My local o2 shop have XDA II's in stock at £350 with a new contract sadly even though the upgrade is only £350.00 too and I get to keep my XDA (WOW) I havent been with o2 12 months so I cant do it yet (Sulk)

I'd warn you all to be very careful indeed I've been had once before on Ebay and never recovered my money.

Can you tell me what you mean by "odd replies"?
Don't want to put anything down here I could be complained at for, but I do a lot of business on ebay and it just seems to good to be true.
Lets face it the o2 shops are only just getting these in and they want £350.00 on contract why would anyone have 100 (now 30) and be willing to sell them sim free for £160.00 delivered look at his other auctions too they are all top of the range phones.
Normally if it seems to be too good to be true it is.

I was offered several of these machines from this ebay seller and when I said that I worked in a nearby town and offered to call to collect the phones, the emails dried up and I've had no further contact since yesterday. I suspect this is a con.

With the name/address, you could look at the electoral role to verify....something like UKINFO 2003 or www.192.com might help....

Thought I would share this with you all, I know how I feel, how about you?
I have been bought an O2 exec on contract via O2 online as an Xmas present. The exec is an advanced device and many things can go wrong that may require it being returned for replacement. It would be difficult for someone without some technical knowledge to give an exec a decent test and ensure everything, BT, Wifi, 3G, SMS, Video, Camera, MP3 etc etc is working correctly. So I contact O2 and request nicely that they confirm my warranty does not start until the 25th Dec. My exec has arrived, I have not even seen the box yet, my wife has already wrapped it ready to place under the tree in a couple of weeks ready for me to open Christmas morning. I could have and still could open it up and test it to make sure I am happy everything is okay but I don't want to! I am so looking forward to opening and holding my exec for the first time on Christmas morning. I understand that if it did turn out to have a fault I would have to wait until I could get to an O2 shop to get it replaced, thats fine. However O2 have stated in there email to me, copy below, that they will not delay my warranty until the 25th and that it will expire while it is still unopened and unused. I am disgusted!

Your warranty will not have run out. Your right to an instant replacement will have run out. If the device is faulty it will still be repaired. But you might be without it for a month.
Expecting O2 to extend the 28day period on your say-so is unrealistic at best. Its not the way the world works (and never will be!).
If they allowed it for you, then everyone would be doing it to get an extra month or so added to the 28 days. They only have your say-so that you aint gonna open the device until December! If I was in customer support and a customer said this to me I would be skeptical to say the least!
If you are worried, and dont want to open it then I would send it back towards the end of the 28 days, say its faulty, and get a replacement. The replacement will have a renewed 28days on it from what I can gather.

You cant change terms of contract willy nilly after the purchase. And chances are that the return/repair terms are tied into O2s contract with HTC.
Besides, theres still the 1 year warranty in case its faulty....
I did not think this was special treatment. It is common practice for shops to allow customers to bring faulty items back for replacement after christmas. How would O2 suffer from agreeing to my request, If the unit works fine they have nothing to fear do they? I have not asked for my contract not to start until the 25th I have not asked for my 1 year manufactuer warranty to start until the 25th. The sim card will not be activated until the 25th. I just feel that in this season of good will to all that this is no way to treat your customers, instead O2 customer services should be shouting from the roof tops that all phones bought for christmas can be replace if discovered to be faulty within 14days of christmas. I really thought I was being hard done by, but now I am starting to feel like I am being the pain in the arse.
@gooroo, look just open it and play with it for a few days and make sure all is well. Then seal again and it will be even more fun to wait until 25 Dec, a bit like foreplay
And you'll the reassurance that on 25th your device will be perfect and no disappointment

Personally, I'm disgusted that you think your so self important that you believe a company should bend over backwards to accomodate your individual Christmas gift requirements.
Imagine if everybody took this stance and ordered electrical items or whatever, but asked for their Warranty to start at a given date because it suited them ?
No offense intended, i'm just kind of surprised anyone would be "disgusted" and "angry" at a service that is quite honest and open about having a fixed 28 day warranty period. :roll:
@gaspx, its not just a given date, its the date at which retailers make a huge amount of profit from us their customers every year!
As for being sceptical, its not like they would not be able to check if I had used it before hand, as soon as I register the sim their network would know.
Anyway, I guess I am being over the top. I am sure it will be fine anyway looking at all the reports on here from people saying, buggy, slow, crashes, not working etc etc. Perhaps I would not be so concerned if we were not expected to beta test their stuff in the first place!

i feel that the company did nothing wrong. you already got it at a special price and if you want to have standards for yourself (not opening presents till xmas day itself), you expect others to follow suit.
As has been said previously...the 28day is a right to return the phone as a change-of-mind option only. The warranty will not end after that period - if the phone has a fault when you start using it, you can send it back for a replacement.

Sorry guys, look I must really have got this badly wrong. My mistake, I really thought you would all take my side and just think O2 were being mean. I dont earn alot of money, it takes some saving before we can afford to buy something like the exec. Like buzz says, I have a family to feed and this is the one time each year that I can choose to have a little luxury. It's not like I am being strange wanting to wait until Christmas before opening presents, I am pretty sure millions do the same thing the world over.
What I was asking for from O2 costs them nothing, indeed if nothing was wrong with their exec it really would cost them nothing and if there was something wrong with it then they would have had to replace it anyway. All I was hoping to avoid was being disasppointed by receiving a gift from my wife at Christmas that did not work and then having to wait 2 weeks maybe before O2 replaced or repaired it under the 1 year warranty.
Sorry to have got you all wound up. I will shut up now and eat some humble pie. Certainly didn't expect this kind of response doh!

gooroo, the one thing you DO want to check (and your wife can easily do this for you now without any technical knowledge) is that they've sent you a NEW Exec. I.e. one that's never been touched before. There are several reports on these forums of O2 sending out previously-returned Execs to new customers instead of sending them fresh ones and reserving the fixed/secondhand ones for warranty returns.
Get your wife to open the box and see whether it all smells new, whether everything is neatly wrapped up in little bags and whether there are any finger prints on the box, the manuals and the Exec itself.
If it looks suspicious then call O2 and stick a rocket up their collective arse. Their practise of selling second-hand phones as new is ****ing disgusting and they should be investigated by Trading Standards. :evil: Just MHO, of course.
After all this I hope you're really happy with your Exec and that you have no problems with it. Have a good Christmas and don't neglect the kids to play with your new 'baby'!
For what it's worth I don't think some of the responses above were warranted (no pun intended)...you made an honest post and people should perhaps have not jumped down your throat about it.
Bottom line is though that the 28day thing is a have-you-changed-your-mind-about-wanting-the-phone thing. Sure they could exercise a bit of festive understanding but it's not their obligation to be. But as your main concern is that it works, not that you won't like it, the 28day limit is irrelevant.
I do suggest that you get your wife to check that it's not a return (I got a refurbished XDA2 supposedly as brand new and I demanded they send a new one out - I didn't return the one I had til they did) and then get her to wrap it all up nicely again. If it's faulty when you get yer mitts on it, then you have the right to send it back as such.
Hope it all works out well for you, which I'm sure it will.

Yeah, well, at the risk of flogging a dead 'un, I wanted to pitch in to support the OP and say I'm doing the exact same thing. I also asked if I could have my renewal start from the 25th so I would have the full 28 days and was told that no, it would actually start that same day, regardless of the fact that I wasn't going to receive the Universal for an unknown period of time...
Knowing that, when it arrived I opened it up (loooove that box) checked it was all ok, doing a hard boot and basic install etc then gritted my teeth and wrapped it all back up again. This was a few weeks ago now (3+ anyway) and I will *never* do this again! :lol: the suspense is killing me!
Respect is due to the OP for delaying gratification in a world obsessed with instant pleasure, and for eating humble pie, another increasingly rare trait.
@gooroo: Do get someone to check that it is an original and maybe run through a basic reboot / sim check because it's easy to do and worth making sure that Christmas day (Christmas Eve for the Catholics amongst us) doesn't end with a whimper

When I first phoned the helpdesk hadn't even received the price list off the service centre. I had to phone them up the next day and then wait for Lee to call me back
Spares are like rocking horse crap at the moment and the only people that seem to have them are HTC's service centres.

Maybe it's just me, but I've never purchase any insurance for any of my phones. The last phone I've had was a $700 Diamond when it first came out. I check to make sure I have my phone on me at all time. NO. MATTER. WHAT. I've grown to the point where I'm very paranoid when I step out of my car and didn't feel the phone in my pocket. Everywhere I go, I make sure the phone is in a secure spot (ie, carrying case) if not, I will make sure it's in an enclosed pocket (front pants pocket). Don't ever put your phone on your shirt pocket or anywhere with an opening because when you bend over to pick up something...BAM!! Just simple reminders that many tend to overlook. It's just a higher level of awareness when you spend an upward of $700-$1000 for a phone.

to say that must be heartbreaking has to be the understatement of the year... lots of dude's don't bother with phone insurance but have you thought about claiming of your house and contents? If you have it the excess fee will surely be less than the cost of outright replacement...

Got mine insured through 'Supercover' - £9.99 per month covers my HD, and the wife and brother in law's iphones. Think (for the gadget mad) they do a 5 gadget cover for £14.99.
Feel your pain - my HD was replaced within 3 days of getting it thanks to an unzipped pocket.

I was just wondering if my supposedly new zoom I just purchased from Best Buy was actually new or a return. It started up like it was new with all the setup stuff. What seemed kind of funny was when a went into my user defined dictionary there was all kinds of foul words in it like it had been used before. also it had software on it that didn't seem like it would come with a new device. Software like Craps, Blacjack, US presidents Trivia, Vampire Trivia just to name a few. Was I sold a used Xoom as New. Thanks for any help.

My Xoom case was sealed. The Xoom itself was in plastic i hade to take off. And none of the apps you mention was on mine. I have the Wifi Xoom, maybe things is different on the 3g Xoom.
I would consider taking it back.
When you got it, was the seal on the box broken? Did it have the protective film on the screen? If it wasn't like this video when you opened it, I'd say so. And also, was it advertised as completely new, or new condition?

I think they tried to pull a fast one on me. Some of the words in the user dictionary were f**king bit*h a**hole amoung others.

Yes....the games installed were a dead giveaway....they sold you a used one, not even reconditioned, because then they would have wiped the data. Someone returned one for whatever reason, and when they took it in back to put the ZAGG on it, they made the swap for some reason.
I would not even bother with dealing with the sales people...take it straight to the manager and raise holy hell. Say your kid had used it for school, found that language in the dictionary...permanently scarred.......going to sue...blah blah. You will come out with a new one and a case AND a giftcard.
Thanks for the help taking back as soon as they open today. I will raise hell with them. This was way out of line. Those salesmen should be fired!

Be careful not to wipe any of the stuff that was already on there.
I would either get a new one or keep the one you got with benefits as some money back or free accessories.
A returned device should always be sold at a lower price and the customer has to be informed that the unit is a returned one.
On a funny side, tell them you are like Jackie Chan you don't curse and don't use guns, and you felt awfully offended by the words specially when your kids are insulting you because they are too smart for that tablet and found the dictionary before you.

I used to bought one Samsung Galaxy Tab from Queens Mall Center the Srpnt Sales booth .
It was the last one but the sales person spinning his head(seriously, he spins his head to show definite yes to my question "whether it is a new one") promising that is a new/unopened one.
And guess what?
When I open Samsung Galaxy for the first time, there was one video in the device shooting the booth manager talking to customer (shooting from the manager's back).
I took it back, and show them the video. (strongest evidence I ever had and no dispute whatsoever).
And as a result of being disgusted, I just returned Samsung Galaxy and not planning to buy anyone from sprint for a while.

i had some isues with 3 xooms that google books were not working as youtube icon.
Well after i research the solution of my problem thanks XDA. i went to buy a new one.
Well the sales person at best buy offered me a new one on a seal box for regular price... and also had offered me an opem item while he said he had opened by mistake idk if it was return or not.
Well he offered me return item for $519.00 so i went for it. i got a girft card back for my remaining balance... abotu $70. i got my self a Motorola case $39.99 and i still have some balance on my gift card.
Until then i havent got any problems with it. was clean though.. like new..
Like peple had mention above you should be able to bring it up to Manager and come out with some freebies and some discounts.. good luck!
make sure you tell the manager it is illegal to sell used items as new. tell them you want COMPLETE satisfaction and a reasonable compensation for your time wasted, aggregation caused by their store and to help restore your trust in best buy. remember that you catch more flies with honey than vinegar. so stay calm, polite but firm and you could walk out with a major win.
I'd skip going to the store all together and write a scathing, but well worded letter to Best Buy corporate including the store number and all the pertinent information. Tell them you and your son were deeply offended by the words found in the dictionary. Make up some scenario where you were typing in a recipe for fudge in a text message and the dictionary suggested "****" as an alternative.
I've been in a few of these situations and have always found that going directly to corporate yields the best results. Do some Google searching or gather some intel at at the Best Buy in question and find out who the regional manager is. This is the information age and people's contact information isn't hard to get. Get people above the retail level involved and heads will roll, especially in the corporate structure where back stabbery and employees screwing eachother over is common place.
EDIT: Threatening legitimate lawsuits is a definite attention getter, and your case seems quite legitimate.
Can't you just match the serial number on the box with the one in the Xoom to verify if it was swapped?
Definitely go in and speak to a store manager. Threaten to call the BBB and while you're at it try and secure an OTG cable.

Agreed, snatch a free otg cable from them while your at it. It will save you a headache later on... plus you deserve it, I'd be pissed.

I'd take it back and demand some sort of compensation. You're most certainly not the first user.
Mine was an open-box return, but it was flawless as far as I could tell and they gave me $50 bucks off. At least tell them you want some accessories or a BB gift card or something.

make sure you tell the manager it is illegal to sell used items as new. tell them you want COMPLETE satisfaction and a reasonable compensation for your time wasted, aggregation caused by their store and to help restore your trust in best buy. remember that you catch more flies with honey than vinegar. so stay calm, polite but firm and you could walk out with a major win.

I would also advise, while saying this do not start taking your pants off. This did not work well for me after following this posters advice.

Hey guys. I know this may be put in another thread but I need as much advice ASAP, so more people that see this the better.
I want to buy the GS3 tomorrow. The thing is, where I live, its going for $1,100 and thats on special. Thats a crapload of cash, so I need to be certain I dont get stuck with a crappy phone.
I currently have the original Galaxy S, and that had a useless gps which gave me endless headaches. Don't want to get stuck with another phone with such a major defect.
Now I have been following this forum but I just wanted to know, besides the screen issues, is there anything to watch out for in terms of common manufacturing defects.
Also, what advice can be given on trying to detect screen issues whilst still in the store?

Don't do it for that much!!! Where do you stay? Have you asked someone to purchase it for you, then send it to you?

You're in California in the US. You're getting ripped off at $1,100. Buy it online for a much lower cost. Don't throw away money like that. Jeez...

I live in Zambia. Its a small country in Africa. The original GS1 sells for $600, the GS2 for $850 and the GS3 is $1,100. This is from a Samsung store. They just started selling the GS3 a few days ago. Actually, I am surprised that it was not more expenseve. Another phone store was selling them for $1,400.
I am really tired of my current phone. It lags too much and no gps. I think its done its time. Flashing roms stopped being too effective a while ago.
If I buy online, there is a chance that there will be a defect and it would be a pain in the backside to try to return it. Shipping itself would cost a bomb, not to mention taxes or the fact that the phone may not reach me at all.
I am still debating whether to get the phone or not, but I nearly bought it today itself, but restrained myself and came straight here to see if I can make sure I dont get a defective unit

Not anymore. Moved out here to zambia a few months ago. What can I say, I need my dose of current tech to make feel alive inside. Its hard adjusting to a country where you dont even get decent internet

Dude, preaching to the choir. My hat's off to you, lol. Really though, just get as hands-on with the phone in store as possible to make sure you don't see any pixel issues. In store there isn't a whole lot you can do for testing as people generally find issues over the course of a few days or longer. That said, can you not buy the phone on amazon for cheaper than $1,100?

I could get it from Amazon, but with shipping, taxes, and duty here in zambia, it will still come pretty high. Still cheaper that $1,100, but if it is defective, I have to ship it back and hope the next one they send me is good. If not, then this will turn out to be an even bigger disaster than spending over a grand on a phone.
Also, I have this fear that the phone will never reach me.

Amazon customer service has never let me down. That's all I can say there. Also, I got mine from Amazon and it's in perfect condition. Can you select a UPS shipping option? Because if you can then you'll get your phone. If it's shipped UPS they'll have the tracking number to ensure it got to you.
