I need to go about returning my 8125 to warranty exchange. Problem is, I did not purchase the phone, rather bought it brand new off of someone else. (who bought it from cingular) The other person is unwilling to do the exchange. Excluding the issue of the reasons for the exchange, and any physical damage (there is only scratches) could I do a warranty exchange without the involvement of the seller? I plan to say the phone keeps freezing. Worked with my razr.
Also, I flashed the phone to a new rom, will this void the warranty? Do i have to flash back to summiter's stock rom? Thanks a lot.
1) Normally Cingular's gonna want some sort of proof of purchase. Since the phone's not been out more than a year though you might be lucky on that point.
2) It had better have the STOCK ROM (not summiter's not Mr. Clean not anything custom, STOCK) before you send it in. Otherwise they're gonna know you messed with it.
where can i get the stock rom
Well according to this link http://www.htcwizardweb.net/node/161 one of the ROM's available from Summiter is infact the original ROM. Summiter must have backed it up before starting to play with it, I guess.
If the rom is still a cingular rom will not void warranty.

I have the same problem got it brand new on ebay everything was wrapped in original box including the sim card. the touch screen is having issues the bottom part wont' do anything. tried to call cingular the would not help .. i explained that i am a cingular customer but i have the phone so i can use it on a data plan with t mobile and they would not help at all told me that if i didn't get the item from them or their authorized seller they will not help. I have been on the phone wiht HTC america a total of 4 hours back and forth and they won't help. look sell it on ebay...... and call it a day. I will never purchase another cingular branded phone. thinking of switching to tmobile but their service sucks. sprint out of the question i have too many unlocked phones big investment and i refuse to be locked to one phone using sprint or veriozon. the entire deal sucks.... they should sell phones like in europe walk in the store get a phone at the phone's price not at some larger price just to line the fat greasy pockets of cingular ceo's they tricked me inot migrating my good at&t plan they told me that i had 15 days to decide and i can cancel but when i asked for my at&t plan they tell me some story about they don't have th plans anymore. Did you tell them you didn't buy it from them? I've done several exchanges and they have never asked me that. They just ask for the IMEI number (which identifies it as a Cingular phone and the model) and then process the exchange. Whatever you do, do NOT volunteer the fact that you got it elsewhere and you should be OK, but yes return it with the stock ROM

Now this is a logical fallacy. Have you even bothered to price the cost of a Wizard in the UK? If they were priced the way you say, you'd be paying a whole lot more for them. Retail price on an unlocked Wizard is between $600 and $700 USD. Retail price on a locked unit (ie, just walk into a store in the US and buy it straight out) is $450. With a contract from either T-Mobile or Cingular you can get them from $0-$100.
When you buy used on eBay you always take a risk. Without a proof of purchase, the store/carrier is really under no obligation to warranty the phone for you. Sure, many times they will but it is silly to assume that they have to do it. If you wanted that level of service you would have bought from the store in the first place. Nothing says you can't walk into a retailer, buy a phone and not get a contract.
If you've got a defective phone you really should be taking it up with the guy who sold it to you on eBay as fully working.

I got it on ebay and the guy who sold it said it was brand new now i can't get in contact with him. the contact info that ebay has is a po box. they guy won't return my calls. He sent me one email asking me for the imie number after i gave him that number all of a sudden the phone would not boot into windows. The inial problem was the touch screen now the entire thing is toast. Should I call my credit card company and dispute the charge.
Just giving someone an IMEI number should not cause a boot failure by itself, however the simply fact that he asked for it is somewhat suspect as there is no legit reason for a seller to need to ask a buyer for the IMEI number of a phone after it has been sold.
I'm not saying this is your case, but the first thing that pops to mind is insurance fraud. A popular eBay scam right now is to sign up for phone service and get an expensive phone for free. The person in question will also get phone insurance. Then they put the phone up for sale and collect the cash, while at the same time reporting it to the carrier as lost or stolen. The phone then gets replaced and they have both cash in hand as well as a new phone.
In much of the world (ie all over Europe) this doesn't work well as IMEI blocking has been implemented by the carriers there. If a phone is reported lost or stolen the IMEI is added to a database and none of the cooperating networks will allow it to register. In the US this hasn't happened yet on the GSM networks. With the CDMA networks they tie to the ESN on the phone and will block a lost or stolen phone (as well as one with an outstanding balance).
Regardless, had the IMEI been blocked by the carrier, you would not be able to make calls but the Wizard should still boot up and function as a PDA. Of course, if the seller was trying to pull insurance fraud that would explain why he asked for the IMEI and is now ignoring you. It would be rather simple for the seller to do a warranty exchange with Cingular on your behalf, but if the phone was reported lost or stolen he wouldn't exactly want to be phoning up Cingular and asking them to service the phone.
Just some idle speculation.

I believe that you should contact EBay or Paypal and your credit card number to put the case on the dispute...let them know that the item not in working condition as they advertise. You may spent a lot of effort and time for it but at least..... this will make the seller to contact you and deal with you again.
Format has failed
I was able to flash the rom. The flashed completed but it still freezes at the start up screen it says the following:
IPL 2.25
SPL 2.25
GSM 02.25.11
OS 2.25.11.1
its stuck onthe Cingular logo screen. When I try to do a hard reset it give the error message
format has failed.....
Can this device be saved?
Sounds like it is having trouble initializing a section of the flash. My guess is that there's a bad flash chip on there. If I ever saw that on my Wizard I'd be on the phone asking for a warranty replacement.

update of my situation
Well still no reply from the seller so I called the credit card company and dispute the charge. i have copies of the guys ad... and copies of the rude emails he sent me. The credit card company told me just hold on to the defective phone and the emails and they will take care of it.. Apparantly the seller was working from a Post office box he was pay apal verified. I just hope no one else falls victim to this guy.

If you bought the phone off of eBay, AND are not an AT&T/Cingular customer, they will not replace the phone... what is wrong with it...?

Very few warranties cover dropped devices... There are a few though, but you have to have the warranty in place on a new device and there are some caveats to them... As for the eBay seller, I doubt that they will offer any real assistance after 4 months of usage... There are a few other options that may be available, but they all concern questionable ethics and morality, so I won't even mention them...

Yep; you're essentially screwed. When you buy something from eBay, you rarely get a manufacturer's warranty, especially if the seller is an individual as opposed to an eBay Seller (business). Even if they are a legitimate business, I too doubt they will warranty any electronic device that has been dropped.
Next time do two things--put the phone in a protective case and use a screen protector; both things are inexpensive insurance against damage.

You cannot ask your friend to have it done, since that phone is not listed on his/her account... That is why you were originally asked for the phone number... You have to buy a new phone or pay to have your phone serviced... You can contact HTC and send them the phone and pay the cost... There is no legal way that you can have the phone repaired under any warranty agreement, after you have already damaged the product...
I hate to say it, since it has already been said... you will have to either pay for the repair, or buy a new phone...

Wise up, people... the phone is utimately warranted by HTC as the manufacturer of the device. They prefer to route things through the carriers because it's easier that way, but you can deal directly with HTC.
To the OP: All you can do is contact HTC and plead your case. You may need to be persistent, but they do have non-carrier and out-of-warranty service. May take 2 or 3 tries to get to someone who knows this.
Oh, and despite what some have said, if you bought if off eBay it still carries the one year manufacturer's warranty (whether or not it will cover having dropped it is another issue). They track the warranty period by S/N. I recently had one -- that I purchased off eBay -- replaced, no questions asked.

My Epic broke a few weeks ago and was denied warranty service, so I suspended my phone service and I will replace my broken screen myself with one from another unit. Assuming Samsung wiped my device during their diagnostics test and my phone would require activation upon boot, will I be able to use my phone without cellular data/voice until I decide to resume my service?
I've read up that the G1s and Droids can be used unactivated by touching the screen corners and I have a link that says the Fascinate can be used with a dialer code (http://androidforums.com/fascinate-tips-tricks/171348-bypass-fascinate-activation-screen.html)
Would any of those work?

Assuming I'm understanding your question right, the answer should be yes. Sprint sent me a replacement phone when mine was just SUCKING BATTERY. I "switched" the activation from one phone to the other a call to Sprint. When the service was switched, I turned the old phone back on, and it worked on wifi only (no cell or data connection). I'm assuming that signing back in to the market via my Gmail account would have worked fine, but I can't tell for absolutely certain as I didn't actually try it. SHOULD work though. If someone has a more concrete answer, that'd be great.
Why not pay the $35 at a sprint store for repair? We have to do these and evo's often.
And on topic yes market and email etc work on wifi without being activated.

You should be able to. I was using my hero as an mp3 player for a little while after I got my epic. The only problem I ran into was I couldn't sign into the android market on my hero if I was using the same gmail address on my epic

I bought a replacement shell with screen on ebay for $35 so I will repair it myself. Samsung wanted $150 to repair it and every single Samsung rep I've talked to on the phone said that their warranty never covers a broken screen under any circumstances.
Hopefully I can make sure I have a working phone before I go off to bootcamp

Since you already bought the screen, this isn't really necessary, but I work at Sprint and with TEP it is a free repair. Without it is $35. I promise! In another thread someone argued that this was not true, but it surely is. I'd be happy to take a pic of an eticket for someone without tep and it clearly shows the $35 charge populated for cracked/damaged screen.
I should mention I didn't purchase any insurance on the phone at all ($71.76 a month after all fees and taxes)
The manager at the Sprint store I went to, which also happens to be the only store in the area authorized for repairs, said that TEP would have been $35 out of pocket, and regular insurance would be $100. Once I said I had no insurance he pointed to a phone and said it was Samsung's problem

If they are corporate or preferred then they are seriously misinformed. The insurance is only for lost/stolen, liquid, or device is in 3 or more pieces. All housing/screen other than that is covered for free if you have TEP or ESRP, but if you only have ERP or NOTHING, then its $35 charge with the option to add tep after the repair or replacement.
I'd complain if they are a corporate or preferred store. If that's the case they are basically saying that they didn't feel like dealing with you, or they have not been properly trained on the new policies.

I got mine @ the Bestbuy mobile store. The rep there said that Android based phones have to be actived to be used and that was the reason I couldn't play with a real one before purchasing. He would let me play with a Blackberry though.

For him to say "android" based phones have to be activated is false. i had my htc hero without being activated and performed a factory reset and i just walked through the setup with wifi and I could do everything on the phone except the phone. When i bought my epic 4g, It was not activated yet I turned it on and messed around with it.

p.s - i dunno if this matters but both phones had been previously activated but were unactivated through sprint.

I can confirm that you can sprint does repair cracked screens for $35 ( I also smashed mine with no (none of any kind) insurance. You can also use your phone through wifi by skipping activation.
You can bring it to sprint even if you have no account with them?

^This. There was a recent policy change and this is now the policy. If it is repairable, the repair is free with insurance or $35 without. If it is non-repairable, water damaged, or stolen, then you can get a replacement under insurance and nothing without insurance.

I had a Best Buy guy tell me the same thing and I had to correct him. Best Buy in my area doesnt know much about the phones they sell. I had my Epic for awhile and never had it activated, but I could use it on wifi for everything other than calls. I finally decided to acitvate it and switched back and forth for some time, flipping between my Evo and Epic. Both worked over Wifi, and still functioned without wifi, when not activated on Sprint. Same with my old Hero.

Does this include parts? Also what kind of things can they replace? The bezel around my screen on the sides has hairline scratches that kinda bug me, I wouldn't mind paying $35 it they'd completely replace it. Please let me know asap!

I went in to sprint the other day to get a replacement and found out that my father who is in charge of the account had canceled the insurance unfortunately this means i would have to pay o get another one and sprint won't let me add insurance. I was thinking to myself today and was wondering if i could get away with giving my phone to a friend who does have insurance and having him swap it out for another one. would this be possible?

If you "swap" with your friend, you'll actually have to activate the phone on his account (you can do it through the sprint website). When you activate a phone, it asks if you want insurance on it, just say yes.

All you have to do is activate any old junky Sprint phone on your line. Once you do the swap it will ask if you want insurance, select yes and it's added to your line. Then you can swap back tot he EVO and get it covered. In the past when I did this I just used the crap phone for 2 days, then used my good phone for 2 days. Shows that it works and sends/receives texts/calls/data. Then I took it in to the store and got my replacement/repair. You can cancel insurance after if you want. I keep insurance on my expensive phones at least a year though.

Call Sprint and speak to the warranty department. I just got my Evo replaced for free through warranty because of light leakage, one flash led not working and a light spot on my screen.

Yeah that's a warranty issue. As long as the phone isn't rooted and stock is loaded, they should address it as a warranty issue. If they won't replace it as a warranty, which they should, then do the other thing that they listed, and try again before taking an insurance claim.
well i had a samsung transform then a friend of mine was selling his evo and i got it added it to mine and got a new one 3 weeks later as long ad the serial number is open u can get it to ya buddy and do tha swap thang
but he as to use it for a few days to not look suspicious you know what im saying
now i have a brand new evo with warranty all for a 100 bucks thats a win

Yep, thats a hardware failure, which is covered under the warranty for one year. You do NOT need insurance to get this fixed. If you have had the phone for over a year (which nobody has yet, since it came out in june last year) then insurance would get it fixed. But you are still within a year. Go back to the store, talk to the manager, and explain how its a hardware failure.
If that doesnt work, call *2, talk to account services, tell them you will cancel your account if they dont fix it.
thanks for all of the advice everyone. I didn't expect everyone to be this nice. I am going to try *2 tomorrow morning and see how that goes. If i can't make any progress there then I will have to go the frowned upon route.
Warranty issues will usually render a $35 fee. They are no longer covered under the new TEP policy. Or you'll be sent to HTC to deal with them but hope all goes good for you

I think people in this thread are getting confused. He's not talking about filing an insurance claim for this. He's talking about the $35 fee that service centers charge to repair or exchange a device that does not have TEP, there is no "warranty". Warranty only applies for the first year on replacement batteries.

Um, then why does it say this on page 181 of the Evo 4G user manual?:

Yes you have warranty with HTC bit its not something that Sprint will honor themselves without the $35 fee. There is no need for a fee however if you deal directly with HTC which usually involves mailing the phone to them.

No this changed a few months ago. Its cool for older phones past warranty that would've been SOL without TEP cuz $35 gets them a new one. But unfortunately for phones that don't have insurance even with warranty there is no longer a free fix or replace policy at repair centers. Any work done or replacement would require a $35 fee.

Just found out that t mo was having a special this month where they were allowing customers to add insurance when they had previously been locked out.
I didn't opt for the insurance when I bought my phone. I called today for a billing issue and found out about this. Even though my phone is out of the warranty period (technically I threw the warranty out the window the second I rooted, but we have Odin to put it back if needed), I was able to add the insurance and lifetime warranty to my phone.
Just thought I'd let you guys know in case there was anyone else like me that could use the insurance but had opted out at the time of purchase.
Today is the last day, so if you need it, call them up and ask for it.
