DETROIT -- An Ann Arbor woman said she is waiting for an apology from Sprint after she bought a phone that had pornographic videos on it.

Rhonda Lee said she bought what she thought was a new Sprint EVO HTC cell phone from a third party Sprint store in Westland.
The phone is usually sold unwrapped, but all of the pieces were wrapped.
When Lee showed off the high-tech phone to co-workers and friends, they discovered five pornographic video downloads.
Some of the explicit videos were as long as 11-12 minutes.
Lee said she was disgusted and mortified by the X-rated videos.
"I'm so, so embarrassed, you couldn't imagine … I mean for you to be going through your phone and you have friends and you're going through your phone and all of a sudden porn shows up. I mean so, so upset," said Lee.
When Lee tried to return it to the third party store, employees first denied that the phone had been used, but they later admitted that another man prior to her purchased it.
After a bit of a runaround, Lee said the Sprint corporate offices told her she could get a replacement phone at the Briarwood mall.
"What upsets me, I keep thinking about the what ifs, not just being me, but what if somebody bought it for it their kid? I have a lot of friends that are religious, what if it was given to them as a gift?" said Lee.
When Local 4 asked a Sprint salesman if it was common practice to sell used phones as new ones, he told us to contact the corporate offices.
The corporate offices have not yet responded.
Lee is a Local 4 viewer and e-mailed us her story.

This happened to a friend of mine, a lady, she contacted a lawyer and sued. It was Verizon. Multiple people from Verizon showed up at her lawyer's office. She didn't contact Verizon first. She went directly to the lawyer.
This happened in NYC. The phone was loaded with porn featuring Verizon store vendors. 2007 or 2008, I believe.
BTW, I don't know how much was the settlement, but it was 67% for her, 33% for the lawyer.
I'm disappointed, mine didn't have any. Maybe it's included in the OTA?
I am outrage as well as a sprint customer I too want this extra bonus to come with my phone!!!
Why should Sprint apologize for a resellers mistake. Also Sprint should not be saying anything because they did not sell her a phone and should not have any employee risk saying something offhanded. It is best they refer it to corporate. The third party store should be the center of topic. The Local news channel is wrong for linking this to a coporate Sprint store.
What can someone sue for if porn was there when they are an Adult buying the phone? Nothing because people rarely win lawsuits over this kinda stuff. Kiddie pron perhaps.
I can leave that stuff on my phone and sell the phone. Whoops my bad that's all.

Let's sue Sprint under the auspices of "what if a really religious friend of mine bought this for their kid and they were traumatized for life" so she can get a fat settlement, as a result of which the costs are passed on to the consumer.
We've become too litigious for our own good, and the rest of us end up paying for it (literally).
News flash lady -- even religious people have sex and know about porn.
Sprint should apologize, give her the phone for free and move on.
Shouldn't Sprint have the records of what data was downloaded when to that phone? If they do, they can easily verify when the porn was downloaded and who had the phone at the time.
why is that the folks who can/would appreciate such things don't get them.

In my opinion, the sprint stores that are operated by third party are shady. There is a tremendous difference between a sprint store and a "sprint store". There is no way for a customer to tell if they are walking into a sprint store or a third party store just by looking at it. Perhaps if they walked in and asked a salesperson.
I bought my evo from a third party store and was charged for two activations and shipping costs despite picking it up from the store.
Sprint customer service actually disparaged their own store and said "some times our third party stores put additional charges on accounts like this". I made note that the store had a sprint sign on the building and she said "yeah i know its tough to tell unless you look on the website".
That being said, I wish I had an extra bonus on my phone when I got it.
Over the years, I’ve bought a lot of phones and have done a lot of returns/exchanges, mostly with Verizon up until this year. With all the carriers, I’ve now been told “don’t worry all returned phones get sent to a warehouse and all data is wiped.” I stopped listening to that when I got a Verizon replacement that had someone else’s contacts and pics (this happened 4 times over that past few years). I keep a lot of business data on my phones and so not only did I hard reset my Evo twice, I also used a nice Windows freeware app called Eraser, to secure wipe the Micro SD Card.
I bought my Evo knowing that it was a return to the Sprint store. Mine didn't come with porn, but it did come with several (~10) shots of a brunette in various places (bar, house, and a couple places I couldn't tell). I'm guessing it was the first owners girlfriend.
She was attractive, but she definitely wasn't naked!

It's possible if enough people let their representatives know they don't like it. But they won't. They never do. And there hasn't been a government with a spine in this country for 20+ years so it'll probably "force" AT&T to make some petty concession in return for the bazillions it'll make off it's substandard service and that'll be that. Americans are self-centered and lazy and you can take that to the bank. AT&T sure will. I mean really, an online petition? Does it get any lazier than that?
Since they aren't breaking any law, there won't ever be a government response.

Just think about most cases like this, big companies buying big companies out. When has a petition ever stopped it? I agree that its a bit crappy for US people but I Ruby there's anything that can be done abut it.

Yes, there will a response because of anti-trust and monopoly laws and prove me wrong about the rest of it. There are entire business models based on the lack of attention and laziness of consumers in this country. Rebates, for example. On the surface you wonder how anyone makes any real money with them but they do because so many people are too lazy and distracted to mail them in. When they do, the first hitch that comes along is the end of it because they don't want to have to pick up the phone and talk to someone. Hell, look at all the questions on here that ask if there's an online way to do something because they don't want to have to pick up a phone and talk to someone. Whining about it doesn't make it less true.

People are over reacting. Show me the anti-trust violation/monopoly violation. People will talk, then after a few weeks it'll be back to Charlie Sheen and his tiger blood, or Lindsay Lohan dropping her last name. Just chill. Taking time off my sweet vacation to visit here...
Before i left to my roadtrip to Florida,
i decided to annoy(what i love to do most) the people at 2 verizon stores.
At one which is close to my house said they have no knowledge about the Samsung Continuum being EOL'd and they just gave me a business card to call Verizon Customer Service, so i told them i already have that number and that i will include the store number and employee information in my conversation, so they started offering me deals on accessories, i just said "Have a freaking good day,bye"
Since i love driving my car, i decided to go to another Verizon store to bug them, which is by a mall, not that far away from my house. They were more helpful. They confirmed the fact that the Continuum is in process of being EOL'd as well the the Fascinate being EOL'd too. I asked for a reason for all this happening to this phone, they said it didnt sell as much as they hoped it would and for that reason they couldnt release the froyo update. But he did show me something that caught my eye. He also had a Continuum. AND IT HAD 2.2 FROYO!!!! As soon as i started talking to him more about this, the manager cut in and asked to speak with him in her office. Im guessing he said too much.
Later that day i called customer service(which should know me by now since i call too much). And i decided to ask alot of questions to them, this was the response.
"Why has the Samsung Continuum been EOL'd?
Each phone has a term of how long it will be out depending on sales
Well since verizon has abandoned this phone is there a possible way we could at least get the 2.2 update released or at least the open source files for it?
I cant comment on the 2.2 update when it will be released but i know its very soon.
Where you trained to say very soon to these kind of questions?
Excuse me, our answer here at customer service are very accurate with the information they provide us with.
well thank you for providing me with answers that did not help me at all, have a nice day."
Well, i guess i am going to call Samsung customer service to ask them a few questions.

I wish people would stay the hell out of it and let the FCC handle it since its their department. They would know what would harm the market or not. not the Department Of Justice.

I hope that it doesn't happen. Anything AT&T controls means bad for the customers and customers being forced to pay for items they shouldn't have to pay for.

Im not saying its bad or good. I WANT the FCC to handle it not other people suing.. THE FCC are the ones who have the power. File your claims with them. Go through them not try to stop stuff by suing. ITS A SUE HAPPY COUNTRY.. that stops innovation easily.
The FCC can deny it and even accept it even if the lawsuit is won. Simple as that. This merger will drive prices down for us. Sprint will be better off. Verizon will become competitive to steal customers away.
Everyone says it will bring people to raise prices. Everyone else says it wont.
The FCC will look at the spectrum thing. Look at competitiveness.
I dont want people without a Business major or a ECON major telling me it will screw things up.
99% of the time the government is involved things are screwed up.
They once asked a major steal company to become a monopoly so that steal prices can go down and then after the war they sued them for being a monopoly.. seriously guys you want a agency dealign with this not the entire government.

Anti-trust laws are partially in the purview of the FCC, and yes it can approve the merger even if the DoJ doesn't like it, but the DoJ is just doing its job at enforcing the anti-trust laws which it has complete jurisdiction of. Especially since AT&T has been broken up before

Xoom Owners - Quick Survey Please

I am curious about some statistics of our Xoom 3G userbase and how many have actually received the 4G LTE update. Verizon reps claims they are actively being made. Many including myself have yet to see or hear of a single instance. I have personally been lied to by verizon reps in store and through direct customer service.

haha hell no. It's actually a guy I used to work with. He set that and a bunch of other wacky profile pictures of himself like that on Facebook
relatively unimportant, but the 3G xoom launched in February 2011. Makes it seem that much worse than March...
