ok heres the deal. I have 3 manufacture defects with my hero.
1. Lots of dust under my screen.
2. Phone overheats when charging and running say google nav. (car charger)
3. More than 15 dead pixels all over the place.
my phone is going to have to be replaced. so my question is do you think they will give me a new Evo instead of another hero.
also I have sprint warranty.

More than likely, no. But you never know.
For me, historically, it's been:
1st phone defective, replaced with same model, up to three times, then they will offer a different phone. I seriously doubt that they will offer an EVO to replace the Hero since the Hero isn't at its end of life.
Think about this: You buy a Chevy Malibu, take it in 3 times for manufacturer's defects, it's a lemon, do they upgrade you to the Corvette? Nope.
I wonder if they'd do it if I offered some cash as well

No they don't give you a Vette, but they don't give you a refurbished car either. It is possible to get an EVO but you are gonna need to sweet talk them to death on phone. I have only once gotten upgraded after a few bad phones, that was the ENV2 to Voyager.
My guess is that you'll be aloud to move over to the Moment. Good luck with trying though. I bought 2 heros in December and both are still in perfect shape. No dust or paint chipping.
Can always ask...
The rule has always been that they will swap it for an equivalent phone of 'equal or lesser value'. I don't think the EVO is going to apply to that.

You're right, they don't give you a refurbished or new car of the same model. Because it's not in the terms of the warranty. Just like it's not in the terms of the Sprint warranty to upgrade to the top of the line model, only to repair or replace with the same or COMPARABLE model, and that repair or replacement is at THEIR option. They could just keep giving you refurbs over and over... wait, they already do!
just like everyone that had the htc diamond and touch pro, they waited a couple months after the tp2 and they all of a sudden there was post after post of sprint gave me a tp2 and swapped out my touch pro. You won't get it right away but after a couple of months it may become possible.
I moved to the Hero from 3 defective Pres, but I had to show the store assistant manager that I was nice, competent, and a repeat customer.
so if I am nice, maybe wave some cash around I might get what I want.. maybe I should send my wife into do it when the Evo comes out.. women seem to get what they want.. haha

fat chance lol it took me 16 replacements to get my touch pro replaced swapped out to the hero ( yea 16 all hardware defects dead keyboard etc etc )

I doubt they will make me pay full price. I convinced them to upgrade me from my instinct to the hero as a contract extension 4 months before my renewal. I have learned that being persistent but nice can normally get you places.

I have always been upgraded to the latest and greatest for my phone problems..

now what they wouldnt allow me to do is go from the tp2 to the hero
my understanding with the store i deal with is...
3 swaps within a 3month period will force them to ask you if you would like something else, and they will have a list, I also found out that they wouldnt allow me to go from winmo to android, nor from a keyboard to non ketboard or vice versa,
so i'm inclined to think that those of us with issues on the hero, will not be allowed to swap for the moment since it has a keyboard, and I've already tried that, and the swap phone needs to be of the same type...
and I have been told directly, they dont care about the phone.. its about continuing service.
I also have insurance and tep.
If you are having many problems, and it has been documented in Sprints notes ie you've called and complained with no results, the escalations department @ Sprint may be willing to deal providing you get a sympathetic one. Best Buy however told me when I. purchased my Hero and their ins. (have both) if unable to fix my phone itwould be replaced with a new Hero, if still being built, if not, then I would get the newest version of it. imo would be the Evo.-)

So I called Sprint today and politely complained about my defective hero. They are sending me a new one in the mail. They did not tell me I had to send my current one in.. is that normal?

in order for this to work out to your advantage, you'd have to wait until the Hero is no longer available from Sprint, and even then it's a slim chance.
Unfortunate for you, you'll more than likely get another Hero, or a Refurbished Hero depending on the way you go about getting your replacement.

this is strange... do you know what department you talked to? If they performed the ticketing process that i believe they did, then you'll get a return kit with your replacement phone, and i would advise that you mail in the defective phone, if not, there's a chance that you will receive a charge in 2 bill cycles from receiving the replacement device showing a $500+ charge for the replacement phone.
In summation, if you get a return kit (a return envelope rather), then use it!... if you feel that you don't need to do this, i'd then advise to call Sprint and make sure that your account notes specify that you don't have to return the phone... otherwise, you need to.

Did he verify the ESN prior to buying the phone? If not, its his fault and there is nothing he can do. Explain the situation to ebay and open a dispute.
He did not verify esn. I just thought it was strange that he would be trying to pull this when he has a 98.6% positive feedback rating with over 2000 transactions.
It will be easier if you have the device ID. Contact Verizon and get paper work from them showing the device has a clean ESN. This will only work if you are either still under contract or left verizon when your contract was finished. If you got out of the contract via the fee changes the esn will be bad.
Assuming the Esn is clean once you have the paperwork that says its clean you just tell the buyer that you have evidence of a clean ESN and that you will fight any dispute. PayPal and EBay see these shady people alot and know what to look for.

The only way he is Intitled to a refund is if he pays shipping and returns it to you
Even if he files a complaint he will have to show proof that he sent it back
So I would not worry to much about it
If he does send one back make Damn sure it is yours and has your esn
eBay has policies in place to protect you and the never do anything out of eBay
And you may be wise to report it to them right away and let them know what is going on This Kind of Deal is a No No you were asked outside of eBay

Also, everyone be careful even letting a potential customer check the esn. When I was trying to sell my blackberry many scammers tried to get at mine. Don't give it to them! They can do a fake activation put insurance on it and claim it lost/stolen.. at that point your esn goes bad and they receive a phone from insurion in the mail.. One scammer even tried to get me to take a photo of the back of the phone with the battery out (where the esn is written) under the pretense he was looking to see if it worked on gsm.. Duh its a world phone... Good luck man. From my experience selling on ebay is nothing but headache.

Make sure you move your money out from paypal and un-link any connected bank accounts. The guy will just call his CC company and dispute the charge. Paypal will take your money and you'll be SOL no matter how much evidence your have. Paypal's "protection" is **** and they'll screw you over in a heartbeat.

That's a scam, no doubt about it. Don't let the feedback rating fool you, because it could be a legitimate account that got compromised. The only way they could win a dispute with eBay is if they can provide proof that the ESN was bad. If you know the ESN was good, then there's no way they could possibly provide that proof.

Im not so sure about that, I just tryed to have them put insurance on a fascinate I bought used and they said you can only put it on if you bought it from them.
Definite scam. As stated before, they won't confiscate the device. It's not their right to.
Unlike with media, you actually own a phone, rather than license it (which is why software, music, and videos can actually be confiscated). For them to take the phone from the buyer would be theft.
Call Verizon, have them pull the ESN from the old phone for you and have them verify that it is good. You should also be able to have them verify if it's been activated or not.
The way the systems work these days, I'm surprised someone would actually try and pull a scam like this one. It's way too easy to verify that they're full of it.
As a few of you know I broke my phone a couple of weeks back. And I'm at the point now where I have decided that I need a thread to ***** and moan about my insurance company.
They received my phone on the 21st of June and took my excess and told me the turn around time was 10 days. So day 10 I call up to find out what is going on.
Because the insurers haven't got heard from the repair centre they will automatically send me a replacement. Call today and they don't have a replacement available so will spend the next 5 days looking for one. If they can't find one they will look at a different handset.
This has me worried, I do not under any circumstances want a phone without a hardware keyboard, obviously it needs to be android and must be rootable and have good dev support. I would be interested if anyone can recommend a handset apart from the G2/DZ that fulfills these requirements.
Also using there timeframe the worst case scenario is that the total time I could be without my phone is a month. Which I consider unacceptable given that I pay £10p/m for what is supposed to be one of the best products available in the UK. And I say that because I have to sell this product as a part of my job.
It's a joke.
Feel free to sympathise with me or ***** and moan about your experiences with insurance company's.

When my previous phone (HTC Kaiser) went bad and had to be sent in for warranty repair, I was resigned to going back to my stupid dumb-phone for three weeks and I almost went crazy.
If something were to happen to my Desire Z, I'd be seriously tempted to buy a new one with over-night shipping (no decent phone stores around here), then send the other in for service. I'd just keep the old repaired one for a spare, or sell it.

Have you ever thought of calling them with a direct threat thatyou will file a complaint to whatever governing department about their incompetency?I can't see how hard it can be to get a replacement for you. Cheers for the links. I have decided to give them until Tuesday before I start going down the the root of making a complaint. If they are unable to offer me suitable replacement handset on Tuesday, I then intend to make a complaint.
I do have another card up my sleeve and its not one that I wanted to play but I may consider it. I work for the UK's second largest mobile phone retailer* and as such the insurance product I have is also the one that I have to sell on a day to day basis. We have it drummed in to our heads that this is one of the best products in country in terms of value for money and the level of cover that it offers.So how am I supposed to sell this supposedly fantastic product when my experience with it has be about the terrible. I am an honest person and do tell things as they are and in all good faith I could not recommended this insurance product given my poor experience with it.
So I'm wondering if I don't get the desired outcome on Tuesday should I tell them this and would it actually help? My guess is no but it is another thing for me to consider

Glad they finally moved on this.
Received my replacement handset today. Got it rooted and virtuous unity running. Wife calls me, volume is on loud but no sound comes out the speaker. Try some music and nothing.
Also the information label under the battery was almost falling off, the void sticker was missing and all of the visible screws looked like they had been unscrewed with an axe.
I now have to wait for a courier to collect the broken phone and wait for them to ship me another replacement.

I'm really pissed off. I wish I had checked that it was all working before I rooted. There is an hour I will never get back.
But I'm definitely writing to them now. The chances of me getting a phone this week are minimal. And a month without a phone is unacceptable.

I have had a horrible problem with HTC. My new desire z broke after 2 days of me having it. I sent it off to get repaired. When it came back it was scratched and dented so I complained. They agreed to replace the parts to say sorry. But it has been 5 weeks since I sent the phone to them and I still do not have it. This is because they have changed repair centers they said. It isn't good enough so after a lot of moaning they are sending me and incredible s which is good as I am not bothered about a hardware QWERTY. Still not good enough from HTC.
how did you even break the phone in 2 days? It sounds like you abused it somehow.

I've been lucky enough to have never needed my phone replaced and I've had over 30 or 40 phones thanks to connections at best buy.
My question is why do people hate them? Obviously your "brand new" (and i use parentheses because people think a 8 month old phone doesn't deserve a refurbished one as a replacement) has the exact same chance of not working properly. I can understand one month old but anything past that is not new anymore.

I think part of the issue with phones is that people don't want something that someone has had pressed against their cheek or stuffed in their pocket for the past few months.
This is apart from the obvious fact that a refurb it may still be broken.
I have personally had very good luck with refurbed cameras.

Honestly, because I've never received a refurbished phone that didn't fail on me within a month.
I don't care if it's "refurbished" or "new" I just want it to work 100% and not fail on me.
I'm inclined to agree that after a certain point you aren't really 'deserving' of a brand new device. I think it's simply the fact that the device isn't 'brand new and out of box' and has been 'handled.' I guess I can sort of understand why people might have a problem with it, but if it works and isn't entirely flawed in some manner, then what is the problem? I had 2 refurbished PS3's die on me in a year. Obviously I got 'lucky.' In that regard I understand why someone would be hesitant to get one. But more often than not refurbs actually work as intended. Shocking. But the practice is a tried and relatively true one.
I think you should get a freebee.. one free new phone. Anything after that.. refurbished

I just activated my refurbished phone. It took Sprint a month to get one for me. This one doesn't charge at all. The store said it would take at least a week to get me another one. When I asked what I should do about my phone in the meantime, the employee told me I could bring my phone into the store everyday to have them charge it. He was serious.
The icing on the cake is that they won't call when the new phone comes in. I'm supposed to call them everyday and ask if it's there. But the store doesn't ever answer their phone! After going through the phone tree twice, it just says "Sorry, all reps are busy, please make an appointment online." Somehow this is the only store in all of San Francisco that can even do replacements. I ****ing hate Sprint. [/RANT]

From what I have expierenced, refurbished phones are rarely problem free. Thus causing people to question refurb phones and the quality control that goes into refurbishment.

Call tech support and tell them your situation and they can send you one over the phone. I have the same problem in the southbay. The store always has at least a 45 min wait before you can even get help and they never answer their phone.

Will they send you a phone if they can't verify the issue? Is there a specific support number you call?
I've never received a replacement "over the phone", it has always taken overnight.
Refurb'd phones are put back together poorly IMO, my wife got a replacement that started to seperate from the case, we complained, they sent a "New" EVO the next day.
I have two refurb'd that are just fine though, we have 8 EVO's.

The term over the phone refers to the fact he can get a replacement by speaking to someone over the phone instead of having to deal with the situation he has at his local sprint store.

Yea they will. You should be honest about the problem because if you lie and sprint determines there is no issue with they phone they can charge you an additional amount.

Sprint has questionable refurbishment techniques. I've been told that the whole process is outsourced. I've read a lot about people getting refurbished phones that have known problems, like screen separation and bright spots on the screen. In many cases, it seems likely that those are the reasons why the phone was returned in the first place, and their refurbishing does not take care of the issue for which the phone was returned.
That said, I used to be on a Centro, and I went through three new ones before I ended up with a refurb. The refurb lasted a hell of a lot longer than the new ones. The only problem with it is that it was kind of gross when I got it. It had smudges and one of the buttons was a little cracked. But the phone itself worked great for the year and a half that I used it.
And yea, there's the gross factor too. Who knows who had their face pressed up against my refurb phone. Ick.
I don't like the idea that it could have been thumped around, and only the most obvious failing component was replaced, leaving you with a "ready to break" phone. That being said, I've never actually had a problem with a refurbished unit, (phone or other). All in the head I guess.

I've seen as many new Evo's that had the screen separation issues, charger issues etc etc. I can see there being a bit more of a chance that a refurbished device isn't going to be up to par. I like the idea of maybe a new device and every device following is a refurb. As for the dirty screens ... maybe that's how I caught that face tattoo known as cheek herpes. :debbiedownerface:

Well... DUH, some people have no sense of humor, must be due to lack of root... I dunno.
So far only on my first refurb from August last year. So far so good (knocks wood). My launch day (002)Evo's 4G got up, and gone (radio was shot). The refurb is a launch day 003. As with anything you put in contact with your body for the first time you should wipe it down first even if new(some of the toxic chemicals used in production are rather nasty).
My god, how the mighty have fallen.
T Mobile customer service used to be the benchmark against which businesses were measured. But over the past year it's become a joke.
Get this.....
Over problems with multiple defective MT4G's I've gotten frustrated with unhelpful customer service reps 3 times and asked to speak to a supervisor. Once in the morning, once in the afternoon, and once at about 9pm.
On all 3 occasions the customer service rep immediately said, without missing a breath or actually taking the time to check...., that "the supervisor just walked into a meeting. He will call you back within 24 hours".
Now that's a hell of a coincidence, wouldn't you say? And those 9pm meetings really cut into the work day.....(sarcasm)
It's unimaginable to me that a customer service office has a canned lie to give as a matter of policy. And that's clearly what's going on here. I'm sure that policy isn't written down anywhere, but there's a supervisor giving that instruction.
But it actually gets worse!
Figuring out that I've been lied to really cheesed me off as a customer. I can deal with the haggling over getting a solution to my problem, but when I get lied to I'm done. So I did what any other pissed off person with too much time on his hands would do. I found the emails of T Mobile's president and chief operating officers and sent them a letter detailing the issues I've had in hopes that maybe they'll put a boot up someone's ass to get their customer service problems fixed. I didn't ask to get my phone situation sorted out. I've given up on that. I'll just deal with the bad screen I've got until my contract runs out and start over.
But within 2 hours of sending that email, an 'executive customer service' rep called me and told me (not asked me) what I was going to do to fix my phone problem. He told me I was going to talk to tech support then he got pissed off when I told him I wasn't going to. I mean, how dare I not jump when he tells me to, right?!
Then he reads me the riot act about T Mobiles terms and conditions of warranty exchanges and tells me, and this is a direct quote, that "I'm going to accept those terms". He then goes on to tell me that T Mobile will never do anything outside of the strict terms and conditions for me again, even if they screw up (by like...I dunno...selling me a broken POS phone and replacing it with even more broken POS used phones).
Is that a hell of a way to speak to a customer or what?!
Then he lies to me more! He goes on a spiel about how even the president of T Mobile has to abide by the rules of the warranty exchange program, and if his phone breaks he'll get a refurbished one too.
Uh huh....sure he will. And I've got feathers growing out of my nostrils. Thanks for basically calling me stupid by thinking that I might believe that garbage.
The whole thing was just surreal. I couldn't believe that a company called a customer up and basically ***** me out because I caught on to their policy of lying to customers.
So my wife, who is off contract, will be becoming a Sprint customer soon. I will be too as soon as my contract expires.
Anyone else having these problems?

Sure, they seem nice enough until you question anything. For me it was the $20 replacement fee to get a refurbished phone when I had just bought a brand spanking new phone that was defective 30 days earlier.
It pissed me off that I was supposed to pay more money to get a used phone when I just paid a lot to buy a new phone. Especially when the guy in the store said there would be no charge.
It pissed me off a lot more when the used phone was even more broken than the new one and they wanted to charge me another $20 to replace that one with yet another broken used phone.
Now they want to charge me another $40 for the last phone they sent me that I couldn't even get to turn on! So they want to charge me the $20 replacement cost and a $20 restocking fee or something. I'm like "Restocking fee?! It should be thrown in the trash can!"
When I got a RAZR like 5 years ago it broke too. T Mobile jumped through hoops to make it right and get me a new one. And that breaking was 100% my fault and they didn't care! They said "It should have held up under the conditions" and went to great lengths to make it right. Now they sell defective products and don't stand behind them, and act like they are doing you a favor when they send you more defective products.
The customer service took a serious nose dive the minute the AT&T acquisition was proposed. Internal cost saving changes were made and the customer service has been garbage since then.
Man that REALLY sucks...if you call up customer support again and during the automated voice thing you say you want to cancel the voice will instantly send you to a "retention service". They will generally cut you a deal if you ***** at them and I'm sure if you mention that call they will definitely do something. That's what I've heard atleast..good luck!

Retention was one of the agents who pulled the "My supervisor just walked into a meeting" trick!
I do the saying 'cancel' during the voice prompt though. That cuts the hold time down from 4-5 minutes to about 2 seconds.

Damn...I've been considering switching to Verizon for awhile now anyway this may be enough to have me move...you should definitely switch carriers..

I personally have never had any issues with T-Mobile or their customer service, and Ive been a customer for roughly 10 years now. Even when I had my phone replaced earlier this year, the reps seemed nice and willing to help me with my problem
Well I definitely got their attention. After writing back to complain about the guy who called me last night a MUCH nicer person called this evening and offered me pretty much anything I wanted. I thought they were half ready to offer me some of that AT&T broken deal money.
I think I'm going to go for the Sensation since it's got developers already working on it. Plus it's a little smaller than the Amaze.
Is there another phone outside the HTC line I should consider?

well, a lot of people have been saying that the Galaxy S II is good, so maybe that? personally though, i don't like it much. i've never had much love for Samsuck though... still.. gotta admit, it's a pretty nice phone
I'm not very impressed with T-mobile's SGS2. They ditched the more powerful Exynos processor for a Snapdragon to gain a theoretical 42 mbps max download on their network. Its still a good phone, but the Exynos is far superior in the graphics department.

It was down to the Sensation and Amaze because they have more rounded corners. And I think the Sensation is going to win because it's a little smaller and already has a CM7 option, even if it's an Alpha. (I can't go back to HTC Sense. I can't do it.)
It sounds dumb, but that's a huge deal to me. A phone with less rounded corners tends to wear out a pants pocket quickly since the phone will usually sit in the same position in the pocket day after day.
I've had nothing but good experiences with T-Mo's customer service. Two months ago, my brother changed his rate plan but forgot to make sure it included unlimited messaging. A few weeks later, his account was suspended because he had accumulated over $700 in messaging fees. Something similar happened when he had Verizon years ago, and they essentially said, "Tough luck. Pay up." What did T-Mo do? They said, "You forgot? It happens. Let's add that unlimited messaging now and wipe those charges." And they did.
