Sign Rogers HTC Dream/Magic Waiver To Avoid 911 ROM Update - G1 General

A few weeks ago Rogers announced a software glitch in the HTC Dream and Magic that prevented users from making 911 calls. To remedy the situation, Rogers pushed out a ROM update.
To make sure that every HTC Dream/Magic owner updated their device, Rogers disabled data access to those phones but also applied a credit to those accounts. However that did not stop many users from not applying the update.
Then, to make matters worse, many users were reporting that Rogers actually cut off their voice service! Any outgoing calls were directed to Rogers customer care and HTC Dream/Magic users were basically forced to update.
Well, considering all of the fuss that Rogers has been receiving over the last few weeks, the company has now released a waiver form for HTC Dream/Magic users that want their account re-enabled, untouched, and want to stop being pestered by Rogers.
The waiver basically says that Rogers is not liable for you not being able to make 911 calls because you did not want to apply the update.
See below for the information on the form:
An issue has been identified on HTC Dream and Magic devices that may prevent 9-1-1 calls from completing in certain situations. Rogers has disabled internet access on these devices as a short-term fix to help ensure that all 9-1-1 calls are completed. Rogers has reached out directly to Dream and Magic customers through multiple text messages and voicemail messages, urging them to install an update that repairs this known issue. Internet service has already been restored for thousands of customers who have completed the update.
While our strong recommendation is that customers complete the recommended software update, some customers are requesting that we re-enable their internet access, even if they don’t update to our recommended software solution.
If you agree to the following provisions, please enter your device information and check “I agree” below. Rogers will re-enable your internet access within 24 hours even if you don’t update your software. By checking “I agree” below, you acknowledge and agree that:
1.) Rogers has informed me of the software issue on my HTC device that may prevent 9-1-1 calls from completing in certain situations.
2.) Rogers has made a software update available to me to remedy this issue and has made several attempts to contact me urging me to install this update for my own safety.
3.) I refuse to install this software update that Rogers strongly recommends for my own safety and understand that I may not be able to complete 9-1-1 calls from my HTC device.
4.) Rogers will not be liable to me or any third party for any personal injury or damages resulting from or relating to the inability of my HTC device.
Users are then prompted to enter the following information:
* Serial Number (15 digit number under the battery)
* Wireless Number
* Email Address
Then check off the “Agree” box and click “Submit”.
So if you want your account re-enabled, want to avoid the update, and continue as you were, check this waiver out and let us know your success.

At least Rogers are doing something, I mean if you own a Dream you get the following out of the deal:
Free Magic + $0 Admin Fee + $50 Credit Rebate + Month of Free Data Credit
Not so bad, but then again this shouldn't have happened in the first place.

ONLY ! and ONLY if you buy the dream on a contract before dec 31 2009
us who spent the money outright for the phones at anypoint are void from this deal which sucks for us.
and rogers isnt doing anything, they are sticking you with a 3 year plan with a 1.5 year old phone to replace your 1.5 year phone.

there have been reports on the other thread of people who updated radio still losing data/outgoingcalls they are looking for radio/build when scanning i believe*dont take my word for it just going on what ive read*

I have updated the radio, following Cyanogen's instructions over 48 hours ago. I've also signed the waiver, about 36 hours ago. Of course, no data. I have rebooted (pulled the battery) many times. I phoned them yesterday afternoon and the tech I got transfered to, who was willing to help, said something like like: hmm.. Are you sure you updated with the update found at [rogers.com/bla/bla] ? it sounded like he could see that I hadn't. At that point I said that I had to hang-up, which was true, as I was driving. In any case, I don't remember reading any post about someone's data coming back on it's own... Guess I'll have to call again.

Here's another issue with Rogers. Remember when outgoing calls were being redirected? If you call in and told them you haven't done the update, they would re-enable your voice, but then put a manual block on your data. You have to call in and tell them to re-enable it manually. I had this problem. Updated radio, but no data for 2 whole days. I couldn't tweet that I couldn't tweet

Ha! Thanks you for pointing that out. I just called, it took about ten minutes. I got transfered to a different person who asked me to go to settings:about phone and read her some numbers. I had to lie a bit about the numbers I quoted them ( firmware version and build number ); I read out the numbers from the Rogers pdf. I should post more instead of just reading, it gets things done...

Since my last post when I updated the radio my data has been reenabled. I didn't do anything (like phone them) to get my data back other then restarting my phone and waiting till the morning.

Today is the last day. If you did buy your phone outright from Rogers, you can tell them their update bricked your phone, and then they'll swap it for a Magic if you want. But then you won't have a rooted phone anymore.

I signed the waiver Sat and got data Sun am. Glad I didnt update!!

I'm wondering if calling customer service would help me sign the waiver.

Hmm, I am trying to sign the waiver, however the form is saying that my IMEI number is not valid. Did someone have the same issue?
Do you guys know how to make the IMEI # valid? Stupid questions, but may there is a trick that I should know.

I'm surprized so many would sign a waiver over updating the radio. I wonder if signing the waiver voids the warranty of the phone. They must know if you're willing to sign this you're doing something to your phone.

Rogers Wireless Customers READ THIS!

I talked to a rep today on the phone and told him I was using a custom firmware and wanted my Data back.
He said sign this waiver, saying you cannot hold Rogers responsible for not being able to dial 911, and you can use your custom firmware.

it is old news , but i've tried for 2 days now and it will constantly tell me to enter a valid serial number ..I am using the IMEI from the box and under battery still no success

Ah ok, yea it's not taking my IMEI either... i called rogers and they are working on it... hopefully they get back to me quickly.
Is this a downgrade? So you can use custom ROMs? Or is it just data enabler for rogers customers? This won't help anyone stuck on sense?
I signed this on Friday and since have had my data cut twice!
The 2G Force trick works for getting it back every time so far, so I haven't bothered to call them on it yet. If they start redirecting my calls again they will hear from me for sure.
I talked to rogers live support because my imei number wasnt being accepted and he ended up putting it through... i think... I haven't installed a rom that wouldnt be blacklisted yet but yeah try that
The waiver form is mostly broken. The IMEI database it is verifying against seems to be missing many IMEIs for handsets purchased directly from Rogers, let alone from other carriers.
If you jump up and down and get to a tier 2 guy, he can manually get your IMEI added to the database so you can put the waiver through. The front line guys cannot add your IMEI, though they can send off a request for it to be added.
If you complain enthusiastically enough, they can re-enable your data services on the spot.
Apparently they cannot fill out the waiver for for you if you IMEI is not being recognised, though the tier 1 techs will lie and claim they are doing this.
This is based on my personal experience, of calls on Saturday, Sunday, a call back from a tier 2 on Monday and then a long and unpleasant call with retentions this afternoon. Magically the retentions supervisor could get me through to a tech that had override capabilities within minutes, once we got past the lies and bull**** stage.
In theory, once you get your waiver in, they should stop screwing around with your data services, redirecting voice calls, and hassling calls and text messages. I will see how it goes....
Well, thanks for the heads up with this waiver. Of course my IMEI # wasn't valid, so I called Rogers Directly, asking for Tech Support.
The point of my call was to get them to update my account, saying I accept this waiver. I think we all know it is hit and miss when speaking with Reps. I was speaking to a guy, he asked my Build Version, and firmware. I didn't tell him the Build Version (MarsDroid SPL7 1.8), because I knew it would not be acceptable. I told him my f/w was 1.6, which he said would be acceptable.
At this point, he said that I would NOT lose my data again, and Rogers would stop scanning my phone. I made sure to ask the question, so whatever I do to my phone at this point on doesn't matter, my data will not be cut off? He said yes.
I am only repeating what I was told, I think you can probably tell by my wording that I am not convinced this will be the case. Eitherway, I feel more confident to flash back to my old radio, which is all i want, because the kernel is much more developed, and makes for much more stable and faster ROMs.
Also, should let you know, so far I haven't had my data cutoff, I switched to CursorSense ROM before the Rogers scanning started, and have stayed on the New Radio up until now.
I signed the waiver on Friday, and got my service back Sunday morning.
No issues with IMEI...
I then called on Monday to get my free HTC Magic that I've been b1tching about for the last month (calling once a week)..
things are looking ok for now.. I have a Dream running Open Eclair (2.1), and now a stock unrootable Magic (1.5).. gonna keep the Magic legit thou..

Spoke with tier 2 support 3 times and a Manager. Apparently there is a system wide problem with allowing some IMEIs to be entered for the waiver to work. I'm getting so frustrated now, I don't know what else to do but wait. I've asked for network refreshes each time, and I've been running Cursorsense with the new radio.
Any ideas?

i lost data yesterday when running a customized 2.1 rom; flashed cursorsense, asked for data reset, and it comes back.
totally not expecting to be haunted with this after so long since the update.

I've been asking for refreshes as well, but I can't find anyone who's willing to do it.
I've even told them that I want to use my old phone until they fix the IMEI problem, but they said they can't allow me to use data on any phone until I do the waiver because I might go back to use the Magic.

I am royally pissed about this because Rogers quietly released this after they started redirecting calls. I would have gladly signed this waiver if I knew about it, but instead was forced to update to their retarded ROM and now I'm stuck with all the pre-installed BS apps and without root access. They should at the very least give people the option to revert back to the old ROM via another "update". I was forced into this update because I couldn't afford to spend (scratch that, WASTE) time dealing with redirected calls.
In lighter news, HTC tweeted about their knowledge of specifically the issue with Rogers and promised something about 2.1 soon.
After reading all this I don't feel so bad about all my data issues. After refusing to flash the rom on the phone with rogers, they offered to send me a free magic+ with the new rom pre-installed. I signed the waiver also. So now I have my old magic with a custom rom, and a new one in a box with the rogers official update that I plan to sit on at least until HTC's 2.1 comes out.
On top of that I *****ed them out so hard after my 4th or 5th data loss/refresh experience that they offered me a few free months and reduced the cost of my data plan.
All of that and I was still pissed I didn't take their offer to upgrade to an iphone at a cost, I was too mad and just kept saying "I'm not paying anything to fix this crap" lol. Doh!
It's been 9 days now without data, and each time I talk to someone, I keep getting the same answer "We are aware of your situation and your call has been escalated and it will be fixed soon, try again tomorrow."
I want my data back and have been willing to do the waiver (it won't accept my imei). Have been running cursorsense with the new radio since all this has began.
I've spoken to Tier 2 support, managers and customer care. Who's left to talk to?

I was reading this & I remembered a situation I had with Bell regarding my internet contract. I've tried that threaten to leave.. and was expecting to get away with some kind of deal..
then was totally shocked when the csr said, 'sure, so you will owe us the remainder of your term...plus a early cancellation fee'
in the end, it costs more to leave then to just stick around.

The same happened to me the other day, they told me it would cost me over 600 to cancel the account for all 3 of my phones.
Still calling everyday and still waiting.

Has anyone used htccode.com to unlock a U.S. Tmobile HD2?

I logged on to their site and chatted with the live person and asked if the U.S. Tmo HD2 was SIM unlockable. They said yes.
I proceeded to go through the motions. Bought unlock on Paypal. Ran local client. Got rejected saying US/France/Canada can't do the auto method, had to email them for code. Emailed. Heard back in about 20 mins. They said computer was not kicking back a unlock code.
This was about 6 hours ago. Still waiting.
Anyone have any luck with the U.S. HD2 and htccode.com? I'm not criticizing them just stating my experience so far.
If I get a code by tomorrow I'll be happy. Otherwise I would like a refund as Tmobile service in my area is not nearly as good as ATT. So I currently have ATT and was just trying the HD2. So I figured I'd unlock it and pop in my ATT SIM to see if I get better luck on reception. Otherwise I'm gonna have to try the Telstra model. Bigger investment.
And yes I know I won't get 3G on ATT. But as it is I'm not getting any reception whatsoever on Tmo.
Not much help to you, but I went with unlock-now.com. Been about 1.5 days and not a peep from them. I am in the same boat, trying to use it with ATT.

If your carrier in India supports the same bands the T-Mobile HD2 does then yes. People like me that are on ATT will be stuck on the 2g/Edge data connections because ATT and T-Mobile don't share the same 3g bands.
All a sim lock does is make only the carriers sim card work on the device.
And for the record still nothing from unlock-now. I wish they would at least reply to my support ticket, I understand it's a new device, but communication is key to a good business.
Let's hope htccode.com can figure this out...

I was about to ask the same question. T-Mobile is usually pretty good about giving out the unlock code. Especially if you bought the device unsubsidized.

I tried first thing on the 24th after obtaining the TMOUS HD2 as well and as you; I have heard absolutely nothing, your right communication is the key.

I called them twice and was told they would give the code after a certain amount of time but only if you have had an active account as they need it to send you the code...I KNOW for a FACT that is not true but its what they told me both times. More likely they have the code right in front of them if not on the next screen, but its not the reps fault they just following orders.
So far:
freeyourhtc.com = Could not return a code...Refunded my money within 2 hours from purchase. $18.99
htc-unlocker.org = Emailed me code after 2 hours; it didn't work. BUT!!! They emailed me twice since saying they are working on it. After 24 hours they emailed me saying the code is not in any of the databases but they can request it from TMO but they want an additional $10.00 and it could take 3 days. $19.99
leo.unlock-now.com (unlock-now.com) = Not so much even as an email to say thank you for the payment. Still waiting, site says it could take up to 2 days...it has been almost a day and a half so far. They sent me a refund (Not quite 2 days yet) saying my code could not be found without me ever emailing them so I guess not so bad after all, also said try back in 15 days.$23.95
I also emailed 2 ebay unlock sellers they have not wrote back yet.

T-Mobile-They have been the most helpful, they said since I purchased my phone at a major retailer they would do it but I had to fax some info. I than said that was unacceptable and the kind lady asked if i had any friends on T-mobile. luckily I did and they said it would at max take 48hrs. I have been waiting since last night..

i have four hd2 t-mobile upgrade which i can`t unlock, had no issues before
maybe there is some software to unlock hd2?
If I remember right there was a legal deal regarding the unlock code situation. You are the owner of the phone and have the right to the code. The carrier is required to give you the code. I have had good luck getting tmo USA to give me my codes on past phones. It sometimes takes a day or two because they had to get it from htc.

When I bought the phone and I made sure to request my phone would would be unlocked so I can compare with my AT&T service. I did not transfer my number and kept my AT&T account open.
When I called in to have it unlocked, one guy said they can't unlock it until after 14 days, which is the last day to return the phone in many states. I called again and a lady said I have to be through 2 billing periods or 40 days to get it unlocked. This is not written in my contract. I demanded something in writing and there is not a written policy or specific terms on this. But yet, I'm "contractually" binded to this "policy" even though it was never discussed to me nor was it in my contract. I didn't leave the store until I got a written documentation of the conversation around the 40 days.
Then I look at the Terms and Conditions online and line item #6 states customers have the right to have it unlocked.

From my interpretation, consumers have the right to waive arbitration and sue for breach of contract.
if you have tmobile call them up for the unlock code, tell them your going out the country. You will get it unlock code free in 24hrs-7 days via email

It's all in how you interpret "you may be eligible"...
WTF does that mean? Do they have the right to place eligibility requirements on it even? What are the U.S. laws regarding this?
How do you think the ones that popped up on ebay right away after release got their codes so fast?
I have tried 3 unlocking sites and they all said code cannot be found at this time.

Tried this, was told the account had to be active for 40 days which is bull because when I called before getting the phone they said you just had to have an account active.

I've been "pressuring" htccode.com to come up with a unlock. If they can do it I told them I'd put a post on my site (HTCHD2.NET) which might drum up some sales. It's gets a decent amount of hits so hopefully this will motivate them.

I've been a Rogers Customer for over 8years. My average bill is about $100 a month, for 8 years. Yet loyalty means nothing with this company. I consider 8 years to be along time. (especially with the current market for cellphones)
MY STORY
I was "duped" into upgrading my phone recently to a HTC Magic, before i went ahead and agreed to the Magic, I researched the phone on the internet, the specs where great, the Android software too. I was assured by the guy on the phone (ROGERS EMPLOYEE) that this phone would recieve all the OS updates in a timely fashion. WRONG.
I proceeded to install my own OS on the phone, as its MY PHONE. However in doing so I had my Data cut off. Which I'm paying for, $30.00 a month.
Of coarse the Online Waiver didn't work, so I called Rogers on Monday 8th Nov 2010, at 8.00pm, after the usual 40min hold time, I explained to the tech what happened, he told me he would enter my IMEI and i'd have Data once i pull the battery from the phone, and restart it. LIE.
Tuesday morning, Today, still no Data, called Rogers before going to work. I need the DATA for my work, emails and whatever. I was told by a tech 3-5 business days.
So if Rogers can just cut me off. Everyone this happens to should recieve a credit for the days they have not got DATA!! I still haven't signed any waiver, yet Ive been cut off!!??
ALSO IF ROGERS HAVE CUT OFF MY DATA AND CANT PUT IT BACK ON FOR 3-5 BUSINESS DAYS (SUPPOSEABLY) THEN WHAT IF I MISS AN IMPORTANT EMAIL, AND LOSE A CONTRACT BECAUSE OF IT, REMEMBER I STILL HAVEN'T SIGNED ANY WAIVER, YOU HAVE JUST CUT ME OFF!! WHO'S THEN RESPONSEABLE??

Hmm..Sounds like my case. I pay 110 dollars a month, for T-mobile. Their customer suppose wont even help me activate my phone. I pay for data, but I cant ACTIVATE it with data. Which PISSES me off, Because I dont even use it alot. Ive been a customer for about 5 years. Atleast they should have gave me a new sim card in the mail, so I have some"hope" inside of me. [Q] febuary update

i have a telus lg optimus 7 unlocked and now on the sasktel network. my question is am i screwed for getting these updates because sasktel doesn't recognize the phone as one of there models and i am not on the telus network so they wont push it to me? i cant justify paying 400 bucks for a phone that i cant get the new updates the Microsoft rolls out.
If you do not get this update, you will get the next one (By mid March) definitely. Microsoft has confirmed that much. I contacted Telus, and it seems they have "no information to offer at this time". Basically, Telus is the only carrier in North America that has yet to offer update for their WP7 devices, but two weeks is not that long to wait, right? Especially considering that this update does...nothing, and all updates are cumulative.

I'm planning on giving Telus a few more days before complaining loudly, as the rollout was to be staged, so maybe they volunteered to be last on the list :|
Personally, I'm fairly concerned about this as Telus doesn't have the greatest record for updates in the past, and holding this back isn't a good sign (imho).
Even if this minor update is rolled into "no-do", there's no guarantee "mango" won't be an 'odd numbered' update, or that we won't be weeks behind others getting either/both.

So as the rest of the world gets copy/paste, theoretically we telus users could just be getting the pre-nodo update.
I'm right there with you I had the same thought when I read that article. I don't understand why Rogers and Bell both have launched it but Telus hasn't I tweet'd customer service about it and they answered back they had no information about unreleased updates.
I am hoping that maybe Telus wanted to "save us" from the trouble of doing 2 updates in a fairly short period of time. At least we know that they can't block nodo. Out of curiosity does anyone know how Telus is with android updates?

I've been looking around all the standard places for more info but haven't come across anything. My fear is that the wp7 userbase on Telus is small enough that they don't consider us a priority.

I hope that we are considered a priority. I'll do my part and call and bug them maybe if everyone jumps on board we'll get this update.
i spoke to sasktel and they have already rolled out the patch on there network. but because my phone is telus branded and the zune software see the phone as telus it wont give me the update. sasktel does not recognize my phone for updates so i would assume that's because they don't sell the phone.
I'm in the same situation as you kazman. Have an unlocked Telus branded Optimus 7 running on the Bell network, and wondering if I'll get the update when/if Telus releases it.
Will report if I do.

that is completely ridiculous. i called a telus store yesterday in Saskatchewan and she told me that they don't know about updates and recommended that i move the date on my phone ahead a year and i should get the update then. but she had just told me a minute ago that there where no updates. they need to get a clue.
So it seems like Telus just doesn't know what to do with updating the phone. I am a bit surprised and doubtful that Microsoft didn't tell them though. It just shows a huge lack of communication within Telus.
as I posted in the other thread, I talked to a telus rep who also no idea about the update; but was able to confirm they didn't have to pay MS for it, so we should be getting it.
I've got a 10 year old account with them and made it clear I would be willing to switch carriers if they dropped the ball.
Hopefully we can get enough people telling telus the same that they'll get their act together.
i would like to know why we cant just get the update from the zune software. and if a carrier such as telus hasn't released the update how does the zune software know not to offer you an update or does telus need to respsond to microsoft that the update is out on there network. how about a new rom from bell or rogers that would solve all our problems.

It's going to be something like that (e.g. telus tells MS it's approved, WinPhoneUpdate sets the flag to allow it).

I'd assume going to a differently branded rom would solve it, although that'd likely negate access to the telus app store. Another potential issue is that the telus optimus7 is a different model number from the european one. I have no idea which version the mexicans got so there may not even be a viable alternate rom. :|
An unfortunate truth
Look guys, this first update was OPTIONAL for carriers. It did not provide any new features and was just a test update before the real update in a week and a bit. Unfortunately for you guys, TELUS decided to not push this one in favour of just sending one update later. You shouldn't be upset at TELUS ... yet. I had an Android phone with them before and just about lost my mind over the update issue, but I think WP7 will be different because MS has more say than the OEMs do regarding Android. I feel bad that you guys are suffering, but it isn't really TELUS' fault.

That doesn't really disuade any concerns.
It's not just a test and no user visible features does not equal not necessary - think API changes before mango
My main fear is that something I'll deem critical will be in one of these minor updates, and telus will make me wait 6 months till the next major update instead of just pushing me the fix.

Just because I feel like nitpicking (I'm just being a smart-ass, don't take it seriously/personally ):
There are three "entities" involved in getting my phone updated
1) Microsoft - they've released the update, not their fault
2) Myself - I've connected to my computer and forced zune to check for updates, not my fault
3) Telus - They're not pushing the update for whatever reason ... pretty sure it's their fault
optional or not this still makes telus look bad when all other major carriers in canada are pushing this update but not telus.

There's a technical requirment that makes them unable to disclose when the update will become avalible... doesn't make too much sense but I do agree with all of you. It's not that I desperatly want this update or that it's really negativly effecting me in anyway, it's that I fear this pattern may continue on to updates that improve the phone. We'll see what happens in March hopefully Telus pulls it together or at least has a better answer then just because.

The T-Mobile Thread

Too much chatter across multiple threads...
I found a temporary solution. I ported my number to AT&T. Thus far, coverage is fine, data speeds are disappointing only in the sense that where I am right now, I am getting less than the 8 Mbps Cricket would cap me at.* Cricket is apparently now owned by AT&T and now offers unlimited talk, text, and 20 GBs of LTE for $60.
My data worked upon activation.* It seemed my AT&T rep had to alter the IMEI associated with my prepaid account to get phone calls working.* Don't know if there will be any implications, but in the hour I have been with AT&T, some root apps (including Ultimate Dynamic Navbar, without which I have no Navbar) have force closed for the first time. Seems like coincidence but I guess not? This is happening regularly now, X many minutes after boot, and bluetooth is being disabled as well.
I hope that T-Mo gets this straightened out, unless AT&T really impresses me, I look forward to hopefully switching back to the $30 Wal-Mart 5 GB plan.

I work for T-Mobile and have also have the same issues with my Z3tc I, being a store manager, have limited resources available to me but i plan to submit a ticket in hopes of resolving this issue, it would help if i had multiple issues to report however. If you folks are willing to help me out with this (power in numbers as they say) i think we may have a chance of getting a fix, what i need from each of you is your T-mobile telephone number that you've been using your Z3TC on and i can submit this ticket. Any luck with the ticket you opened? You might consider posting the ticket number both here and in the t-mobile support forum so that anyone with the same issue can easily contact t-mobile and reference that ticket. As you said there is power in numbers!

Any update on this? My billing cycle started today and I think I got my internet pulled too. Called tech support and they said they don't know what the problem is. They said they elevated my ticket to a engineer and should hear back from them in 3 days. :crying:
just port the number to Metro its' the same network and just $10 more for unlimited you can always port the number back if t-mobile fix this issue.
Tweeted at Legere and Tmobile help and now I'm sitting on the phone with a tech rep. Let's see what happens. Seems like such an easy thing to switch and the irony is the paying customers and getting screwed and are jumping ship to pacify the freeloaders. I'm in love with huge phones and this is the First tablet with phone capabilities that plays nice with us carriers. I'm prepared to jump ship over this.
SO far she keeps insisting that it will work fine its it has the phone capabilities and i have the proper rate plan. She keeps putting me on hold....
There's someone who clocks into work 9-5 at t-mobile who can fix this issue with very little trouble, just have to locate that person.

So, The tech rep I just spoke to says that she can't open a ticket for me to send to the engineers until there's physically a problem. SO, I'm going to pick it up tomorrow and start the process. Anything happen with your ticket? Am I wasting my time?

Please, also get it elevated so that they realize this is not an isolated incident. I stopped by at&t today to ask about porting over my number. They said it would take 15 mins. The question is, you can't buy this device from a good reputable store with a 14 day no questions asked return policy. Expansys, or Amazon (not fulfilled by amazon) and the place where I'm going to go to in Manhattan are all "you buy it you keep it".
So, should I even go buy this tomorrow... The only way they will submit a ticket is if I actually have the device with the issue but if it turns out no one will fix the problem... I dont want to be stuck with it..
I guess I could always switch carriers but I'm in a family plan where we split the bill each month and the payments on my note 4 are going to come due... Big mess... But maybe that's what I'll do.
Why not just switch to metro though? Why at&t? Metro the exact same coverage. Or so I've heard.
Maybe I'll take the time to check out metros coverage while I wait for the issue to be fixed. Although.. I wonder, people were already working on this 2 months ago,why should I have any impact at all.

I just read through a pretty depressing thread. I'm posting the OP's final depressing post after finally getting through to a tmo vp. You can read through the whole thread too if you like. Seems like the battle is lost at this point, it's over, i just have to decide in a few hours when the store opens if I want to leave tmo over this and go to metro... After doing some research I got a hold of a couple of T-Mobile's executive e-mail addresses and typed in detail about what is happening here hoping someone would respond. Today I received a phone call from the office of the Vice president of T-Mobile. I had a detailed conversation about the problem. They said that our device, the Sony Xperia Z3 Compact Tablet LTE SGP621 should have never worked as phone with a data plan and T-Mobiles network should have recognized the device as a tablet and not allowed it to work as a phone with a data plan for the few months that it did right away. He also stated that T-Mobile up until I told him was unaware our device existed. He actually had to look up the device. He then went on to explain how the network didn't register the IMEI of the device right away that's why it worked on their network for those few months until the IMEI of the device was registered and classified on their network as a tablet. He didn't actually admit it was the free data for life program but if you understand how network protocols work I don't have to state the obvious. So the bottom line is that T-Mobile doesn't offer the service we are asking for on our devices. The way the network is structured it uses the IMEI number to determine the devices classification and then only allows approved services to be used on that particular device. So the rules on T-Mobiles network work says "Smart phones" are allowed to make phone calls, surf the web, send multimedia text messaging ect. and "Tablets" are only allowed to have a mobile data plan and are incapable of making phone calls. Our device is a phablet but there isn't a phablet classification on T-Mobiles network. Even though our devices will work, have worked, and can work the way we want, it is irrelevant due to the way the network protocols have been written. The industry is somewhat at fault here by not having a specific classification for a device like ours. It really should just be classified as a phone. The world I live in, if a device is capable of making phone calls its a phone end of story. Phones make phone calls, this is kid stuff. So there is no solution to our problem and there never will be one as of right now. So the device is useless in the US for what we bought it for. I would have never bought the LTE version if I knew this was the situation. The service I'm willing to pay for is not offered by any US carrier according to T-Mobile. I find the whole situation funny at this point. Look at it in this perspective, the hardware of our device is identical to the Sony Xperia Z3 that T-Mobile currently offers, the only difference is the size of the screen. and the IMEI number that says its a tablet. You can actually flash the Sony Xperia Z3 operating system onto our devices thats how Identical the hardware is. It's just the IMEI number that defines the devices classification. Overseas this isn't an issue. I'm hoping soon there will be a US carrier offering this service, the first company that does I'm switching to. I think I'm just going to cancel the line and use WiFi for now. I can't believe I spent close to $700 for this device and it's now basically the $400 WiFi version. I'm keeping my T-Mobile account because I'm grandfathered into a very good rate and I'm hoping they will eventually offer the service. but I know for a fact our devices will never work the way they did because of our devices classification. They would only be able to work if T-Mobile changed the networks protocols that classifies the device as either a phone or a tablet, as long as they have that protocol in place we are out of luck. I really don't see them ever getting rid of this classification/rule system on their network. So if they ever do offer a "Phablet" device with the service it will be on T-Mobile branded devices only because those devices will have an IMEI that classifies it as a "Smart phone" or by that time they will have added the new classification of "Phablet".. Good luck to everyone that was having the same issue, I really thought we had a chance at solving the problem because our devices "WORK" on T-Mobiles network perfectly. If anyone knows a carrier willing to provide the service to our devices please let us know.

I just read through a pretty depressing thread. I'm posting the OP's final depressing post after finally getting through to a tmo vp. You can read through the whole thread too if you like. Seems like the battle is lost at this point, it's over, i just have to decide in a few hours when the store opens if I want to leave tmo over this and go to metro... I've been really happy with tmo up until now...

After doing some research I got a hold of a couple of T-Mobile's executive e-mail addresses and typed in detail about what is happening here hoping someone would respond. Today I received a phone call from the office of the Vice president of T-Mobile. I had a detailed conversation about the problem. They said that our device, the Sony Xperia Z3 Compact Tablet LTE SGP621 should have never worked as phone with a data plan and T-Mobiles network should have recognized the device as a tablet and not allowed it to work as a phone with a data plan for the few months that it did right away. He also stated that T-Mobile up until I told him was unaware our device existed. He actually had to look up the device. He then went on to explain how the network didn't register the IMEI of the device right away that's why it worked on their network for those few months until the IMEI of the device was registered and classified on their network as a tablet. He didn't actually admit it was the free data for life program but if you understand how network protocols work I don't have to state the obvious. I'm going to port my number out.
I just called back tech support and they didn't even know what was happening. No one ever seems to know. I'm going to Metro PCS. EFF these s0n's of b!tch3s.
Yup... Yup... I just had a very long conversation with a tech support guy (i gave him all a bunch of different forum thread links to read through) he read everything I showed him and he understood fully. He transferred me w8th details to someone else who again took plenty of time to read through everything including internal T-mobile discussion. He's gonna call me back on Sunday. I left off with him that everyone is jumping ship because of this, including me, all to pacify some freeloaders.
Of course, I'm not delusional. after reading the above thread I realize he's probably gonna get back to me with a sorry, nothing we can do. That's why I'm going to a metro pcs store today to sign up. I'm not porting my number just yet, first I want to test metro and give tmo a little more time. Plus, I have a new note 4 (warranty issue replacing my current note 4) coming which I will then have to pay off when I port my number out so I'm gonna sell. And actually, I'm going to finally port my number to Google voice so I can always jump around and back to our tmo family plan if they ever fix this.
So, to recap, joining metro today with the tablet and if/when he comes back Sunday with nothing, I'm porting out to Google voice.
I'm so disappointed with tmo. I joined them in 2012 right before everything started getting exciting in 2013 and on and I have been increasingly more happy with them ever since...

I just came back from the cricket store. After writing my last post, I put my jacket on, and walked out, walked 6 blocks down, and had them port my number. So far so good. LTE speed is decent, and now I'm actually paying less! $35 a month. 2.5GB (which is enough for me, they had $45 for 5GB, maybe I'll upgrade next month) and unlimited talk and text. Not too shabby.
Dear T-Mobile. See how easy it was to "Un-carrier" you? I did it in less time, than it takes to do one load of laundry.
Nice hope it works for you. I need the unlimited data because I use North of 30gb a month... With I could go to cricket, but metros probably where I'll end up

Well, I'm now a happy metro pcs customer. Just started porting my tmo number to google voice and it'll work through the new metro number. Turns out, my eip on my note 4 doesnt come due at all. As long as there are still more lines on the account, i can just keep paying it off month by month. Of course I'm gonna sell it soon but still.
BTW, to anyone who had this issue with tmo, you can get through to the engineering department for technical support, forward them to the following link so they can read up on the problem and then you can get them to credit your bill for the data portion since february. The credited my account 60 bucks.. Not bad. I wish I could have stayed with t-mobile but what can ya do.
Again, to all you people holding out for this to change. Not gonna happen. Not a chance in hell. really. It's a tablet now and it's final. you're gonna all have to move on
Metro is working fine for me is $10 more for the unlimited data but I am happy at least to have this working don't hesitate guys
