New 5 GB cap = Break contract without paying EFT? - Vibrant General

So, as some of you may know, if T-Mobile changes the terms of your contract, you can break the contract without have to pay an EFT (early termination fee, usually $200). I am not sure if this only applies to changes that will change how much you pay, or if it is changes in general.
So, does anyone know if the new 5 GB cap will allow us to break contract without EFT? It isn't changing our monthly bills but it is changing contract terms.

I wish I could complain about that and break loose from the etf. The problem is that before the 5gb throttling, they included overage if you went above 5gb. After that they said they would throttle but didn't. Now they are saying that they will turn on the throttling.
So really, they were just lazy with what they said they would be doing along time ago... sry man, no etf jailbraking for you.
On the other hand, if you had the overage charged 5gb plan, and now they are turning to the throttling way... you would have a vague but legally plausible excuse to demand an etf free break.

I might consider a switch if I thought any carrier were really better. AT&T has a terrible cap. Sprint has a 5GB cap except for WiMax, plus you pay $20 more. Verizon is unlimited, but their data throughput is crappy, they're more expensive, and they're moving to a cap very soon anyway.

There is no cap....where does it say there's a cap? Source please? I the OP has a PEBKAC in place here.

And no, you more than likely won't be able to break the ETF.

Actually you can bread the etf. When you purchased your vibrant from them it was marketed with certain sevices that fail to function properly, TMoble does not have an equivalent phone available as a replacement at this time. Contract is now broken. Just contact their legal department. There is no way they are going to let this go to court because they continued to sell these phones with full knowledge that they were defective. This is called fraud.

Get a unlimited usage contract
The cost differential between a term plan and unlimited is not that much. You then do not have to worry abut limitations. Furthermore, buying a phone cheaper on a contract is actually more expensive. So, It is almost ALWAYS better to buy the phone and get a no contract plan

Simple Mobile will cut your data off completely after you hit 1GB. I'm a Simple Customer as well.

There always was a soft cap at 10gb. They just lowered it. The amount of data allowed is still unlimited (unlike other carriers), they can just slow you down if you're using an excessive amount of bandwidth. It effects less than 1% of customers.
It doesn't violate ANYTHING in your contract or outlined in the T&C, so no, it doesn't let you get out of contract for free.
I don't understand the point of leaving T-Mobile when other carriers are way more strict/limiting in regards to data usage. I guess the grass always seems greener...

Unfortunately, there is no "full knowledge" of "defective" Vibrants. This isn't a bait-and-switch tactic you'd like to make it out to be. I have had a Vibrant since the day it was launched and all "marketed sevices" have worked perfectly, so it's not as if your problems are experienced by all Vibrant owners, or even a majority. Some people experience problems/glitches with electronic devices. This in not news, it's an inevitability in the industry. Not "fraud".
So, the likelihood of you having a reasonable court case for problems that are already fixed is pretty much nonexistent. I'd be willing to bet that if T-Mobile let you out of contract it's because they got tired of your pissing and moaning and having you go to another company would be a win/win situation.

Perhaps a legitimate reason for the $10/mo EVO fee

Just a thought I had today, but since the $10 fee did seem to come out of no where, but sometime after they said the 4G would be free at CITA, and since they haven't expressly said it was for the 4G data...
Perhaps, they knew the first batch of phones were going to have the screen problem, as well as other problems, but they found out after they had several thousand/hundred thousand made, thus knowing they were going to have to replace a hell of a lot of phones within a month or two and with this so-called "Prem Data Fee" they could regain some of the money for replacing all the early adopters phones.
I don't have the screen problem...yet, but I'm going to be exchanging mine because the speaker is half blown or something in the earpiece.
Any takers on the idea?
Doubt it, but it's definitely an excuse to pad their pockets a bit more, since Sprint has the lowest margins across all post-paid providers.
I was thinking more along the lines of the stupid amount of data we are going to be using on these phones with 4g. on 3g alone i've used 350mb in 3 1/2 days (i love it) Honestly this 3g is really fast, faster than verizon and t-mobile thus far (speed test prove it). I get better signal is area that my verizon phone does, but that might because its a storm 2 ()
Interesting theory, but I think it's a bit far fetched. I truly think the $10 is for unrestricted data usage, which I am thoroughly enjoying.
I for one hope they plan to use the extra money to strengthen and expand the 4G coverage.
It is a little bit far-fetched, but you never know. Last minuet stuff always happens and companies might make drastic measures to compensate themselves.
It was just a thought, especially since they've never actually said the fee was for the data, it's for the phone experience, which directly links it to the phone, if you go by what they say the fee is for.

Probably the same ideology as to why AT&T ditched the unlimited data plan right before or when the iPhone 4 was announced.
Sprint needs customers and since the EVO is going to be one major source of income and/or data usage...they probably decided to implement a fee for unlimited 3G/4G data usage while keeping the unlimited plan available. When you think of Sprint, you immediately think "SIMPLY UNLIMITED EVERYTHING!"
What I say or think really doesn't matter...the $10 fee is mandatory so there is no use in trying to fight it or be sneaky about trying to get out of paying it.
I am glad I have this fee and no soft cap. I have used 1GB+ in the last 6 days. I get to laugh at ATTs new customers about their 2GB cap hahahaha.

But why? According to AT&T, a majority of its customers wouldn't even come close to the 2GB cap and do not need unlimited data
I was always under the assumption for the charge that you can hook the evo up to any computer via usb and use it for internet access.

Well, just an update...
The Sprint store said that my speaker was wacko for sure, and when I checked the other two phones we have tonight, both of their screens are raising up. What find strange is, mine got 10x the usage over the last week than the other two did and mine doesn't have the screen problem...yet.
Anyhow, I guess Sprint will be sending us 3 new phones.
i am rooted using wifi tether and i dont feel the least bit bad for it.. they are going to screw me for an extra 10 bucs a month im going to get my monies worth..... take that sprint.
I plan on returning my Evo tomorrow. I don't care how much data you use, they shouldn't offer a unlimited data plan if they don't like you using unlimited data. I have filed a complaint through the FCC and encourage everyone here to do so as well. This is deceptive advertising, and an unlawful fee. The name of the fee is "premium data plan" but other than the 6 people that live in a 4g network, it is a "right to own the Evo fee". You DON'T have to pay it, you SHOULDN'T be paying it. I am never passionate about anything ever, but this one really puts me over the edge. http://esupport.fcc.gov/complaints.htm.

I got the phone for the hardware, and android. I want to go to T-Mobile for the HD2, but it lacks the 8mp camera, no WiFi tether, and WinMo, yuck. I understand the fee in 4g areas, but they can't justify the fee for any other area. Call/email them, they sound like idiots trying to explain why we're being charged $10. "Rich data experience" (3g network?), "1ghz processor", "YouTube hd", "android operating system" are all the reasons I have gotten. I can provide email proof. The fee is a scam, not premium data.

Even when i tethered extensively during my summer vacation this year, i still came nowhere NEAR 5gb. i think i maxed out at 3gb. 5 seems reasonable. I like that a lot better then a 100mb etc cap.

For those of us with "premium data", I think 5GB is too low. I'm NOT looking for a "stupid fee" argument, nor am I complaining about it. I think of it like animal farm. We are just more equal than others.
I can reach over 5gb without any tethering. I just can't wait until other companies put out their prices for 4g so people can stop complaining about the $10, but still cheaper than every other company, charge. Verizon is supposed to be releasing that soon

DirtyShroomz does not understand this concept at ALL.
He thinks that it "costs money" when yes - it "costs money" but the reality of the situation is corporations want to make more money off the smart phone craze. You don't "buy" kilobytes and megabytes when companies like Sprint have their own ISP backbone. Essentially, it does not cost them anymore to have customers use the supplies they are providing - they just want to charge extra.
You're right - unlimited means unlimited.
Maybe Sprint will stay Unlimited and will get more customers from ticked off customers of the other companies. I would like to see Sprint become more embracing of Android and data users. Now if we could get Sprint to unlock Bluetooth transfers to other phones. In the 6 years I've been with them I have not once ever gotten Bluetooth to work with another phone.

Now, if a company pays for 10 gigs of data and customers are using 20, then the company must come out of pocket for the extra 10. This is the reason all companies are turning to throttled or capped data. This is the reason almost all home companies have already turned to capped data. This is also the reason why your terms and conditions don't say "pure and simple unlimited" but say "unlimited as long as customer stays within reasonable means" - because it costs money and the data was never really unlimited.
Do some research, you will find some very interesting stuff on where the "internet" really comes from and how ISP's are just that, the PROVIDERS but not the "creators"
And believe it or not, you can get kicked out of buffets for eating too many plates. Have you ever been able to take "unlimited" (if any) plates home? If it's unlimited why can't you pay once and eat forever? Because it's not really "unlimited" but rather capped to that one visit to the restaurant.

The phone companies are the backbone of the internet. Sure they are not the only ones but there is a very good chance they are the ones who are getting paid when you use your local cable companies internet.
Of course they could always argue that bandwidth used by you is bandwidth that is not being sold to someone else, it just depends on which route is more profitable for them.
With these Changes Tmo is going to impose

Sure, SOME people may "Abuse" the unlimited cap, but let's think about this....
If there are 100,000 subscribers paying $10 a month extra for the "Unlimited" usage, that's $1,000,000 that Sprint is taking in.
If 5,000 of those people use DOUBLE the 5Gb that Sprint thinks is "acceptable usage", and the other 95,000 use under the 5Gb per month, Sprint is STILL making a HUGE profit.
obviously, these are figurative numbers, as I have no idea how many people have Evo's and Epics being charged the $10 "Premium Fee".

You blew my analogy out of proportion, first of all, i never been to a all you can eat buffet and expect to be able to eat unlimited food forever, but i know, i was never told, we are going to cap your plate limit at 7 plates, and if you eat over that you will get thrown out, I paid for my set fee to give me access to the buffet, I expect to eat until im full. Not until the restaurant thinks im full.
Maybe they should just up the unlimited price to a higher amount. I myself wish I could pay a little bit less since I apparently never use even a gig. So sprint how about making tier plans for this. Thats the entire problem with unlimited usage plans, regular users pay the same amount as the heavy users. Oh well no need to worry people who complain about all these extra $10 for 4G premium still need to realize that as of right now Sprint does have one of the cheapest best overall value for what you are paying no?

I'm with you man, even with the $10 fee my plan is still at least $40 cheaper than anything comparable from AT&T, Verizon, or TMo. Factor in my 23% discount and there's no question.

Since when are Bluetooth transfers locked? In fact just yesterday I transferred a file from one EVO to another using bluetooth. I've done it many times between EVOs, between evo and blackberry, and between evo and palm devices with no problems.

without understanding what the issue is. Here’s the deal - the data is unlimited. As in absolutely and truly unlimited. This has nothing to do with the $10 fee either – the data is unlimited because of the Everything Data plans that the EVO requires. However, that data is only unlimited when you abide by the terms and conditions of the contract that you entered into when you started service. Among other things, this means that you get unlimited data as long as you’re on network, and if tethering, you’re paying the $29.99 fee for the hotspot feature. The term abuse comes into play because of all of the people who rooted to get free thethering, and use that to the extreme, either as their home internet, or just simply to see how much they can actually download in a month (as in 50-100+ GB/month). To go back to your analogy, all you can eat buffets are “all you can eat” as long as you follow the terms of the buffet – meaning you have to eat within the restaurant. They won’t allow you to back your truck up and load it with food from the buffet to take home.

edit - and as a reminder, nobody has ever indicated that they were taking your unlimited data away. If the rates for unlimited data do change, or they decide to do away with it completely, that would apply to new customers sighning new contracts.

Companies want to make more money on overages. As these phones get more advanced you'll see more people using more data.

Your data is still unlimited, you'll just be throttled to a slower speed once you exceed 5gb. So likely no different to the unlimited data you had before 3g was in existence.
I still think TMO's tiering/caping is the most reasonable in the industry. At least they aren't flat out cutting you off or hitting you up to pay for another 2gb bucket like other carriers. Though maybe an option to pay up to lift the cap would be a nice option for heavy users, but that might go down the slippery slope of them going that route and being like ATT rather than the throttling they are doing now
What would actually be nice is if they didnt just flat out throttle you at 5gb but throttle you with bursting ability. that way loading the quick email or light web page will still be snappy, but if you attempt any streaming or large downloads then you get throttled down.
What im curious about that hasn't been covered much is exactly what speed do you get throttled down to? do you still get 3g coverage, just throttled. or does the throttling turn off your ability yo use the 3g signals, leaving you stuck with edge coverage?
I may just have to test it out this billing cycle, and do some very large downloads the last couple days of my billing cycle and try to hit 5gb a couple days before my cycle resets and see just how bad it gets.

Yeah i know it sucks as far as being stuck in a contract thinking you were getting one thing and getting something else
But as far as i see legally they are still holding up their end of the contract, you are still completely unlimited in your net access. They never advertised a set kbps or mbps of service they would provide. no internet provider does, unless youre talking about a leased business class line. All your home based broadband connections are advertised as "up to" whatever speed

I get it, in order to sign contracts with multi~billion dollar corporations, you must first hire a multi~billion dollar attorney to translate the fine print.

Either way, you can't argue that you aren't getting unlimited data because you in fact are. They aren't cutting off your data once you hit 5GB or charging you more money when you go over 5GB. How is this a breach of contract?

Not a huge porn fan, but I do download a ****e ton of stuff from xda trying out all of the awesome cabs, and I do dig the youtube vidz of all things science/engineering/technology.
As far as arguing that my "unlimited" data plan is now "limited"to 5GB per month and how that is somehow not a breach of contract, well I am going to have to disagree with you.
The speed at which I agreed to pay for i.e. 3G, is slowed to less than DSL when I reach the recently altered terms set by Tmo concerning usage in a billing cycle.
If they are going to throttle my usage, they can also deduct that lost speed from my monthly bill.
In a nutshell, I am no longer getting what I signed up for 7 months ago but per my contract I am still expected to pay the same amount.
Or fork over mad cheddar to bail from the contract...don't know about you but it was $lightly terrifying for me $igning onto a premium package and a $et up like this for 2 more years.
Business expense, but still My Wife would be peeved to know it cost me $300 to pay another $300 for the ETF.

All I do is use the internet a lot throughout the day looking at news and sports sites and my bill says I use 5GB a week. I don't download anything. Why buy a G2 if you just want to make phone calls?

I recieved a text 3 days ago.
I browse the net, and post regularly on quite a few forums. The only thing I can think of that kills it is downloading the themes etc. from forums directly to the phone.
I checked my account and it reads 0 due to that pesky unlimited data plan, and tmo has no way of compiling my total usage into a nice round #. All they see on their system is my entire usage broken down into individual "visits" to the network. Yeah, I almost insisted that she break out the calcuator and get to addin'!
Like I said, they seem a bit out of their element having just launched this new system.
Not one rep could offer anything more than an apology for not having more info when I went through my list of straight forward, and comprehensive inquiries.
What bothers me, among other things is the lack of transparency on their part in the form of the inability to answer simple questions. How can I be sure that they are capping at 5gb, or find out what speed have I been lowered to?
For all I know they are making up the rules as we're plowing down this dark gravel road to unknown parts.
A free speedtest could offer better data than the company I am paying good money to, and that is pretty jacked up.
To answer your question, I have no idea how I hit 5gb 1 week shy of my billing cycle ending.
And with no way to keep tabs, it looks like my Leo will be collecting a bit more dust in the future...I'd hate to blow the cap 2 weeks in.
Youtube vids now take 4 min. to load a 56 sec. clip.

i guarantee that the contract you signed in no way states what speed of service they will provide. that would be impossible to tmobile to hold upto, what about all the people paying the same price for their data service as you, but they are stuck in areas still only served by edge or god forbid gprs service?
Yes these service areas still exist, i personally experienced them on a road trip over the summer. 1 bar of gprs service in a cabin in north mississippi is real fun. i guess by your logic tmobile owes me a billing credit because i couldn't get 3g service while on the road for a week

If I left an area where service was solid, that would be one thing.
I am in K.C. where the service rivals Sprint's due to their "campus" being located here.
3 1/2 bars since day 1, another "issue" I have...
No movies (not til I pony up for coreplayer), and as far as music, the speaker sux bawls on the Leo and earbuds irritate me.
Just regular usage rivaling that of my average daily p.c. surfing was before I got my htc hd2 set up.

Anyways, after that lasts dumb post. I agree with the others up top, with the data cap instated, you are still getting data, just at a slower rate. No where in your contract does it state that what speeds you will recieve using mobile data, only that your access to mobile data is unlimited.

So I notice I don't have this famous data cap everyone is getting. I downloaded/used much more than 5gb on tmo network and never got slowed down . I'm a flexpay on contract and I haven't yet pay my bill and got network connection anyway (sweet) I have proof I'm gonna log in my account from the phone and you guys will see my account is suspended but I got network services just no calling service tho.

My old network "Eircell" used to cut numbers off if you didn't top up every 6 months. When I got a new number my old one was cut off eventually...but the gprs data still worked. Had free internet for months was great.
As for stealing service is wrong, well maybe but so is charging 20euro for 1GB of data so I guess it balances itself out so I wouldn't lose any sleep over it enjoy your free data!

I see no moral quandary with having data on a suspended phone. If T-Mo does not properly shut it down more power too you, or more data to you as the case may be. But not paying your bill in the first place is wrong. At the least it is irresponsible and should not be considered a legitimate tactic for getting service.

Do not try and justify illegal actions with indignity. T-Mobile offers a service for a price, you can use it or go elsewhere. If you feel their price is unreasonable then go to a different carrier.
Advocate flexpay all you want, it is technically under the same cap as all other plans. Maybe enforcement is not 100% or there are other problems but I would not bet on the lack of softcap continuing. At this stage we do not even know if all flexpay is uncapped or if it is something wrong with your account.

You paid $30 for unlimited web, which in the fine print outright states they may throttle you. I agree that the use of the term "unlimited web" is wrong but that is not material to the fact that the terms were available at the time of service. Unless you are on a really old contract (like me) the TOS at the time of signing explicitly disallows tethering. It has been this way for years. T-Mo just did not enforce it. Even my contract has a clause saying that T-Mo can update the TOS. So you are not getting ripped off, you are living under a false sense of entitlement.
For that matter since you are $60+ in the hole and on a suspended account you are not paying for anything and thus that justification is invalid.

Going flexpay and not paying your bills is not "fighting it." That is playing with your credit rating in hopes that T-Mo does not notice that your data has not been disconnected. It does not sound like a good deal to me.
The way to fight it is to leave T-Mo. If you are on contract a change of TOS is sufficient to allow you to leave the contract. Theft of services is not the brightest way of protesting.
Personally I am upset with the new cap since I go over 5GB a month regularly without tethering. This has forced me to adapt and use wifi occasionally. Overall T-Mo is in line with the other major carriers in the US on cost with a more reasonable (to me) way of handling the datacap.
Yea all you got to do is call them up and tell them you want to go flex pay.

It can but only if you leave debt like let's say I don't pay my bill and the account gets cancel and I owe tmo the 200 dollars cancellation fee there it can. But by paying your bill late they can't report it because you are paying for what you will have in advance. Already had this talk with tmo. So it can only if you don't pay the cancellation fee. Remember flexpay is supose to build credit tmo told me that's the point of flexpay. And I'm not stealing services I just can't pay my bill yet. It is tmos responsibilty to shut down cancelled services, what can I do about it? Nothing I'm just enjoying my free data which won't be anymore on Thursday when I pay my bill
See the reason for that they can't report when you pay your bill late on flexpay is because I already paid the month in advance. When you on regular account paying bill late is stealing services because tmo was trusting you to pay your bill on time and you didn't pay the service tmo offered you on time so you never paid for the services you got in the first place. But as for me I paid my the services I got this month already the first day I got the phone so I owe them nothing. That's why they can't report me, because I already paid for my service. Now if I cancel my phone line and don't pay them the 200 dollars than I owe them and they can for sure report me and that's never going to happen anyway

It is not stealing. It is also not a practical way of getting uncapped data service.
People always talk without doing research, in case anyone didn't know, flexpay can't bring your credit down lmao. I already had this convo with tmo on credit. Flexpay makes your credit go up that's the point and it is for people that got no credit I'm just 18 that's why I'm flexpay. And anyone can switch to flexpay to avoid losing credit over not paying bill on time and things like that. No matter what I do tmo can't bring down my credit on flexpay that's why its called flexpay.

I really think Clear's lawsuit against Sprint for the $10 fee is what forced Sprints hand here. I can't say I think its a terrible decision as was previously stated, their prices are still cheaper then other carriers.
Now I just have to work stuff out to get my wife to switch to my old Hero before 1/30 so we don't get charged $10/month more.
Pretty much telling me that they expect all their future smartphones to be 4G.
Oh, and you say it's not a 4G free, you're sorta right. Sadly it's the exact same "Clearwire" fee that Sprint pays them for every handset sold with 4G capability. Sprint is just passing that fee along to the customer.

So then what is the other $10 for? If I already pay for unlimited data why am I paying another fee for the same thing. Does anyone watch the office? Remember the episodes where Michael starts his own paper company and when things start to go south he starts calling customers asking them to pay more for services already delivered? Ya, they don't react so well. This is exactly the same. I signed up for a service and agreed to certain charges. I agreed to the 4G charge because I was bold-faced lied to by my sprint rep. Its my fault for believing him and I plan on owning up to that when come august my wife's contract is up and I cancel mine with Sprint.
Sure 159.99$ for two lines with 1500minutes and "Premium data" sounds reasonable but my wife and I combined never use more than 300 minutes combined across all types of calls (excluding nights and weekends). But hey, lets include those. That is when we call our relatives who are mostly on Tmobile. On Tmobile I can get a plan with 750 minutes for 139.99$ and real unlimited data as well as 4G in my area. So why am I paying Sprint so much for so little only to have more charges heaped on me? Because I was a sucker.
Finally, to return to my first analogy: Sprint is the Michael Scott paper company. So why am I paying Sprint so much for so little only to have more charges heaped on me? Because I was a sucker.

You can get the $109.99 plan for Employee Preferred which has 1500 landline minutes, so that you're paying $129 for 2 -4g devices. If you really are that unhappy - just pay the $70-80 ETF and move on.

anyone read the press release? they keep mentioning things like "unlimited text while on sprints network" and the other carriers it says "unlimited" ... they changing their roaming policy?
i know it's been something like more then 50% usage while roaming they can close your account or at least restrict it.

If you read the (not-so) fine print, normal "unlimited" data is capped at 5GB/mo. It has been like that for forever and a day. Every other carrier was like that. The extra $10 REMOVES that cap and allows you to go over that 5GB/mo without incurring extra charges. You aren't going to get real unlimited data from T-Mobile, Verizon, or AT&T as they all have caps and do not offer uncapped data for a meager $10 extra. Your analogy fails because they are adding to an existing service and giving you more for your money. They're removing the cap and allowing you to consume as much data as you can not charging you extra for what you're already getting.
If you were lied to by your Sprint rep, that's your fault. It is your duty as a responsible consumer to at least look at the terms and conditions of the contracts that you sign into as well as do research. If you don't then you cannot claim ignorance as a justifiable excuse for being shafted.
"Unlimited" in the mobile world has always meant capped, whether you saw that cap or not. The premium data charge removes the cap. That's not hard to understand and you can whine and complain all you like but you'll still be wrong.

That's because if you're roaming they can't guarantee delivery of your messages but on theirs they can. They can't speak for other carriers.

I agree 100%, why should i have to pay $10/line more for unlimited data when my plan already states unlimited data. The only consolation is that it won't affect only 4g phones anymore.
Your unlimited data isn't unlimited and never has been. There's always been a 5GB cap. Learn to read.

Its in the fine print of the sprint rate plan guide...go pick one up and read it. While you're at it go pick up rate plan guides from every other national carrier and you'll find the same thing. You are wrong. If you're not happy then go get Metro PCS, or T-Maybe....

First of all, I took responsibility for taking my Sprint Reps word. I actually did my research though. There is 4g Coverage from Seattle to Tacoma north of me and Portland South of me. I live in the capitol of Washington. Why wouldn't 4G come here? I looked all over for a 'roadmap' of releases of 4G but I could never find one so when a Sprint Rep told me that he knew for a fact that 4G coverage would be in my area within a 2 months, I bought it.
I read every contract I sign and I regularly question the other parties on the terms, I know that there is a "cap" on the data. I also know that the 4G fee gets you unlimited 4G (or it did until this comes into effect). There is nothing justified here, its just corporate games to make up for money they lost.

Actually, you're wrong. It depends on how you get your contract. I know a lot of people with completely unlimited data on AT&T.
If your total usage exceeds 5GB (amount is subject to change without notice; please check T-Mobile’s T&Cs on www.T-Mobile.com for updates) during a billing cycle, we may reduce your data speed for the remainder of that billing cycle.

The above is quoted directly from tmobile's terms and conditions. May reduce data speed. That means I can continue to use data over 5gb but they might decide to throttle it a bit. That's better in my opinion given that I rarely use even close to that much even with two android smartphones on my plan than having to pay twice for "unlimited data" on Sprint.

Those on AT&T were grand-fathered in and will lose their unlimited plans eventually. You cannot currently get that plan anymore.
T-Mobile's data throttling is more than "a bit" from the experience of my friends. The throttling makes it as fast as 2G/EDGE.
The unlimited 4G is true and it also applies to 3G for those with 4G devices not capable or just not using 4G.

I know very well they were grandfathered in and I know that no one can get that plan (its the reason those people are not leaving AT&T despite hating their service). As I stated, I have never gone over my data cap on sprint so I have no fear of my speeds being throttled after that limit.
Finally, the unlimited 4g is not currently applied to 3G and if they do plan to apply it to all data as this would imply:

Do you even read before posting? I clearly said I've never gone over and therefore you are absolutely I am in no way entitled to a refund. However, given how they are changing the scope of the charges that they've already been applying to accounts for months it would be the just and moral thing to do to refund any overages customers who have been paying the fee for unlimited data but have been charged overages for 3G data may have incurred.
