Okay, so I'm probably going to buy a brand new MyTouch 4G off ebay. It is brand new, never turned on, sealed, or had a sim card in it.
Since I will be the first to put *my* sim in the phone, won't I get the warranty, because the IMEI will be tied to my account? T-Mobile is telling me conflicting info.
And not the HTC warranty, the warranty where I can walk into the tmo store for a replacement.
Would anything change if they gave me their receipt?
I'm trying to figure out how Tmo would know whether the phone was bought a week ago or 5 months ago.
Please help me..very important!
HTC warranty would apply but pretty sure T-Mobile would have to have a record of you purchasing it to warranty it

There have been quite a few people on this forum that got warranty exchanges with phones they got off craiglist, ebay.
I was able to get a replacement from tmo and I bought my MT4G from CL.

I actually bought my MT4G off ebay brand new, no sim card inserted. I have the full warranty from tmobile and HTC. I've returned three phones to tmobile for warranty repair (washed out screen), i'm on my fourth and finally nice screen. I'd be more worried if the screen is type 1 or type 2.

Yes you will be able to get insurance. The best thing about insurance is there is nothing you can do to void your insurance.

because Tmobile abides by the terms and conditions set in the contract. If you go outside the contract, they aren't liable to support you.

All I did was ask if I will have a warranty with a phone from ebay, and if it was possible to get one. I never asked for anyone to tell me anything that would violate the terms and conditions. Also, it's not really "unprofitable" to them. If a phone has never been activated on the network, $ hasn't been wasted on warranty replacements and fixes, etc. So, I don't really understand you..? And I really don't feel the need to explain myself to you.
But I didn't make this thread to have people post random excerpts of the terms and conditions. I asked a question, and it was answered.
Now I'm just wondering if a phone bought from ebay that was new would be able to have insurance.

This was from a thread I found from the moderator of the HTC forum:
"HTC will not warranty an item purchased on eBay. HTC Only warranties devices sold thru 'Authorized' dealers. eBay is not an HTC authorized dealer. If the eBay seller is an authorized dealer, then HTC will honor the warranty, but you need a receipt that does not mention that it was purchased thru eBay. HTC does not allow warranty transfers either. You must be the original purchaser, & you must purchase thru an authorized dealer."
Specifically it states that HTC does not allow warranty transfers. So technically it has no warranty with HTC and thus also with T-mobile, since HTC authorizes the warranties.
Hmm, in the warranty terms it says you just need proof of purchase. Nothing about authorized retailers. HTC has also implied you dont need to be the purchaser. So maybe if the person sent the receipt with the auction?
And T-Mobiles and HTC's warranty are different with their terms, HTC will usually repair vs. tmobile will replace, etc. HTC has also said that the warranty is tied to the phone, not to the user.
How do you tell if screen type one or two?

If you plan on doing the warranty through T-mobile then you better hope the rep doesn't look up the issue and see that it explicitly states not to do an exchange on the screen type. HTC turned me down also, as their policy states the same.
I have my Evo in moderate to bad condition. The screen has a crack over the front camera and each corner has a chip. The stand is basically unpolished and the rear camera has a few scratches.
I also shaved off the black paint on the rear rim, which makes it unique.
Anyways, my plan is to call assurion for a replacement. ($100) so that I can trade it for a $150 off the Evo 3D. (They wont accept a poor-condition Evo...)
Is that a good idea or is it against some type of government law or something...? :sarcasm:
My 1 year upgrade is on August 28, so I don't know what other tricks to pull out my sleeve.
Ideas welcome! Trolls too!
Sounds like a good idea, just keep the replacement in good condition! Oh and you get a refurbished, make sure it is a good one

*Technically* what you're planning on doing is a form of insurance fraud.
If I'm reading your post correctly, you'll be paying $100 for a replacement to get the $150 trade in credit? Is the $50 you save really worth the
a) time you'll spend filing an insurance claim, packing & sending sending your phone back
b) the guilt of doing something that's technically against the law in many (if not all) states.
Do it if you want, no one will judge you (at least I won't). But I personally probably wouldn't go through all the trouble for $50.

I don't see fraud here. He is paying for insurance and the phone is damaged. If you had a car you were thinking of selling and were in an accident you would use the insurance to fix it right before selling, as selling it crashed would be bad for you. He is doing the equivalent, he has insurance to fix the phone if it is damaged, which it is (screen crack). Now if he damaged the screen on purpose just so he could file a claim that would be different.

What he's asking is NOT illegal in any way, technically.
He buys insurance and their policy states that up to three times in any 12 month period you can, for whatever reason, pay them $100 for a replacement that will most likely be a refurbished unit.
This is a legal, contractually designated transaction between a company that sells a service and the consumers that purchase the service.
edit- if he says it was stolen then keeps/sells the old one then yes, technically that's fraudulent.

If you and everybody thought like this insurance costs would skyrocket.
It is considered fraud based on the story he gave us. Have him call the insurance company and tell the truth. You know the same story he just told us. Something tells me they wont offer him a replacement. In order to get his phone replaced, he would have to lie or change his story. Therefore the insurance company would replace his phone under false pretenses and thus fraud.

So its fraud if I tell them that I broke my screen and I will pay 100 for the replacement and in the future ill exchange it for a newer phone, restarting my contract and keeping the insurance or start a new insurance with the new phone I buy from sprint?

When you pay the deductible, do you send your phone in? If so, that's fine. But if you are reporting it as lost/stolen/completely broken, but you plan on keeping it (which is what I implied), then yes that's fraud.

No it's not you moron. He has the insurance and the insurance covers a cracked screen. It does not matter what he plans to do with the phone as long as he sends the other one back. He does not have to lie in anyway, all he has to do is tell them that the screen is cracked. I swear some people on this site are so damn ignorant it's ridiculous.

Dude.. seriously.. come to your senses and understand the insurance you buy is not a warranty or guarantee, it is a service agreement that you purchase. As with any paid service there are terms. Exchanging $100 and your current device for a replacement (for WHATEVER reason) up to 3 times in 12 months IS the agreement. Asurion pays (on average) almost nothing to refurbish a phone then turns around and trades it to someone who is ALREADY paying them $8/mo for their phone and another $100.
The device I have now is a replacement. I called Asurion and said (100% true story) "I'd like to have my device replaced. I dropped it and there is a tiny crack in the corner. I'm sure it will be an easy refurb for you guys." They sent me a brand new-in-box unit, never refurbished, never activated.
When someone lies to avoid paying the $100 and/or submitting their old device they are circumventing the agreement thus committing a form of fraud, I believe it's called "theft by deception". When someone intentionally bricks their device so the carrier or the OEM will replace it for free that is fraud. If you had half as much clarity as you have integrity you would understand these distinctions. Hell, call Asurion and ask them about it.

This is what is known as a "materially adverse change of contract" and by standard contract law, it renders the contract void if one of the parties doesn't like the change.

So a few questions if anyone has gone this route in the past:
What is the process to follow to do this? Do you just walk in and ask to be let out of your contract?
Are there any negative consequences if you decide in the future to go back to Verizon?
If you break the contract, can you remain with VZW until you purchase another phone/plan from someone else (Sprint)?
Dumb question. but if you do this can you sighn up for another 2 year contract for the discount on a new phone.

Breaking the ETF does not entitle you to an upgrade on your equipment. So basically you would have to start a new line of service if you do not have an upgrade. This means losing your current mobile number, and possibly paying additional activation fees/pro-ration on your next bill. If you do not care about losing your current mobile number, I say go for it.
The primary benefit I see in this is if you are already planning on switching carriers, and are currently under contract.
Monthly bill with verizion is getting too much for me especially since a lot of my family members are wishing to get smartphones.
This will be useful for me as I do not wish to pay 600 dollar to end the contract of 4 phones.
I did this yesterday. It took five minutes and was probably the easiest call I had with Verizon ever. I'm glad I don't have to give them another cent. I was told I wouldn't be able to continue paying month by month on the line but I'm not sure about signing another agreement. I wouldn't be surprised if they denied you.

I called and went straight to retention (I can't remember if I called the usual customer support number or the 1-888 number on the bill but either way it shouldn't matter). A woman picked up and I said I'd like to cancel my cell service because of the increase in the Regulatory Charge. She asked if they were indeed raising the price so I read the "Notice of Change To Regulatory Charge" from my bill. She asked when I received notice of this and I told her it was on my current bill. She asked if there was anyone else I'd rather just transfer the line to, I said no. Somehow I ended up reading her the bold part from the second paragraph below. She asked me if I was planning on taking the number to a different carrier, I said yes. She told me the ETF would show up on my bill with a credit, the line was being disconnected (I assume at the end of the current billing cycle) and that I'd be unable to continue paying month by month on that line because of how I was canceling.
I don't recall her even talking to a supervisor. I had the following copied straight from the user agreement just in case though.
An hour later I left the Sprint store with my number, a $125 credit for leaving verizon and an HTC Evo 3D.
What Charges Are Set by Verizon Wireless?
You agree to pay all access, usage and other charges that you or the user of your wireless device incurred. For Postpay Service, our charges also include Federal Universal Service, Regulatory and Administrative Charges, and we may also include other charges related to our governmental costs. I highly doubt you could. Think about it: You're canceling your account completely due to the increase. Then you try to open a new account?

You could do this in a very roundabout way, particularly if you're not the primary line on a family plan.
If it's just you, they will make you wait at least 45 (that's what Sprint does) days (VZ could be 60 or even 75, I can't remember) days before you can sign up with them again.
If you want to save some $ and wait it out (when you come back in, you wouldn't be on unlimited, though), you could port your #(s) off to a prepaid carrier (Net10, TracFone, etc) and let it sit there while the waiting period runs out.
If you're planning on staying with Verizon, it's totally not worth it. If you've been looking to jump to Sprint (cheaper) or AT&T/T-Moble (LAWL), then it's a great time to do so.
Yeah, the only reason you should even consider doing this is if you'd been thinking about switching to Sprint at the end of your contract anyways (for the savings).
'Cause if you think Verizon is bad, just wait until you try AT&T or T-Mobile.

No competition there: the Epic 4G was meant to compete with the original Evo 4G and is thoroughly outclassed by the Evo 3D (single-core 1ghz vs. dual-core 1.2ghz, 512mb vs 1gb RAM, etc.).
The Nexus S 4G, while still a 1ghz single-core/512mb RAM device, is much newer, has some extras like NFC, and is a pure Google phone (read: instant updates) so it would be a far better second option.
Does anyone know if this took effect? I know it was scheduled for July 1st, but verizon may have found a way around it does anyone have the facts?
If I could somehow use this to get an upgrade without using my new every two upgrade, that'd be awesome. But I doubt it.

I just got off the phone with Verizon and they said I could not cancel without paying the ETF fee. Any ideas?

Did you ask to speak with a manager? Did you read the article from OP? They give plenty of pointers in the consumerist article.....

I have had an exhausting morning trying to figure this out. I posted a few times in the Epic Touch prices thread but am not getting any answers. I want to upgrade the phone on my wife's line on our family plan and switch it to my line (I really want the epic touch and she wants my epic). I've spoken with 2 chat representatives and 2 phone reps. Both chat reps said the phone must remain active on the line it was upgraded on for 6 months. I asked them if they just meant the services, and they said "no" the phone itself. After chat session 1 I called in. Representative said it was ok as long as any service add-ons remained active for 6mo. I washed and repeated the whole process and came up with the same answers from another chat rep and another phone rep. Chat no, phone yes. Does anyone have experience doing this at Letstalk?
I think I found my answer. After multiple calls, I got confirmation over the phone that it is not possible to switch the phone following an upgrade to a different line. 3 sales representatives said it could be done as long as the services remained active. I asked for someone who could give me written confirmation and she stated that it was not possible within the first six months. I stated and restated several scenarios (wife doesn't like phone, gets broken no insurance then fixed, etc) and she said they would all be subject to a Equipment Subsidy Fee of $250. I hope not many of you were planning on doing this like I was. I guess it is Best Buy or RadioShack for me. Wonder if I will have to pay 200(+36 for activation) vs. 124. Damn it.
If you read LetsTalks terms and conditions to their discounts, it says that switching lines and what not "Does not apply to Sprint plans" Answer your question? Ill find it again in just a sec.

I answered you in other thread too. I do remember the service rep stating something about it being ok because I am on sprint. She said no way if I was on verizon or tmobile.

The CS Rep I talked to on the phone said that it doesn't apply to Sprint and that I could do it.
I had 3 reps on phone confirm it was possible. 1 phone and 3 chat reps said it wasn't. This is even after I showed them the wording "provisions DO NOT apply to Sprint purchases". We might have a class action if they charge us all 250. jk
Can you switch lines even if your not on a family plan, could I use my girlfriend upgrade and switch phones, she's on a family plan and I'm on a indivual plan?

Hey, so last thursday I got a free arnova 7c g2 on contract. Due to a system malfunction on their end they never activated my connection. Now they are demanding that I pay £150 for the tablet or they won't activate my connection.
How is this fair? Is it even legal? I signed a contract that they would give me the tablet free in return for the monthly fee. When I signed they said "once you've signed the contract it cannot be broken" and yet they are breaking it and demanding either £150 or the unit back.
What should I do? I have a copy of the contract.
I find it utterly disgusting that they are trying to charge me money not stated on our initial agreement and contract because their systems messed up.

Nope the guy at carphone warehouse tried that, that's what they did, when they redid the sale three wanted the money up front. That's where the £150 came into it. But the original contract was a free tablet, not £150

Explain the problem better.. they gave you a free tablet as part of the contract deal?
Then you took it home and due to an error on their part they never activated the service, now they're using it as an excuse the get the unit back?
You have the leverage here, since they're threatening to keep you disconnected if you don't return it or pay for it. But if they don't activate your service they can't bill you for anything.
If push comes to shove, escalate the matter and threaten to put in an official complaint. I would also look through the contract about the parts concerning the tablet offer and read it back to them over the phone.
Thank you for your advice Soldier Blue, yes that's about the size of it, they either want the tablet back or £150 to connect it which was not past of the contract I signed. For a £150 deposit I could get a better tablet than this one.

Long time lurker here, but I have to ask, how does this belong in networking? This does not seem to have to do with any network hardware, software, settings etc. From what I can tell this seems to be more about a legal dispute involving a tablet's service contract and not networking.
Sorry if my judgement is incorrect, it just seems that Uppy needs advice and this is not the appropriate section of the forum in which to get it.

I'm not an attorney but I am studying US law, which UK law is very similar to. This is a breach of contract. Given the facts as you've represented them, you're neither required to pay the £150 nor required to return the device. Tell them to get your service running without any additional payment.

A deposit is different than a payment for the tablet. While the tablet may be free, they may be charging you a deposit on the line due to poor or no credit. It is common practice in the States for this type of thing. Even on my first cell phone line so many years ago, I had to put down a $150 deposit on the line since I hadn't built up a credit score/reputation.
Check the wording that both the company and you are using here. Just because the tablet is free, that doesn't mean that your service is.

Yeah I know dude. But the point is that there was no deposit when I took the contract out, meaning they have altered the terms of the contract after I signed it. Surely this is not legal?

Ask them to show you what you signed. If they can't, you can keep the tablet and go somewhere else. If they can, then they can't ask for anything new that's not in the contract.
