Apple - BROAD Patent Granted - Or Was It? - Vibrant General

PC Mag and about every other site is talking about it. Here is the excerpt from the end of their article.
Apple could conceivably restrict makers of touchscreen smartphones, tablets, and other mobile devices from selling their products in the U.S. More likely is that Apple would reach a settlement with such competitors and start licensing its patented technology for a tidy new income stream.
If Apple does decide to play hardball and squeeze out rivals rather than set up cross-licenses, the source said, it's entirely possible that a court could find it in the public interest to scrap the patent rather than allow a monopoly on what has become a defining interface for an entire category of consumer devices.

Here is The Patent
Rather than post my entire rant.. these are my thoughts!
While I was proud to be one of the first saying people should stop freaking out... this article is MUCH better than mine.

This is the same as what if the first air regulator for diving was patented to include the general idea of breathing under water. What if Ford patented the idea of steering a 4 wheeled platform with a round object. I mean to say that if they tried to patented the idea that you can use your finger to manipulate objects on a screen it would never make it. That is to general. Besides wasn't there a Nokia phone that did that before apple? and I remember they did that on star trek and other scifi shows with real panels long before Apple.
No worries here.

^ They WERE granted the patent.
My point, every site seems to say it is some HUGE BROAD patent and every other competitor is either going to get out of the market or start paying Apply loyalties. But, that is not how I am reading the patent. I think they are wrong.

Advanced tech patents have been BS for decades. The Patent Office isn't not technically up to speed with the industry.

i don't know man...the way it reads to me is that apple essentially has a patent on multi-touch displays. your analogy of scrollable google maps within a page doesn't seem to make sense to me. maybe you can explain your thoughts on that part better?
it also sounds like they're describing multi-touch gaming such as Gun Bros where N finger would operate left joystick, and M finger would operate right joystick.

This is BS. Apple can come and lick my a**.

AppleCare: The iPhone 4 Update Won't Solve the Antenna Problem
Well this is just a nice way to come back from a holiday. It seems someone at AppleCare has stated that the iOS 4 update won't solve the antenna issues so many users are complaining about on their new iPhone 4. Apparently it will change the way the antenna indicator calculates bars, but that won't solve what happens when you touch the left lower portion of the antenna.
We'll still call this post a rumor until we see the update to the OS actually working and confirming it as a fact, but according to Gizmodo, they gave AppleCare a call three times today and in these three times they got the same "pretty much read" responses:
• There is an antenna interference problem when you hold the iPhone 4 in a certain way
• One solution is to hold the phone differently, avoiding to touch the left bottom corner of the phone
• The other other solution is to buy a case or one of Apple's $30 bumpers
• The incoming software update will not fix this antenna problem, only change the way the phone displays the available signal, make it more accurate
So much for state of the art industrial design. Don't get me wrong, the concept is cool and I am a big fan of the phone. I just wouldn't call this a break through until Apple can prove it can work. Surely getting a free bumper is a great solution Apple should attend to by giving these away for free, but there are some of us here who simply don't like to carry their phones on cases..
ok what now??

Hahahahahahahahahahahahahahaha....you get the point
recently i was talking w/ a frind of me about the hd2 (he really wants one and sorfs this forum very often) and we began to talk about the iphone.
[flame]
we began talking about the new "features" of the ios 4 (about 2/3 of those "features" are supported by wm/android for ages; the others are useless, like increase digital zoom for the camera). i then took a look on apple's ios4 web site.
for your sanity i advise NOT to take a look on that page, i don't know if i should laugh out loud about what is written on that page or rather bash my head against a wall.
beginning at that "facetime" stuffs (video telephy) that only works when connected to wifi, to the "security measures" and busibess functions, it's all either "wtf lol" or "wft lame" or even both for me.
and in the headline it states "With its easy-to-use interface, amazing features, and rock-solid stability, iOS — Apple’s mobile operating system — is the foundation of iPhone. And even as other phones try to catch up, the technologies and features built into iOS 4 keep it years ahead of the competition". come on.

[Q] Why do Apple lovers hate the XOOM so much?

I am an Apple user (no kidding) and am puzzled at the lack of love for the Xoom, particularly at MacRumors (been a member since 2006). Where is the love?
Comments such as:

makes me wonder whether Apple users are mostly pricks?
I think it comes down to religious fanaticism. They feel that there is only one "right" choice and everyone else must follow them and they don't care how they achieve that goal. I've seen it here too.
It's funny because on here I think i haven't seen too many 'bad' words about apple / ipad - mostly that the UI is very clever, but not to their taste...
lack of customization etc.
I see apple stuff more as a fashion statement personally - and I'd feel restricted if I had one - but that said, I think it's good for people who want something simple...

Great products? Have you heard about the defect with their LCD screens? Light bleeds in several points of the edges of the screen. A lot of iPad users are complaining about it, but of course, hardcore Apple fans call it a feature. LOL
What the crap are you talking about? The Xoom isn't that much more the the 32gb 3g version of the ipad 2 and given how much more advanced it is via hardware...I can understand the price increase. Do I like paying more...no...but my Xoom works for my needs 10x better then the ipad. That is just my personal opinion. The wifi only Xoom is the same price as the 32gb wifi ipad 2. You need to compare price points for similar products...not just make random incorrect statements.
By the way, Xoom isn't that buggy at all...atleast not for my wife and I. People seem to forget that the ipad had to wait 8 months for fake multitasking as well as other features. Everything takes time.

Okay, when think about it. I want to rephase "apple" as "big companies"
The thing is there are some inventions that can only be designed one way. If apple sues samsung then palm should sue apple since the apple iphone is very close to the palm life drive.

Apple is suing everyone.. Amazon for the "app store' name, HTC, Motorola, and other companies for the 'swipe to do something' feature.. it's just a never ending story.
it sure took Apple a long time to notice the similarities between their products and Samsung's...or any other phone manufacturer for that matter. A dinner plate is like the moon if you point out enough common properties.
Apple: "Oh my god you copied the iPad and made it smaller, put cameras on it, and an sd card slot too?! shame on you! (...hey that camera idea is not bad..lets put them on the iPad2...)"
i can understand that they would see a imitation of the iPhone 3gs through the galaxy s.
but seriously, they are still selling iPhones like no other company is selling.
and their newest model, the iPhone 4 looks completely different.
and to say that Samsung is imitating the look and feel of the ipad with the galaxy tab is completely ridiculous.

Reminds me of the Rolf Harris song ~ "Two little Boys had two little Toys".
Someone should go talk to the boys @ Xerox and see what they have to say about Apple and Intellectual Property..
...and on a side note, exactly how many different ways can you make a tablet and not have it be flat and rectangular with smooth edges ???
Fine until Samsung stops supplying parts to apple
Sent from my HTC Wildfire using XDA App
Seems like this will see the end of rectangle devices with curved edged and devices with a black frame around the screen that are the same width.
I don't get why Apple don't just sue every manufacturer. It'll save them time as they're going at them one by one.
Its just such BS. Ill put a turtleneck jumper on my c0#k and sue Steve Jobs for stealing my idea.
Sent via zombie infested Gingerbread.
All good points above. But understand this is the way of corporate America.
I am part owner of a company that imports musical instruments to the US. Specifically guitars.
I cannot tell you how many times I have received letters from Fender, Gibson, Taylor attorneys. NONE of my guitars are marked with these names, some of them do look similar.
But as has been said above, how many different guitar designs can there be? Made of wood, with a neck, 6 strings???
We have always replied stating that we do not use the name or photograph of THEIR product to sell ours. We have only once been sued by a guitar manufacturer for intellectual property rights violations. We fought, we won. But it cost us nearly $50k.
These corporations HAVE to do this. They have to draw a line in the sand and not allow others to infringe. Because at the point they no longer do that, they open themselves to ALOT of lost revenue.
I'll just leave this right here...
Found this article on www.cnn.com and kinda makes sence. I would love though to see samsung counter sue apple though imagine the amount of money they would get from iphone sales LOL.

I'm not an Apple fanboy, in fact quite the opposite. But the facts of this post are wrong. F700 was announced in Feb 2007 and showcased at 2007 CEBIT NOT 2006 show. And it was accused of being an iphone ripoff even back then.
Feb 8th 2007 date of video upload.
And if we want to be pedantic here.
The first touchscreen phone was the IBM Simon, launched in 1992. During this decade the popular iPaq (not made by Apple by the way) was launched with touchscreens and optional phone attachments. HTC, the leader in touchscreen phones up until the iPhone and makers of phones like the Nexus One launched their first touchscreen phone, the HTC Wallaby aka XDA in 2002.

In my opinion, the problem is that Apple is kind of feared. Android is being developed and, according to Google News, 350,000 Android terminals are activate every day, and this is a commercial strategy to stop Android's development.
Although, if I am not wrong, Samsung and Apple work "together" in a certain sense, because Samsung provides hardware for Apple products... So I can't get the reason of this lawsuit against Samsung. It is probably a commercial thing - Apple will "earn" MUCH money with this.

Didn't you know?? They give the definition of "unique" to a phone which has Samsung and LG components... And they're complaining for something which is not fair to complain for. TouchWiz UI and iOS UI are similar for the drawer and the app bar, and so what? I mean, that's a minor problem: imagine if those companies who are providing components for Apple stop doing it... I think giving them a "license" to use a (let's call it like that) similar interface is a good strategy...

I am not saying this will happen, but is quite possible if the government doesn't block Apple in their tracks from doing so... (I think once Google Appeals, these parents will be made standard for touchscreens...)
The one saving grace is that it's pretty clear the current patent system that dates back to George Washington in 1790 is clearly broken as it applies to technology. Should Apple start abusing their horde of patents to eliminate competition leaving them as the only purveyor of functioning smartphones and tablets governments worldwide will intervene. It's already started with Judge Posner throwing out the Apple v. Motorola case in Chicago with prejudice calling it "ridiculous" based on lack of or concocted damages. If Apple wins the Samsung case in California they'll lose anyway. It'll be the beginning of a massive move toward patent reform because in a democratic society you don't let one manufacturer control an entire industry whether their patents entitle them to or not.
Patent reform needed...
Old news, a repost and a lot of misleading and wrong information. Good job trying to direct traffic to your site thought, you could have just asked.

How exactly does Apple have patents for things they didn't invent? Oh, wait, I remember now, theft.
I'm not sure that Apple CAN be granted patents for technology that already existed - smartphones have been around far longer than the iPhone, despite what the Apple folks would have us believe and I had phones that were doing these sorts of things long before Apple came along.
The law may be an ass, but I don't think it's a complete tool.
