all heros have 12 month warranty right? you dont need to apply for it? if anything goes wrong with your phone then you just need to contact htc ? am i right?

That very much depends on where you are physically located, and where you physically bought the device.
My phone came from T-Mobile UK, and comes with a 1 year warranty. If I have a problem with the device in that time, I should go back to the original vendor (i.e. T-Mobile UK) to seek remedy. In addition, even though I only have a 1 year warranty, my statutory rights are not affected - see this link
Bear in mind that this is going to be covered differently in other regions.

Assuming you are in the UK, if you bought it from a UK company on Ebay and is was sold "new", then they are responsible. The same may well apply across the EU, but I'm uncertain of this.
If it was bought as second hand from an individual, the situation is not so clear, but it is probable that the original retailer should still be required to honour the warranty.

I faced that issue some time ago and i contacted htc for a problem.
well from what they told me, if the phone wasn't bought at an official htc vendor, then you have no business with htc. Only thing you can do is you can send your phone to htc to get repaired or checked but you'll have to pay for it ( even if you have a guarantee from a shop)
You should contact the store where you bought the phone. And the catch at these local stores is that you should have your guarantee and receipt on your name to be able to claim it. so buying on ebay ...... i cant say for sure

If you bought the phone off of eBay, AND are not an AT&T/Cingular customer, they will not replace the phone... what is wrong with it...?

Very few warranties cover dropped devices... There are a few though, but you have to have the warranty in place on a new device and there are some caveats to them... As for the eBay seller, I doubt that they will offer any real assistance after 4 months of usage... There are a few other options that may be available, but they all concern questionable ethics and morality, so I won't even mention them...

Yep; you're essentially screwed. When you buy something from eBay, you rarely get a manufacturer's warranty, especially if the seller is an individual as opposed to an eBay Seller (business). Even if they are a legitimate business, I too doubt they will warranty any electronic device that has been dropped.
Next time do two things--put the phone in a protective case and use a screen protector; both things are inexpensive insurance against damage.

You cannot ask your friend to have it done, since that phone is not listed on his/her account... That is why you were originally asked for the phone number... You have to buy a new phone or pay to have your phone serviced... You can contact HTC and send them the phone and pay the cost... There is no legal way that you can have the phone repaired under any warranty agreement, after you have already damaged the product...
I hate to say it, since it has already been said... you will have to either pay for the repair, or buy a new phone...

Wise up, people... the phone is utimately warranted by HTC as the manufacturer of the device. They prefer to route things through the carriers because it's easier that way, but you can deal directly with HTC.
To the OP: All you can do is contact HTC and plead your case. You may need to be persistent, but they do have non-carrier and out-of-warranty service. May take 2 or 3 tries to get to someone who knows this.
Oh, and despite what some have said, if you bought if off eBay it still carries the one year manufacturer's warranty (whether or not it will cover having dropped it is another issue). They track the warranty period by S/N. I recently had one -- that I purchased off eBay -- replaced, no questions asked.

If you don't want to use the HD2 on T-Mobile you will have no warranty as you described.
If you are going to use the HD2 on T-Mobile then as long as the person you buy it from has not used it then your warranty will be good. The warranty is tied to the account that first uses the phone. The IMEI number on the phone registers with T-Mobile on the account it is first used on for warranty purposes, any warranty claims would go through T-Mobile on that account.

EVERY country has diferent rules. For example, in the states you have almost no consumer protection but in the UK you have very strong consumer protection.

Its not t-mobiles responsibilty. Under UK consumer law you return the device to the person/company who sold it to you and NOT the manufacturer. So, if you purchased the phone from t-Mobile, then you return to T-Mob, if you purchased from Fred Smith on Ebay, return to Fred Smith on Ebay.
The device is also expected to last for a reasonable lifetime without fault. In the case of mobiles, if they wish to sell them on 18/24 month contracts it should be reasonable for a phone to last 18/24 months.
First you need to contact them letter via recorded delivery post detailing the problem and asking them to fix or replace the device.

If its Cavallipurosangue you are talking to this is very unlikely to work. T-Mobile will want to tie this up with the customer that they have and it won't.
Acer certainly wouldn't do this for me. I purchased a phone under a company contract (and therefor not covered by consumer rights) and it turns out that phone was already registered to someone else. Acer point blank refused to deal with me, almost claiming that I had stolen property.
In both cases, its NOT T-Mobiles responsibilty (in the eyes of UK Sales of Goods Act) and IF they do repair/replace, it will only be good will and out of there choice.
T-Mobile will have a "contract" (and i don't mean 12/24 month contract) with the buyer who would have been "Fred Smith" and no-one else, specialy not with the two posters here. The two posters have entered into a contract with the Ebay sellers and this is where ALL liability lays.
The Sale of Goods act doesn't cover private sales, which are effectively 2nd user sales. It's a case of buyer beware unless the item is faulty from the outset.
In this case, 'Fred Smith' has a duty to accurately describe something he is selling, but once accepted by the new owner his liability ends, even if it was technically a sealed box sale.
HTC have accepted responsibility for these sort of warranty claims in the past under their pan-european warranty, but they have no legal obligation so to do.
If a foreign buyer buys a T-Mobile phone, and it later goes wrong, his only other option is to contact the seller and see if he will negotiate with T-Mobile as a goodwill gesture.

I hope some Romanians can verify this?
My phone has the famous digitizer issue (screen not responding when coming out of standby), where I called HTC Romania.
They told me to contact their repair center in Bucharest. (http://www.cirma.ro/)
That repair center states I have to pay 1000 LEI (250 EUR) for this repair, while the phone still is in warranty. Aren't there such things as 'in warranty repairs' here in Romania?
As I am not Romanian, I would like some info in regards to this. Otherwise I have to ship it to the UK or to Holland (where I'm from) to have it repaired.
Please, some feedback would be appreciated.

Hy, here , in Romania, the thing are a little bit different. You could repair your phone in warranty only if you bought it from here.The procedure is also very complicated, we must go with the deffective device on our provider, they send the phone to Cirma, after repair Cirma send it back to the provider and only after that we can enjoy again about our beautifull device. Also they ask for entire package, not only the device, I don`t know why ! And the whole procedure takes about 3-4 weeks . So , I think you can send it to your country for repair, the time will be almost the same. I called also Cirma service an they told to me that replacing the digitizer costs 1000 LEI.
I had a screen problem too on my Hd2 (a white spot) and I've been to Collection Point (on Stefan Cel Mare), they made and a diagnose of the problem and then they changed the screen for free (on warranty). In my case I bought the device from Romania.
My advice is to go to a Collection Point with your Invoice and warranty certificate in order to clarify if your papers are eligible here in Ro.

Just came of the phone with Cirma, and they won't repair my HTC device, as I didn't buy it here in Romania. (Which, legally is very wrong, as HTC has a European Warranty certificate and Cirma is supposed to be a valid repair partner).
Next to that, there is no such thing as a warranty 'certificate' when you get a phone in Holland. You have your proof of purchase, with warranty booklets by HTC. I've been everywhere in the world, but this is the only country still sticking to certificates and stamps..

But i have some positive news. I went into a repair point from Cordon Electronics (Auchan/Titan) and explained them everything.
Last Friday I gave my phone with a proof of purchase to them, explaining that in Holland (where i bought the phone) does not have 'warranty certificates' and I showed them the HTC warranty booklet. They took my unit in (Friday night at 20.00) and just now i received an SMS, that the unit can be collected from the same point, repaired and all.
New mainboard, buttons, digitizer, LCD panel All in warranty. I guess when things can be explained properly and the person understands the situation, not much can go wrong
Can't wait to get my beloved HD2 back after work

Went to the Service Point last night, only to find out they did replace the mainboard, and LCD, unfortunately, it did not fix the problem.
So again, it's in repair

At the time I purchased my phone, most of the carrier stores were sold out of the HTC one. However I found someone local who was selling a brand new unit that they had won in a raffle.. so I purchased it from them.. The unit was brand new in a sealed box.
Fast forward to today, I have been had the purple camera issue for a long time now, and decided I would finally send the unit in for warranty repair.. I logged onto the HTC support chat a started speaking a rep.. I explained the issue I was having with the camera. After confirming that I was still having the issue after upgrading to version 4.3 he said he could proceed with a repair order for the phone.. Great I thought, this will be easy. He asked for my shipping address, he then stated that for canadian customers, they ask that we first go to our carrier stores to try and process a warrenty exchange. If the vendor could not do that then HTC could move forward with the repair order.
I explained to him that I had not purchased the phone from a vendor, but it was purchased brand new and sealed in a private sale.
At that point he stated that it would not be covered under warranty because it wasn't purchased by a validated vendor..
What the hell??
I argued the fact that the phone was brand new and the repair was for a well known flaw, but he refused to budge.. stating that purchasing from a third party vendor, the warranty would not switch over because the vendor was not an actual HTC vendor.
Frustrated I ased him if my phone has now been flagged to be out of warranty.. His response was "I would not be able to process this as a repair in warranty as you have provided that it has been purchased through third party vendor."
SO the moral of the story is to LIE…. If I had just lied and said the carrier would not exchange the phone I would have been fine..
Anyone have any suggestions on how to escalate this?

Call again and hope you don't get the same rep. If they pull up that you already claimed it was purchased privately, say it was a misunderstanding and blame it on something else (line was breaking up and rep heard parts of what you were saying and misunderstood). Go crazy. Best imagination wins HTC repairing their phone.

My Verizon 10 has formed a yellow band on the right side of the screen. I would like to send it in for repair, but I bought the phone second hand and am not using it on the verizon network.
1) Would Verizon accept my warranty claim without a receipt or VZW account?
2) Would HTC repair it under warranty as if I bought it from them?
3) if the answer to 2) is no, would HTC repair it at a cost, and does anyone know how much a screen replacement costs?
Getting in touch with the original owner is not possible either. Any help would be appreciated!

Verizon won't do anything for you. The only way they would is if you are the original purchaser, in which case they will replace the device if it's within the manufacturer's 1 year warranty. HTC *might* do something for you, but I'm not too knowledgeable on their warranty policy. There's a good chance they will restrict warranty service to the original purchaser, or tell you that since it's a Verizon phone, you'll have to go through them. HTC does offer a one-time "uh-oh" protection, but that's limited to people who purchased their phone through HTC.com.
You can try it yourself, the digitizer runs around $70 on eBay, but it isn't a simple repair. Otherwise, most screen repair services charge in the $150-$200 range.

That's good to hear. I'd wager it's because the date of manufacture is well within the 12 months, since I don't think the HTC 10 has even been out a year. It says a lot about a company that they're honoring their warranty when, technically, the don't have to.
That's awesome and it definitely says a lot about what type of company HTC is. They have been my go to for years and I'm so happy to continue backing them when they make business decisions like these.

True, I was also impressed when I had my m7 and they offered to fix my purple-tinted camera for free way after the warranty was over (I didn't go for it because they said I would absolutely have to pay to fix my screen at the same time even though I didn't want to). But I've also heard bad things about their customer service (for example at the launch of the 10). This is my first time dealing with a warranty claim with HTC so I'll cross my fingers it goes well.
Update for anyone in a similar situation: HTC replaced the screen and shipped the phone back to me from Texas to Montreal, Canada overnight at no charge. The whole process including my own shipping took only 8 days, pretty impressive. And not a single dent/scratch or other trace of the repair. Very impressed with this service.
Only downside is having to pay 40$ shipping with insurance for a faulty device, but considering I didn't have a receipt I won't complain too much here!
