Did it come in a brand new box with a charger? Because if not, it was a refurb. They put new backs on them and redo your customizations if you had any.
If it was refurb the software would have been updated

Maybe but according to Motorola all of the warranty replacements are refurbs now. They send you a refurb with the same customizations as your old phone. Verizon isn't going to buy you a new phone; they are going to get a warranty replacement for you from Motorola.
They kept happening after a new SIM.
If he said it was new then new. What's the point of going back and forth?

So that other people won't be misled into believing they will get new devices when they go through Verizon. If it didn't come in an original box with a charger, it is not a new device, it is a refurb. They put new backs on them and will make the refurb have the same customizations as your original.

I think you are misleading others well. Whether you get refurb or not is rather simple, it is depend on their stock availability. If they don't have any refurb available, then you get a new one. They will not waste their time to dissemble two-three refurbs to customize one refurb.

You don't know what you are talking about, lol!! Motorola has LOTS of returned devices available for refurbs at this point. They put new backs on them and redo your customizations.
Stop spouting off about things you don't know anything at all about.
OP never answered when I asked if his device came in a new box with a new charger. Instead he claims the OS version number proves it was new. No it doesn't - if it didn't come in a new box with a new charger, it isn't new it is a refurb.
When the device is new and they don't have lots of returns available for refurbs, they give you a motomaker code to make a new one if you need a warranty replacement and it comes in a new box with a new charger. Otherwise, you get a refurb.

When I did my replacement what OS came on the phone was based SOLELY on what the ORIGINAL phone had shipped with. If the ORIGINAL phone purchased shipped with 444 that is what your replacement should receive. If like me you got a new phone that came pre-loaded with lollipop then your replacement will also have lollipop pre-installed.
Wow..my excitement to be off lollipop has caused a stink. I did not receive a new charger. In the past when they sent me a device, I knew it was used simply due to the software not being what the phone was initially sold with. That's logical. What is not logical is to assume they are going to take a new device out the box, update the software, then place it back in the box. And yes, everything depends on stock availability. If refurbs are gone, you get a new one. This was not through Assurion. At the end of the day...can't we just celebrate that someone has a the os they wanted?

ok heres the deal. I have 3 manufacture defects with my hero.
1. Lots of dust under my screen.
2. Phone overheats when charging and running say google nav. (car charger)
3. More than 15 dead pixels all over the place.
my phone is going to have to be replaced. so my question is do you think they will give me a new Evo instead of another hero.
also I have sprint warranty.

More than likely, no. But you never know.
For me, historically, it's been:
1st phone defective, replaced with same model, up to three times, then they will offer a different phone. I seriously doubt that they will offer an EVO to replace the Hero since the Hero isn't at its end of life.
Think about this: You buy a Chevy Malibu, take it in 3 times for manufacturer's defects, it's a lemon, do they upgrade you to the Corvette? Nope.
I wonder if they'd do it if I offered some cash as well

No they don't give you a Vette, but they don't give you a refurbished car either. It is possible to get an EVO but you are gonna need to sweet talk them to death on phone. I have only once gotten upgraded after a few bad phones, that was the ENV2 to Voyager.
My guess is that you'll be aloud to move over to the Moment. Good luck with trying though. I bought 2 heros in December and both are still in perfect shape. No dust or paint chipping.
Can always ask...
The rule has always been that they will swap it for an equivalent phone of 'equal or lesser value'. I don't think the EVO is going to apply to that.

You're right, they don't give you a refurbished or new car of the same model. Because it's not in the terms of the warranty. Just like it's not in the terms of the Sprint warranty to upgrade to the top of the line model, only to repair or replace with the same or COMPARABLE model, and that repair or replacement is at THEIR option. They could just keep giving you refurbs over and over... wait, they already do!
just like everyone that had the htc diamond and touch pro, they waited a couple months after the tp2 and they all of a sudden there was post after post of sprint gave me a tp2 and swapped out my touch pro. You won't get it right away but after a couple of months it may become possible.
I moved to the Hero from 3 defective Pres, but I had to show the store assistant manager that I was nice, competent, and a repeat customer.
so if I am nice, maybe wave some cash around I might get what I want.. maybe I should send my wife into do it when the Evo comes out.. women seem to get what they want.. haha

I doubt they will make me pay full price. I convinced them to upgrade me from my instinct to the hero as a contract extension 4 months before my renewal. I have learned that being persistent but nice can normally get you places.

I have always been upgraded to the latest and greatest for my phone problems..
titan=>mogul
mogul=>tp
tp=>tp2...
now what they wouldnt allow me to do is go from the tp2 to the hero
my understanding with the store i deal with is...
3 swaps within a 3month period will force them to ask you if you would like something else, and they will have a list, I also found out that they wouldnt allow me to go from winmo to android, nor from a keyboard to non ketboard or vice versa,
so i'm inclined to think that those of us with issues on the hero, will not be allowed to swap for the moment since it has a keyboard, and I've already tried that, and the swap phone needs to be of the same type...
and I have been told directly, they dont care about the phone.. its about continuing service.
I also have insurance and tep.
If you are having many problems, and it has been documented in Sprints notes ie you've called and complained with no results, the escalations department @ Sprint may be willing to deal providing you get a sympathetic one. Best Buy however told me when I. purchased my Hero and their ins. (have both) if unable to fix my phone itwould be replaced with a new Hero, if still being built, if not, then I would get the newest version of it. imo would be the Evo.-)

in order for this to work out to your advantage, you'd have to wait until the Hero is no longer available from Sprint, and even then it's a slim chance.
Unfortunate for you, you'll more than likely get another Hero, or a Refurbished Hero depending on the way you go about getting your replacement.

this is strange... do you know what department you talked to? If they performed the ticketing process that i believe they did, then you'll get a return kit with your replacement phone, and i would advise that you mail in the defective phone, if not, there's a chance that you will receive a charge in 2 bill cycles from receiving the replacement device showing a $500+ charge for the replacement phone.
In summation, if you get a return kit (a return envelope rather), then use it!... if you feel that you don't need to do this, i'd then advise to call Sprint and make sure that your account notes specify that you don't have to return the phone... otherwise, you need to.
My original phone was broken (when I bought it). When they sent me a new one, it came in a cardboard box, no battery, no sdcard, no battery cover.
Called in to make sure it's new... "well to tell you the truth sir, it's reconditioned like-new.... no we can't replace it, because the phone that you sent to us was used, so we had to send you a used one.... I'm sorry sir, theres nothing we can do."
buyer beware...
thats usually how it works, especially with a phone in such high demand
except that Verizon policy states that if you're within your 30 period, you can replace your phone with a BRAND NEW one
I've decided that if customer support won't send me a new one, there's nothing stopping me from just going around them. Since I'm still within 30 days, I'm going to simply return my phone for a refund of my purchase price, and order a new one.

TBH sometimes if you describe the loophole you described to the person you're talking to, they will help you out.
I've literally told customer service reps for various things I've owned that I can simply do that, and they usually oblige.
Very true; i started having issues with my droid and customer service informed me that i would have to put up money for the replacement device. After they received the failed device they would credit my account.

There are two type of replacements for the x only within 30 days. First would be a wfg which would come with charger etc. and would be back ordered. The second would be only the phone and for a doa which you had they are new searching the esn shows no other activation s. This one is only for the x atm.
I'm a vzw tech btw and have no reason to lie
I went round and round about this with them. You are getting new ones in the little white boxes without the battery (for now)
I'm not sure it's "refurb" providers send phones without the bact etc to help avoid people calling in pretending their phone broke and then selling one and keeping the other. I know you aren't doing that, but I'm sure that plays a part it why they do it like that.

Probably a refurb. Have you been reading the forums? Plenty of people getting swaps for no reason..

Aren't sellers normally required to identify a refurb? Look for a sticker when you open up the back.
The box
usually they come in a different non printed box. And, the yare supposed to disclose if the unit is refrub look inside behind the battery... etc
Also look at the terms of your replacement insurance in the contract. It usually will have some disclosure LIKE: we will replace with like kind new or equal.... or something like that That is contract-eeze for Refrub
They all come in a white box. That doesn't mean it's a refurbished phone or not. The stickers are usually slightly different too.

refurbs are fun! if you replace your phone alot, on the 3rd time, you are eligible for a different phone. my HD2 was borked as bawls. got it replaced with refurbs, which still didn't fix anything, and now I have my shiny new vibrant having phone insurance is great
EDIT: i had my vibrant replaced already and it was a refurb, but still works just fine
i have a replacement, and i dont care if its refurb. or not. fact is it works better then 1st one i had, and as long as its a samoled screen and all specs work what difference does it make? besides once its rooted with one click lag fix the phone is blazingly fast
I got my replaced and now its still perfect after 1 month.
Getting a refurb is bad for factory warranty purposes. That is why lots of people don't like them. Manufacturers track manufacture dates by IMEI, so you can't lie to them. Buying a phone now and getting a refurb from July is bad.

I just received a refurb last friday for my launch day EVO and it was not in full working order. The Home button would not illuminate and the menu light was faded. I was pissed. I'm receiving my 2nd refurb today and if its messed up I'll be requesting a new one. Most of the time in the past my refurbs have been on point. Only once did I receive 2 bad BB and demanded a new one and they sent me one.
As for as receiving the package DD, the EVO refurb came in a small general Sprint box that looks like one they send all refurbs in. All replacements either via Sprint or Ausrion will be refurbs. Remember if you are inside your 1 year warrenty which all EVO owners are Sprint will replace it, unless of course you smashed or lost it.
BTW my refurb was a HW 0003. Same as my launch day one. I'm really curious if the 0004 version has a better screen like some say.
Interesting. My launch day Evo is HW 002. I have had the screen replaced due to dust under the glass in the upper left corner, and the camera lens cover replaced because I cracked it. Otherwise, the phone works great!

No. The phone you have now is NOT new, its used, therefore you wont get a new one back. You have 30 days to replace your phone with a new one, after that its considered used. And no, its not your "right" to get a new phone. If you get in a car accident, your car insurance company doesnt give you a new car. They fix the one you have with reproduction (refurbished) parts.

WTF? Mine was definately refurbished because it had scum and dents in the outer casing!
Other than cosmetics it came with 2.2 and rooted it just fine.
Refurb if they have any, new if they don't.
I received my phone today and it was a refurb. Rooted fine, but still a refurb.
Asurion put out a communication a couple weeks ago that due to low supply chain (which has been ongoing), they were shipping new in box.
I haven't heard anything changed recently, but seemingly the supply chain has been restored, so refurbs are going out again.
I have received 3 Phones from Asurion, yes, they love me...haha. Anyway, if you get a refurbished one as I did. Dont accept it. Call them back, tell them that you refuse it. Ship it back, and get a new one. Although it may take more time, it was worth it to me to recieve a new one, the one they sent was if far worse shape than the one I had before It got broken..

I agree.
Unfortunately when phones are refurbished they tend to not fix this issue.

so this really works? I just got some damaged mine after a week of use, (sad that this is the first phone i have wrecked within a year). I really dont want a refurb phone but I need a phone because of work. Did you just call and demand a new phone not a refurb?
