To all
Mods, I apologize if this is not the right place to put this thread, but I figured that it will have more exposure to the developers than if I were to put it in General.
I just learned from the Slither's cube thread that there is an ebay user trying to sell his work. However, if you look into his other stuff, he is also selling S2U2, PocketCM, PCM Keyboard, Grumps Iphone Interface, the Iphone Dialer, along with some other apps.
Here is the link to his auction(s)
http://cgi.ebay.com/Iphone-Theme-To...ryZ38331QQssPageNameZWDVWQQrdZ1QQcmdZViewItem
I urge you guys that if this is your work, to report this a--hole to Ebay. Who knows, maybe even slap a suit or two.
Mods, can we get this as a sticky (at least until this is resolved)?
Thanks
Absolutely disgusting.
I'm curious if people's programs are being licensed, that sucks. hope he gets removed from ebay, that's not right.
Maybe people xda should set up a freeware license. Free to use, but illegal to sell. That way people will have legal rights to their work.
Thats seriously out of order! What a complete £^&*%$!!!!

Like I said in my first post. We can try to report this a--hole to ebay. He is obviously doing it w/o permission from any of you guys. Let's try to do something about it. Any ideas are welcome. I think that the same thread where I got this from, also had a link for violations of intellectual property for ebay. I will look it up and post it here when I find it.
are the works here licensed under GNU GPL open source?
i swear if i find this guy ripping my rom build and posting it on ebay i'll personally make it my mission to find him and knock some sense into him! this just makes me sick, i dont even ask for donations for the stuff i've contributed and this [email protected] goes around making money from us. the sad thing is people actually buy his stolen stuff.

Keep in mind that a lot of people do not know about this site. In looking for the latest upgrades for something that is supposedly not upgradeable, all of the sudden you see it in ebay "cheap" and hassle free with easy to follow instructions, I would not think about it twice and purchase it.
I do agree with you, if I had an app stolen for profitable purposes by this guy, I would not rest until I up my foot so far up his as% that he would have to make a whole in my boot to be able to eat...
I don't agree with what he is doing, but the fact is, he could argue he is only "selling" his original work and material. The applications are all freeware (true even if they were GPL). He states that, "This auction is for a CD with all tools and step by step instructions (with pictures)." Assuming he wrote the instructions and is compiling the CD, he may be sly, but not illegal. If he was making claims on the "tools" then that would be a different story.
Like I said, I don't agree, but I am not sure it is illegal, or against ebay policy.
I sent a note to the PocketCM folks. I figure it can't hurt to get as many people being hurt by this guy in on it.
I suggest we email the buyers. In fact I've done the top three in his feedback. They can complain to paypal or ebay themselves

Im affriad Phill is right if we were to do somthing about it he could back fire on us.... we dont know if in the instrutions it say thanks to the guys from xda-developers.... i dont agree cuz there still the fact that he is charging for freeware that are people from xda ppcgeeks and ect are working there arses of for fun of being admired for there amazing power by us (the public)
im just simply saying.... lets think before we raise hell on him
Makes a good point, he may jsut be selling "his instructions and his cd-r and packaging", but that's not cool. I guess, like someone mentioned earlier, just point out that it's here for free. and by the way I donate whenever I can, at least 5 bucks and i'm no richy rich!

You can raise hell on him.
My applications are available for free, but distribution isn't allowed, it's clearly stated about everywhere. Freeware doesn't mean "do whatever you want with it".
The prob here, is that I can just waste time complaining to ebay, which take time and probably won't lead to anything.
I should probably just stop waste time sharing my stuff completely, it would certainly avoid this kind of issue (and that means you'll never see PocketCM Calendar).
ps: for the people that didn't make the link, "pocketcm folks" is basically ... me.
and people have actually bought software from him.....ridicoulous
someone should sue. I'm not rally one for lawsuits but cmon!
You could start another auction with a similar title, and in the description, tell people about this site and that all other auctions are rip-offs. That way people searching for such things would likely see it.
I see some low life #[email protected]# #@#] is making money out of everybodys great development work on Ebay item number 180301613315.
So if nobody minds i thought about placing our own item on ebay exactly the same as this #unt# but for free and with a link directly to this site. What do ya think.

He said it is freeware...
None of those apps have any kind of restrictive license that prevents resale that I know of. In addition he's selling it for 2GBP, which is like.. nothing. I'm surprised he's bothering considering the time it takes to burn the disc and ship it. When you add in free postage, it's clear that he's not making any money on it.
really don't get this! not being undecent on stuff but can't someone just go ahead and download these apps for free online(in cabs), immediately. or are some of the software included sold*like the bubbles-is it the one from spb(is this version full?)
clearification please!
He's trying to get people aware of these wonderful apps? I'm sure people will start googling after they've bought and used them. Therefore, they'll reach this site I think in the end it will help the developers. I think this guy is a good samaritan not a thief.

Don't worry, People that have HD2 in their hands wouldn't be that stupid.
Don't be so sure about that. Just look at the number of stupid posts by people who can't figure out how to drop a folder on their sd card and touch haret.
Somebody should report that guy. He could be taking cash from the pockets of the developers on this site.

If you have an ebay account, just select auction and hit the report button to ebay, and they will close that auction... I did that to a few of them... When you report the auction, just be sure to include XDA web site so ebay can see that the info is there for free, and those people selling the info is fraud.......
Yeah its not good!! Some people will fall for it...
According to his listings he has sold 8 copies so far for US$10.
Also this one selling an SD card with it on for GBP£30
http://cgi.ebay.co.uk/HD2-ANDROID-I...MobilePhones_MobilePhones&hash=item2c56e0f5ab
I am not an ebay customer, but can he be stopped? He/They are selling a copy of freely available work. Only a chef can stop them if they claim property rights.
Best way is for an ebay customer to look at who purchased a copy, contact them through ebay contact email, let them know they were conned and ask if they will give you sellers name, address and/or email, then add comments to ebay forum.

well, this one is not that bad. he tells that the payment is only for the work he does.
he does that only for the ones that doesnt understand how to do it alone
he even writes that every purchase gives a donation to the devs of the hd2 android project and gives credits to the devs.. so i dont know if its really that bad as u say?
i mean, he is not selling the software, the buyers only pay his work

It's actually illegal, and making money from someone else's work, which is also thievery.
I can't see why someone would defend such people... unless you are one of them, of course.

i don’t think that someone that cannot do it himself/herself should pay though! We never denied help to anyone around here and personally i even received two phones by mail, unlocked them, flashed a custom rom and send them back so no i will not say "it's ok"
i volunteer if any of those sellers needs help to send me the SD and i will send it back with the Android OS (i don’t believe its necessary though, its some simple steps)
i will try to contact the newswritters abt this issue

why should this be illegal?? if you pay for his work of compiling information, and not for the build itself? he says he'll send instructions, not a file/zip/sdcard/device...
don't get me wrong - i'm not defending this guy. but there's a difference between being illegal and being impolite/unfair/an as*h*le....
to state it clear once again: i personally don't like what the guy is doing, i do not support this inacceptable behaviour.

It is always a gray area as eBay sellers only sell the links (most of them don't even compile the instructions themselves), they do not sell the software. It is a shame that this happens (has happened for years), but they clearly state that they are only providing the info on how to do things. I agree that no one should sell even knowledge that is not theirs, but technically speaking, it is not illegal. They are only selling info...
I still reported it though, but I doubt anything good will come out of it.
Unfortunately there is no law against people profiting off of stupidity.

First i want to start by saying im sorry that you all are not understanding what the 5 bucks is for . its hard to find things on the net and in the forums. When i first started i came here to xda i soft bircked my phone from a rom so i asked for help here and got yelled at, called names and told im posting in the wrong room . I didnt know, but still someone could of helped me instead i was made fun of and laughed at for my spelling here at xda . so i went out and found out alot about phones made a couple videos and poof everyone found me ....i was helping so many people, my phone was none stop ringing but i picked up . i helped them out by telling people where to go, how to get what they want was hard so i made a site it was free all day up intill 5 months ago . see the site was coasting me 250 a month that i did not have but people still needed help they tryed to come here but people where mean cuzz where noobs . so thats why at akaskriller.com it coast 5 bucks . everyone knows these roms are free on the net there not paying for the roms there paying for a just cause for helping people in need no matter what . for the roms i put out i say i hacked theme or themed them out . its fun to theme them out and help people ..
so im sorry if u all got it wrong and i give back to the devs that i take the most calls on lol but for real you all stop being silly and saying bad things about me.
and we pay peoples bills that can not ... ask your selfs y do you all care so much what others do for help?
seriously? why hide the roms behind donations then? why not post it freely and market it as a pay support site? why post paid apps for free behind the donation? why not post it all for no donation at all and post a link for 5.00 a month tech support? i'm certain this thread will be locked in no time and look forward to the humiliation headed your way.
I do not accept your apology. You are a fraud. You stole peoples work to make money

it doesn't matter your logic for any of that.
1) you cannot advertise anything that has a registration/paywall on xda, it's against the forum rules (it's the same reason we don't see posts by samfirmware stuff anymore, even though we all know about it)
2) you cannot include links to services/devices you sell (it's fine to tell people of a download mode JIG and even to check ebay or other places, but to point directly to yours is also against the rules)
3) if you don't have the money to run the site, don't run it (why host anything at all beyond a few lightweight html files with explanations)
4) make the donation optional. register for the site for free and then people can donate if they want (hey, sounds an awful lot like what xda is)
5) do you have the permission of the ROM developers to repost their work elsewhere? (especially behind a lazy paywall)
if you can't follow xda's rules, then what do you expect to happen?
What you do is wrong!
1. You host warez on your site.
2. You steal all of out Dev's roms
3. Just link you "subscribers" to xda
Why not use something like forumotion.com to so you don't have to pay?
And the no credits?
This... this is going to get nasty unfortunately.
Be respectable people.
Suck my balls.
@aka , not s15 >.>
see this is xda all you all do is talk bad im sorry but there are no paid apps in site and app brain or 4share.com lol theres all your apps for free ... i tell you all and you dont here me
And the lying about creating a Gingerbread ROM with GPS?
I think the point that most are upset with is that you have done this in a sneaky manner and not asked any dev if it was okay to post their work. For us to put sometimes months into building a better rom and then you to take it change a couple icons or colors and then post it as your own work when you probably wouldn't know a XML from a bml and charge people for "support" which they get here for free. I personally have tried to answer every "noob" that has approached me and not once charged.

Attention, one comment on Amazon says that this book was badly port from Apple App Store to Google Play.
Exchange Reviews with other developers
Lets face it, become successful on Google Play market is nothing easy, yes you need a very unique app but you also need a good marketing campaign in order to get enough downloads and a good rating, most indie developers can't afford that. But wait... there are many apps submitted everyday to android market, that means there are many developers trying to show their own apps, so that means... we are a lot.
Why not help us each others?
Join AndroidKi community and Exchange reviews with other developers!
How it works?
In order to submit your app to get reviewed, you need to review other 3 apps too. Each review gives you 5 AndroidKi points, you need 15 to submit your app. Simple, effective and SEO friendly.
