I think its the "alerts" tone you have to change. Or use ringdroid from the market to use your mp3s, it'lorganise them into the right place. I think it'l be in sdcard/media/alerts...

You may need to use third party softwares like phone alarm for it. The best way would be using wav converted tones!

Several Programs can set mp3 as sms tones, such as photoalarm, ringo mobile, etc...
Could someone tell me how can I do it with my own code? My machine is a WM5 one.

one thing you can use is http://www.fmod.org/
Just Copy the Ringtone/SMS-tone in "My Dokuments", so you can use it as Ringtone and SMS-Tone.
i use the boyppc for HD2 (7008)
I can use my own ringtones BUT only one for all not like 1 for my mum ... 1 for my son and so on

found something out
IF i change an ringtone in an contact and leave the main ring tone on an regular one that comes with wp7, then it will not play the custom ringtone.
BUT if i change the main ringtone to an custom ringtone once all custom ringtones in my contacts work as they should

You can dump mp3s to sdcard/notification folder, then change notification sound as usual.
My text app has a way to use a separate alert tone, other than what the system has set. Some apps allow a different tone for different contacts, but I don't go that far. If you don't have any you like, any MP3 will work or you can use Zedge from the playstore and search for text tones or SMS tones.
I installed this app which allows you to set custom wav/mp3 as notifications and ringtones. Really simplifies the process (has worked on S4/HTC M9 and now 6P.

How do you find the file folders to move it add the files? I'm kind of a tech dummy... Do I need to download a file manager app, or am II just to dumb to find one already on the phone? Lol!
