So here's the deal, since I got my Evo the back cover hasn't fit properly - I don't mind too much so I placed a small sheet of paper which gave the back the proper curve and fixed it.
But now I've got a new issue starting to appear - The screen coming loose towards the bottom!
My friend got an Evo and his is flawless, why should I suffer from pre-ordering!?
I work in Chicago, and naturally I went to a Radioshack close to where I actually live - no Evo's, can't help me.
I call Sprint, they tell me go to where I bought it or all the can do is sent me a re-certified phone - that's bull****, the phone is brand new & not even two weeks old yet.
I go to the Radioshack where I bought it - No Evo's, all they can do is call me when one comes in. Also claim they haven't been sent any since launch.
So here it is, I'm a new Sprint customer who just switched from Verizon and they are already leaving me dry. I've got 30 days to cancel all this, yet they don't seem to care enough to get me a new phone.
My phone is brand new and defective, how the hell does Sprint think they can send me some re-certified model!?
Do they have some deal where if they don't send phones back to HTC they get a discount? I mean seriously, if this phone isn't under a manufacturer's warranty against defects it damn well should be!
This also doesn't cover the fact when I preordered, Radioshack told me there was no $10 data fee - not to mention failed to tell me about activation fees and Sprint surcharges!
I asked about it, almost insisting they could be wrong, yet they kept reassuring me there was no charge. I put $50 down on a non-refundable gift card to pre-order, bull**** they didn't know/disclose all costs when I asked! (Their disclosure of costs was "taxes")
If I don't get my NEW phone before 29 days, I will cancel the whole thing and rant anywhere and everywhere until I am heard!
EDIT: Let me put it this way, for all those who don't understand...If Sprint guaranteed me a new phone when there's availability, that would be 100% fine with me, this is not the case, they want to send me a re-certified phone right after I just bought one brand new!
EDIT #2: Here's my logic...the phone is provided by Sprint (to Radioshack), Sprint pays a spiff (to Radioshack), my service is through Sprint (which is paying off the phone), and my contract is through Sprint.
Why does the fact that I bought it at Radioshack even matter!? Sprint is at the core of all of this.
It's like saying a have a 1 year warranty on an Sharp TV that Sears sold me and trying to take care of it through Sears...after that 30 days it's not Sears' problem. The service through Sprint is ongoing and this phone is part of it, how is Sprint not responsible?
You have got to be kidding me with this post right? I guess you assume the magic phone maker ferry is going to make YOU a phone just so YOU can be happy, but everyone else has to wait until they get re stocked because they sold out of all their phones.
Please, just cancel it already, people like this ruin it for the rest of us. How can you not understand that being back ordered means NO ONE is getting new ones right now, they can't just make it appear out of nowhere. Yikes.

My situation is similar. I planned on switching from AT&T to Sprint, however, now, I don't know what to do. I have two defective EVOs, bought from Best Buy, and I have called every Best Buy in a 1 hour driving radius from my home in order to locate one (5 or 6 of them), none had any AND they refused to even take down my information to call me when they came in. Basically, they just told me to screw off. I am free to call back whenever I want to check, but they refuse to hold it in store even if I find one. Apparently it's a first come first serve basis, since they already have my money, what do they care?
Best Buy told me to use my warranty, Sprint won't do me any good because I don't want a recertified phone, as mine isn't even two weeks old yet.
And it's sad, because I really like my Sprint service, but I don't have time to screw around driving all over the face of the planet, escalating issues, etc. I just want two working phones, and that's all. I don't want credits, I don't want freebies. I'll even buy two new screen protectors with my own money.
But, 30 days is fast approaching, and once that mark hits they're no longer liable to care at all about my issues, and I have a feeling that's just what will happen.
I'll try over the next two weeks to locate a replacement. Otherwise, I'll just have to cancel (and I feel bad for Sprint, as it's not really their fault).
I understand all that, but where in the contract does it say the 30 days is waved from such circumstances?
Where does it say after 30 days I will still be eligible to trade for a new phone?
You both seem to be missing my point, the contract says 30 days if you have issues or want to cancel, it doesn't mention circumstances such as this.
What makes you think they wont give someone bull**** about the 30 day policy?

This is not even close to accurate in so many ways. First of all, he isn't complaining that he doesn't like the phone, he's complaining that he has a defective one and they don't have one in stock immediately to replace it.
Second, I guess you should tell that same horrible argument to the iphone, blackberry, porsche, ferrari, lambo, etc. owners that buy their high priced items only to find out there is a problem of some kind. There will ALWAYS be problems. That's why we have warranties and replacements, you just gotta be a little patient sometimes. This whole I WANT IT RIGHT NOW OR I'M GONNA RAISE HOLY HELL attitude is why companies have stopped caring if they fix things or not, there will always be nitwits and numbskulls who complain even if theirs is the only one to ever have an issue. "It's junk, take it back, don't get one, mine failed!" get real, grow up, and go back to apple land so steve jobs can control everything you do.

The thing is, if you are paying for your insurance plan, they will cover it as long sa you have the phone and replace it 100 times if they have to or upgrade you to the next model up. It's a feature sprint is great with and will go out of their way to help you with. If your phone can't be fixed by simple methods in the store, you get a new one. Problem is, at the moment, there aren't any left in stock, so you may have to wait a little bit to get one. If you like the phone except for the hardware trouble, don't sweat it, they'll give you a new one as long as you own in and as long as you have the insurance plan for 7 a month. If you don't, then add it before 30 days and don't worry about your phone ever being defective.

It really doesn't matter what you think - in the end it's a horrible business decision by Sprint. They give people the option to cancel in thirty days, then sell people a phone that breaks in 2 weeks. I think the expectation of having it last longer is not extraordinary.

That has 0 to do with sprint though, this will be HTC's problem. I'm not mad at all, I'm dumbfounded by the ignorance of people that are posting on some of these issues. Anything you buy could have trouble, if the company that sells it to you is willing to stand behind it and replace it for nothing, why sweat it? It's not like they are saying you're screwed haha you have to pay to fix with ti or live with it broke, they'll fix it for him free of charge, they just have to have one in first.
How in the world this justifies a post of how horrible sprint is and how they are stiffing their pre order customers I have no idea, how can you replace a defective item if you have nothing to replace it with?

That's pretty uppity to say, considering the OP was worthless in making the post to begin with and flat out wrong in saying sprint won't help their customers. I am def trying to help him, by showing that sprint will fix it as soon as possible and for free, but some people just don't get it.....
The issue imo is people come in with both guns blazing acting like add holes and wonder why it rubs people the wrong way.

You didn't say that even once and nor did Sprint.
I bought a new phone, I want a NEW replacement...that's all I don't care if I have to wait a month as long as I get what I should very well be entitled to (and the current phone doesn't die completely during that month)!
EDIT: Come to think of it you're changing your attitude drastically after seeing other feedback, it disgusts me, you want to put others down and can't take the heat in return.

Say what?? Tell me, can you do a google search? Can you see sprints insurance policy? Better yet, can you make it to a sprint store and talk to a rep? They will tell you, if the phone is defective and you have insurance on it, they will replace it for you. If it's something you caused, such as losing it or absolutely destroying it, you pay a deductible and then get the phone replace. Obviously you've never been with sprint before, because not only do they stand behind this policy, they do it with 99% of the time no trouble. A quick trip to sprints site and google will verify this.

How can you possibly replace the first run defective issues if you DON'T HAVE ONE TO REPLACE IT WITH. When they come in, you'll get one, it's really not that complicated.

People that have been doing this awhile know two things:
BuY from a private sprint store and you can run into trouble
Buy from retailer x and if it breaks you can't expect retailer y to fix it
So we act like cheap ****s and buy from retailers that don't have the rebate and we end up being stuck with said retailer should something happen. You can always send your device in to htc for repairs.
if it were me I'd return it, and buy from a sprint corporate store and let it be lesson learned. When you buy **** from third parties and it doesn't work out there can be issues. Sprint can't tell if that device came from ebay, bb or shack. I don't se how they are responsible for fixing what you retailer should fix.
If you want sprint to fix it, buy it from them.
Sprint doesn't make the device so before you start comparing apples and oranges think about it.

I shouldn't have to have an insurance plan to replace a defective phone that's entitled to be replaced in the first place.
I may end up adding it, but it's ridiculous I should even need it for this particular instance!

That's such a horrible mindset though. you're telling me you should be able to buy a defective computer, or car, or whatever, and with no insurance plan be able to just have it replaced whenever you want?
If you don't want the $7 sprint insurance, yet another quick search would show you that HTC has a 1 year warranty on the phone. you can send it back to HTC, and they'll send you a new one when it comes in stock. Or, you cna do what most people have figured out, and for $7 for the life time of the phone, take it to the local sprint store and get a new one for free. You think you can buy a laptop with no extended plan from the place you bought it and have them replace it for free if it's defective? You have to send it to the manufacturer to do so, same as this HTC phone. Or, add the insurance, and never worry about it no matter what.
I just don't see why this is so complicated! Go ahead and send it back to HTC if you don't want to spend the extra 7 a month, you can do that if you want, just be prepared to be without one for a few weeks, just like any other product that has this happen....
To me, you sound like the type that would go to a car dealer and buy a car, and if it has an issue after the first month or so you DEMAND a new car RIGHT AWAY instead of letting the dealer at least have a chance to look at it and see if it's something that can be fixed without much trouble. I can't stand those kind of people.
had to replace my phone cause my microusb port was all jacked up, was really loose and would only charge if i had my cord wrapped up a certain way.. had many other cords lying around which conformed "yes" it was the port and not a bad cable.. so the phone came in today and i have a big smile on my face cause its only had the 2.1 update and its a rev0002 so im all smiles cause i wanted to be able to reroot it the day it came it... #justsayin
also i know there is that possibility that i could have a refurb which i really could care less.. the phone looks new without a scratch on it so that works for me.. im not one of those that cries because i paid for a new phone when there is that possibility that it isnt.. incase someone those in the whole you have a "reburbished phone dumbass" response

How did you manage to get sprint to mail you your replacement? I tried and the rep had the nerve to suggest I say I lost my Evo and pay the $100 deductible and then I could get a $50 credit over a hardware defect

Mine is, but its hardware 003 which i think has the fixed port so im happy

i was transferred to that insurance company whoever the hell they are and they told me that i would have to be paying the 100 bucks and i basically just said why do i have to pay 100 out of my pocket if its a defect with the phone and he said i would need to talk to a sprint rep about that so i said just transfer me back cause i dont wanna pay a deductible.. so when i went back to the sprint rep luckily it was a girl so you just gotta play the koolguy role and be all nice calling them by their names and all the good stuff.. just be all flattery which as cheesy as it sounds it usually works.. so we pretty much just started talking about "sadly sprint" and the prices and how they are cheaper compared to most other carriers, ive been with them since 98 and it was kool cause she was actually the one that brought that up so the was sort of the conversation starter, i was asking who she used and she said she used to be with att but switch to sprint after she started working for them and realized how much cheaper their plans were and we just sorta went from there.. anyways when it came down to the phone i was telling her that the insurance ppl were saying that i had to pay the hundred bucks and i was like why would they charge me if i didnt damage it, and she was telling me that that its because they just assume that damage to that port is cause by abuse, so i was telling her that i had just googled "loose microusb" and the first things that come up are topics regarding the evo so i was telling her that it has to be a defect in the phone (but you say it all kool, not **** like.. just sorta keeping the conversation going) so i then was asking her if there was anyway that i could get a new phone without having to pay the deductible because i swear i treat my phones like little kittens (cheese joke) so she said that she could sent me the phone without me paying the deductible but just to know that if it was damaged from abuse they will bill my acct, and i was like "thats a deal" so she basically said okay she will send it in the mail.. its all about finding the right person and just being fractious with them.. dude, ill even be a flirt with a dude if he is feminine enough..

yep its a refurb, but my phone had over a 1000 more minutes use then this phone so screw it... still happy, thanks for the tip btw
oh yeah, and i used simpleroot for the first time.. i rooted using toasts method when the phone first came out so there was no purpose for me to try simpleroot before.. WOW, that was easy.. there is absolutely no reason for anyone to say that dont know how to root a phone..
and to unroot my old phone i just ran simpleroot to change the hboot then ran the stock ruu...

You dont need to play the cool guy lol. Sprint always tells me I have to get transfered to the insurance co but then I tell them wait dont transfer me I am not paying for something that isnt damaged physicly or anything like that. This phone isnt damaged this phone has a hardware defect. The insurance co handles damaged phones and sprint handles swaps on defective phones. Sprint is always trying to pass me to the insurance co lol. They try to pull a fast one all the time. They are shady *****es. Also I dont care about refurbes they always look new to me so what the heck.
i did the exact same thing due to a damaged usb port about 1.5 months ago... got a refurbed nova 002 as a replacement and its been working fine ever since
after working at a service and repair store for sprint for 2 years I'll tell you that I've seen more defective phones from the manufacturer than I have from the Refurb warehouse lol.
BUT!!! I have had to exchange up to 5 phones in a row for someone because all the Refurbs I kept exchanging were defective and then we ran out and I had to order one haha

I believe this! I went through 5 TP2's
1st new
2nd refurb
3rd refurb
4th refurb
5th New, used for 5 days then sold it on craigslist to get my EVO.
All had issues with freezing when on the charger.
I just got my replacement today also not a referb but brand new. Mine bricked when I tried to do the OTA update. It went to reboot and powered off but would not power back on no matter what. Took to a Sprint Repair Center they could not get it to boot. So it took 7 days to get my replacement but I got it. Brand new very nice. Confirmed not a referb via the ##786#.
I simple rooted it then put the Damage Control on it. Very happy!
My question is, since I found this site

they can still void warranties because you rooted your phone, they just cant get the law involved.. if i send in a rooted phone they can make me pay the deductible just because, its sucks but its business! i understand where they are coming from though, there are a lot of noobs that try things like unlocking and rooting and it would be ****ty for sprint to have to take the hit for someone elses screwup
im on my 3rd evo just got it yesterday
1st one - dust under the screen - bottom left corner, it started small but then it got worse within a week.
2nd one - screen seperation and light leakage on the bottom corners.
3rd one - seems ok, so far... about dam time!
So then I would have to unroot just to a replacement. How are the replacements? An I seen something on here about the 002 an 003,I mean can u ask for the 003? What's the difference
Thought I would share my experiences with you guys to hopefully settle some stomachs.
I got my first incredible the day they were released. About a month after i got it, it started randomly rebooting and shutting off. It would run great for days, then have a fit of reboots. I used it like that for quite a while until root was released. I rooted it, then shortly after installed some of the leaked roms. I hoped that updating everything would help with the reboots.. nope.
Anyway, long story short. I called VZW and they sent me a replacement device. I sent back the first phone with S-off, rooted, radio updated, and running a cryogen mod.
As soon as I got the replacement phone, I re-flashed it with all the goodies. Last week I ended up bricking it because my kid ran by and pulled it off the USB cable during a flash of sky raider. It would boot into Hboot, but i nothing i did made it work right again. Anyway, I called that day and said "my phone doesnt turn on anymore" they sent me another replacement. I sent that phone back with s-off and radio 2.15 and not booting past the silver HTC screen.
I was wondering wtf, i thought for sure i would get a call or a letter or SOMETHING. i have a buddy that works at the VZW warehouse so I asked him. He said all they do is open the box, verify that the numbers on the phone match the numbers on the return order and move on. They get 1,000s of phones a day from warranty exchange. Nobody "checks them". Hes just a lowly worker but I think hes right.
I have had VZW for just over 10 years now, and have utilized their "exchange 3 times per year" service on almost every phone I have had. I have sent in phones that I broke the screens on, by saying "my phone doesn't work anymore". I have sent in phones i dropped in the water by saying "my phone doesn't work anymore".
The people in the warehouse who check the phones numbers have NO IDEA why you sent it in, or what the tech told you, or why they told you to take it back.
bottom line.. don't stress about it. and take advantage of VZW's service of letting you exchange your phone 3 times per year.

Just wanted to add... They give you 10 days to send the phone back, that first incredible i sent back, i kept for over a month. They even posted an equipment charge to my account for not sending it back, but that took them a month. I just called 611 and said "oh gee wow.. i forgot to send that back" lady told me no problem and sent me out a new box and i mailed it back. 3 days later they credited my account the $500+ equipment charge. That was the phone with s-off, radio update, and running cryogen. That 3x a year deal, is that with one of their insurance plans? I elected to for-go that when I bought my Incredible so I don't know what the deal will be if any one of my phones boink... just glad I don't have a kid to fudge things up anyway... although I do have a girlfriend that likes to seemingly randomly unplug my electronics because "our power bill is sooo high!". Yes, I know honey, it's called summer + A/C usage x.x

no, that is just the manufacture warranty. they will exchange it 3 times during the 1 year manufacturer warranty. on the 4th time, they will either send you a brand new phone in the box, or upgrade you to another phone. your choice

It's how I got my Incredible. Upgraded for free from D Eris. I got a big scratch on my screen somehow. Need a refurb soon. Haha.
I'm not sure if the masses should know any of this.
This is exactly how I got the Incredible from the Moto Droid. 3 times returned (the 3rd time not even for an unfixable problem *oopsie* ) and then they said they would send me an Incredible. I love VZW tech support

Edit: this is good to know if something really does go bad with my phone. But I would never take advantage of it.

1 in 4 people with 2 year contracts could make a full replacement purchase price claim and they'd still have a nice profit, assuming they had to pay full price MSRP for replacements. Wonder how much they'd make by using refurbs as replacements, rejecting claims, etc.
I may be in the wrong business.

Because warranty doesn't cover getting it wet, replacement of lost/stolen, cracked screen, break due to drop or abuse, etc.

that's how i got my dare from a Venus. The Venus always had something wrong and the tech himself told me well if they replace 3 in a month then you can get another phone.

Attempting to mold community behavior by restricting the flow of information is a really dumb idea, especially on a hacker forum. And preserving a loophole that lets a knowledgeable few commit warranty fraud by concealing the means & opportunity from the other "hundreds of thousands of people" who read XDA is elitist, self-serving, and morally reprehensible all at once.
Fortunately for the scruple-challenged, my sense is that VZW is well aware of the potential, but just doesn't care--or at least is unwilling to invest in the kind of training and verification overhead that would allow them to examine each claim for legitimacy. So by all means: keep returning those bricked phones for an upgrade, but do stop hiding the Machiavellian ingenuity of your methods under a bushel--let it shine forth unto the ends of the earth! Well, I suppose it's terribly old-fashioned to suggest that your conscience might trouble you if you went that route... But ethics aside, if you lost the phone outright, or smashed it to tiny bits, you could still need that insurance. The VZW workers might be inattentive and uncaring, but I'm guessing even they might notice an empty box, or a phone that arrives in a sandwich bag with no one fragment larger than 30 mesh!
I am posting a new thread because the other related threads were misleading at best and I searched high and low for this info and finally took a chance to confirm it.
When I lost my nexus at the beginning of the month, Asurion told me they would not replace it, my only choice was a vibrant.
I tried the MT4G for this month (CA has 30 day remorse) and prefer the N1.
Called again and told them the last info I could find from August was that N1 was available from google through the developer program. I could not find any answer to the question "Is the Nexus One really still available?"
I spent the $25 to join the developer program and the answer is "YES"
I can order up to 10 at full retail.
Of course, if this were uninsured, I would just buy one off the street and I will drop the insurance because it has been a royal waste of time, but as soon as I scrape up an extra $600 (because it will likely take a while for Asurion to reimburse me), I will get it.
I went all the way through the purchase process up to the place order button, so it looks like there is no backorder or anything.
It appears the only requirement to join the developer program is a google account (can be an apps account but only certain kinds) and $25.
Edit - Fockers backed out on my "deal" only offering POS vibrant. certainly not same capability or features as N1.
Fail to see how this indicates that Asurion will cover your new N1... How about we wait and see what happens in the end.

They will reimburse you up to the retail value of the phone, minus deductible, if you don't wish to use one of the options they provide you. If you want to spend the $ to join as a developer, the OP is right - they will cover you.

1. If I remember correctly policy says within 30 days, but I would call them anyways as they still might. When I got mine they wanted to physically see the phone first, just to make sure they weren't insuring air or an already broken phone. Made sense since I didn't buy it from T-Mo they couldn't just look it up. Bought mine on launch day, and had ins. by the end of the week. $140 deduct is way cheaper than $579 again. It did take a week to get everyone on the same page (Asurian and T-Mo) since the phone was so fresh it wasn't in any of their published list of phones yet.
2. Anytime. It's just to register as a developer. If you never buy a phone or make an app im sure Google is happy to keep your $25. Just buy the phone whenever you're ready.
I got the insurance because warranties are for *ussies. I like to void them (XBMC, DD-Wrt, cars, etc) and planned to with my Nexus as well. Since warranties are intended to only ever cover manufacturer defects, not user error, if I bricked it or fried it it's insured. Look into it, and if you can get it do it. It's only like $4.95 a month. And you're right: If you don't have it, you'll need it. And if you have it, you wont need it.
And don't fear dropping it, I have. Too many times. Almost shed a tear the first time. Til I realized this thing is so damn-well built, I have but only 3 scratches. And it has taken a couple of ugly falls.

They didn't let me take this path and I called 3 times talked to different people. In the final call, I said I'd prefer a G2 since it is very similar amd this very nice/polite guy went to the supervisor (so he said) and 10 mins he came back and said they woudlnt do it bcause the G2 has a keyboard and the N1 doesn't. The G2 covers the G1 he said.
So, I have now a vibrant which I am starting to like except for the GPS which is worth &^#$. However the Vibrant experience made me decide to get a Nexus S when it comes out (GPS fixed-hopefully, camera flash, 2.3, SAMOLED, etc etc).
Messing with the vibrant firmware is a tricky road though.
Funny thing, I bought a G2 and disliked it to death (except the HSDPA+), returned it in five days, tried an HD7 and settled on the Vibrant at the end.

That is correct at this time. I found someone to lend me the extra $500 and called asurion to make sure I had the process right and fockers said "we show reimbursement is denied for this phone because we can't go to the google site and buy it"
It's completely f'd up. The damn phone is available at retail for the same purpose it was originally sold (developer phone) and they are saying "nope".
My claim can stay open through late april, so I am going to hold on until I can find a way to force them to get me an N1 or get something better than a POS samsung vibrant.

Looks like they are not going to let me do it without a fight. I have a decent loaner phone so I am not in a huge hurry.
Has anyone had success getting asurion to cover an N1 purchased from anywhere besides google's website?
This seems like typical insurance ripoff crap. I think I will have to consider squaretrade or one of the other "write a check" type providers for my next phone. I sure won't do assurion anymore unless it is just until I get another policy in place.

Almost certainly not. They don't even offer the G2, only the POS vibrant.
About two weeks before my claim, they changed the way they work with T-Mobile.
They only authorize phones that T-Mobile sells and T-Mobile ships out the replacement handsets from their own warehouse.
This doesn't make sense for a phone that is unlocked and is just using T-Mobile service, but asurion seems to be saying they only provide replacement phones that are sold by carriers no matter what you think you are insuring with them.

Yep. Happened to me, the first vibrant had a greenish screen so I cried foul but came with a *T-Mobile* 1yr warranty in the box, so they bounced me to TMO who shipped me a replacement one, refurb as well. Came from the same address and in the same box as the original.
They were nice during the whole very long process (seems I was lucky, I saw tons of people on the web claiming they were quite rude).
I'm not hating the Vibrant so far -although I tried to reject it in every possible way-. Has a nice screen and doesn't have the 3G issue I had until the last day and my GF's still has. Miss Froyo and an easy way to install roms. Has a freakin' awesome camera....

I just went through something like this (not exactly) with Asurion. You pay $5 a month. I had a Motorola Cliq and it was junk. Regardless I smashed it. The deductible was $120. wtf. I could buy a new one for less as my line was eligible for an upgrade.
Needless to say I purchased a MyTouch 3G Slide, in which case my GF left 4 days later. Moral of the story: Don't buy chicks phones and don't pay for Asurion crap. I broke the motorola on accident btw.

I need to find my actual contract to see if there is any fine print I can take advantage of. Online I read something in one policy that they would replace it with a device with the same capabilities. I am not sure that is in mine.
You're better off buying a squaretrade policy, it looks like, and just holding the assurion policy for the 30 day grace period before squaretrade takes effect. If you buy squaretrade same day as purchase, no waiting period.
If squaretrade can't fix or replace, they write you a check.
Ok, so I was told that if I bought the best buy insurance that they would replace my phone on the spot no questions asked.
Well... my phone broke (usb is not recognized by any computer, so I think the processor is f*ed).
I took the phone to best buy and they they told me they had to send it in for repair. I was pissed. I then had to pay $150 for a loaner phone, not even an evo phone.
25 days later the phone comes back. They phone is still not fixed.
Now I am livid at this point. The manager is gone from the store so I am dealing with the peons. They said they called the manager and they want to send it in again for repair.
I told them that I followed the process / procedure and it did not work. I asked for them to replace it and they will not.
I told them I know they have power to overide things and replace the phone.
They still will not do so.
I NEED HELP. What do I do? Does anyone have anyone I can contact?

Ill tell you this....i had the same deal. Best buy told me the same ****, so I went to the sprint store and after looking at it they told me I would receive a refurbished one in the mail. Cool....its better than paying a deposit especially since I don't have TEP. Now....
3 days ago my usb port went all shaky on me. Took it to the sprint store again still without TEP. This time they replaced it with a brand new one even though it had that new camera (another story). Forget best buy. Manufacture warrantys can protect you.
Two things to take from this....best buys insurance sucks and the sprint store is a good option even without tep. Im waiting on open enrollment for TEP now because I done believe the third time will be a charm. Hopes this helps.

Welcome to Best Buy's crap warranties. Same thing happened with my Droid. The Mic went dead, they sent it out for 2 weeks, came back with the "Speaker" replaced. The Mic still didn't work. Sent out again, took 4 weeks to finally fix the Mic. I got tired of waiting and got my Evo. The Mobile manager would do nothing. Said you have to wait for 4 failed repairs to get a replacement. I reported them to the state attorney generals office. Get the word out to everyone not to buy these **** plans. I wouldn't take one of these plans for free at this point.

Do you happen to know if this was a corporate sprint store, or a franchise sprint store like 'mobile lifestyle' that just deals sprint? I've not heard of a franchise store doing anything like that, but if one did I'd like to know. Maybe it just depends on the franchise, too.
In any case, yes - it's usually better to take problems like that to the corporate stores. Extended warranties from the likes of Best Buy and Radioshack are seldom worth it on phones (tvs and other electronics are another story, though).
It was a regular sprint store with in house techs to work on phones.
I have my brother's Evo on my account with mine and it's at BB for it's second try at fixing the boot loop. I told him he should have just paid the $35 at the Sprint store for a new one. I'll be cancelling that coverage at Best Buy and seeing if I can switch to the TEP at Sprint.
Awsome, I took your advice and went to the sprint store.
I paid $35 and got a new phone, no questions asked.
A small price for me to pay for making a bad decision at best buy.
Never will shop there again.

Last time I shopped at Best Buy they pulled that magazine scam on me. I started realizing that every month I would have a charge on my bank account about some magazine but never had the time to check on it. A year later I took the time and realized it was Best Buy who signed me up for it when I had paid for my purchase with my card.
If you google Best Buy scams you'll find a lot of horror stories with warranties and magazine scams.
I worked at Best buy for a long time part time. They (Sales Reps) mis-represent the warranty ALL THE TIME. It works the way its supposed to (according to the pamphlet no one reads), but not the way they present it.......("If it breaks we replace"). I've been screamed on too many times to count.
Nothing you can do until the General Manager comes back or if you deal with a Assistant store manager with some balls. Good luck

Yep... even though they do not work in commission they still have a hard time explaining to leadership why the service plan does not sell, and then when it sells its all based on lies.
to OP: the reason why they won't just exchange the phone on the spot its because it hits its revenue: you see, when the phone is authorized for exchange by the service center, the insurance company that backs up the plan refunds the retail price of the phone to the department but when they do it 'on the spot' basically the department has to eat 100% of the retail cost because they cannot send the phone for repairs (even if under warranty) and for the new phone that you are getting. The store might sent the phone back to the manufacturer but the store wont get full credit for the retail price on the device.
The best thing you can do is either locate the original associate that helped you and request the manager from the department or even the store manager and confront the associate in front of the manager OR call customer relations and see if they can help you as they can force the hand of the store manager and allow you to get a new device.

Hell, I would do that but instead of videotaping it I would just wait for the associate to say that they replace it on the spot and then whip out my busted EVO and say "OK then buddy, replace my busted EVO".
My phone stopped reading the SD card and charging. I have a wall charger for batteries thank god. Took 19 days for them to say yes your phone is broke and you can have a new one. This completed my warranty so I have opt back into the BB warrant again. I said not now. They asked me a total of three times.
The first phone call I made was to Sprint to get their insurance.

That's what I just had to do with my Evo to get a replacement screen because the touch sensor was all screwed up and it had a white spot in the middle of it.
Best Buy manager wouldn't do anything, so I had him call and cancel for me and told him I'd be getting Sprint's plan. Maybe I'll even blog about it.

Please blog about it, Best Buy is pretty evil and I see way too many people get f'ed over by their scams.
You'd be surprised how many times the customer service number will over ride the store.
Best buy isn't evil. Actually on the outside looking in and on the inside looking out I can honestly say for such a large chain they are pretty decent. Its hard to satisfy everyone. What gets everyone riled up is the way the service plan is sold and the unwillingness to help (in some cases) after its put to the test.
I've also seen customers try to scam the system as well so it goes both ways.
If you know what you are getting into and don't listen to the sales people that are put under TREMENDOUS pressure to sell the service plans (More important then the prduct itself). Then there are no surprises.
Ok well I have best buy insurance. Havent had a problem yet. But wouldnt it be better to copy all your sd card on to the computer. Erase your sd card. Then drop it in the toilet. They cover water damage right? Then the'll be no way they can fix it and they have to give you a new one the same day right? Good idea??
