Hi, I had my phone for a few days before I noticed that the front speaker grill was lopsided. I got mine from affordable mobiles in the UK sim-free. I've contacted them regarding a replacement and they are saying that I should have contacted them in 72 hours to report that my phone was damaged. I told them that the phone is not damaged and that it is a manufacturing fault. After quoting the Sales of Goods Act to them they have said that I could send them the phone if I want and they will inspect it but if it is deemed to be cosmetic error that it won't be deemed faulty and they will send it back to me and not replace the handset. They told me contact Samsung I did already but they said my contract is with the retailer.
Do you think the store should replace the handset? I received the phone on the 3rd of June, but I didn't use it straight away as I was waiting for cases to come.
Anyone had any success in replacing the handset because of the lopsided speaker grill? can it cause future problems?
Is there anyway to fix it? I tried to slightly push it down but that didn't work and I don't want to break anything. How is this part attached to the phone?

Personally i would go to shop , try to explain nice whats about, but if they would keep with their 72h bull$hit ....i would argue a bit and ask for manager. And i would i ask to put my phone side by side with any other demo ones to compare. Something like this is not acceptable. Its a manufacturing defect.
Thanks for the reply, unfortunately the store is only online. So I will have to send it to them through the post. In their terms and conditions they say that if your item is faulty within 28 days they will replace it but when they emailed me they said that if the problem is a cosmetic error I won't be entitled to an exchange and they will just send it back to me.
They told me to write a letter stating what I would like to do also that I should send with the phone. I will add more detail when I get on a plane as I'm typing on my phone.

Ok no problem if is online. This is what you have to do: You paid by paypal or Credit card? Either of them you have right to claim refund if the item is not as described/faulty. Its a manufacturing defect, doesn't matter is cosmetic, the phone should be flawless. So contact them again, and tell them if they not gonna replace you will ask bank to refund you and thats all.
When I ordered it I tried to pay by credit card but the order wouldn't go through, so I used my visa debit card instead. There was a deal going on and others also said that when trying to pay by credit card there system wouldn't accept payment.

So contact the shop you bought from, best is to call them. And say that if they not gonna replace you will go to bank and chargeback the transaction. Try like this, if still they gonna argue about this , just ask the bank to chargeback and thats all, but i'm sure if you gonna tell them you will chargeback they will solve this for you.
This is a quote from a bank here in Ireland:
What extra protection does Visa Debit offer me?
''If you make purchases with your Visa Debit Card and they show up damaged or not at all, then we may be able to help you recover your money in the event that you have not received a satisfactory resolution from the retailer.''
Good luck man.

thanks for your help.
I'm writing them a letter now, that I have to send in with the phone. I spoke to somebody not long ago who said that I would need to send the phone in for them to look at it before anything.
I mentioning that the speaker grill is lopsided and that it must be a manufacturing defect / fault. I'm mentioning the Sales of Goods act and my statutory rights.
Anything else anybody can think off? Can that speaker grill end up breaking/peeling off or anything?
This is horrible service, I tried getting mine through them but went with virgin instead... glad I did now, sounds like there stalling to try and wait until the 28 days is over... document everything with pictures/videos before sending it off with time/date stamps just to be safe

Hi, I finally got it replaced. I sent in a letter with the phone that I returned mentioning the Sales of Goods Act, my statutory rights etc and they sent me a new replacement phone. They didn't communicate anything with me, I just received a new phone in the post from them. The new one doesnt have the lopsided grill so I'm happy with that.
Thanks for the help too everybody who responded. :good:

I have given my phone for repair after having a look at it the woman said one of the pins for the sim card are bent.
She said it may not be covered by the warranty as it looks like you tried to force the sim card in. I said I didn't then she said she will have the engineer take a look at it and if he can't fix it on site they have to send it off.
When I got the phone on contract it came with a micro sim and an adapter to use it which is very tight and fiddly to get in so I think that's why this happened.
So I phoned my network provider and talk them to send me a full standard size sim card which they will charge me £3.75 for...

yes, me, and gotta say, my local store is really on the ball. though, you need to know your consumer rights with them because they will try it on, and not offer what is rightfully yours - as it costs them money. i had to argue a point to get what was legally mine when dealing with a cpw call centre, so don't hold back. (if you have any experience of dealing with latin companies who tend to do exactly the same, then you'll know what i mean!)
ymmv from store to store, so try a different store if you can, ask for the geek squad - who are usually real geeks and speak your language - and then explain what's going on.
calmly state your point. point out you used reasonable care and didn't force anything in like they claim, show them the adapter thing and get them to do it. is it in a case? no scratches etc to strengthen your argument. if they refuse a repair under guarantee (when it sounds like this doesn't fall outside of reasonable use so they are obliged to - under uk law, legal duty falls on the store for guarantee repairs) then explain you're not happy and ask to speak to the highest person in-store - if you're young, unfortunately it may be best to take an elder with you here - take that persons name, time, etc, and record them if you can (audio will be fine) no, you don't need permission for this, and don't let on you are because they'll stfu. if they start rambling about shop policy, your consumer rights outweigh any shop policy they can dream up to justify their point. (their shop policy is not on clear public display at time of transaction, so matter not)
calmly explain what's happened, how it came to be, and what this in-store person has said, and that you're not happy with their decision etc etc. you're a good honest person blah blah. prompt them for answers about how to resolve the situation and let them talk. there's a clear line between mistreating a £400 phone, and using it with reasonable care. ask them if they think the phone looks like it was mistreated.
if they refuse to send it off under guarantee (when they have a duty to), ask why, and either call samsung / whoever is responsible for the support for the ns and explain the store is refusing, and / or, seek a small claims court case (as final choice though as this costs about £35) for any costs involved wit hsending it back manually + cost of the filing (hence the recording to strengthen your case).
i have heard a lot of bad stuff about them too, but they're real people so treat them like it, they're just working to a tight set of guidelines by their big boss (which most of the decisions i'd probably make myself tbh).

Thanks so much your info was very helpful.
The adapter is not in a case its just a flimsy piece of plastic shaped like a sim card with a hole in the middle where you you just plad your sim and insert in in your phone. It does not lock tin sim into place you have to hold the sim with one game and try and get it into the phone carefully.
Iforgot to mention before I did have a phone repaired from carphone warehouse before and it took 3 attempts for them to fix it.

I sold a HTC Desire HD with a cracked screen and a missing volume rocker on ebay for £80.
Before sending the phone I tested everything and everything was working perfectly fine.
Now the buyer has messaged me saying the vibration doesn't work on the phone but I am 100% sure that it worked when I sent it.
He hasn't asked for a refund but I'm worried that he will and I can't really afford to issue one.
What can I do? Because it was working when I sent it but I don't have proof of that.
Thanks.

Depends on what you had in your listing.
Was it sold as faulty or spares/repair? Was it sold with no returns?
Ebay unfortunately have a habit of siding with the seller. Try contacting the buyer and offering a partial refund rather than a full one.
Returns not accepted.
But there was nothing wrong with the vibration, and I don't want the buyer or ebay to think I ripped him off because I didn't, and I don't see how the motor could have broken in transaction.
I'm skint at the moment due to many bills coming in at the same time, so I can't afford any type of refund.
Sent from my Samsung Galaxy S3 using Tapatalk 2
As long as you were detailed on your ebay listing quoting phone has issues buyer should assume there are issues. Do not fret if he opens a claim against you with ebay, they will look at your posting and see that you mentioned there are defects with the phone, As long as you did not place in ad phone 100% funtional you have no issues and if you did you dont have the burden of proof. As well as look into how long it took seller to reply or even if they took phone apart to repair screen, I had a buyer wanting a refund back saying item did not work 45 days later saying they just opened it. They lost so dont worry about something that has not begun yet. Ebay is a very solid and trustworthy sight that does the right thing for buyers as well as sellers. Unlike craigslist and their scammers.
Edit: Plus they do not get a refund until ebay knows you recieved item back in same condition as shipped. DO NOT OFFER partial refunds cause possible buyer trying to get one over on you let ebay deal with the dispute if there is any.
The vibration motor on my DHD packed in one day. Just went from working to not working. No drops or anything like that, so it could happen.
But...
When did you sell it and when did the buyer receive it? Was there a few days between them actually taking delivery and then contacting you?
When I purchase anything via eBay, I immediately check it and if necessary contact the seller. This is to eliminate any "you've had it a week, you broke it" scenarios.
The fact you listed it as having a cracked screen and faulty volume rocker indicates you were honest with its state pre-sale, why would you hide the fact vibration motor didn't work? I think in any event eBay would see that you were honest with your description.
I would contact the buyer and let them know that it was thoroughly tested before you posted it, and that any damage other than what you disclosed must have happened in the post. And in that case to claim from Royal Mail, DHL, Yodel (or whoever your courier was). I'm assuming you used a method of dispatch that was insured.
Thanks for the great advice Andy
Sent from my Samsung Galaxy S3 using Tapatalk 2
Quite true what mr. Mod says there but I encountered once almost the same situation as you with ebay. Their rule there states that as long as the defect is not stated in the listing then it's the seller's responsibility. I even hear sellers ranting on the forums about their product's parts being replaced and returned to them but ebay insists a return unless the seller could really prove their claim. Regarding the vibration not working if the buyer states that it's not working since he/she recieved it maybe you both could redirect the case on the courier you used on delivering the package and file a mishandling case on their side.
If you're sure that vibration is working when you said it and the buyer claims that it doesn't work since he recieved it then point it to the delivery man
But before that ask the buyer first when did the vibration stopped working. if he says greater than 1 day then ignore him!
He's now asking for refund. I don't have the money so what will happen if eBay side with him?

Stand your corner, if you are 100% sure that the vibration worked before dispatch, then you have done nothing wrong. You should direct the buyer to the courier as that can be the only source (other than the buyer) that could've caused the damage.
Sould the buyer file a dispute with eBay/PayPal, just be truthful, state that the vibration motor worked prior to dispatch and that it must have occurred in transit. State that you have contacted the buyer to file a claim with the courier (which you should do, if you have not already).
Worse case, the buyer should return the handset to you, postage at buyers expense, before you refund the money. Should give you chance to relist it if necessary. In my experience, although limited, with eBay & PayPal is that if you are honest you should be ok.
The buyer is happy with me contacting Royal Mail to claim. I insured the postage so should be fine, but I've had a problem with Royal Mail insurance claim in the past.

As long as you state the facts, you should not have an issue. Insured carriage is designed to cover circumstances such as yours. Contact the buyer and ask for photo's of the packaging, perhaps that shows signs of mishandling.
I actually did a bit of temporary driving work for Yodel, driving HGVs between depots, and I can guarantee that your packages are thrown about.
If the pictures show dents, crush marks or anything to suggest mishandling, you are covered.

ebay will always side with buyer, if u want to "play the ebay game" then get the item sent back with tracking, wait on the refund ebay will refund your buyer, you then refund ebay but u dnt repay. instead u dispute the claim ie phones more damaged than when u sent it. hey presto ebay pay the refund and u get the phone to resell.
maybe not the correct way but id say this buyer just wants a partial refund hes playing the "ebay game" as he knows ebay will ask u to refund.

Is the speaker rattling or do you hear something when you shake the phone? The camera can make some noise when you shake the phone.
But if you hear distorted noise from the speaker, then okay.
I happen to be in the exact same boat as the OP - got a phone with a really funky earpiece with crackling during calls, to where the crackling doesn't go away unless the volume is lowered almost all the way down. And I've been around phones and electronics enough to know that this is most definitely a defective speaker (also the calls sound perfect when listening via earphones or headphones, so the problem is with the speaker all the way).
I just got off the phone with Google to see about the possibilities of doing a return like the OP suggested, saying that I bought the phone off of "my friend" who got lucky and bought an extra on launch day. The rep said I would have to have my "friend" (i.e. the eBay seller) put in for a return/replacement, have the return label sent to me so I can send it in directly, and then have a new phone sent back to me directly. But this really isn't doable for me, because I can't afford to be without a phone for any period of time. Sooooo, basically I think I'm screwed here, at least until the phones are available once again through Google Play and/or TMobile, at which point I could purchase one from them and return this defective one in its place, thereby avoiding not having a phone for any period of time. I'm seriously sick to my stomach over this, this blows.

This is how Google RMA works
First, you do not need to ship your phone until you get the replacement.
the catch
they place a hold of the value of the device (minus the taxes and shipping) on your cc , once you return the defective device it will be removed.
the problem you have
you got it from fleebay and am pretty sure the seller would want a hold of 349 on his card (assuming you got a 16gb) for you.
resolution
wait for the parts to show up on fleebay and change the speaker on your own.
My rattle is coming from a slightly lose volume rocker button. Check to see if it's just that that's doing the rattle.

Nope, here's what's gonna go down (and I know how Google RMA works), but my particular situation is actually a bit different from the OP. See I originally purchased an N4 on launch day, but had to send that one back for a refund (screen issue). At the time I didn't even think - and it wasn't offered to me - that replacements were available, given the fact that everything was sold out everywhere. So at that time I just opted for the refund, and knew I would then look to purchase on eBay. I then purchased the phone that I currently have from eBay, and it turns out that this one actually has earpiece speaker problems (my luck sucks!). But, given that my original order had been received by Google but not yet refunded, I called Google and asked about switching my "refund" into a "replacement", which we have done (arrival of the phone in a couple of weeks). So now the rest is very easy - I will receive the new phone, then call the request a return/refund for it, and send the my defective earpiece phone back in its place. And before the usual douches come out of the woodwork to make their comments on "ooh you shouldn't do that", might I please remind of what a horrible time that myself and so many others have had with this friggin N4 experience? In light of that, I really don't give a crap and don't care one bit. Its time to look out for #1 for once. :good:

:good:

I'm sure they'll notice that the IMEI and Serial Numbers don't match up to the unit they are expecting back.

I am willing to bet that they will care. Plus they have your credit card number, so it's not like they won't be able to do anything about it.
Anyway, how you choose to conduct your transactions is a personal matter.
However, please don't get us in trouble and refrain from discussing fraudulent actions here in public.
Thank you!

Why isn't anyone mentioning the fact that in order to place the request for an RMA unit you need to use the email address that the original Nexus 4 was purchased from Google Play with?
If you do not have access to the email address used to make the initial purchase you are screwed.

That's not what is going to go down. You won't be getting a refund for the phone you purchased off eBay. That, I can assure you.

Fair enough, you'll hear no more from me on the subject
I recently opened a ticket with Samsung regarding apparent corrosion/flaking under the corner of my screen. Has anyone had any luck getting them to send a replacement before mailing the defective device in? I don't really like the idea of being phone
less for 10 days. I'm assuming they'd need to place a hold on a credit card.

Samsung is a multi-billion dollar company. They won't not return your device, ruining their reputation because of this. One Note 3 is mere trash to them. It won't benefit them in any way unlike a typical small company where they can just keep the phone forever.

Sorry if it was unclear--I'm not worried about losing the phone, I'm just reluctant to send it in before I have a replacement given how much I rely on it in my day-to-day life. I was just curious as to whether anyone else had been able to finesse a replacement out of them before sending the defective unit in (presumably by placing a hold on a credit card--I doubt they'd take my word, bond though it may be).

Oh then now I get it.
My carrier issued a substitute while my phone was in repair (It was a Blackberry if I remember) back in the days when I owned an iPhone 4. Samsung won't do this at all costs.

Yeah, just spoke with them, and they wouldn't budge. Understandable enough. I'm on the T-Mobile jump program, but I'm not sure they'd replace it given that it's apparently a manufacturing defect. I just hope there's no quibbling over whether it's user damage--a quick search yielded several pictures of the exact same problem, but in my case it seems to have eaten out to the bezel.

if ur on tmobile, this one that I have is my 2nd replacement, not including my original...
call tmobile, and they will send u a replacement 1st, then u send in ur phone in the same box and it has a mailing attachment for u to send it back to them,
all u do is pay $5, because the jump program u pay $10 is also insurance...
call tmobile, not Samsung...

Thanks for this. Quick and easy--the replacement is already out for delivery. The rep did warn that the reconditioned devices are occasionally wonky--"better the devil you know, sometimes" were his words IIRC--so I'll report back if there are any issues.

Is anyone being a problem with the home button? Mine has to be pressed dead central for it to register. I can fully press it at the extreme right or left and nothing happens.
Have I got a faulty unit?

No issues here. Had a few issues with fingerprint recognition at first, but then I programmed the same finger a second time and had no problems after. As for the actual home button, it recognizes it no matter how I push it. Sorry to hear you're having issues.

I have this exact same issue but only with the right portion of the home button. TMobile is sending me a replacement unit after I called them yesterday.

Yes I have the exact same problem! Mine has to be pressed dead on the center or it doesn't go home. Taking it back to carphone warehouse to get a replacement tomorrow.
Samsung (online) won't replace my phone, they will only give me a refund.
What a poor service. Now I have to go and buy another (and the refund may take over a week to get back to my account)
Not a good experience from my 1st purchase from Samsung online.

You'd rather them put a hold on your card, and ship you a new one while you ship them the old one (how a return works if they don't make you send the old phone in, wait for them to receive it, and then send you a new one).
Seems refund and buying it again is easier for all involved.

I' rather they ship the replacement and collect the faulty one when they drop off. I've had that service from previous on-line stores.
In terms of the cost - I paid by paypal so I am already in debt to £640 and now I have to find a further £640 until they process my refund - It's not how it should be.
Also - I offered to go to my local Samsung store to do a swap but that is not an option.
I f I had bought from CPW on-line (which I now wish I had) If it was faulty I could have returned it to any store fore an exchange.
I love Samsung products - I have had many but I am just disappointed with their after service.
I got my pre-ordered one at the store today. Checked specifically for this problem, and, boom, there it was. Replaced a new one right away.
Sorry to hear about Samsung online not replacing products in warranty. They are doing the same on me at the moment with a faulty screen. I'm going to have another go at them. All I want is a replacement....
No issues with mine.
I would suggest going to your nearest Samsung store for a replacement.

As I say - that is not an option for Samsung! Quite annoying that the Shop just refused to show any interest and say if bought on line I must deal with the problem on line.

I'm going to spend this afternoon phoning them up to get a replacement. The contact number in the UK for the shop is +44(0)1628 918334
They take 1 minute to attempt to answer a call. Which is true, getting them to send a replacement appears to take a lot longer
I've got the some problem.. http://forum.xda-developers.com/s7-edge/help/galaxy-s7-edge-home-button-t3333830

That's BS. Expecting you to go without until they have received the device and then processed a refund (which takes long enogh itself). I would suggest ringing them and not giving in, request an escalation.
Ok, just finished on a call after escalating to the UK call centre manager. They have just sent me this email:-
Looks like they will ask you to keep the VR headset, refund you and arrange collection of the device.
After that just go to Carphone warehouse and buy a new one:-
Thank you for contacting Samsung UK Shop.
As promised, we are sending you an e-mail, with which, we would open the returns case. Would you, please, advise me on a convenient for you collection date for your faulty device and if you could provide us with the pictures, that replicate the fault, so that I could add them to our records.
I would attempt to contact you once again by the end of the working day to provide you with an update regarding the procedure and to confirm the collection date.
Thank you for your patience and I remain at your disposal.
Thank you for contacting us.
Regards,
I thought it was because I had the plastic still over top of it, but I've noticed this too. As far as I can tell that's the only issue though, I have no pixel issues, no tint issues, no screen issues at all that I can see so rather than risk it I'm just going to keep it. Not that big of a deal.
Old phone now returned and new one purchased.
Home button on new one is working fine I'm pleased to say.

I am having this exact same issue with my S7 Edge bought from Samsung UK online at launch with free VR.
My feeling is they don't want to know, and there "support" has been horrific!
I bought mine outright on my credit card, how did you get the exchange sorted in the end, and did you have to do without your phone while they sent the new one?
Thing is fingerprint etc all still works fine, but its seriously hacking me off knowing it shouldn't be doing this!
I have the same problem now.Does the waranty cover this issue?
