Only the gallery was found infringed which we know a simple update will fix and sales will continue. Everything else was thrown out

I'm mad that they even have to change the gallery, but all these lawsuits are just stupid...
I can't blame Apple for suing (since they have patents) but they should never have been approved in the first place!

hurray for the Judge, did the right thing by acknowledging it was just software feature that can be changed and not a hardware thing as claimed by apple

Like i stated in tnhe galaxy tab 10.1 forum.
What really irritates me about this current filing with the touch screen and image gallery is once again someone did this before apple yet they take the idea and run with it. LowFat anyone? http://www.peeniewallie.com/2006/03/lowfat_image_vi.html look at the date on that page March 15th 2006? I think that was before the iphone, just a little.
Add LowFat with a Linux distro running a touch screen and man that looks pretty much like what they are filing suit about.

That's all fine and dandy but did fat patent it? People come up with ideas long before someone else does it but the original person didn't put a patent on it so they are sol.
I don't have a 10.1 so I don't know what the gallery looks like. Like many other reviews of the app, I'd like to see quickpic be a standard.

If you can show it existed well before an existing patent does that.still hold true? I thought prior art was a legit argument to be used in such cases like this. The gallery app they are referring to is the standard android gallery app. Apple says all Android devices infringe on this patent.

So how does everyone feel that apple has stolen the things that set android apart? Such as the drag down notifications! I think that for a company that loves sueing people, its a bit funny that they'd steal something so obvious as this...? It actually angers me!

Steal something? What they have done is a stroke of engineering genius that's accessible to the common user. Android's version is much more geeky and could never get mainstream usage.

Swings and round abouts, it was actually the jailbreak community they stole everything from. Lots of pee'd of dev's now with redundant apps.
Hell they even employed a dev after already sticking his notification app into iOS 5 - way to avoid any legal issues.
on another note it actually looks more advanced that the android notification system.
without Apple and ios most phones would still be stuck on symbian with Nokia sitting in its hands milking the same crappy and outdated OS for years to come.
Let Apple copy and play catch-up , not a big deal imo.

I don't see the point of this thread. Oir the point of XDA keeping a separate domain for iPhone developers. Don't we all have smartphones in the end? Wouldn't it be better if we all had a common hub for developers to influence each other? I'd love a Blackberry section as well...

I agree, I think iPhones (and Blackberrys to some extent) are waaaaaaay over rated, they just have alot of hype.
Take BBM for example, it is almost exactly the same as WhatsApp, yet everyone is going nuts about it. The only feature it has over WhatsApp, is that is has a notification system where it tells you when the recipient has read the message. On the other hand, WhatsApp imo, is alot better because it supports Android, Nokia handsets, IPhone and I think, although not sure, BlackBerry too.
Besides, whats so much better about the iPhone/iPads? Except the fact that everyone glorifies them for no justified reason

whatsapp has nearly the same. 1 green mark next to a message says it's safely off your phone on the interwebs

Why oh Why Samsung!

READ THIS
Cause they is inept.......Plain and simples!
They have THE best phone currently available in the market (SGS2), one of the best tablets (10.1) and about to have the mutha of ALL phones (Galaxy Nexus), SO you have to ask yourself a question about the motivation of a company who seems to be hell-bent on cementing their place in the market as a rip-off merchant.
At least Apple try and pretend to have come up with an idea (by preaching out the usual "innovate" subliminal dictorate) BEFORE launching their attack dogs. Sammy just blatantly highlight>copy>paste>plagiarise and HOPE that no-one else in the world has eyes, sense, access to a computer or quite simply the nous to notice what they have done.
What is the Korean for "IDIOTS"?
Rofl, thats hilarious!
This is ingenious, i think we're not giving them enough credit. Now when apple sues them they can say "clearly our products are different enough for anyone to spot the difference" and cases get thrown out of court. Or maybe their just stupid as fk, who knows.
Well a few years back, wasn't it just norm, to copy paste publish what ever they wanted. Like the pirates they are.?
I am not surprised, seems they need to engage a USA firm of Americans who know the difference, and can setup a good thing.
Boss: Can we have a picture of Google maps running on the Galaxy Player 5.0 please.
Marketing firm: Sure no probs, a quick google search later and 'shop out the Apple bar and nobody will be able to tell the difference.
Boss: Thanks
Fandroids (inc me): Doh!

One too many times on the bus...

I'd just like to point something out:
When referring to my or any other Android-powered smartphone, do not call it "an Android". That is incorrect; Android is the operating system, not the entire device. I don't run around calling your iPhone an iOS. Go with "Android phone" or "Android device" or something similar.
Secondly, despite Samsung's commercials, calling a device by it's manufacturing name is wrong too. You can argue that all you want: but referring to your Blackberry as a RIM, your iPhone as an Apple, or your Pre Plus as an HP sounds absurd. Android and WP7 devices are created by different manufacturers. So it's even more wrong to do so. It sounds wrong, and it is wrong.

Pretty much this. Who cares what the proper nomenclature is. Calling an Android device an "Android" or a "Droid" isn't any different than calling any brand of facial tissue "Kleenex" or (for you old timers out there like me) any portable cassette player a "Walkman".

I believe the common term for this literary phenomena is "proprietary eponym". 'Kleenex' for facial tissue; 'Xerox machine' for a photocopier, etc etc. Our mod and I live in Central Florida where people drink "Cokes" when they are holding a can of 7-Up...
"Droid" has come on board as any mobile smartphone device NOT manufactured by Apple or RIM.

That is a tough question as there are so many aspects I am not sure where to start.
1. Customization - The IOS UI is a grid of apps, Android can be what you want it to be. Widgets, toggles, clocks, the choices are endless. Also, keyboard choices, not really open on Apple, just modifications of the ios keyboard. I personally really enjoy quickly browsing my news, calendar and weather widgets, without opening an app. Not the case on IOS.
2. Freedom - IOS: Walled into itunes with drm locked media. Android: Play what you want, when you want, on whatever player you want. Choose what media player suits you on your pc, not stuck on that piece of crap bulky itunes program.
3. Useability: IOS forces you to go back to a general options icon to change settings for a large number of apps. Android has app settings integrated into the apps themselves.
4. App returns: Apple are complete pricks when it comes to trying to get a refund for an app. Google Play: For 15 minutes there is a refund button you can click for an instant refund. I personally experienced this on my wife's ipad when purchasing an app that didn't do what it claimed. Had to go onto the desktop itunes program, find some obscure feedback button, only to get a response that I had to take it up with the app developer. When I did, the app developer said they are unable to do refunds through the Apple App store.
I could keep going, but in the end, if people would get over the Apple marketing machine/branding, and try Android, they would quickly realize how much better it is. No scientific analysis here, but everyone I know who has made the switch from Apple to Android has never gone back.
Just want to add, apple saved the music industry with itunes and the music in itunes is not drm locked, you can use it on any player that support aac file format.
And btw I am enjoying the android experience better compared to ios. But in the end both android and ios has their ups and downs and I enjoy both operating systems

Your point is supported, although I disagree with the premise of that article. My opinion is itunes did not in fact save the music industry, but hurt them through prolonging their need to adapt. My premise is based on 2 facts: 1. All industries must change with the times; 2. All market leaders eventually lose market share to innovative competition.
No one will succeed in stopping the inevitability that the internet has changed, and will continue to change, how we purchase and consume media. Free is the way things are going and therefore creative methods must be determined in the music industry to procure other methods of generating revenue. So, if itunes saved the industry by extending the almost extinct practice of purchasing music, what happens when competitors, with no such sale model arise? There is no stopping history based on one company, even the almighty Apple. Instead of finding alternative promotional, ad based, or other methods, the industry has just fed on itunes. Apple's dominance will not last forever, and the industry must adapt to that. Apple's pretty little walled garden will not support them forever.

That....is insane. Maybe the Samsung case victory went to their heads a little too much.
I think Apple’s corporate belief (and this started with Jobs) is that people are really, really stupid and can’t be trusted with anything. They completely lock down their products and make them so frustratingly simple a 2 year old can use them to their full potential. They may actually believe that their users are so stupid they might mistake this polish deli for some incredible, magical new product from Apple.

and i probably said shoulda have said i was joking lol...about the 10 post count part...
none the less...the apple situation and the way i think are true
but either way i agree with you
This reminds me of when Chick-fil-A went after that local grocery store guy for using the slogan "Eat more kale" to advertise the kale he was selling. They said it was too similar to their "Eat mor chikin" slogan.
Big companies can be so crazy sometimes!
Someone should start a class action lawsuit on behalf of the trees that have been producing fruit of the same name for centuries...

theres a book out there that has somthing to do with an apple F***n everything up...we should learn from our mistakes.
Next thing you know they'll be suing the fruit..

This feels like Apple's playing poker with the big shots like Samsung and so-forth at the table. They keep bluffing and going all in with those lawsuits. They won't be able to keep that up for long. I've spoken to many friends who are Apple users and they too are upset with the ridiculous Apple Legal Team. It isn't fair to Apple as a whole to be looked down upon at its entirety, but its the "Don" at the top calling the shots..

So you're saying Apple is going to file a class-action lawsuit against all women for defamation??
