it, outside of that there is nothing else they will do. If you bug tmobo reps over something they or tmobile has control over that is one thing. Do you thing tmo just said, "hey samsung, release a defective item, we dont care".
and when you say tmobile can give you "something", thats really liberal, they didnt say, for your troubles take this, you said "for my troubles i want this". big difference

I'm not coming back to this topic again and I know the person I quoted isn't coming back either, but I just had to say this.
Look at what is in bold in the quote. T-Mobile isn't giving us "something" for our troubles. You, or the OP(whomever it is), is "asking" for credit. If T-Mobile offered me free credit, then hell yeah I'll take it, but I'm not going to ask for credit unless it's appropriate. For example, the stupid salesman at the T-Mo store didn't charge me $249 for the phone like they were suppose to, so I had to ask for a $15 credit, which I deserve since they promised me a full upgrade price.
If I was having issues with the phone, I would just return it for a refund and then rebuy it when it's fixed or a better phone comes out.
That's it, bye.
true i agree on that money is money
i have had any problems with GPS so far, but i had also did the fixes that was available, so far it works great, but money is money and if their is a way i can get something off my bill from my service provider whether its there fault or not i will do that.

you're right and you're wrong and heres why... Cell service carriers are ultimately responsible for the phones used on their network since they are the ones who limit our choices of models in the first place. If Tmo didnt require its users to choose from a list of cell phones they authorize then I wouldnt hold them accountable for them, but since they do i expect them to have fully researched and tested all models that they impress upon us to buy. If I could buy my phone directly from the manufacturer and choose my service provider from there then I would only hold the manufacturer responsible. I understand the difficulty GSM CDMA TDMA and varying network bands but this is the situation the carriers have gotten themselves into due to competing strategies. If t mobile is willing to issue these credits to then i can only assume that they understand this as well. and since applications like google maps latitude navigation and telenav all require GPS and a data connection to send back and forth i would have to disagree with you again that i am in fact not receiving all the services i am paying them for with this phone. each of these are bundled in the 95% functional phone that t mobile sold me and each of these are why i pay $30 every month to tmo for my data plan
In all Honesty O have been with TMO for 8 years and they have always been fair with me. the last thing they did for me which they were in noway responsible or have to do, was to help me with the HD2. I was trying to get this phone from Walmart for 50, because that was a walmart sell. After 2 days walmart totally screwed up my account and wouldn't sell me the phone. TMO straightened everything out and sent me the HD2 for $50.
Now if you feel that TMO is at fault for the GPS sure call them and get the $20
But have you tried getting into the GPS menu and enabling Skyhook? This works fantastically
*#*#1472365#*#*
Application Settings
Use Skyhook = ON
Back out of the menu
As for getting a credit from the cable company for the faulty box I can guarantee you that if it was a problem from the manufacturer with every box they wouldn't credit you, but wait for a firmware update.
IMO TMO should do the same. this is a samsung problem since other phones have no problems with GPS on TMO's Network

Free Airave 3g + White Evo Info!

Just passing on a little info to you guys. Some of you guys are interested in the Airave model that can also do 3g. Just ordered one thru Sprint Retentions Department. The unit was free and a free monthly service discount will be added to my account upon activation. The retentions department stated they are the only department that can make this offer at this time. These units can not even be ordered by any other department till sometime in January (for the general public). This is what I was told.
Also an advance replacement order was placed for another EVO because of some hardware issues I was having. An order was placed, but the interesting part was....I had to except a WHITE EVO, because I was told they would not be carrying the BLACK EVO's anymore. The rep stated the WHITE one's would ship within 2 - 3 weeks. (backorder status)
That would really piss me off...I can't stand the white Evo!
That rep is full of ****. No way they're going to discontinue the black EVO. That would kill sales.

He actually tried to order the black but it no longer showed in his system. He checked with his supervisor and the only option was the white. We'll see when it gets here. I don't care what color it is cuz its gonna be wrapped up in a case anyway. It is possible that maybe the black will only be available in stores and not via telesales or online. The online avenue already says to check with stores.

Well after doing the Evo order, I complained about the service in my home. The rep then tried to push the original airave on me for $99 dollars and $5 a month service. I told him I heard about some customers getting a newer model for free on a case-by-case bases. He said he didn't know anything about it, but he would transfer me to telesales, they would have more info. He put me on hold, but then someone from retentions picked up the line and already new what I was calling about. Told me I qualified and placed the order. I suspect he asked the rep from telesales and they referred him to retentions while I was holding. Maybe I just got lucky?
I was told that my replacement phone would be a white Evo as well-the rep tried to tell me that it was a great looking phone. Anyway when the phone came in, my replacement was black.
Can't say I care either way.
Airvana -DO info...
its called the Airvana Access point 2.0
you must not be on an ASL type account
must be in good standing
must be a sprint user for at least6 months (though this length of time varies--YMMV)
----you may or may not need more than one line. again YMMV on this----
i have the original samsung model. i called in saturday to inquire about the latest model--they already know im in fringe (at best) area so there was no explaining needed.
they will add an 18 dollar activation charge to your order. i had that waived so when/if anyone calls in to grab one, make sure you look out for that.
this model does -DO data (Rev A) and 1XRTT. it can run up to 6 simultaneous voice calls at once. it is even a VoIP device capable of using a new (however not announced) VoIP service Sprint may offer later.
its a tad bigger and about a pound heavier than the samsung model.
this is called the Arivana Access point.

Corporate store. They seem to be able to get either white or black but they seem to be pushing the white phone.

I got the Airave for free as well. I've had service for almost 10 years, and I told them that my job required me to have mobile phone access, and my home (where my office is) had abysmal reception. I told them if I couldn't figure out some solution, I was going to have to look at other providers in this area that did have service (sadly, AT&T and Verizon both have better reception around here...) They told me about the Airave (it was new at the time) and offered it to me for free, plus no monthly fee. I now have full signal in my office.
I didn't know the new model pumped out 3G as well...that would have made me happy a few years ago when I had a Blackberry without wifi Now I simply use wifi for data and don't worry about 3G.

That's cool, glad you got your phone. My corp. store is useless. They don't even do the waiting list thing, at all.
I am really wondering what is going on with the EVO production though, I mean we are not really limited by any sort of parts delay, are we? Or is HTC just over there heads on trying to produce too many different models for too many providers?
Got my Airvana on the way. Just call them threatening to cancel because reception at home has been abysmal. Tell them you read online about this Signal Booster Router Thingy and you're willing to give it a try if they waive all costs.
Trust me, they won't lose you over it.
I actually called *****ing about my 5th replacement Palm Pre and the guy threw my first Airave in there just to calm me down. I had no idea it even existed lol.

I have a ASL account, in good standing w/ automatic payments, and was able to get the new airave for free. I was transfer 4 times so to prevent that just talk directly to retentions. As far as the airave goes, it is much larger then the first release and has 2 Ethernet ports out. It is meant to be connect directly to your modem and not to your router (if your modem and router are separate). If your modem and router are one device, I recommend using QoS settings to make sure you get maximum bandwidth to the airave. This change in settings took my data speeds from 1Mb to 2.3Mb. I do have wifi, but my wife not being tech savy at all benefits the most from this as our QIK chat is now lag free. As a word of advice, be patient, the initial setup took 1 hour followed by a call to airave support (here is the number 1-866-556-7310 write it down because regular tech support can't help you). Hope this helps.
BTW...
You will notice VOIP is available on this model and it will go live Q1 2011. I don't know the pricing but it will run off the airave and use the already assigned number.
I'm going to be doing this tomorrow morning. My house is in a white circle of no service (I get service, but dropped calls) All the houses around me are on the edge, but my house is like the hole to hell, well, if you look on Sprint's map.
DSL seems to also be a problem at my house - Can't get anything over 5.0 Mbps, yet my neighbors 50 feet away can get 7. :|||
I got a free 1st gen from retention last year but be careful they say its free or charge buy they credit you a year at 5 bux but still charge you 5 mo for all your other lines. So free for 1 line for 1 year, not all lines. Was misleading.

My Sprint "Experience"

Ok, So I am incredibly unsatisfied with Sprint's service as of late. I purchased the Epic 4g Touch and experienced the dreaded "Loss Of Service" bug frequently. I was within my 14 day return limit so I went into the Visalia California Sprint Store to swap out for a different model (namely the Evo 3d which I traded in for the e4gt). I also signed 5 of my friends up with sprint as well and 2 of them got the e4gt and had the same exact issues. They convinced me to try a replacement and assured me that if it still experienced that bug I could return it within 14 days of receiving the replacement phone. The replacement phone was worse than the one I had originally and lost service every hour. I missed several calls from work leaving my employer under the impression I was angry and ignoring her and almost cost me my job. So I went in to the Visalia California store yet again to get a replacement model. I spoke with the same woman that convinced me to get the replacement model (She was also the manager) and she stated that the device was out of its 14 days since the FIRST device and that I couldn't get a different model (see what she did there?). So I went home and called Sprint off of another line and spent 4 hours total on hold. I hung up and called Sprint tech support and after running tests and walking me through updates and such the rep spoke with a manager on his end and concluded that I needed a different model of phone. He stated that he would note that down in the ticket and to go into the Visalia California store and they would give me a different model. So I went in to the store and spoke with the manager yet again. This time after reading the ticket she became rude and uncivil stating that the ticket says "customer needs to try a different model of phone" and that they didn't have to provide it for me and that even if it did, corporate cannot make them give me a different model. The whole time I was civil and polite but my frustration was building. I drove an hour to the Sprint store in Fresno only to find out that Visalia had to handle my case and that they could not even replace it with the same model. So I found a man on craigslist and traded it for a Nexus S 4g. I plan on paying out my contract asap and switching to Verizon. They know how to treat a customer.
/End rant/
I might be wrong, but i'm pretty sure since you live in the state of California you have up to 30-days to return a device and not 14 like other states.
i was told 14.

*nevermind*
read your local laws, scan or photo them, and send them to sprint. I have been a customer since 1999 and they would NEVER pull this poo with me. I threaten them every time I am on the phone, you'll get what you want, ask for the account retention department...
Wait what the hell? Verizon and AT&T both limit your data now? WTF I cant do that God they are sooo lucky I need a phone. So I get a choice between sh*tty customer service and sh*tty cellphone service... I can't live in this world anymore

sprint is fine, i work for them, it's just you always get the a**holes at some sprint stores, i would never treat a customer like that, let alone lead them in the wrong direction just for a commissioned pay, that's probably why that manager did that, but anywho, don't be mad at sprint, i'm sure you experience will get better with them, my parents have been with them for 15 years+ and never had an issue, and i've been with them for about 5 or 6 under my parents account, they have good service, just right now it's kinda hard keeping everyone happy while doing a MASSIVE network upgrade, but some people are impatient, but trust me sprint is the way to go
P.S. from reading your post, the initial issue does sound like it was the phone itself, you should have gotten something else, and don't bother with the 3d unless you can return it, i'm using it now, low signal strength, i would recommend the Photon (also own) the signal strength and radios in that phone are the strongest i've ever seen in any phone out there
buy your phone at target next time they have way better deals than sprint company stores and do a 30 day exchange period.. i work at a target mobile, we will treat you right,

I Beat AT&T today!!

AT&T started throttling my data this afternoon. I kindy went up to my local AT&T store and asked to be put on the phone with customer service. Their phone was tied up so I just ended up using my cellphone and leaving it on speaker phone to amuse the customers and make the staff look ****ty. The employees thought i had no chance but little did they know I remember my contracts and agreements class from college. I never signed a contract with AT&T since i bought my own phone in and I never upgraded or even bought a phone through them. I explained to the customer rep that I am following the terms of the original plan that was provided to me. I explained to them that as long as I have not put a signature on any sort of agreement altering my account then you guys can't legally alter it without consent from me. They tried to say they could and I told think twice before you make your company look really uneducated. Then I told the lady I would like to speak to your supervisor. Oh i got transferred 12 times until this cocky idiot came on the phone. This guy tried to be a smart one when i was explaining the law to him. He said, "The company doesn't give a damn about a law." Then i said sir your conversation is being recorded on my phone as well as your company phone." He said "excuse me?" I said "you heard me fool. You are being recorded and i got you on speaker phone with about 35 people listening and taking notes." He thought i was lying so me being in the bad mood i was in i gathered 10 people around my phone and let them say something to him. The little girl sad "bad man!" She was so adorable. This elderly lady cancelled her service and told the man to go burn in hell. The rest just laughed. After I the elderly lady left went to the counter the guy was kissing butt for real. He said he will see what he can do for me. I told him I can just send Jim a text. He said Jim who. I said Jim Hood our state attorney general. He put me on hold and 5 minutes later he came back saying that i was correct and your data will be fully restored in 10 minutes. I told him we can wait together then. 5 minutes later i did a speed test and I got 6.8 mbs down and 1.58 mbs up. After that i told him i am glad that this was resolved but I will save the conversation for just encase this happens again. He said have a nice day and thanks for being an at&t customer. I said whatever and hung up. The customers actually clapped and the staff looked like someone died. I'm on cloud 9 at the moment. I think I should have went to law school instead getting into Networking and Computers.

I just print screened this original post because I am dying of laughter.
Without going too far in-depth, you were wrong. According to you, you were under no contractual agreements with AT&T, therefore, neither were they. Ergo they can change the terms of service at any point and you can decide to cease payment at any point. Both parties can do these actions sans penalty because, according to you, there are no contracts in effect.
You did not beat AT&T. They just got tired of you, which is okay.
To all others: Do not do this. AT&T will put you on hold and laugh at you. Chances of this working for anyone else are slim.

Technically I was. They was not providing the service that I was supposed to get according to their terms. It was funny though. Most people who renew their contract actually agree to the shady terms. I was really mad because I didn't get a warning before I got throttled. And I got throttled at 3.022 gb according to the idiot on the phone. I think the rep using profanity in front of a bunch of customers got my data back on track to be honest. I am glad I used my cellphone to be honest. I was sure going to give CNN my conversation for real. I have to thanks the HTC developers for including the call recorder app in their sense roms. I think it is the RCMix rom.

You obviously did not read a line of those terms so, technically, you were not. I am not certain what obligations you think AT&T holds if you did not sign a contract but from my observations, it is much smaller than what you think it really is.

Yes I did. I still have the original brochure from 2006. Those are the terms that are agreed upon. I'm sure it can be googled. The terms of the data back then basically said they can cut you off because overwhelming activity. If I was crazy and used 30gb like some customers then I wouldn't even worry about them cutting me off. They didn't follow their terms and the rep cursed during a service call. What more defense could you provide for AT&T? If you want to get down to the core of throttling it is illegal to throttle unless the service is selected for certain speeds such as what the home internet providers do. I think when some attorney general gets free time on their hands they will go after all of these mobile phone providers and penalize them heavily. Sprint, and T-Mobile are the only smart major national providers so far that are making sure that they avoid trouble in the future by being upfront about their data.

The thing you don't understand is that it is classified as a product when their is no contract. The terms is what was written in 2006. A product and a service are 2 different things. That's why you see the terms prepaid service and postpaid service. They don't use product a often any more.

OH MAN, YES! Dude you Rock! I would have loved to see this.
I love seeing AT&T get kicked in the nuts.
This throttle sh!t p!sses me off. I had a very nice rep use a dead IMEI so he could switch my grandfathered unlimited plan, which now gets throttled at 3GB's, becasue ATT refarmed the extra 2Gigs to Simple Mobile, etc.; put me on the LTE plan so I can get 5GBs which is about what I use. I would have bought an LTE device except we probably wont have LTE for another few years! Not to mention the fact Im using a malyasian Galaxy tab plus 7.0 for voice calls and data, because I dont like being force fed the bloated recycled crap options in their stores.
This is so EPIC WIN. I understand networks are changing and much more data is being used these days, but at least let us original unlmited people use a fair amount..
best read all day!
I would happily settle for a sneaky way to unthrottle oursleves, but they are doing it server side, so I dont think we will have much luck.
I will check with my ex but I'm sure that is the reason why. She is an attorney and she normally helps draw up contracts for local entertainers.

Send me the contract when you have an opportunity. I am NOT distributing legal advice, however, I am speaking from the perspective of an individual who is one term from graduating from a T14 Law School. I am suggesting so as you are misleading individuals.
A SERVICE cannot be classified as a PRODUCT in any legally binding terms or agreements (it can, but is unenforceable). Regardless, that is moot as you hold no legally binding terms nor agreements with AT&T. You are still ignoring my previous comment that AT&T can shut off your service tomorrow because there are no legally binding agreements between the two parties. AT&T can throttle you anytime they would like and you can stop paying them anytime you would like as neither of you are constrained contractually.

I got it. My ex has been an attorney for 4 years so I take what you say with good vision but experience is supreme. I was partially wrong in my argument. According to her the basis of it is consumer protection laws and AT&T's own terms. My plan which is not a contract but it is a post paid plan. Since I have never put a signature to give consent to any changes I am only held accountable for what is on the brochure for 2006. The brochure which you can find online clearly states that the provider can cut my phone off if I abuse the network in anyway. Throttling is not introduced in 2006 buddy. No one can be held accountable for a contract they never seen let alone never signed. AT&T would have to completely shutdown my phone and release me from the usage of their network according to the brochure. It can be found on google if you are looking for it. As far as misleading the community I did explain but I think most of them might understand it now. So I apologize for not clearly explaining why I can't get throttled. If you are upset because you may have gotten messed over by AT&T or you may have a part time job with them then all I can say is get over it. You are the only sore one out of the bunch.

It's been widely reported that AT&T has a habit of throttling their so-called "unlimited" plans. You waited until it happened to you to go make a scene in an AT&T retail store?

Yup because I thought something was wrong until I switched to my inspire then I knew I was throttled. Yes I did go to the retail store because there is an order to do things and I have learned that in order to get your voice heard you have to make them hear you. Call me crazy but I have no time to play phone tag with anyone. You can sit back if you want to and let them control you at will but with me they are going to have to stick with what was on the brochure of plans they printed for customers to stare at.

I actually wish that could happen. I honestly would be with big red if their network wasn't mainly cdma. The voice coverage is the best in the business.

Haha, I don't have AT&T so I wouldn't really know about "letting them control you"
