I need to go about returning my 8125 to warranty exchange. Problem is, I did not purchase the phone, rather bought it brand new off of someone else. (who bought it from cingular) The other person is unwilling to do the exchange. Excluding the issue of the reasons for the exchange, and any physical damage (there is only scratches) could I do a warranty exchange without the involvement of the seller? I plan to say the phone keeps freezing. Worked with my razr.
Also, I flashed the phone to a new rom, will this void the warranty? Do i have to flash back to summiter's stock rom? Thanks a lot.
1) Normally Cingular's gonna want some sort of proof of purchase. Since the phone's not been out more than a year though you might be lucky on that point.
2) It had better have the STOCK ROM (not summiter's not Mr. Clean not anything custom, STOCK) before you send it in. Otherwise they're gonna know you messed with it.

Well according to this link http://www.htcwizardweb.net/node/161 one of the ROM's available from Summiter is infact the original ROM. Summiter must have backed it up before starting to play with it, I guess.
If the rom is still a cingular rom will not void warranty.

I have the same problem got it brand new on ebay everything was wrapped in original box including the sim card. the touch screen is having issues the bottom part wont' do anything. tried to call cingular the would not help .. i explained that i am a cingular customer but i have the phone so i can use it on a data plan with t mobile and they would not help at all told me that if i didn't get the item from them or their authorized seller they will not help. I have been on the phone wiht HTC america a total of 4 hours back and forth and they won't help. look sell it on ebay...... and call it a day. Did you tell them you didn't buy it from them? I've done several exchanges and they have never asked me that. They just ask for the IMEI number (which identifies it as a Cingular phone and the model) and then process the exchange. Whatever you do, do NOT volunteer the fact that you got it elsewhere and you should be OK, but yes return it with the stock ROM

Now this is a logical fallacy. Have you even bothered to price the cost of a Wizard in the UK? If they were priced the way you say, you'd be paying a whole lot more for them. Retail price on an unlocked Wizard is between $600 and $700 USD. Retail price on a locked unit (ie, just walk into a store in the US and buy it straight out) is $450. With a contract from either T-Mobile or Cingular you can get them from $0-$100.
When you buy used on eBay you always take a risk. Without a proof of purchase, the store/carrier is really under no obligation to warranty the phone for you. Sure, many times they will but it is silly to assume that they have to do it. If you wanted that level of service you would have bought from the store in the first place. Nothing says you can't walk into a retailer, buy a phone and not get a contract.
If you've got a defective phone you really should be taking it up with the guy who sold it to you on eBay as fully working.

I got it on ebay and the guy who sold it said it was brand new now i can't get in contact with him. the contact info that ebay has is a po box. they guy won't return my calls. He sent me one email asking me for the imie number after i gave him that number all of a sudden the phone would not boot into windows. The inial problem was the touch screen now the entire thing is toast. Should I call my credit card company and dispute the charge.
Just giving someone an IMEI number should not cause a boot failure by itself, however the simply fact that he asked for it is somewhat suspect as there is no legit reason for a seller to need to ask a buyer for the IMEI number of a phone after it has been sold.
I'm not saying this is your case, but the first thing that pops to mind is insurance fraud. A popular eBay scam right now is to sign up for phone service and get an expensive phone for free. The person in question will also get phone insurance. Then they put the phone up for sale and collect the cash, while at the same time reporting it to the carrier as lost or stolen. The phone then gets replaced and they have both cash in hand as well as a new phone.
In much of the world (ie all over Europe) this doesn't work well as IMEI blocking has been implemented by the carriers there. If a phone is reported lost or stolen the IMEI is added to a database and none of the cooperating networks will allow it to register. In the US this hasn't happened yet on the GSM networks. With the CDMA networks they tie to the ESN on the phone and will block a lost or stolen phone (as well as one with an outstanding balance).
Regardless, had the IMEI been blocked by the carrier, you would not be able to make calls but the Wizard should still boot up and function as a PDA. Of course, if the seller was trying to pull insurance fraud that would explain why he asked for the IMEI and is now ignoring you. It would be rather simple for the seller to do a warranty exchange with Cingular on your behalf, but if the phone was reported lost or stolen he wouldn't exactly want to be phoning up Cingular and asking them to service the phone.
Just some idle speculation.

I believe that you should contact EBay or Paypal and your credit card number to put the case on the dispute...let them know that the item not in working condition as they advertise. You may spent a lot of effort and time for it but at least..... this will make the seller to contact you and deal with you again.
Format has failed
I was able to flash the rom. The flashed completed but it still freezes at the start up screen it says the following:
IPL 2.25
SPL 2.25
GSM 02.25.11
OS 2.25.11.1
its stuck onthe Cingular logo screen. When I try to do a hard reset it give the error message

Sounds like it is having trouble initializing a section of the flash. My guess is that there's a bad flash chip on there. If I ever saw that on my Wizard I'd be on the phone asking for a warranty replacement.

update of my situation
Well still no reply from the seller so I called the credit card company and dispute the charge. i have copies of the guys ad... and copies of the rude emails he sent me. The credit card company told me just hold on to the defective phone and the emails and they will take care of it.. Apparantly the seller was working from a Post office box he was pay apal verified. I just hope no one else falls victim to this guy.

If you bought the phone off of eBay, AND are not an AT&T/Cingular customer, they will not replace the phone... what is wrong with it...?

Very few warranties cover dropped devices... There are a few though, but you have to have the warranty in place on a new device and there are some caveats to them... As for the eBay seller, I doubt that they will offer any real assistance after 4 months of usage... There are a few other options that may be available, but they all concern questionable ethics and morality, so I won't even mention them...

Yep; you're essentially screwed. When you buy something from eBay, you rarely get a manufacturer's warranty, especially if the seller is an individual as opposed to an eBay Seller (business). Even if they are a legitimate business, I too doubt they will warranty any electronic device that has been dropped.
Next time do two things--put the phone in a protective case and use a screen protector; both things are inexpensive insurance against damage.

You cannot ask your friend to have it done, since that phone is not listed on his/her account... That is why you were originally asked for the phone number... You have to buy a new phone or pay to have your phone serviced... You can contact HTC and send them the phone and pay the cost... There is no legal way that you can have the phone repaired under any warranty agreement, after you have already damaged the product...
I hate to say it, since it has already been said... you will have to either pay for the repair, or buy a new phone...

Wise up, people... the phone is utimately warranted by HTC as the manufacturer of the device. They prefer to route things through the carriers because it's easier that way, but you can deal directly with HTC.
To the OP: All you can do is contact HTC and plead your case. You may need to be persistent, but they do have non-carrier and out-of-warranty service. May take 2 or 3 tries to get to someone who knows this.
Oh, and despite what some have said, if you bought if off eBay it still carries the one year manufacturer's warranty (whether or not it will cover having dropped it is another issue). They track the warranty period by S/N. I recently had one -- that I purchased off eBay -- replaced, no questions asked.

Where was the sim found exactly? if it's second hand then it could be the previous owners. If it's new then it's either a pay as you go card, as already suggested or a contract sim card waiting to be activated.
It could also be a stolen phone but for $350 i doubt. Easiest way to tell is if it came with the shipping screen protector on it. It has the words "to prevent damage please remove from pants pocket before sitting down" or something like that.
Well, phone is like new t-mobile USA, seller says in auction:

Phone contained few family pictures, no call history, when I click on software information is showed 7 min of outgoing call and almost 2 min of incoming call.

I shouldn't worry about it. I'd guess it is a t mobile payg card, because the phone will still be locked to tmo, so the seller is including one. That way if some dim wit buys it and tries to put a different network sim in and it doesnt work, the seller can say 'hey, i gave them a sim'. The hours testing sounds fair but only 11 months warranty? how long has this guy had it? overall it sounds above board and if it is nicked you actually have proof you had no idea as long as you take a copy of the item description and keep the invoice
TMobile USA version of the HD2 comes with a Tmobile sim so that you just have to call tmobile (number on the sim) and provide the sims number to activate it (this is so that if you bought the phone via phonecall to tmobile and not in a tmobile store, you can use the phone no problem). That's most likely what you're referring to.
Seller replied to my question saynig:
"I kept the sim card since it was linked to my personal data and

I can imagine only one scenario (if he is being truthful). He was already a T-Mobile customer when he purchased the package, and he just shoved his old sim in (the one that contains his contacts), he didn't need the new sim included in the package so he left it intact.

When I brought it home and told her how I got it, she became worried that if we put her sim card into it, and it IS stolen, a red flag will show up at T-mobile and she might get into trouble.
Is there any way T-mobile can tell who has the phone if it IS stolen? Also, if she ever has to send it in for a replacement through warranty, will she be screwed? I know I shouldn't have bought it off of Craigslist, but it's too late for that now...

lol, i know. it sounds pretty bad, but i assure you, that's not the case.
they can tell if it's stolen. they can tell if more than one person has the same IMEI number. whoever was using the phone will have that IMEI on their account, and if your gf puts her sim card in it, they will be able to see the IMEI from the phone. that's done on purpose, so that if someone does report a stolen phone, and the IMEI turns up on another account, they can flag it. however if it was not reported stolen, then there isn't much they can do as they don't know whether or not the original owner sold it to you or a shady guy on craigslist sold it to you, so reporting to the authorities would be pointless for them, as it may have been a legal transaction. as for calling them, they're probably not going to give you the info if that IMEI is registered in their system, they may not even tell you if it is. but if it has been reported stolen, and the IMEI shows up under a different account it will probably be flagged, I'm not sure what would happen at that point. More than likely rather than calling the authorities they'll just cut off the service to the phone.
Try a prepaid sim card and see if it was IMEI blocked?

If you got it with box, supplies and cables its very low chance that it stolen. Actual price in my local craiglist is really low, but it doesn't mean that most of all are stollen

If that were possible I would like to think they would have told me when my TouchPro2 got stolen... The fact that they didn't mention anything like that leads me to believe they can't tell just by the sim card.
i buy/sell phones on craigslist almost weekly and put my sim in all of them
when i call t-mobile to change the internet plan they always ask me where i bought the phone. i always say from t-mobile and they never say anything about it. guess they cant really tell

I'm not in the US but i always purchase phones from US and UK on ebay.
Always when i buy phones which are doubt to be stolen or reported as stolen i use this site www.checkmend.com.
They are even recommended by ebay. They claim to have a connection to a database that has all the information on Mobile Phones, Laptops, GPS navigators, etc. Which they can track by the serial number.
In your case you will need to provide them with the IMEI number of your phone and they will give a report on the status of the phone and past owners if they are registered. (they send this report by email instantly. they charge you USD 2.99 for this service. i thinks its quite worth than the risk.)
in my experience I've tried this service twice and a HD that i bought from the UK was returned with a report that said "This item has been blocked during its lifetime by one or more UK network(s)." which means it was reported lost or stolen.
and i even tried my HD2 which i'm using currently which i got from US cos i didn't get any box or accessory with it. But the report came out clear and i am in peace of mind.

usefull site. does it give any detail? i blocked my last phone thinking i'd lost it, 4 weeks later it turned up in a friends sofa, so i had them un block it and used it for another 18months.

Someone mentioned the IEM number that is the way they can tell if its stolen. So when and IF you ever take your phone into the store to have the useless sales people help you solve some problem. That is how they will know if its stolen. If there is a way to tell by electronic signal Tmobile simply doesnt care. I asked when I bought mine and they told me to get insurance. I asked how do you know if I dont just keep the phone and get a new one for 100 bucks. IEM number shows up was their answer.
Your IMEI and sim info are constantly broadcast about the cell network, you don't have to go into a store for this information to be picked up.

I could be mistaken but I believe that if you select the G1 unlimited data plan, then any smart phone you have after that will not need to be updated...I am using the G1 plan with my HD2 and it works fine. So maybe you can avoid lying to them.

Now I have a "No Service" message whichever SIM I try to use. I tried cleaning the SIM contacts, restoring earlier Titanium and Nandroid backups and eventually restored the official Orange 2.73.61.66 ROM.
Still no service.
Maybe it's become blacklisted. How can I check this?

You can call up your service provider (either o2 or orange) and check whether the phone is blacklisted.

No - but if you update to the latest official release it should also update your radio. Either way is fine. Personally i'd say try the network first - they should give you a straight answer.

the straight answer from o2 is that the phone is not blacklisted. This seemed like a genuine, considered and helpful response, so it probably wasn't a fob-off but who knows for sure? Maybe I should get that response in writing before I pay to have the phone repaired, if such a repair is a realistic possibility.
Do radio versions become obsolete as they're superceded by newer ROMs?
I ask because from what you suggest above, it seems that wiping the phone yesterday and installing the official Orange 2.73.61.66 ROM, would've installed afresh the radio version associated with that ROM, which still had the phone showing "no service" after the installation.
Maybe installing the very newest ROM will have a better effect.
Because I'm not yet managing to pinpoint the solution, some details of the "No Service" fault might shed enough light for someone to suggest the cause.
Yesterday morning there was "No Service" using the o2 SIM which had been working OK for 4 months. Replaced the SIM with an Orange one, which worked for 10 minutes, allowing calls and texts both ways, then the Orange SIM began to display the "No Service" message constantly after this short period of functionality. This is what made me think that some sort of blacklist process was being introduced by stages, rather than it being a direct functioning/non-functioning hardware or software fault state.

Completed the 2 part update of 2.1 Orange ROM to see if that would fix the "No Service" problem but no improvement.
I recently found a thread where someone with a HTC Dream pulled the phone apart and reseated the antennae wires to successfully recover from a constant "No Service" problem.

Maybe the Hero is sufficiently similar for me to carry out this kind of remedy.

Sounds like you may want to phone orange before opening the phone. I think they have blacklisted the sim or the phone. You may well still have some form of manufacturers guarantee from HTC also.
it was Orange locked, unlocked to o2, worked fine. When you put in an Orange sim, it then decided to say no service. To me, it seems that either didn't like that Orange sim, so have blocked that, or didn't like the phone being on their network, so blocked that. Possible the phone could be an insurance scam, or that the SIM could have been registered as stolen or something (albeit incorrectly).

I called Orange and they told me that the phone is blacklisted as it
has been reported "stolen or lost". Orange said that contacting eBay
and resolving the matter through them would get the blacklisting
lifted.
I spent most of the rest of the morning trying to negotiate the eBay
online resolution procedure but it doesn't recognise items bought in
April.
I telephoned to speak to an eBay person and contacted a lady who told
me that the 45 day dispute period was over and my only recourse was to
take the matter to the police.
Maybe there is a PayPal resolution possible so I'll try there next.
I don't see a lot of point in trying to contact the seller under the
circumstances.

Don't contact the seller. I would leave it to Orange and contact the police as well.
Definately phone the police, The seller has commited fraud, or had originally stolen the device themselves. I'm shocked at eBay, they should be helping with this due to fact that, again, it is fraud / theft, disregarding the 45 day policy. I'd see if you can phone again and get someone more understanding.
I agree with btdag, definatley don't contact the seller.
Remember to keep records of all correspondence with police/eBay etc, as this will likely turn out to be insurance fraud, where the seller has reported the phone stolen or lost. By reporting this to the police, along with your proof of purchase from the seller (ideally paypal information showing seller's address), they should be satisfied you actually purchased it, and will likely end up chasing up the insurance company that paid out.
The seller will likely end up being done for insurance fraud here, so make sure you don't do anything which could prejudice legal proceedings, like contacting them. This is a matter for the police now.

There's just one aspect of the situation I'm concerned about. This is based on the suggestion by some people elsewhere, that the blacklisting by Orange could be a mistake. Something that is not uncommon it seems. I'd like to ensure that the blacklisting is not a mistake before I approach the police on this matter.
Once I'm convinced that the blacklisting is for a genuine reason, I'll follow the advice given here with gusto.

use the checkmend site to make sure its actually stolen.
its recommended by the police, after calling orange its your other real alternative in finding out.
i cant see how it is oranges mistake. if it was a fault with your sim, fair enough, but you tried with a different network, no?
personally i wouldnt bother with the police. id just resell it on ebay as faulty and chalk it down to a lesson learnt and never buy a phone off of ebay again.
thats just me though.
This happened to me when I bought an MDA Vario 2 (HTC Hermes) from eBay. ebay won't help as the seller just waits for a few months before committing the fraud. I tried eBay and Paypal with no success, and reported to the Police who were predictably uninterested. Sorry to be the bearer of bad news, but I'm afraid you're stuffed - lesson learnt, I don't buy phones from eBay any more. T-Mobile customer services told me that it's very common, and that if you buy a second hand phone you should ring the network and register it as yours - that way if someone else tries to report it as "lost" the network won't do it.

I bought an S8+ from someone who upgraded their contract, which has developed a line across the display today. Will Samsung repair it under warranty regardless?
Samsung might need a receipt but you'll have to check. Worst case the repair will have to be initiated and done by the original owner. If this person is a decent human being they should be able to handle this for you, either through the carrier or through Samsung.
It should be repaired.
It depends whether the warranty is transferable. Hisense TV's for example don't allow warranty transfer. You'll have to read the Ts&Cs.
Just came off the phone with Samsung UK and they've organised a brand new phone to be delivered on Tuesday, no questions asked. Brilliant.
just make sure you get a copy of the upgrade paperwork from the original owner and then just do the warranty call saying you are that person and give your work address to get the phone sent back to.

No need, new phone delivered this morning. I see lots of people have problems with Samsung support but I really can't complain as it was a painless experience.
My only worry buying a contract phone from someone else was that they would report it stolen and me ending up with a blacklisted phone. No more such worries as I have a new IMEI number.
