Stolen Phone...How one can determine? - Vibrant General

I sold my Vibrant to my brother living overseas and since I cannot live without my phone, I immediately started eyeing the ones on Craigslist. This one guy was selling a Vibrant, in the original box, with the original charger, a car charger, couple screen protectors, a rubber case and a Motorola bluetooth ear piece, all for $150. The phone looks brand new except a tiny little scratch at the top. After messaging back and forth all day, I decided to drive to his house, which looked like an abandoned place. His room was in the attic where there was no furniture - just a laptop on a coffee stand. I asked if he ever rooted or put custom ROM and he looked at me like I was from outer space. The phone still had Eclair! So I went ahead and got the phone. Now, it's been 20 hours and it's been working great. I already put Trigger's ROM and everything works as expected.
Can this phone be stolen and should I expect local Police of FBI at my door when I go home tonight? Anyway to know if the IMEI is reported as stolen/lost?
Please advise.

Well, I'd say the likelihood of it being stolen from someone is lower based on the fact that he has the original box. I guess if you're the paranoid type you could match the IMEI on the box with your phone.

OMG! The IMEI's do not match. I'm serious. Does it mean it's stolen?? I am pissed now. Stupid me, why didn't I check it while I was there!?!

If someone is selling something that far below market value you can be pretty sure they are not on the up and up. I would have passed on the deal.

Why do you think I'd get in trouble for paying in cash? The dude's ad is still on CL with his cell phone #. I know his address since I drove there. Can I report to local police before I get in trouble?

im messing with ya, you could get in trouble but not that bad. If you are afraid it may be stolen then contact p.d. Not sure what good it would do since the dudes house was probably an abandoned house he found to make the deal. So more than likely the cops will take the phone as evidence and you will be out what you paid. The guy made some cash dumped the phone he used to communicate with you and on to next guy.

Dude u didn't know it was stolen you are not gunna go to jail. If your on tmo they wont care dont believe me lose ur phone but record your imei tell them to track it they say they won't do that. Just be more careful next time

You know, if I sold you my vibrant, the imei on the box wouldn't match either. I've had three replacements.
Maybe you should stop freaking out and start enjoying your good deal. Is it likely someone stole a box, cases and accessories? Not very.

^ Same here, i've had plenty of replacements and have different IMEI as well.
Don't freak out, you bought it, and the chance of the original owner coming to your house is as much as a lightning striking you, then turning right and blowing your phone up.
Just enjoy the phone ;D

Not necessarily stolen especially if he had those accessories with him. Next time you buy anything meet in a public place though. Coming over to a possibly abandoned house is a good way to get robbed.

Yup, $130 incase the phone is stolen/lost. The warranty also extends to 2 years instead of 1. And they will service it free of charge if there is physical damage. I took it for the G2 due to the hinge, so over 2 years if the hinge gets REALLY bad I can get a replacement.
The warranty isn't for two years, its for as long as you have it out as long as they support it

Yea you could say some lie like that BUT remember that #1 insurance companies are giving you a 500 dollar phone for 130. So they make it their business to know what happend to your phone. I had to file a claim for a lost g1 and they made me get police reports and everything before they helped me out. #2 every phone has an IMEI number unique to itself and it is registered on the network when the phone is in use (I'm not 100% sure of how it works but they know if that phone is being used or not.) AND if the insurance company finds out that the phone YOU purchased (with its unique IMEI number) that is now claimed to be stolen is being used they might go and find out who is using it or who knows...
I wouldn't risk the fine or jail time or court just for a phone for your girlfriend if you want her to have one sooo bad then you can save up for it or at least tell her you'll give her half or some thing...
Besides I wouldn't see the g2 as the best upgrade option I'm bummed out that it was released with an 800mhz processor... WHY? All the new high end phones are using 1ghz... but w.e. everyone has theyr likes and dislikes... I'm personally waiting for something else...

There's another warranty thats 1.99 a month and it covers all the same thing the 6 dollar rate does except for lost or stolen phones. Its only available up to 2 weeks after you purchased the phone. I think it's more likely to have a phone that has broken hinges and buttons instead of losing a phone.

Actually, not even that with the $130 deductible, you would only save $120.
But sticking to the original question it covers a lot and its easily worth the $6 if anything happens to the phone physically (cracked damaged broken stolen ran over, abducted by aliens) the insurance company, asurion, will replace it for $130 deductable.
And if anything like software wise or memory card reader messes up or something inside that's NOT your "direct" fault tmobile will replace it for free. But it can't be physically damaged or cracked screen or anything it has to be something inside or even bricked, you can get away with some good excuses and making believe you don't know anything when they ask, did you try to root it? Uhhh... what's that? Lol

The other great thing about a carrier having your IMEI# is that they can render it unusable on their or any other network within North America. I am about 98% certain that when you report a phone lost or stolen to Assurion, or Tmobile that their policy is to Blackllist the IMEI # of the phone.
As far as I can tell it only works on this continent, you could get a blacklisted phone to work in Europe.
It is similar to how a phone is added into a network, like say you flash a Verizon phone to Metro, they have to add the IMEI into their system so you can use it. In this case they just make it so you can't use it.
Also they do know if you have used a phone. I had a Nexus one and a Vibrant. I lost my Nexus while using my Vibrant. When I placed the claim with Assurion, they wanted me to call Tmobile and find out the last day my SIM card was used in my Nexus. Tmobile new exactly the last day my sim was in the Nexus.
So they know. And now, you know that they know.

In the table, it says that the warranty (1.99) covers only malfunction. And "normal wear and tear" is grouped with malfunction in the description at the top of the page. So hinge falling apart is normal wear and tear I'm assuming? what about scratches? And then how is Damaged defined? Any one have any idea? I don't want to pay 6 bucks when I can pay 2...

I had similar thoughts when I was younger and even talked to a T-Mo rep about it. I learned that if at any point you insert your own SIM card into the phone you claim was lost or stolen, you can expect a not-so friendly visit from the insurance company's lawyers or investigators.
Say you give your phone away to your girlfriend. The first thing they will do is check the SIM card and the account it is tied to. If you don't share the same address, or are linked in some way say through relatives or former addresses (anything a basic background check would show), then they will check the call history and see if you two know each other. It doesn't take a high school education to figure out if your phone was stolen or not. Claiming it was lost won't do much for you either.
I wouldn't be surprised if T-Mo can now remotely disable devices. If the phone is on and transmitting, it can be located pretty easily as well, whether that's for prosecution or recovering losses. I am pretty sure that if you make a claim with the phone in-hand and turn it on, you'll find yourself in trouble very quickly. If **** goes down, good luck convincing anyone, especially a lawyer or judge that your girlfriend stole it.
They don't take fraud lightly; I don't think you should as well.

[Q] Illegal to sell galaxy s ??

Hi, i purchased a galaxy s from a guy in the boozer yesterday, He seemed really genuine and said it was an unwanted upgrade, It came with all leads, books, box everything.
Anyway, it turns out its been blacklisted (insurance job?).. Looking back it was a dodgy decision, but it was a good deal so i just did it lol.
Anyway, i doubt i can unblacklist it without breaking the law so im thinking of selling it on ebay or something as spares / parts, Or to a buyer from outside the UK.
Is this illegal to do ? because i assume the phone has been reported lost/stolen. Am i at risk of 'handling stolen goods' ?
I just want to get a bit of money back for it, so its not so much of a disappointment.
Any ideas?

well in order to unblacklist it, i will need to change the imei, possibly to the same imei as my other samsung galaxy so the mobile companies dont smell a rat.
but in the UK fiddling with the IMEI can cost you a 5 year prison sentence lol, i would rather count my losses than get bummed in the showers

Return it to the mobile company and explain how you got it. Or put out a "found" ad. When someone calls ask for the imie number, they can get it from their provider. At least this way there is a small chance of reward, as long as you don't ask for it, then it's ransom.

It's illegal to even have it in your posession, if you're unlucky enough to be caught out you would be arrested for minimum handling stolen goods! If I was you I'd just use it as an iPod or if you have any family/friends abroad ask if they want to buy it. Just leave out the part about it being classed as stolen in britain haha.

Why do people hate refurbished phones?

I've been lucky enough to have never needed my phone replaced and I've had over 30 or 40 phones thanks to connections at best buy.
My question is why do people hate them? Obviously your "brand new" (and i use parentheses because people think a 8 month old phone doesn't deserve a refurbished one as a replacement) has the exact same chance of not working properly. I can understand one month old but anything past that is not new anymore.

I think part of the issue with phones is that people don't want something that someone has had pressed against their cheek or stuffed in their pocket for the past few months.
This is apart from the obvious fact that a refurb it may still be broken.
I have personally had very good luck with refurbed cameras.

Honestly, because I've never received a refurbished phone that didn't fail on me within a month.
I don't care if it's "refurbished" or "new" I just want it to work 100% and not fail on me.
I'm inclined to agree that after a certain point you aren't really 'deserving' of a brand new device. I think it's simply the fact that the device isn't 'brand new and out of box' and has been 'handled.' I guess I can sort of understand why people might have a problem with it, but if it works and isn't entirely flawed in some manner, then what is the problem? I had 2 refurbished PS3's die on me in a year. Obviously I got 'lucky.' In that regard I understand why someone would be hesitant to get one. But more often than not refurbs actually work as intended. Shocking. But the practice is a tried and relatively true one.
I think you should get a freebee.. one free new phone. Anything after that.. refurbished

I just activated my refurbished phone. It took Sprint a month to get one for me. This one doesn't charge at all. The store said it would take at least a week to get me another one. When I asked what I should do about my phone in the meantime, the employee told me I could bring my phone into the store everyday to have them charge it. He was serious.
The icing on the cake is that they won't call when the new phone comes in. I'm supposed to call them everyday and ask if it's there. But the store doesn't ever answer their phone! After going through the phone tree twice, it just says "Sorry, all reps are busy, please make an appointment online." Somehow this is the only store in all of San Francisco that can even do replacements. I ****ing hate Sprint. [/RANT]

From what I have expierenced, refurbished phones are rarely problem free. Thus causing people to question refurb phones and the quality control that goes into refurbishment.

Call tech support and tell them your situation and they can send you one over the phone. I have the same problem in the southbay. The store always has at least a 45 min wait before you can even get help and they never answer their phone.

Will they send you a phone if they can't verify the issue? Is there a specific support number you call?
I've never received a replacement "over the phone", it has always taken overnight.
Refurb'd phones are put back together poorly IMO, my wife got a replacement that started to seperate from the case, we complained, they sent a "New" EVO the next day.
I have two refurb'd that are just fine though, we have 8 EVO's.

The term over the phone refers to the fact he can get a replacement by speaking to someone over the phone instead of having to deal with the situation he has at his local sprint store.

Yea they will. You should be honest about the problem because if you lie and sprint determines there is no issue with they phone they can charge you an additional amount.

Sprint has questionable refurbishment techniques. I've been told that the whole process is outsourced. I've read a lot about people getting refurbished phones that have known problems, like screen separation and bright spots on the screen. In many cases, it seems likely that those are the reasons why the phone was returned in the first place, and their refurbishing does not take care of the issue for which the phone was returned.
That said, I used to be on a Centro, and I went through three new ones before I ended up with a refurb. The refurb lasted a hell of a lot longer than the new ones. The only problem with it is that it was kind of gross when I got it. It had smudges and one of the buttons was a little cracked. But the phone itself worked great for the year and a half that I used it.
And yea, there's the gross factor too. Who knows who had their face pressed up against my refurb phone. Ick.
I don't like the idea that it could have been thumped around, and only the most obvious failing component was replaced, leaving you with a "ready to break" phone. That being said, I've never actually had a problem with a refurbished unit, (phone or other). All in the head I guess.

I've seen as many new Evo's that had the screen separation issues, charger issues etc etc. I can see there being a bit more of a chance that a refurbished device isn't going to be up to par. I like the idea of maybe a new device and every device following is a refurb. As for the dirty screens ... maybe that's how I caught that face tattoo known as cheek herpes. :debbiedownerface:

Well... DUH, some people have no sense of humor, must be due to lack of root... I dunno.
So far only on my first refurb from August last year. So far so good (knocks wood). My launch day (002)Evo's 4G got up, and gone (radio was shot). The refurb is a launch day 003. As with anything you put in contact with your body for the first time you should wipe it down first even if new(some of the toxic chemicals used in production are rather nasty).

Blacklisted S4

Okay so I bought an S4 off craigslist and the next day he reports it stolen and blacklists it, I contact his friend trying to work it out (note: everything we said to each other was over texts, so I have them still as proof - and I got his friends number the day I met him.. he deactivated his service).. he said he doesn't know why his friend blacklisted it but he would call AT&T to unblock it, shortly after he said he did it.. I waited patiently but to realize that it was still blocked so I text him again, he doesnt respond for a full day so I told him I will call the Police. He must have gotten scared because he finally responds and unblocks it.... I used it for a couple hours, then my service cuts off and he sends me this long message telling me that he blocked it again and is calling the cops because I threatened him?. I never said anything threatening to him but whatever....
So I call the police, report everything and tell them the story. A couple hours later a detective calls me and asks if I would like to prosecute, I agreed... so now Im waiting to see what happened...

Yeah definetly, I flip phones every now and then on craigslist but only meet in public areas infront of cameras, and I make sure its a real number. Which in this case it was, he must have thought I was bluffing when I said I would call the police.. I just turned 20, I really don't have time for this mess with school and work.. I gave the detective his information and he said he located him and spoke with him, and will me a line up after the weekend.. I mean seriously? Just give me back my money dude, why even risk jail time when I told him id drop charges...... people these days are ridiculous...

That's... really messed up. You should definitely win. So long as you have all that information condemning him, I don't see any reason why you should lose. Obviously this guy is retarded because he doesn't realize that he will be convicted of fraud (against you), insurance fraud, lying to the police, and possibly other things. Over a phone? How much could this guy possibly make from a scam like that? A few hundred bucks maybe, and obviously can't keep doing this because AT&T would catch on to the fact that he keeps buying phones from them with insurance and losing them.

I sell phones on Craigslist all the time and this is why it is no longer a good practice. Can no longer trust anyone and that causes more low ball offers.

I just got my s4 this past Thursday through craigslist, I told the guy that for us to make a deal we would have to meet at a corporate AT&T store to have the phone verified and documented that I purchased his phone . to make sure there was no back lash on me.

legal ways around this...
ask for purchase reciept with signature name and id
ask for his/her id
go to local att/tmob/verizon whatever store and and confirm IMIE/serial belongs to seller
ask for manager and tell them phone is being sold not stolen (or call)
friend sells/buys phones off CL all the time, unless they agree to all the above he wont deal with them. only way to be safe. also, i would report the guy who did it; thats insurance fraud, falsifying a police report, and some minor infractions. you have his number? call him leave message and tell him you will report insurance fraud; they will pursue it.
I have a detective on the case already, he deactivated his number but he was stupid enough to tell me where he lives and gave me.his friends number the day I purchased it.

I sell my old phones on CL and have noticed people are being extra paranoid these days.
When I sold my iphone 5 the buyer asked for the imei # I refused to give it over the text. how do I know what this person plans to do with it?
of course they asked if it was stolen, I obviously said no. I showed them the original box, even the shipping box it came it, I of course removed my address. Let them pop in their sim card and they were satisfied.
I'm curious to know how much you bought your 2nd hand S4 for? I would think someone looking to scam someone would try to make a quick buck with people that aren't gonna think twice to buy it if it's too cheap.
Let's say like 300? no one in their right mind would sell you an S4 for half of what it costs new, of course unless if they were going to scam you... I would be suspicious of it before I agree to buy something that seems too cheap...

I never said anything threatening to him but whatever....
So I call the police, report everything and tell them the story. A couple hours later a detective calls me and asks if I would like to prosecute, I agreed... so now Im waiting to see what happened...

You will win. You can take him to small claims court and have him pay the fees too.
See if you can get a cache of his ad just in case for evidence. Most likely he'll cave in and refund you.
Show him all of your evidence and say "we can take this to court and I'm sure I will win."
On a side note, what an awesome detective working your case. I'm sure he's very busy too. These guys have back logs of cases not resolved and have to work tons of overtime.

300 is right. But it was in bad condition, the frame was jacked up. Other than that nope. I thought I just ran into some idiot.. turns out I was right, an idiot he was.

It's not small claims though, the detective asked if I would like to prosecute him in court and I said yes. Later asked if it would be small claims and he said no, so im guessing its the real deal... anybody know if any fees will have to be paid out of my pocket for court?

sold nexus 4 yesterday in perfect condition, guy tells me today it's not working

Its been in perfect condition, its hard to believe it just stopped working
Only thing I can think of, I didn't update to kit Kat, did updating ever cause screen responsiveness for any of u? He updated and says its not working.
Telling me there's a crack on the screen when I gave it to him in perfect condition
What should I do? His stories really shady, he's asking for his money back, but I'm pretty sure he did something to make it stop working, either dropped it in snow or something because its been working perfectly, even showed it in front of him

Buyer's fault on this one. He should have checked the unit thoroughly before closing the deal. A crack is easily noticeable, he could have noticed it when you show him the unit, so why just now?
(btw, is it cash on delivery or shipping transaction?)

You may be held liable to a certain degree. If you say the phone was in 100% working order and was in mint condition without a scratch/crack and he inspected it himself finding nothing then it's his negligence. However, if the phone suddenly stopped working a day after, and suddenly "died" on him without him tempering with it, then you may be held responsible due to a innocent misrepresentation.
I have no reason to believe he is a crook and possibly switched your phone to a different already broken one, and is just looking to scam you. Not much people are that low, and hopefully you have some type of background knowledge of him before you did the exchange. If you have the IMEI Number/Seriel Number of your phone still, I'd ask him to send that information back to you to ensure it's the same phone.
The worst that can happen if he called the cops is you would have to give him his money back, and he can't press any charges on you due to the innocent misrepresentation tort.
edit: I don't think you should be concerned at all to be honest, you can try to help him if you're tech savvy and guide him through Odin his phone back to stock, but if its a hardware problem, it's most likely his fault for dropping it or something.

This is a tough call. I'm not sure how much he paid for the phone but it may be simpler just to refund the purchase price and eat the loss just to have peace of mind. If you take it back, make sure the imei matches the phone you sold.
How long did the buyer have the phone before contacting you?
if what you wrote is complete and real, then in that case, I would not give the money back to the person for these reasons.
1. worked when he bought it.
2. he inspected it, it was in mint condition, now it have a crack.
3. crack doesnt appear by magic.
tell him, if he want hes money back, then he have to give back the items in the exact same condition, thats mean, mint condition, without any crack or defect.
Of course what I wrote is real, and I've decided I'm not giving him his money back unless he gives the phone in the exact same condition I gave it, which was perfect

If he wants his money back and you refuse, there's nothing he can do except to take you to court. The police has no reason to deal with this kind of issues (except to try to persuade you to settle it because the other guy is bugging them). Personal safety however is another issue entirely. If he keeps on calling you or even show up at your doorstep, you can call the police to and tell them that you feel threatened by his actions. Unfortunately, if he does decide to attack you, you are going to have to learn to defence yourself. Therefore, next time don't give anyone your home or work address.
this is a cautionary tale of how to (and not to) sell a phone. i go through phones like underwear, and i can tell you that covering your own butt is the easiest way to avoid these unfortunate situations.
first off: NEVER have someone to your home. you never know who you're dealing with. secondly, make sure that the person fully checks out the phone, and is completely satisfied with what they are buying BEFORE they leave. unfortunately, a lot of people get buyer's remorse, and expect you to just refund the money to them, despite you selling an item that was properly described.
when selling a phone, i always make sure to overstate any possible problems, even if they don't really exist. i feel it's better to be as up front as possible. that way the persons are usually surprised at how much better the phone actually is.
i just sold an unlocked phone to a guy a few weeks ago, and was with him for ten minutes as he went over the phone. i plainly asked him to make sure if he had any problems now, since this was a no refund sale. he said all was good, and paid me. well, five hours later i get a text from him saying the phone doesn't work, and he wants his money back. it was an unlocked g2, and he said it wasn't getting any data with his tmobile plan.
i reminded him that he had looked at it for a good while, and assured me he had no problems with it. at this point, there was nothing i could do. apparently he had checked out the phone with the wifi on, and hadn't tried the data plan. i also did all the requisite checking on google (something he wouldn't do himself) and had discovered that all he had to do was call tmobile and get the proper apn settings so that he would get the data working.
from that point he claimed he was a moron, and that he didn't even know how to do that. after i laughed at him for that response, i reminded him to take a deep breath, absorb what i had told him, and to fix the problem himself. it was not my responsibility to show him how to do that, and the extra time i took to find this out was above and beyond anything i should have been expected to do for this sale.
he eventually stopped texting me, and i assume he went ahead and made the adjustments on his own.
but i would NEVER have someone meet me in my home, for various reasons; but the main one is what you are looking at now.
from now on (after my last experience) i am going to make the person sign a contract stating that the phone was sold as described, and that they fully checked it out before buying it. i know there are shady people out there...those that buy, and sell. you need to cover your bases as best you can.

It was perfectly fine before the update. So obviously he screwed up with the update.
So he should not be seeking support from you. Is not your fault.
Is a private sale, there no refund or warranty.
But hope you learn something. Don't use your home or even workplace as a place to meet up random stranger to buy/sell.
Like what other said: Safety first, call police if you see him linger around your place!

As everyone else said, there's nothing really person could do...BUT most importantly....DONT EVER EVER invite strangers to your place....I am sure there are lots of Tim Hortons around where u can meetup in Brampton.
If you had images on your ad that you might have sent him you might be lucky...but even if u dont...no biggy...for him to convince anyone that u sold him cracked screen without him knowing is just plain dumb n stupid on his part.....
all u have to deal with is...him nagging u at ur place (phone/text etc u can block through various apps), except for that u should be good. dont be scared about it. u could tell him things as is & not to bother u again!
Do not give back the money. I wouldnt care much if he knows where i live. Big deal anyway. When you gave the phone it was in perfect condition and was working. Why did he bother messing with the software if he is noob? Ask him to give the phone back in the exact condition as it was sold and he can have his money back. If not, avoid him. Let him call the cops; in fact let him call the army. Its not your fault. Last year, I remember an idiot broke my tablet and he was trying to blame it on me. Btw, you don't have to pick up his call right away; just tell him to call you only certain time in a day as you are working.
If I see him around my place; I would just call the cops and explain the situation.
