I need to go about returning my 8125 to warranty exchange. Problem is, I did not purchase the phone, rather bought it brand new off of someone else. (who bought it from cingular) The other person is unwilling to do the exchange. Excluding the issue of the reasons for the exchange, and any physical damage (there is only scratches) could I do a warranty exchange without the involvement of the seller? I plan to say the phone keeps freezing. Worked with my razr.
Also, I flashed the phone to a new rom, will this void the warranty? Do i have to flash back to summiter's stock rom? Thanks a lot.
1) Normally Cingular's gonna want some sort of proof of purchase. Since the phone's not been out more than a year though you might be lucky on that point.
2) It had better have the STOCK ROM (not summiter's not Mr. Clean not anything custom, STOCK) before you send it in. Otherwise they're gonna know you messed with it.
where can i get the stock rom
Well according to this link http://www.htcwizardweb.net/node/161 one of the ROM's available from Summiter is infact the original ROM. Summiter must have backed it up before starting to play with it, I guess.
If the rom is still a cingular rom will not void warranty.

I have the same problem got it brand new on ebay everything was wrapped in original box including the sim card. the touch screen is having issues the bottom part wont' do anything. tried to call cingular the would not help .. i explained that i am a cingular customer but i have the phone so i can use it on a data plan with t mobile and they would not help at all told me that if i didn't get the item from them or their authorized seller they will not help. I have been on the phone wiht HTC america a total of 4 hours back and forth and they won't help. look sell it on ebay...... and call it a day. I will never purchase another cingular branded phone. thinking of switching to tmobile but their service sucks. sprint out of the question i have too many unlocked phones big investment and i refuse to be locked to one phone using sprint or veriozon. the entire deal sucks.... they should sell phones like in europe walk in the store get a phone at the phone's price not at some larger price just to line the fat greasy pockets of cingular ceo's they tricked me inot migrating my good at&t plan they told me that i had 15 days to decide and i can cancel but when i asked for my at&t plan they tell me some story about they don't have th plans anymore. Did you tell them you didn't buy it from them? I've done several exchanges and they have never asked me that. They just ask for the IMEI number (which identifies it as a Cingular phone and the model) and then process the exchange. Whatever you do, do NOT volunteer the fact that you got it elsewhere and you should be OK, but yes return it with the stock ROM

Now this is a logical fallacy. Have you even bothered to price the cost of a Wizard in the UK? If they were priced the way you say, you'd be paying a whole lot more for them. Retail price on an unlocked Wizard is between $600 and $700 USD. Retail price on a locked unit (ie, just walk into a store in the US and buy it straight out) is $450. With a contract from either T-Mobile or Cingular you can get them from $0-$100.
When you buy used on eBay you always take a risk. Without a proof of purchase, the store/carrier is really under no obligation to warranty the phone for you. Sure, many times they will but it is silly to assume that they have to do it. If you wanted that level of service you would have bought from the store in the first place. Nothing says you can't walk into a retailer, buy a phone and not get a contract.
If you've got a defective phone you really should be taking it up with the guy who sold it to you on eBay as fully working.

I got it on ebay and the guy who sold it said it was brand new now i can't get in contact with him. the contact info that ebay has is a po box. they guy won't return my calls. He sent me one email asking me for the imie number after i gave him that number all of a sudden the phone would not boot into windows. The inial problem was the touch screen now the entire thing is toast. Should I call my credit card company and dispute the charge.
Just giving someone an IMEI number should not cause a boot failure by itself, however the simply fact that he asked for it is somewhat suspect as there is no legit reason for a seller to need to ask a buyer for the IMEI number of a phone after it has been sold.
I'm not saying this is your case, but the first thing that pops to mind is insurance fraud. A popular eBay scam right now is to sign up for phone service and get an expensive phone for free. The person in question will also get phone insurance. Then they put the phone up for sale and collect the cash, while at the same time reporting it to the carrier as lost or stolen. The phone then gets replaced and they have both cash in hand as well as a new phone.
In much of the world (ie all over Europe) this doesn't work well as IMEI blocking has been implemented by the carriers there. If a phone is reported lost or stolen the IMEI is added to a database and none of the cooperating networks will allow it to register. In the US this hasn't happened yet on the GSM networks. With the CDMA networks they tie to the ESN on the phone and will block a lost or stolen phone (as well as one with an outstanding balance).
Regardless, had the IMEI been blocked by the carrier, you would not be able to make calls but the Wizard should still boot up and function as a PDA. Of course, if the seller was trying to pull insurance fraud that would explain why he asked for the IMEI and is now ignoring you. It would be rather simple for the seller to do a warranty exchange with Cingular on your behalf, but if the phone was reported lost or stolen he wouldn't exactly want to be phoning up Cingular and asking them to service the phone.
Just some idle speculation.

I believe that you should contact EBay or Paypal and your credit card number to put the case on the dispute...let them know that the item not in working condition as they advertise. You may spent a lot of effort and time for it but at least..... this will make the seller to contact you and deal with you again.
Format has failed
I was able to flash the rom. The flashed completed but it still freezes at the start up screen it says the following:
IPL 2.25
SPL 2.25
GSM 02.25.11
OS 2.25.11.1
its stuck onthe Cingular logo screen. When I try to do a hard reset it give the error message
format has failed.....
Can this device be saved?
Sounds like it is having trouble initializing a section of the flash. My guess is that there's a bad flash chip on there. If I ever saw that on my Wizard I'd be on the phone asking for a warranty replacement.

update of my situation
Well still no reply from the seller so I called the credit card company and dispute the charge. i have copies of the guys ad... and copies of the rude emails he sent me. The credit card company told me just hold on to the defective phone and the emails and they will take care of it.. Apparantly the seller was working from a Post office box he was pay apal verified. I just hope no one else falls victim to this guy.

My gf's old phone broke, and I found a cheap HD2 on craigslist. I went ahead and bought it from the guy. He seemed ok, maybe a LITTLE shady. When I brought it home and told her how I got it, she became worried that if we put her sim card into it, and it IS stolen, a red flag will show up at T-mobile and she might get into trouble.
Is there any way T-mobile can tell who has the phone if it IS stolen? Also, if she ever has to send it in for a replacement through warranty, will she be screwed? I know I shouldn't have bought it off of Craigslist, but it's too late for that now...

Don't think they will call the police on you , If you tell them you are going to , but I bet they will want to take your name, just in case ...

lol, i know. it sounds pretty bad, but i assure you, that's not the case.
they can tell if it's stolen. they can tell if more than one person has the same IMEI number. whoever was using the phone will have that IMEI on their account, and if your gf puts her sim card in it, they will be able to see the IMEI from the phone. that's done on purpose, so that if someone does report a stolen phone, and the IMEI turns up on another account, they can flag it. however if it was not reported stolen, then there isn't much they can do as they don't know whether or not the original owner sold it to you or a shady guy on craigslist sold it to you, so reporting to the authorities would be pointless for them, as it may have been a legal transaction. as for calling them, they're probably not going to give you the info if that IMEI is registered in their system, they may not even tell you if it is. but if it has been reported stolen, and the IMEI shows up under a different account it will probably be flagged, I'm not sure what would happen at that point. More than likely rather than calling the authorities they'll just cut off the service to the phone.
Try a prepaid sim card and see if it was IMEI blocked?
well, we put her sim card in it and nothing has happened so far. i suppose it was legit.
If you got it with box, supplies and cables its very low chance that it stolen. Actual price in my local craiglist is really low, but it doesn't mean that most of all are stollen
tmobile dont care if the phone stolen or not. it doesnt really matter.

If that were possible I would like to think they would have told me when my TouchPro2 got stolen... The fact that they didn't mention anything like that leads me to believe they can't tell just by the sim card.
i buy/sell phones on craigslist almost weekly and put my sim in all of them
when i call t-mobile to change the internet plan they always ask me where i bought the phone. i always say from t-mobile and they never say anything about it. guess they cant really tell

I'm not in the US but i always purchase phones from US and UK on ebay.
Always when i buy phones which are doubt to be stolen or reported as stolen i use this site www.checkmend.com.
They are even recommended by ebay. They claim to have a connection to a database that has all the information on Mobile Phones, Laptops, GPS navigators, etc. Which they can track by the serial number.
In your case you will need to provide them with the IMEI number of your phone and they will give a report on the status of the phone and past owners if they are registered. (they send this report by email instantly. they charge you USD 2.99 for this service. i thinks its quite worth than the risk.)
in my experience I've tried this service twice and a HD that i bought from the UK was returned with a report that said "This item has been blocked during its lifetime by one or more UK network(s)." which means it was reported lost or stolen.
and i even tried my HD2 which i'm using currently which i got from US cos i didn't get any box or accessory with it. But the report came out clear and i am in peace of mind.

usefull site. does it give any detail? i blocked my last phone thinking i'd lost it, 4 weeks later it turned up in a friends sofa, so i had them un block it and used it for another 18months.

Someone mentioned the IEM number that is the way they can tell if its stolen. So when and IF you ever take your phone into the store to have the useless sales people help you solve some problem. That is how they will know if its stolen. If there is a way to tell by electronic signal Tmobile simply doesnt care. I asked when I bought mine and they told me to get insurance. I asked how do you know if I dont just keep the phone and get a new one for 100 bucks. IEM number shows up was their answer.
Your IMEI and sim info are constantly broadcast about the cell network, you don't have to go into a store for this information to be picked up.

I could be mistaken but I believe that if you select the G1 unlimited data plan, then any smart phone you have after that will not need to be updated...I am using the G1 plan with my HD2 and it works fine. So maybe you can avoid lying to them.
My room mate just bought a Droid X from a girl on craigslist. She seemed nice enough, but mentioned it had ties to her (ex?)boyfriend and she just wanted to get rid of it. Sold it to my roommate for $175. Me and my room mate went straight to the Verizon store to activate it, and they said it was on the lost and stolen list and they couldn't activate it. Been on the phone with Verizon for a while now, seems like they can't do anything. Any ideas? The girl wont answer her phone now.

Nope, not a damn thing you can do. If it's on VZW's black list, that's that. Unless the seller pay's their bill, it's most likely stolen, past due amount on the account or there is an ETF not paid.
You can take it to Cricket and flash it worse case scenario. We don't know if it is indeed stolen or not and if you guys think it is, I would contact the Police and make a report to try to get your money back and press charges.
No phone number, no pictures taken of the phone...man, that's a huge red flag right there for buying a used cell of craigslist. Sorry for your luck.

Well, through email we had a name and she gave us a contact phone number, and we had no problem contacting her up until the sale, after that she didnt answer anymore. Shes not a verizon customer, based on the name associated with the email and the phone number she gave. There were pictures of the phone, but they may have just been pictures from the ads.
One thing I wished we had done was met at a verizon store and got it all checked right then and there.

Same thing happened to my best friend, he bought a DX from a girl on CL, she wanted $200 for the device, but took $150 after some haggling (from the way he described her and her outfit she was probable a dancer/escort).
When he tried to set the device up on his VZW account, the CSR informed him that it was on the "Lost or Stolen" list and was given an incident #. He contacted the Dallas PD, turned out the girl was a stripper/escort/dopehead and had been jacking her customers for their wallets or cell phones.
He ending up, having to turn the device over to the PD and was out the $150.
After all of this (and at the time this was probably a [email protected] thing I pointed out to him), but you can pick up a pre-owned DX from VZW for $149 and they come with the full warranty.

Rule of thumb, never buy a cdma phone (VZW or Sprint) without first checking with C.S if the ESN is clean.

Somebody at work is supposedly going to sell me his Samsung Galaxy S II today for £270, which ordinarily wouldn't bother me, but this phone is new and under contract. When I asked him about it he said he'll keep the contract and after six month's or so when he's able to upgrade the phone, he'll get a new one.
I'm not too concerned about the ethics of it, because as far as I can see I'm not really doing anything wrong, he's obviously made his mind up and if wants to sell somebody a new £500 phone for half the price and continue paying for it then that's up to him.
What I am concerned about is if he's isn't telling me the truth, and reports it stolen after selling it to me, what's the possibility of me ending up with a phone that is unusable on any network.
I may be thinking to far into it, but I have ask myself why he'd want to do it, but then again it's not that different from somebody borrowing from a loan shark and paying twice as much back.
I vaguely remember discussions a few years ago about IMEI locking stolen handsets off networks and I was wondering if this has been implemented yet, if so, is it all networks or just the major ones.
I know that it's possible to change IMEI numbers, but since it's highly illegal here in the UK, it's not an option I like to consider.

If the IMEI does get locked in the uk, I think you could sell it abroad as the IMEI check is different. As for an upgrade after 6 months, I don't think any operator do this and would get me thinking.
Just get a receipt from him with his signature on it. If he's reluctant to do so, back away from the sale. If he does try something further down the line, the receipt proves that it's yours.
Thats far to cheap I would ask what network the phone is on then make enquiry of that network and also ask to see his original contract/bill of sale .
Network phone presume its locked top that network .
The seller would be responsible in the first instance for the phones warranty .Doubt if the original network would stand a warranty claim . I would check out if Samsung hold warranty for a second user .
The phone is not part of the contract and is an inducement to buy the contract which he will be liable for until end of contract . Yes he can sell an unwanted phone and many do .

Just to chip in, I can see where you're coming from, I'd be cautious too however I can also see where the seller is coming from. When I got my Galaxy S on contract I got a fantastic deal but later decided to sell my phone for a lot less than it was worth because 1) it was a quick sale and 2) it was damn cheap on monthly price was worth it for the texts/phone/internet alone so wanted to keep the contract but not the phone.
If you get box and accessories then you could say you purchased from the owner complete...

A receipt is a good idea and will ensure you wont get prosecuted if it does come back on you but the phone could still get confiscated if it has been reported stolen.
Personally I'd take the risk and get a receipt, if they work with you and it does come on top then you might be able to get your money back anyway.
Go for it, its a great Phone.
I brought the money in last night, and didn't see him. Got a call off him and he said he'll bring it in today (starting to wonder if he's just full of it), but for now I'll give him the benefit of the doubt anyway.
In one way I hope he doesn't bring it in, and in another way I hope he does.

You get 45 days to return any item on ebay, just go to the resolution center and "Report that you received an item that wasn't as described"

unfortunately for you and the person who the phone was stolen from. the blacklist is on the carrier end. and as far as i know you can't hide or alter the IMEI serial on your phone. so unless you want an oversized ipod touch, i suggest you return it and hopefully can get a refund from the seller on ebay.

Legally, nope.
How cheap? ~200? Even at that price is not worth it if is blacklisted. Anyways the Nexus 4 is very cheap as it is! (comparing it to similar phones).
If you still want to buy another from ebay, I would recommend to get the 8GB version, since that one is only sold directly from Google, is impossible that it can get blacklisted.

If you report your phone stolen to your ISP, they will add the device's unique IMEI to a database that blocks it from accessing the network, effectively making it useless on the carrier. Depending on how the blacklist database works, the device may still work with other carriers, but it's also possible for this blacklist to be shared among carriers. So as long as you buy your device from the Play Store or directly from your carrier, it will be fine. Used phones should always be tested with a SIM before buying it, and keep your IMEI safe. Even if you buy a used phone, it's possible for the seller to report it stolen after they get your money.
If the buyer doesn't accept it or its too late, just sell it out for parts. You can sell the screen, back cover, battery, camera, usb port, and headphone port, for at least $200. Just don't sell the motherboard as that's the part that has the blacklisting

Well, seeming as the Nexus 4 is only $199, £159, that price is amazingly cheap, I'd say you should get your money back and order one from the play store..
